Department of Homeland Security March 2011 – Federal Register Recent Federal Regulation Documents

The Department of Homeland Security (DHS), National Protection and Programs Directorate (NPPD), Office of Cybersecurity and Communications (CS&C), Office of Emergency Communications (OEC) will submit the following Information Collection Request to the Office of Management and Budget (OMB) for review and clearance in accordance with the Paperwork Reduction Act of 1995 (Pub. L. 104-13, 44 U.S.C. Chapter 35). DHS is soliciting comments concerning New Information Collection Request, General Meeting Registration and Evaluation.

The Commander, Fifth Coast Guard District, has issued a temporary deviation from the regulations governing the operation of the Grassy Sound Channel Bridge across the Grassy Sound Channel, mile 1.0, at Middle Township, NJ. The deviation is necessary to facilitate the cleaning and painting of the structure. This deviation allows the bridge to remain closed for the entirety of the deviation period.

On April 14, 2010, FEMA published in the Federal Register a proposed rule that contained an erroneous table. This notice provides corrections to that table, to be used in lieu of the information published at 75 FR 19320. The table provided here represents the flooding sources, location of referenced elevations, effective and modified elevations, and communities affected for Sumter County, Alabama, and Incorporated Areas. Specifically, it addresses the following flooding sources: Factory Creek (backwater effects from Tombigbee River), Fenache Creek (backwater effects from Tombigbee River), Folsum Branch (backwater effects from Tombigbee River), High Run (backwater effects from Tombigbee River), Jones Creek (backwater effects from Tombigbee River), Noxubee River (backwater effects from Tombigbee River), Sandy Creek, Sucarnoochee River, Tombigbee River, Tombigbee River Tributary 13 (backwater effects from Tombigbee River), Tombigbee River Tributary 16 (backwater effects from Tombigbee River, Tombigbee River Tributary 7 (backwater effects from Tombigbee River), Tombigbee River Tributary 8 (backwater effects from Tombigbee River), Toomsuba Creek, and Whiterock Creek (backwater effects from Sucarnoochee River).

This rule identifies communities, where the sale of flood insurance has been authorized under the National Flood Insurance Program (NFIP), that are scheduled for suspension on the effective dates listed within this rule because of noncompliance with the floodplain management requirements of the program. If the Federal Emergency Management Agency (FEMA) receives documentation that the community has adopted the required floodplain management measures prior to the effective suspension date given in this rule, the suspension will not occur and a notice of this will be provided by publication in the Federal Register on a subsequent date.

The Coast Guard is temporarily changing the enforcement period of special local regulations for a recurring marine event in the Fifth Coast Guard District. These regulations apply to four recurring marine events that conduct a rescue at sea demonstration, an air show, a swimming competition, and power boat races. Special local regulations are necessary to provide for the safety of life on navigable waters during these events. This action is intended to restrict vessel traffic in a portion of the Severn River at Annapolis, MD, the Chester River near Chestertown, MD, and Prospect Bay at Kent Island, MD during the events.

The National Boating Safety Advisory Council (NBSAC) will meet on April 1-2, 2011, in Arlington, Virginia. NBSAC discusses issues relating to recreational boating safety. The meetings will be open to the public.

On September 8, 2009, FEMA published in the Federal Register a proposed rule that contained an erroneous table. This notice provides corrections to that table, to be used in lieu of the information published at 74 FR 46074. The table provided here represents the flooding sources, location of referenced elevations, effective and modified elevations, and communities affected for Troup County, Georgia, and Incorporated Areas. Specifically, it addresses the flooding source Shoal Creek.

On December 7, 2010, FEMA published in the Federal Register a proposed rule that contained an erroneous table. This notice provides corrections to that table, to be used in lieu of the information published at 75 FR 75945. The table provided here represents the flooding sources, location of referenced elevations, effective and modified elevations, and communities affected for Skagit County, Washington and Incorporated Areas. Specifically, it addresses the following flooding sources: Left Bank Overflow Main Stem Skagit River, Left Bank Overflow Main Stem Skagit River/South Fork Skagit River, Left Bank Overflow North Fork Skagit River, Main Stem Skagit River, North Fork Skagit River, Overflow from the Main Stem Skagit River between the North Fork Skagit River and the South Fork Skagit River, Padilla Bay, Right Bank Overflow Main Stem Skagit River, Right Bank Overflow Main Stem Skagit River/North Fork Skagit River, Right Bank Overflow North Fork Skagit River, Right Bank Overflow South Fork Skagit River, Samish Bay, Samish Bay/Padilla Bay, Simlik Bay, Skagit Bay, Skagit Bay/ Swinomish Channel, Skagit River, Skagit River Delta Overbank Flowpath 1, Skagit River Delta Overbank Flowpath 2, Skagit River Delta Overbank Flowpath 3, South Fork Skagit River, and Swinomish Channel.

