Safety Zone; Fourth of July Fireworks, City of Sausalito, Sausalito, CA
The Coast Guard will enforce the Fourth of July Fireworks, City of Sausalito, safety zone from 9 a.m. through 9:30 p.m. on July 4, 2008. This action is necessary to control vessel traffic and to ensure the safety of event participants and spectators. During the enforcement period, unauthorized persons or vessels are prohibited from entering into, transiting through, or anchoring in the safety zone, unless authorized by the Patrol Commander (PATCOM).
Safety Zone; Vallejo Fourth of July Fireworks, Vallejo, CA
The Coast Guard will enforce the Vallejo Fourth of July Fireworks Display safety zone for the city of Vallejo, from 8 p.m. through 10 p.m. on July 4, 2008. This action is necessary to control vessel traffic and to ensure the safety of event participants and spectators. During the enforcement period, unauthorized persons or vessels are prohibited from entering into, transiting through, or anchoring in the safety zone, unless authorized by the Patrol Commander (PATCOM).
Tank Level or Pressure Monitoring Devices on Single-Hull Tank Ships and Single-Hull Tank Barges Carrying Oil or Oil Residue as Cargo
The Coast Guard proposes to remove its regulations for tank level or pressure monitoring (TLPM) devices because compliant devices remain unavailable. In July 2005, we published a final rule suspending Coast Guard regulations for TLPM devices with a request for public comments on the status of TLPM technology development and other means of detecting leaks from oil cargo tanks into the water. We received two comments supporting our suspension of the regulations for TLPM devices. We received no new information on TLPM devices or alternatives for detecting leaks into the water from single-hull tank vessels carrying oil or oil residue as cargo. Based on the public response to the suspension, the absence of new information regarding TLPM devices or alternatives, and the results of a Congressionally-mandated study, the Coast Guard revisited the feasibility and practicality of retaining regulations for TLPM devices on single-hull tank vessels and concluded that it is appropriate to remove these regulations.
Temporary Safety Zone; Wreckage of the M/V NEW CARISSA, Pacific Ocean 3 Nautical Miles North of the Entrance to Coos Bay, OR
The Coast Guard is establishing a temporary safety zone on the waters of the Pacific Ocean encompassed in the 1000 yard radius surrounding the wreckage of the M/V NEW CARISSA located 3 NM north of the entrance to Coos Bay, Oregon. The Captain of the Port Portland is taking this action to safeguard individuals and vessels involved in a salvage operation involving the M/V NEW CARISSA. Entry into this safety zone is prohibited unless authorized by the Captain of the Port or his designated representative.

The Coast Guard is establishing a temporary security zone in the waters adjacent to the 10th Avenue Marine Terminal, San Diego Bay, San Diego, CA. This action is needed to protect the U.S. Naval vessels, their crews and the public during a military out load evolution from sabotage or other subversive acts, accidents, criminal actions or other causes of a similar nature. Entry, transit or anchoring in this zone is prohibited unless authorized by the Captain of the Port San Diego, or his designated representative.
Safety Zone; Patapsco River, Northwest and Inner Harbors, Baltimore, MD
The Coast Guard is establishing a temporary safety zone upon certain waters of the Patapsco River, Northwest Harbor and Inner Harbor during the movements of the historic sloop-of-war USS CONSTELLATION. This action is necessary to provide for the safety of life on navigable waters during two tows of the vessel in Baltimore, Maryland; one from its berth at Baltimore's Inner Harbor to a berth at the South Locust Point Marine Terminal, and the other from the South Locust Point Marine Terminal to its berth at Baltimore's Inner Harbor. This action will restrict vessel traffic in portions of the Patapsco River, Northwest Harbor, and Inner Harbor during these events.

This rule is necessary to protect participants and spectators from the hazards associated with the launching of human powered flying craft over the navigable waters of the United States.

Drawbridge Operation Regulation; LaLoutre Bayou, Yscloskey, LA
The Coast Guard proposes to change the regulation governing the operation of the State Route 46 (LA 46) Bridge across LaLoutre Bayou, mile 22.9, at Yscloskey, St. Bernard Parish, Louisiana. Due to Hurricane Katrina, the Louisiana Department of Transportation and Development (LDOTD) has experienced a shortage of bridge tender personnel in the area where the bridge is located. This proposed rule change allows for more efficient use of personnel by requiring a two hour notice for night time openings.
Safety Zone: 31st Annual Virginia Lakes Festival Fireworks Event, John H. Kerr Lake, Clarksville, VA
The Coast Guard is establishing a 700-foot radius safety zone on John H. Kerr Lake in the vicinity of the Highway 58 Business Bridge in Clarksville, VA in support of the 31st Annual Virginia Lakes Festival Fireworks Display. This action is intended to restrict vessel traffic movement to protect mariners from the hazards associated with the fireworks display.

