Type: Proposed Rule
Date: 2013-06-26

DoD, GSA, and NASA are proposing to amend the Federal Acquisition Regulation (FAR) to continue the implementation of the requirements of section 803 of the National Defense Authorization Act for Fiscal Year 2012. The proposed rule seeks public comments on applying section 803 with respect to that provision's expansion with respect to contracts that had been awarded by DoD, NASA, and the Coast Guard before the date of enactment of section 803 (which was December 31, 2011) of the application of the senior executive compensation benchmark amount. Section 803 expands to a broader group of contractor employees the limitation on reimbursing compensation costs. As section 803 provides, this proposed rule would apply section 803 retroactively to contracts awarded before December 31, 2011, with respect to the contractor compensation costs incurred after January 1, 2012. In addition, also as part of the implementation in the FAR of section 803, DoD, GSA and NASA are separately issuing an interim rule (FAR Case 2012-017) that addresses the prospective application of section 803 to contracts awarded on or after December 31, 2011.

Draft Environmental Impact Statement for the Disposition of Hangars 2 and 3, Fort Wainwright, Alaska
Document Number: 2013-14726
Type: Notice
Date: 2013-06-21
Agency: Department of Defense, Department of the Army
The Department of the Army announces the availability of the Draft Environmental Impact Statement (EIS) for the disposition of two historic hangars at Fort Wainwright (FWA). The Draft EIS analyzes and evaluates the potential environmental impacts associated with proposed disposition options for two historic World War II-era hangars (Hangars 2 and 3) and supporting infrastructure located on the Main Post of FWA. Environmental consequences were evaluated for seven resource areas: Air quality, cultural resources, hazardous materials/hazardous waste, safety, environmental justice and protection of children, sustainability, and transportation. No significant impacts would be anticipated under all resource categories except cultural, which would experience significant impacts. The Army considered several reuse alternatives for the hangars. All but one of these reuse alternatives were not compatible with the current or future military mission at FWA. This one reuse exception as an unmanned aerial system maintenance hangar was determined to be prohibitively expensive. As a result, only one action alternative was considered as reasonable and is analyzed in detail in the Draft EIS: Demolition of Hangars 2 and 3 (Alternative 1). The No Action Alternative is also considered and carried through for detailed analysis in the Draft EIS. Under the No Action Alternative, demolition of Hangars 2 and 3 would not occur, the hangars would remain vacant, and they would be maintained at minimal levels. The No Action Alternative provides the environmental baseline conditions for comparing the impacts associated with the other alternative.

The Congressional response to the devastation in the wake of Hurricane Sandy included a mandate to collaborate with federal, state, tribal and local government agencies to regionally address the vulnerability of coastal populations at risk within the boundaries of the U.S. Army Corps of Engineers (USACE) North Atlantic Division. The goals of the North Atlantic Coast Comprehensive Study authorized under the Disaster Relief Appropriations Act, Public Law 113-2, are to (1) reduce flood risk to vulnerable coastal populations, and (2) promote coastal resilient communities to ensure a sustainable and robust coastal landscape system, considering future sea-level rise and climate change scenarios. In addition, the Comprehensive Study will identify activities warranting further analysis and institutional barriers to comprehensive implementation. A draft of the North Atlantic Coast Comprehensive Study will be available for public review and comment in early 2014 and a final report is due to Congress in January 2015. The study will identify those areas warranting more detailed evaluations; however, USACE is not authorized to develop designs or implement such projects at this time. Although potential environmental impacts will be generally evaluated, National Environmental Policy Act (NEPA) compliance processes will not be completed due to the scale of the study. Full NEPA and other environmental compliance would be required as part of future detailed evaluations before any actions could be implemented.