The Federal Emergency Management Agency, as part of its continuing effort to reduce paperwork and respondent burden, invites the general public and other Federal agencies to take this opportunity to comment on a proposed extension, without change, of a currently approved information collection. In accordance with the Paperwork Reduction Act of 1995, this notice seeks comments concerning the Severe Repetitive Loss (SRL) Program appeals process.

This notice amends the notice of a major disaster declaration for the State of New York (FEMA-1957-DR), dated February 18, 2011, and related determinations.

On September 15, 2009, FEMA published in the Federal Register a proposed rule that contained an erroneous table. This notice provides corrections to that table, to be used in lieu of the information published at 74 FR 47169. The table provided here represents the flooding sources, location of referenced elevations, effective and modified elevations, and communities affected for Sanpete County, Utah, and Incorporated Areas. Specifically, it addresses the flooding source South Creek.

This rule makes nonsubstantive, technical changes to Title 33 of the CFR to reflect the realignment of boundaries shared among Sector Lake Michigan, Sector Detroit, and Sector Sault Ste. Marie. This action is taken to rebalance workload and span of control among Ninth District sector commands. These changes affect internal Coast Guard organization and functioning only and will have no substantive effect on mariners or other members of the public.

The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the Upper Hack Bridge at mile 6.9, across the Hackensack River, at Secaucus, New Jersey. The deviation is necessary to facilitate electrical repairs. This deviation will allow the bridge to remain in the closed position for two days.

The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the Meadowbrook State Parkway Bridge across the Sloop Channel, mile 12.8, at Hempstead, New York. The deviation is necessary to install new link arms at the bridge. This deviation allows the bridge to remain in the closed position.

The Coast Guard is withdrawing its notice of proposed rulemaking (NPRM) concerning the establishment of remote drawbridge operating procedures for the Canadian National Railway Bridge across the Fox River at Mile 55.72 at Oshkosh, Wisconsin. After careful consideration of the comments from all parties it was determined to be in the best interest of navigation to withdraw the NPRM.

As part of its continuing effort to reduce paperwork and respondent burden, CBP invites the general public and other Federal agencies to comment on an information collection requirement concerning the Request for Entry or Departure for Flights to and from Cuba. This request for comment is being made pursuant to the Paperwork Reduction Act of 1995 (Pub. L. 104-13).

The Lower Mississippi River Waterway Safety Advisory Committee will meet in New Orleans to discuss safe transit of vessels and products to and from the ports and related waterways of the Lower Mississippi River and related waterways. This meeting will be open to the public.

In accordance with the Privacy Act of 1974, the Department of Homeland Security proposes to establish a new Department of Homeland Security system of records notice titled, ``Department of Homeland Security Office of Operations Coordination and Planning002 National Operations Center Tracker and Senior Watch Officer Logs System of Records.'' This system of records consists of a National Operations Center and Senior Watch Officer Tracker Logs. The Senior Watch Officer Tracker Log is a synopsis, in the form of a word document, that records all significant information received and actions taken by the Senior Watch Officer during the shift. The National Operations Center Tracker Log is the underlying cumulative repository of responses to all-threats and all-hazards, man-made disasters and acts of terrorism, and natural disasters, and requests for information that require a National Operations Center tracking number. The National Operations Center tracker numbers are used in a wide variety of products originated by the Department or external sources. They are shared inside and outside of the Department and serve as shorthand for tying data, used in internal and external reports, and agency actions to the event that caused them. The National Operations Center Tracker Log contains a copy of all documents and information that is requested, shared, and/or researched between all National Operations Center Watch Officer Desks. Because of the depth and breadth of information that the NOC receives, categories of individuals and records are broad so as to cover the possibility of this personally identifiable information entering this Privacy Act system of records within the NOC. Some of the records in this system are in part transferred from the Department of Homeland Security/Information Analysis and Infrastructure Protection001 Homeland Security Operations Center Database system of records, April 15, 2005, with the overall intent of narrowing the focus of these records to the specific purpose outlined in this system of records notice. It is the Department's intent, after all records are transferred into this and other system of records, to retire the Department of Homeland Security/Information Analysis and Infrastructure Protection001 Homeland Security Operations Center Database system of records. The Department of Homeland Security has issued a Notice of Proposed Rulemaking consistent with this system of records elsewhere in the Federal Register. This newly established system will be included in the Department of Homeland Security's inventory of record systems.

The Department of Homeland Security is giving concurrent notice of a newly established system of records pursuant to the Privacy Act of 1974 for the Department of Homeland Security Office of Operations Coordination and Planning002 National Operations Center Tracker and Senior Watch Officer Logs System of Records and this proposed rulemaking. The National Operations Center and Senior Watch Officer tracking functions were previously covered by Department of Homeland Security/Information Analysis and Infrastructure Protection 001 Homeland Security Operations Center Database, April 18, 2005. In this proposed rulemaking, the Department proposes to exempt portions of the system of records from one or more provisions of the Privacy Act because of criminal, civil, and administrative enforcement requirements.