Shipping; Technical, Organizational, and Conforming Amendments
This rule makes non-substantive changes to Title 46, part 31 of the Code of Federal Regulations. The purpose of this rule is to make conforming amendments and technical corrections to Coast Guard shipping regulations. Specifically, this final rule updates 46 CFR 31.10-16 concerning inspection and certification of shipboard cargo gear. This rule will have no substantive effect on the regulated public.
Proposed Expansion of the Cove Point Facility, Cove Point, MD: Final Supplemental Environmental Assessment and Finding of No Significant Impact
The Coast Guard announces the availability of the Final Supplemental Environmental Assessment (EA) and the Finding of No Significant Impact (FONSI) that evaluated the potential environmental impacts resulting from the proposed issuance of a Letter of Recommendation (LOR) on the suitability of the waterway for the expansion of the Cove Point LNG facility for Dominion Cove Point LNG, LP, in Cove Point, MD.
Regulated Navigation Area; Chesapeake and Delaware Canal, Chesapeake City Anchorage Basin, MD
The Coast Guard is establishing a temporary regulated navigation area (RNA) in certain waters of the Chesapeake and Delaware (C & D) Canal, within the anchorage basin at Chesapeake City, Maryland, on June 28, 2008. This RNA is necessary to provide for the safety of life, property and the environment. This RNA restricts the movement of vessels throughout the anchorage basin during the Town of Chesapeake City's Canal Day 2008 event.

The Coast Guard is establishing a temporary security zone on certain waters of the Patapsco River, Middle Branch, in Baltimore Harbor, Baltimore, Maryland, during the USS STERETT Commissioning ceremony. The security zone is necessary to provide for the security of the USS STERETT and the safety of life of event participants, spectators and mariners on U.S. navigable waters during the event. Nontank Vessel Response Plan Enforcement
The Coast Guard is issuing this notice to inform U.S. and foreign flag nontank vessel owners and operators that effective August 22, 2008, we will begin enforcing the requirement to prepare and submit a nontank vessel response plan (NTVRP) for certain nontank vessels, as required by the Coast Guard and Maritime Transportation Act of 2004.

Drawbridge Operation Regulations; Intracoastal Waterway (ICW); Beach Thorofare, NJ
The Commander, Fifth Coast Guard District, has approved a temporary deviation from the regulations governing the operation of the Margate Bridge, at ICW mile 74, across Beach Thorofare at Margate, New Jersey. The deviation is necessary to sandblast, paint and make repairs to the bridge. This deviation allows the bridge to provide partial vessel openings.
Drawbridge Operating Regulations; Sabine Lake, Port Arthur, TX
The Commander, Eighth Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the State Route 82 (SR 82) swing span bridge across Sabine Lake at mile 9.5 between Cameron Parish, Louisiana and Jefferson County, Texas. This deviation provides for the bridge to remain closed to navigation for 19 consecutive days to reverse the direction of the swing span to facilitate construction of a new replacement bridge adjacent to the existing swing span bridge.
Drawbridge Operation Regulations; LaLoutre Bayou, Yscloskey, LA
The Commander, Eighth Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the State Route 46 (LA 46) Bridge across LaLoutre Bayou, mile 22.9, at Yscloskey, St. Bernard Parish, Louisiana. This deviation will test a change to the drawbridge operation schedule to determine whether a permanent change to the schedule is needed. This deviation will allow more efficient use of personnel by requiring a 2 hour notice for night time openings.

