Fees for Customs Processing at Express Consignment Carrier Facilities
This document proposes amendments to title 19 of the Code of Federal Regulations (19 CFR) to reflect changes to the customs user fee statute made by section 337 of the Trade Act of 2002 and section 2004(f) of the Miscellaneous Trade and Technical Corrections Act of 2004. The statutory amendments made by section 337 concern the fees payable for customs services provided in connection with the informal entry or release of shipments at express consignment carrier facilities and centralized hub facilities, and primarily serve to replace the annual lump sum payment procedure with a quarterly payment procedure based on a specific fee for each individual air waybill or bill of lading. Section 2004(f) amended the user fee statute to authorize, for merchandise that is formally entered at these sites, the assessment of merchandise processing fees provided for in 19 U.S.C. 58c(a)(9), in addition to the fees that are currently assessed on individual air waybills or bills of lading. Lastly, pursuant to the authority established in 19 U.S.C. 58c(b)(9)(B)(i), this document proposes to raise the existing $0.66 fee assessed on individual air waybills or bills of lading to $1.00 to more equitably align it with the actual costs incurred by CBP in processing these items.
Drawbridge Operation Regulation; N.E. 14th Street Bridge, Atlantic Intracoastal Waterway, Mile 1055.0, Pompano, FL
The Coast Guard is temporarily changing the regulations governing the operation of the N.E. 14th Street Bridge, Atlantic Intracoastal Waterway mile 1055.0, Pompano, Florida. This temporary rule provides for solely single-leaf bridge operations twice an hour between July 5, 2006 and September 30, 2006. During this period, the bridge will operate on a single-leaf schedule unless a four hour notice is provided for double-leaf openings.

Privacy Act of 1974: Implementation of Exemptions
The Department of Homeland Security is giving concurrent notice of a revised and updated system of records pursuant to the Privacy Act of 1974 for the Automated Biometric Identification System. In this proposed rulemaking, the Department proposes to exempt portions of this system of records from one or more provisions of the Privacy Act because of criminal, civil, and administrative enforcement requirements.
System of Records
The Department of Homeland Security is republishing the Privacy Act system of records notice for the Automated Biometric Identification System in order to expand its scope and authority to serve all or most programs that collect biometrics as part of their mission. As previously published, this system stored biometric information as a result of encounters pursuant to the Immigration and Nationality Act. As now proposed, this system will store biometric and limited biographic data collected for all national security, law enforcement, immigration, intelligence, and other mission-related functions.
Processing Additional Aliens Privacy Impact Assessment
The Department of Homeland Security has updated and is making available its United States Visitor and Immigrant Status Indicator Technology Program (US-VISIT) Privacy Impact Assessment (PIA) to discuss the impact of program change on privacy. The PIA can be found under the Privacy Impact Assessment Section of the Privacy Office's Web site, www.dhs.gov/privacy.
United States Visitor and Immigrant Status Indicator Technology Program (“US-VISIT”); Enrollment of Additional Aliens in US-VISIT
The Department of Homeland Security established the United States Visitor and Immigrant Status Technology (US-VISIT) program in 2003 to verify the identities and travel documents of aliens. US-VISIT automates this verification by comparing biometric identifiers, and by comparing biometric identifiers with information drawn from intelligence and law enforcement watchlists and databases. Aliens subject to US-VISIT may be required to provide fingerscans, photographs, or other biometric identifiers upon arrival at, or departure from, the United States. Currently, aliens entering the United States pursuant to a nonimmigrant visa, or those traveling without a visa as part of the Visa Waiver Program, are subject to US- VISIT requirements, with certain limited exceptions. Under this proposed rule, the Department of Homeland Security will be extending US-VISIT requirements to all aliens with the exception of aliens who are specifically exempted and Canadian citizens applying for admission as B1/B2 visitors for business or pleasure.
Extension of the Designation of Temporary Protected Status for Somalia; Automatic Extension of Employment Authorization Documentation for Somalia TPS Beneficiaries
The designation of Somalia for Temporary Protected Status (TPS) will expire on September 17, 2006. This Notice informs the public that the TPS designation for Somalia has been extended for 18 months, until March 17, 2008, and sets forth procedures for nationals of Somalia (or aliens having no nationality who last habitually resided in Somalia) with TPS to re-register and to apply for an extension of their Employment Authorization Documents (EADs) for the additional 18-month period. Re-registration is limited to persons who have previously registered for TPS under the designation of Somalia and whose application was granted or remains pending. Certain nationals of Somalia (or aliens having no nationality who last habitually resided in Somalia) who have not previously applied for TPS may be eligible to apply under the late initial registration provisions. Given the timeframes involved with processing TPS re-registrants, the Department of Homeland Security (DHS) recognizes that many re- registrants may not receive a new EAD until after their current EAD expires on September 17, 2006. Accordingly, this Notice automatically extends the validity of EADs issued under the TPS designation of Somalia for six months until March 17, 2007, and explains how TPS beneficiaries and their employers may determine which EADs are automatically extended.

