School Improvement Grants-American Recovery and Reinvestment Act of 2009; Title I of the Elementary and Secondary Education Act of 1965

The U.S. Secretary of Education (Secretary) proposes requirements for School Improvement Grants authorized under section 1003(g) of Title I of the Elementary and Secondary Education Act of 1965, as amended (ESEA), and funded through both the Department of Education Appropriations Act, 2009 and the American Recovery and Reinvestment Act of 2009 (ARRA). The proposed requirements would define the criteria that a State educational agency (SEA) must use to award school improvement funds to local educational agencies (LEAs) with the lowest-achieving Title I schools that demonstrate the greatest need for the funds and the strongest commitment to use those funds to provide adequate resources to their lowest-achieving Title I schools in order to raise substantially the achievement of the students attending those schools. The proposed requirements also would require an SEA to give priority, through a waiver under section 9401 of the ESEA, to LEAs that also wish to serve the lowest-achieving secondary schools that are eligible for, but do not receive, Title I funds. Finally, the proposed requirements would require an SEA to award school improvement funds to eligible LEAs in amounts sufficient to enable the targeted schools to implement one of four specific proposed interventions.

On August 17, 2009, we published in the Federal Register (74 FR 41407) a notice inviting applications for new awards under the American Recovery and Reinvestment Act of 2009Impact Aid Discretionary Construction Program. The notice specified a deadline of October 1, 2009 for the submission of applications. Since publication, however, we have learned that the Department's e-Application system will be shut down on October 1 in connection with the Department's transition of its systems to the new fiscal year, which begins on October 1. Therefore, we are correcting the deadline for the submission of applications to October 8, 2009.

The U.S. Secretary of Education (Secretary) proposes to adjust the statutory caps on State administration under Title I, part A of the Elementary and Secondary Education Act of 1965, as amended (Title I, part A), and part B, section 611 of the Individuals with Disabilities Education Act (IDEA) with respect to funds available for those programs under the American Recovery and Reinvestment Act of 2009 (ARRA), Public Law 111-5. The proposed adjustments would allow State educational agencies (SEAs) to reserve State administrative funds from their fiscal year (FY) 2009 ARRA allocations under Title I, part A and section 611 of IDEA to help defray the costs of data collections that are specifically related to ARRA funding for these programs (including, for Title I, part A, data collection related to waivers). This notice only affects administrative costs for data collection under Title I, part A and IDEA section 611; for costs associated with other ARRA data collections, SEAs may use a portion of the State's Government Services grant under the State Fiscal Stabilization Funds or funds allowable for that purpose under individual programs.

The Secretary amends the regulations for the American Indian Vocational Rehabilitation Services (AIVRS) program to permit a consortium of Indian Tribes to establish a separate legal entity to apply for a grant under this program. This change is needed to provide the flexibility required by the Department to make grants to Indian Tribes that choose to form a consortium and, rather than authorizing one of the Indian Tribes of the consortium to serve as the grantee, create a separate legal entity that serves as the grantee on behalf of the consortium and that is responsible for using the grant funds to provide services to all the Indian Tribes in the consortium.

On May 14, 2009, we published in the Federal Register (74 FR 22729) a notice inviting applications for new awards for fiscal year (FY) 2009 for the American Indian Vocational Rehabilitation Services (AIVRS) program. The application notice for the FY 2009 AIVRS program competition established a July 23, 2009, deadline date for eligible applicants to apply for funding under this program. Elsewhere in this issue of the Federal Register we have published interim final regulations that amend the regulatory definition of the term consortium under the AIVRS program. In order to apply this change to entities applying for a FY 2009 grant, through this notice, we are reopening the competition and establishing a new deadline for the submission of applications by those applicants affected by the change.
