Energy Conservation Program: Request for Exclusion of 100 Watt R20 Short Incandescent Reflector Lamp From Energy Conservation Standards

The Energy Policy and Conservation Act of 1975 (EPCA), as amended, prescribes energy conservation standards for various consumer products and certain commercial and industrial equipment, including incandescent reflector lamps (IRLs). The U.S. Department of Energy (DOE) received a petition from the National Electrical Manufacturers Association requesting the initiation of a rulemaking to exclude from coverage under EPCA standards a certain type of IRL marketed for use in pool and spa applications. Specifically, the lamp at issue is a 100- watt R20 short (having a maximum overall length of 3 and \5/8\ or 3.625 inches) IRL (``R20 short lamp''). DOE published this petition and a request for comment in the Federal Register on December 23, 2010. From its evaluation of the petition and careful consideration of the public comments, DOE decided to grant the petition for rulemaking. DOE published a request for information in the Federal Register on September 8, 2011. Based on the comments received and additional data gathered by DOE, DOE proposes to exclude R20 short lamps from coverage under the EPCA energy conservation standards.

The Department of Energy (DOE) received a petition from the Association of Home Appliance Manufacturers (AHAM) requesting reconsideration of the U.S. Department of Energy's (DOE) final rule to amend the test procedures for residential dishwashers, dehumidifiers, and conventional cooking products, published on October 31, 2012, and DOE's direct final rule to amend energy conservation standards for dishwashers, published on May 30, 2012. Specifically, AHAM requested that DOE stay the effectiveness of the test procedure final rule and final standards rule until DOE either: Revises the standards in the final standards rule to account for the impact on measured energy resulting from test procedure amendments to measure fan-only mode and standby and off mode energy use; or delays requirements regarding measurement of fan-only mode and standby and off mode energy use until promulgation of a revised standard for dishwashers. DOE seeks comment on whether to grant the petition and proceed with a rulemaking on this matter.

The U.S. Department of Energy (DOE or the ``Department'') is adopting amendments to the compliance dates for manufacturers to submit certification reports for certain commercial and industrial equipment covered under the Energy Policy and Conservation Act of 1975, as amended (EPCA or the ``Act''). Specifically, DOE is extending the compliance date for the certification provisions for commercial refrigeration equipment; commercial heating, ventilating, air-conditioning (HVAC) equipment; and commercial water heating (WH) equipment to December 31, 2013. DOE is extending the certification date for automatic commercial ice makers to August 1, 2013. Lastly, DOE is adopting a correction to the packaged terminal equipment standards table, which would impact standard-size packaged terminal air conditioners and packaged terminal heat pumps with a cooling capacity of 15,000 Btu/h.

Energy Conservation Program for Consumer Products: Test Procedures for Residential Furnaces and Boilers (Standby Mode and Off Mode)

In an earlier final rule, the U.S. Department of Energy (DOE) prescribed amendments to its test procedures for residential furnaces and boilers to include provisions for measuring the standby mode and off mode energy consumption of those products, as required by the Energy Independence and Security Act of 2007. These test procedure amendments were primarily based on provisions incorporated by reference from the International Electrotechnical Commission (IEC) Standard 62301 (First Edition), ``Household electrical appliancesMeasurement of standby power.'' In this current final rule, DOE further amends its test procedure to incorporate by reference the latest edition of the IEC Standard, specifically IEC Standard 62301 (Second Edition). The new version of this IEC standard includes a number of methodological changes designed to increase accuracy while reducing testing burden. This final rule also clarifies the rounding guidance and sampling provisions for the new measurement of standby mode and off mode wattage.

Quartzsite Solar Energy (QSE) has requested to interconnect the Quartzsite Solar Energy Project (Project), a proposed 100-megawatt (MW) concentrating solar power plant, to Western Area Power Administration's (Western) Bouse-Kofa 161-kilovolt (kV) transmission line. QSE has submitted a right-of-way (ROW) application to the Bureau of Land Management (BLM) for the Project facility to be constructed on a total of approximately 1,675 acres of land managed by the BLM. The Project area is in an undeveloped area of the Sonoran Desert in La Paz County, Arizona. In accordance with the National Environmental Policy Act (NEPA) of 1969, as amended, and the Federal Land Policy and Management Act (FLPMA) of 1976, as amended, Western and the BLM prepared a Final Environmental Impact Statement \1\ (EIS) and Yuma Field Office (Yuma) Proposed Resource Management Plan Amendment (PRMPA) for the Project, and by this Notice Western and the BLM are announcing the availability of the Final EIS/PRMPA. Western is the lead Federal agency for purposes of satisfying the NEPA requirements with the BLM acting as a cooperating agency.