Privacy Act of 1974: System of Records; National Finance Center (NFC) Payroll Personnel System; Correction
This document makes a correction to the notice published in the Federal Register on July 17, 2006, establishing a new system of records under the Privacy Act of 1974. The new system is known as the National Finance Center Payroll Personnel System (DHS/TSA 022) and is to be used to reflect the Transportation Security Administration's (TSA) migration from its legacy payroll system (the Department of Transportation's Integrated Personnel and Payroll System (IPPS), Consolidated Uniform Payroll System (CUPS), and Consolidated Personnel Management Information System (CPMIS)) to the Department of Agriculture's National Finance Center (NFC). TSA inadvertently transposed the digits in the RIN number in the document headings section. This document corrects this number.
Special Local Regulation: Annual Dragon Boat Races, Portland, OR
The Coast Guard is establishing a permanent special local regulation for the Dragon Boat Races held annually on the second Saturday and Sunday of June on the waters of the Willamette River, Portland, Oregon. These special local regulations limit the movement of non-participating vessels in the regulated race area. This rule will provide for the safety of life on navigable waters during the event. This rule will also remove special local regulations for the formerly- annual, Clarkston, Washington, Limited Hydroplane Races which no longer occur on a regular basis.
Automated Commercial Environment (ACE): National Customs Automation Program Test Of Automated Truck Manifest for Truck Carrier Accounts; Deployment Schedule
The Bureau of Customs and Border Protection, in conjunction with the Department of Transportation, Federal Motor Carrier Safety Administration, is currently conducting a National Customs Automation Program (NCAP) test concerning the transmission of automated truck manifest data. Drawbridge Operation Regulations; Thames River, New London, CT
The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the Amtrak Bridge, across the Thames River, mile 3.0, at New London, Connecticut. This deviation, in effect from July 14, 2006 through September 11, 2006, allows the bridge to remain in the closed position except during specific time periods when the bridge will remain open for the passage of vessel traffic. This deviation is necessary to facilitate unscheduled bridge repairs.
Drawbridge Operation Regulations; Hutchinson River, Bronx, NY
The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the AMTRAK Pelham Bay Bridge, across the Hutchinson River, mile 0.5, at New York City, New York. This deviation allows the bridge to remain in the closed position from 5 a.m. to 9 p.m. on July 23, 30, August 13, 20, and 27, 2006. This deviation is necessary to facilitate scheduled bridge maintenance.
Standards for Tariff Classification of Unisex Footwear
This document proposes new criteria to be used by the Bureau of Customs and Border Protection (``CBP'') to determine whether footwear should be considered to be ``commonly worn by both sexes'' (unisex) for tariff classification purposes under the Harmonized Tariff Schedule of the United States. The rates of duty applicable to footwear ``For other persons'' (i.e. ``unisex'') are about 1.5 percent higher than the rates of duty applicable to footwear ``For men, youths and boys''. CBP is seeking comments from the public on its proposed criteria prior to adoption of a final interpretation.

The Coast Guard proposes to establish temporary special local regulations for the ``Clarksville Hydroplane Challenge'', a power boat race to be held on the waters of the John H. Kerr Reservoir adjacent to Clarksville, Virginia. These special local regulations are necessary to provide for the safety of life on navigable waters during the event. This action is intended to restrict vessel traffic in portions of the John H. Kerr Reservoir adjacent to Clarksville, Virginia during the power boat race.

Chemical Transportation Advisory Committee
The Chemical Transportation Advisory Committee (CTAC) Subcommittee on Hazardous Cargo Transportation Security (HCTS) will meet to discuss various issues relating to the marine transportation of hazardous materials in bulk. The CTAC Working Groups on Barge Emissions and Placarding; the International Convention for the Prevention of Pollution from Ships, 1973 (MARPOL) Annex II; and Marine Vapor Control Systems will also meet to discuss environmental issues and proposed changes to regulations. These meetings will be open to the public.
Safety Zone; John's Pass, Tampa Bay, FL
The Coast Guard is establishing a temporary safety zone on the waters of Tampa Bay, Florida in the vicinity of the John's Pass Bascule Bridge. This safety zone is being established to protect mariners from the hazards associated with the blasting demolition of the concrete portions of the John's Pass Bascule Bridge. This rule is necessary to provide for the safety of life on the navigable waters of the United States.
