In May 2012, we announced our intention to establish a negotiated rulemaking committee to prepare proposed regulations for the Federal Student Aid programs authorized under title IV of the Higher Education Act of 1965, as amended. On April 16, 2013, we published in the Federal Register a notice announcing additional topics for consideration by that committee. We announced three public hearings at which interested parties may comment. We also announced that for anyone unable to attend a public hearing, we would accept written comments. This document corrects the inconsistent docket numbers we provided for commenters in the April 16 document. The correct docket number is ED- 2012-OPE-0008.

The Secretary intends to use the existing slate of applicants developed for the Credit Enhancement for Charter School Facilities Program in Fiscal Year (FY) 2011 to make new grant awards in FY 2013. The Secretary takes this action because a significant number of high- quality applications remain on the grant slate and, given the limited funding available for the program in FY 2013 relative to the typical grant amount, the Secretary believes the benefits of running a new competition are outweighed by the cost of spending program dollars on peer review.

The Secretary proposes priorities, requirements, definitions, and selection criteria under the Race to the TopDistrict program. The Secretary may use one or more of these priorities, requirements, definitions, and selection criteria for competitions using funds from fiscal year (FY) 2013 and later years. The Race to the TopDistrict program builds on the experience of States and districts in implementing reforms in the four core educational assurance areas through Race to the Top and other key programs and supports applicants that demonstrate how they can personalize education for all students in their schools. The U.S. Department of Education (Department) conducted one competition under the Race to the TopDistrict program in FY 2012, and we propose to maintain the overall purpose and structure of the FY 2012 Race to the TopDistrict competition. These proposed priorities, requirements, definitions, and selection criteria are almost identical to the ones we used in the FY 2012 competition. We describe the changes at the beginning of each section of this document.

The Assistant Secretary may use this priority for competitions in fiscal year (FY) 2013 and later years. We take this action to ensure that NIDRR's resources are appropriately allocated across the three outcome domains of individual well-beingcommunity living and participation, employment, and health and function. We intend this priority to strengthen the capacity of the disability and rehabilitation field to train qualified individuals, including individuals with disabilities, to conduct high-quality, advanced multidisciplinary rehabilitation research; and through this training contribute to improved outcomes for individuals with disabilities across the domains of community living and participation, employment, and health and function.
