Certain Polyethylene Terephthalate Film, Sheet and Strip from India: Final Results of Antidumping Duty Administrative Review

On April 12, 2006, the Department of Commerce (the Department) published the preliminary results of the administrative review of the antidumping duty order on certain polyethylene terephthalate film, sheet and strip (PET film) from India. See Certain Polyethylene Terephthalate Film, Sheet and Strip from India: Preliminary Results and Rescission in Part of Antidumping Duty Administrative Review, 71 FR 18715 (April 12, 2006) (Preliminary Results). This review covers three producers/exporters of PET film, MTZ Polyfilms, Ltd. (MTZ), Jindal Poly Films Limited\1\ (Jindal), and Polyplex Corporation Ltd. (Polyplex). The period of review (POR) is July 1, 2004, through June 30, 2005. Based on our analysis of the comments received, we made changes to the preliminary dumping margin calculation for one respondent, Jindal. The final weighted-average dumping margin for the reviewed firms are listed below in the section entitled ``Final Results of Review.''

Lavin, November 29-30, 2006, followed by spin-off missions in six Indian cities, December 4-5, 2006. Leaders of U.S. business, industry, education, and state and local government are among those encouraged to take part in the Summit, which will provide access to India's high-level business, industry, and government representatives and insights into the country's trade and investment climate. The spin-off missions in Bangalore, Calcutta, Chennai, Hyderabad, Mumbai, and New Delhi are open to qualified U.S. exporters in a range of sectors; they will include market briefings, networking events, and one-on-one business appointments with prospective agents, distributors, partners, and end-users. (DuPont)\1\ for a changed circumstances review and a request to revoke, in part, the antidumping duty (AD) finding on certain polychloroprene rubber products from Japan. In its June 30, 2006, submission, DuPont stated that it no longer has any interest in antidumping relief from imports of such polychloroprene rubber with respect to the subject merchandise defined in the ``Scope of the Finding'' section below. Interested parties are invited to comment on these preliminary results.

Notice of Amended Final Results in Accordance With Court Decision: Antidumping Duty Administrative Review of Certain Cased Pencils from the People's Republic of China

On March 7, 2006, the United States Court of International Trade (CIT) affirmed the voluntary redetermination of the Department of Commerce (the Department) in the antidumping duty (AD) administrative review of certain cased pencils (pencils) from the People's Republic of China (PRC). See China First Pencil Co. Ltd., et al. v. United States and Sanford Corporation, et al., 427 F. Supp 2d 1236 (CIT 2006), and the Department's Final Results of Voluntary Redetermination Pursuant to Court Order: China First Pencil Co., Ltd., et al. and Shandong Rongxin Import & Export Co., Ltd., v. United States and Sanford Corporation, et al. (dated December 20, 2004). As there is now a final and conclusive court decision in this case, the Department is amending the final results of this administrative review.
Cut-to-Length Carbon Steel Plate from the People's Republic of China: Notice of Rescission, in Part, and Preliminary Results of Antidumping Duty Administrative Review

In response to a request from Nucor Corporation, a domestic producer and interested party in this proceeding, the Department of Commerce (``Department'') is conducting an administrative review of cut-to-length carbon steel plate (``CTL plate'') from the People's Republic of China (``PRC'') for the period November 1, 2004, through October 31, 2005. We preliminarily determine that application of adverse facts available (``AFA'') is warranted with respect to the sole company participating in this administrative review, China Metallurgical Import & Export Liaoning Company (``Liaoning Company''). In addition, the Department is preliminarily rescinding the administrative review with respect to Angang New Steel Co., Ltd. and Angang Group Hong Kong Co., Limited (collectively ``Angang''), as its request for review was properly and timely withdrawn. If these preliminary results are adopted in our final results of administrative review, we will instruct U.S. Customs and Border Protection (``CBP'') to assess antidumping duties on all appropriate entries of subject merchandise. Interested parties are invited to comment on these preliminary results. We will issue the final results no later than 120 days from the date of publication of this notice.

Pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act), the International Trade Commission (the ITC) determined that revocation of these orders would not be likely to lead to continuation or recurrence of material injury to an industry in the United States within a reasonably foreseeable time. In response to requests from Allegheny Ludlum, North American Stainless, United Auto Workers Local 3303, United Steelworkers, and Zanesville Armco Independent Organization, Inc. (collectively, petitioners) and the collapsed respondents ThyssenKrupp Nirosta GmbH (ThyssenKrupp Nirosta), ThyssenKrupp VDM GmbH (TKVDM), and ThyssenKrupp Nirosta Prazisionsband GmbH (TKNP) (collectively, TKN), the Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on stainless steel sheet and strip in coils (S4) from Germany. The review covers exports of the subject merchandise to the United States produced by TKN. The period of review (POR) is July 1, 2004, through June 30, 2005. We preliminarily find that TKN made sales at less than normal value during the POR. If these preliminary results are adopted in our final results of this review, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties based on the difference between the constructed export price (CEP) and normal value (NV). Interested parties are invited to comment on these preliminary results. Notice of Preliminary Results and Partial Rescission of Antidumping Duty Administrative Review: Ninth Administrative Review of the Antidumping Duty Order on Certain Pasta from Italy

In response to requests by interested parties, the Department of Commerce (``the Department'') is conducting an administrative review of the antidumping duty order on certain pasta (``pasta'') from Italy for the period of review (``POR'') July 1, 2004, through June 30, 2005. We preliminarily determine that during the POR, both Corticella Molini e Pastifici S.p.A. and its affiliate Pasta Combattenti S.p.A. (collectively, ``Corticella/Combattenti'') and Atar, S.r.L. (``Atar'') sold subject merchandise at less than normal value (``NV''). If these preliminary results are adopted in the final results of this administrative review, we will instruct U.S. Customs and Border Protection (``CBP'') to assess antidumping duties equal to the difference between the export price and normal value (``EP''). Further, requests for review of the antidumping duty order for the following companies were withdrawn: Barilla G.e.R. Fratelli, S.p.A.,/ Barilla Alimentare, S.p.A. (``Barilla''), Moline e Pastificio Tomasello S.r.L. (``Tomasello''), and Pastificio Laporta S.a.s (``Laporta''). Because the withdrawal requests were timely and there were no other requests for review of these companies, we are rescinding the review for these companies. See 19 CFR 351.213(d)(1). Furthermore, we are preliminarily rescinding the review with respect to Italpasta/Pasta Berruto S.p.A. (``Italpasta'')\1\ because Italpasta submitted a letter stating that it had no shipments of subject merchandise during the POR. See 19 CFR 351.213(d)(3). As discussed in the Partial Rescission section below, customs data did not contradict Italpasta's claim that it did not have shipments of subject merchandise during the POR.

As a result of the determinations by the Department of Commerce (the Department) and the International Trade Commission (ITC) that revocation of the antidumping duty orders on circular welded non- alloy pipe and tube from Brazil, Mexico, and Republic of Korea (Korea), and antidumping duty orders on welded carbon steel pipe from India, Thailand and Turkey, and countervailing duty order on welded carbon steel standard pipe from Turkey, would likely lead to continuation or recurrence of dumping and countervailable subsidies, and material injury to an industry in the United States, the Department is publishing notice of continuation of these antidumping and countervailing duty orders.

On April 5, 2006, the United States Court of International Trade (CIT) sustained the final remand redetermination made by the Department of Commerce (the Department) pursuant to the CIT's third remand of the final results of the 1997-1998 administrative review of dynamic random access memory semiconductors of one megabit or above (DRAMs) from the Republic of Korea (Korea). See Hyundai Electronics Industries Co., Ltd. and Hyundai Electronics America, Inc. v. United States and Micron Technology, Inc., 425 F. Supp. 2d 1321 (CIT 2006) (Hyundai IV). Because all litigation in this matter has now concluded, the Department is now issuing its amended final results in accordance with the CIT's decision. Effective Date: August 3, 2006.
Notice of Final Results of Antidumping Duty New Shipper Review: Certain Welded Carbon Steel Pipe and Tube from Turkey

On April 26, 2006, the Department of Commerce (``the Department'') published the preliminary results of its new shipper review of the antidumping duty order on certain welded carbon steel pipe and tube (``welded pipe and tube'') from Turkey. This review covers one producer/exporter of the subject merchandise. The period of review (``POR'') is May 1, 2004, through April 30, 2005. On June 2, 2006, we received a case brief from petitioner.\1\ On June 9, 2006, we received a rebuttal brief from respondent.\2\ Based on the Department's analysis of the issues, these final results have not changed from the preliminary results. The final results are listed in the section below entitled ``Final Results of Review.''

On April 6, 2006, the Department of Commerce (``the Department'') published in the Federal Register its preliminary results of administrative review of the countervailing duty (``CVD'') order on certain welded carbon steel standard pipe from Turkey for the period January 1, 2004, through December 31, 2004. The Department has now completed the administrative review in accordance with section 751(a) of the Tariff Act of 1930, as amended (``the Act''). Based on our analysis of the comments received, the Department has not revised the net subsidy rate for the Borusan Group (``Borusan''), the producer/exporter of subject merchandise covered by this review.\1\ Further discussion of our analysis of the comments received is provided in the accompanying issues and decision memorandum.