On December 12, 2012, the U.S. Department of Energy (DOE) published in the Federal Register, a notice of availability for the Draft Programmatic Environmental Assessment (PEA) for the Recycling of Scrap Metals Originating from Radiological Areas (DOE/EA-1919) for public review and comment (77 FR 73996). In that notice, the email address for submitting comments on the Draft PEA contained an error. On December 20, 2012, DOE resolved this issue, and the email address listed in that notice is now working. In addition, on December 20, 2012, DOE received requests to extend the comment period due to the several holidays falling during the original 30-day comment period. Because the email address for submitting electronic comments was not working from December 12 through December 20, 2012, and in response to the requests for additional time, DOE has decided to extend the public comment period by 30 days. The email address printed in the Draft PEA was correct and now both that email address (Scrap_PEA_ Comments@hq.doe.gov) and the one in the notice of availability (Scrap_ PEAcomments@hq.doe.gov) may be used to submit comments.

In this Final Rule, the Federal Energy Regulatory Commission (the Commission) is amending its regulations, pursuant to sections 222 and 307(a) of the Federal Power Act (FPA), to grant Commission access, on a non-public and ongoing basis, to the complete electronic tags (e- Tags) used to schedule the transmission of electric power interchange transactions in wholesale markets. This Final Rule will require e-Tag Authors (through their Agent Service) and Balancing Authorities (through their Authority Service) to take appropriate steps to ensure Commission access to the e-Tags covered by this Final Rule by designating the Commission as an addressee on the e-Tags. After the Commission is designated as an addressee, the Commission will access the e-Tags by contracting with a commercial vendor. The commercial vendor will provide data management services and receive e-Tags addressed to the Commission. The information made available under this Final Rule will bolster the Commission's market surveillance and analysis efforts by helping the Commission to detect and prevent market manipulation and anti-competitive behavior. This information will also help the Commission monitor the efficiency of markets and better inform Commission policies and decision-making, thereby helping to ensure just and reasonable rates. In addition, this Final Rule will require that e- Tag information be made available to regional transmission organizations and independent system operators and their Market Monitoring Units, upon request to e-Tag Authors and Authority Services, subject to appropriate confidentiality restrictions.
Regional Reliability Standard PRC-006-SERC-01; Automatic Underfrequency Load Shedding Requirements

Under section 215 of the Federal Power Act, the Federal Energy Regulatory Commission (Commission) approves regional Reliability Standard PRC-006-SERC-01 (Automatic Underfrequency Load Shedding Requirements), submitted to the Commission for approval by the North American Electric Reliability Corporation (NERC). Regional Reliability Standard PRC-006-SERC-01 is designed to ensure that automatic underfrequency load shedding protection schemes, designed by planning coordinators and implemented by applicable distribution providers and transmission owners in the SERC Reliability Corporation Region, are coordinated to mitigate the consequences of an underfrequency event effectively. The Commission approves the related violation risk factors, with one modification, violation severity levels, implementation plan, and effective date proposed by NERC.

The U.S. Department of Energy (DOE) intends to prepare an Environmental Impact Statement for the Plains & Eastern Clean Line Transmission Project (DOE/EIS-0486; Plains & Eastern EIS or EIS) to assess the potential environmental impacts of participating with Clean Line Energy Partners LLC (Clean Line) in the proposed Plains & Eastern Project (the proposed project). The proposed project would include an overhead 600 kilovolt (kV) high voltage direct current (HVDC) electric transmission system and associated facilities with the capacity to deliver approximately 3,500 megawatts (MW) primarily from renewable energy generation facilities in the Oklahoma Panhandle region to load-serving entities in the Mid-South and Southeast via an interconnection with the Tennessee Valley Authority (TVA). The proposed project would traverse Oklahoma, Arkansas, and Tennessee, a distance of approximately 700 miles between interconnection facilities in Texas County, Oklahoma, and Shelby County, Tennessee. The proposed project would require construction of a new alternating current (AC)/direct current (DC) converter station at each end of the transmission line. Portions of the proposed project may affect floodplains and/or wetlands. This NOI, therefore, also serves as a notice of proposed floodplain or wetland action in accordance with DOE floodplain and wetland environmental review requirements (10 CFR part 1022). The Plains & Eastern EIS will include a floodplain and wetland assessment. DOE plans to coordinate the National Environmental Policy Act (NEPA) review and the Section 106 compliance process under the National Historic Preservation Act (NHPA). DOE also intends to consult with the U.S. Fish and Wildlife Service (USFWS) and the National Marine Fisheries Service (NMFS), as appropriate, pursuant to Section 7 of the Endangered Species Act.