The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the Meadowbrook State Parkway Bridge across Sloop Channel at mile 12.8, at Hempstead, New York. Under this temporary deviation the bridge may remain in the closed position for 2\1/2\ hours to facilitate public safety during a public event, the Veterans Fireworks Display.
Drawbridge Operation Regulations; Piscataqua River, Portsmouth, NH, and Kittery, ME, Public Event
The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the Memorial (US 1) Bridge across the Piscataqua River at mile 3.5, between Portsmouth, New Hampshire and Kittery, Maine. Under this temporary deviation the bridge may remain in the closed position for one-hour during the Fourth of July fireworks display. This deviation is necessary to facilitate public safety during a public event.
Drawbridge Operation Regulations; Hackensack River, Jersey City, NJ, Maintenance
The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the NJTRO Lower Hack Bridge across the Hackensack River, mile 3.4, at Jersey City, New Jersey. Under this temporary deviation, the NJTRO Lower Hack Bridge may remain in the closed position for ten hours on two weekend days to facilitate scheduled bridge maintenance. Vessels that can pass under the draw without a bridge opening may do so at all times and vessels that need a bridge opening can do so by providing a two-hour advance notice. This deviation is necessary to facilitate upgrades to the control system at the bridge.
Safety Zone; World War II Beach Invasion Re-enactment, Lake Michigan, St. Joseph, MI
The Coast Guard is establishing a temporary safety zone on Lake Michigan, St. Joseph, MI. This zone is intended to restrict vessels from a portion of Lake Michigan during a re-enactment of a World War II beach invasion. This temporary safety zone is necessary to protect event participants and spectator vessels and restrict spectators and other vessels from the re-enactment site.

This action is necessary to provide for the safety of life during these displays. Entry into, transit through, mooring, or anchoring within these zones is prohibited unless authorized by the Captain of the Port, Puget Sound or his designated representatives.
Temporary Safety Zone: Arlington Chamber of Commerce Fireworks Display, Arlington, OR
The Coast Guard is establishing a temporary safety zone for the Arlington Chamber of Commerce Fireworks Display to be held on the waters of the Columbia River in the vicinity of Arlington's waterfront in Arlington, Oregon. The safety zone will restrict vessels from entering the designated area during the fireworks display. This temporary rule is needed to provide for the safety of life on navigable waters during the event.

This rule makes non-substantive changes throughout Title 33 of the Code of Federal Regulations. The purpose of this rule is to make conforming amendments and technical corrections to Coast Guard navigation and navigable water regulations. This rule will have no substantive effect on the regulated public. These changes are provided to coincide with the annual recodification of Title 33 in July.

Implementation of Vessel Security Officer Training and Certification Requirements-International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as Amended
On May 20, 2008, the Coast Guard published in the Federal Register an interim rule with request for comments to amend its regulations to implement the vessel security officer training and certification amendments to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended, and the Seafarers' Training, Certification and Watchkeeping Code. In the interim rule a clerical error was made stating as an option that to qualify for a VSO endorsement, a person must ``have approved sea service of not less than 90 days on any vessel subject to section 104.215 of this part * * *.'' Instead, the option should have stated that a person must have not less than six months to qualify for a VSO endorsement, not 90 days. This document corrects that error.

This action is necessary to protect vessels and people from the hazards associated with fireworks displays. This safety zone will restrict vessel traffic from portions of the Captain of the Port Lake Michigan Zone.
Regulated Navigation Areas, Safety Zones, Security Zones, and Deepwater Port Facilities; Navigable Waters of the Boston Captain of the Port Zone
The Coast Guard is establishing regulated navigation areas around a recently constructed deepwater port facility in the waters of the Atlantic Ocean near the entrance to Boston Harbor as well as safety and security zones around liquefied natural gas carriers (LNGCs) calling on these deepwater port facilities. The purpose of these regulated navigation areas, as well as safety and security zones, is to protect vessels and mariners from the potential safety hazards associated with deepwater port operations and to protect the LNGCs and deepwater port infrastructure from security threats or other subversive acts. All vessels, with the exception of LNGCs and deepwater port support vessels, are prohibited from anchoring or otherwise deploying equipment which could become entangled in submerged infrastructure within 1000 meters of the submerged turret loading (STL) buoys associated with the deepwater port, and are prohibited from entering waters within 500 meters of the deepwater port STL buoys or the LNGCs using them. Additionally, this rule makes minor amendments to the existing LNG security regulations for the Boston Captain of the Port (COTP) Zone to reflect multi-agency enforcement of those regulations.
Marine Events Regattas; Annual Marine Events in the Eighth Coast Guard District
The Coast Guard proposes to update the list of marine events and regattas that take place in the Eighth Coast Guard District and to change patrol requirements for these events. This update is needed to provide effective control over regattas and marine events to insure safety of life in each regatta or marine event area.

The Coast Guard proposes to establish temporary safety zones in support of the scheduled Festival of Sail Events from July 23, 2008, through July 27, 2008. The event will include a parade and mock cannon battles. The temporary safety zones are necessary to provide for the safety of spectators, participating vessels and crews.
