Missoula Resource Advisory Committee

Stakeholder Listening Sessions on New Rural Innovation Stronger Economy (RISE) Regulation
The Rural Business-Cooperative Service (RBCS) is hosting three listening sessions for public input about the new Rural Innovation Stronger Economy (RISE) program and regulation. The RISE program will assist rural job accelerator partnerships in improving the ability of distressed rural communities to create high-wage jobs, accelerate the formation of new businesses, and help rural communities identify and maximize local assets. This rule will be published as a direct-final regulation after addressing comments received from the listening sessions and written comments in response to this request for information. RBCS is currently drafting the RISE regulation and requests input on application implementation and project priorities to reach the desired outcomes.
Child and Adult Care Food Program: National Average Payment Rates, Day Care Home Food Service Payment Rates, and Administrative Reimbursement Rates for Sponsoring Organizations of Day Care Homes for the Period July 1, 2020 Through June 30, 2021
This notice announces the annual adjustments to the national average payment rates for meals and snacks served in child care centers, outside-school-hours care centers, at-risk afterschool care centers, and adult day care centers; the food service payment rates for meals and snacks served in day care homes; and the administrative reimbursement rates for sponsoring organizations of day care homes, to reflect changes in the Consumer Price Index. Further adjustments are made to these rates to reflect the higher costs of providing meals in Alaska and Hawaii. The adjustments contained in this notice are made on an annual basis each July, as required by the laws and regulations governing the Child and Adult Care Food Program.
National School Lunch, Special Milk, and School Breakfast Programs, National Average Payments/Maximum Reimbursement Rates
This Notice announces the annual adjustments to the national average payments, the amount of money the Federal Government provides States for lunches, afterschool snacks, and breakfasts served to children participating in the National School Lunch and School Breakfast Programs; to the maximum reimbursement rates, the maximum per lunch rate from Federal funds that a State can provide a school food authority for lunches served to children participating in the National School Lunch Program; and to the rate of reimbursement for a half-pint of milk served to non-needy children in a school or institution that participates in the Special Milk Program for Children.

The document contained incorrect deadline to submit proposals. The deadline has been corrected to August 26, 2020.

Food Distribution Program on Indian Reservations: Two-Year Administrative Funding Availability and Substantial Burden Waiver Signatory Requirement
Through this rulemaking, the U.S. Department of Agriculture's (the Department or USDA) Food and Nutrition Service (FNS) is codifying a revised statutory requirement included in the Agriculture Improvement Act of 2018. The 2018 Farm Bill at section 4003 requires FDPIR administrative funds to remain available for obligation at the Indian Tribal Organization (ITO) and State agency level for a period of two Federal fiscal years. This provision was self-executing and went into effect upon enactment of the 2018 Farm Bill in Federal fiscal year (FY) 2019. This final rulemaking will also amend the Department's previous implementation of the 2018 Farm Bill provision on the administrative match waiver requirement based on substantial burden.
Petition To Manufacture Foot-and-Mouth Disease Vaccine in the United States
We are notifying the public that the Animal and Plant Health Inspection Service has received a petition from Zoetis, Inc. to approve the manufacture within the continental United States of a vaccine derived from a leaderless strain of the foot-and-mouth disease (FMD) virus. While introduction of live FMD virus into the United States is prohibited by law, the petition states that this attenuated strain of the virus is incapable of causing FMD symptoms or infection in animals. We are soliciting comments from the public regarding the petition and requesting information that will aid us in determining how best to respond to the petition.
Inviting Applications for Rural Cooperative Development Grants; Correction
The Rural Business-Cooperative Service, USDA published a notice in the Federal Register on July 2, 2020, that the Agency is accepting fiscal year (FY) 2020 applications for the Rural Cooperative Development Grant (RCDG). This document inadvertently referenced an incorrect application submission deadline in the Submission Date and Time and the Application Review Information sections and corrected references to an Office of Budget Memorandum.
OneRD Guaranteed Loan Regulation
The Rural Business-Cooperative Service, Rural Housing Service, and the Rural Utilities Service, agencies of the Rural Development mission area within the U.S. Department of Agriculture (USDA), hereinafter collectively referred to as the Agency, are proposing a unified guaranteed loan platform for enhanced delivery of four of its existing guaranteed loan programs: Community Facilities (CF) administered by the Rural Housing Service; Water and Waste Disposal (WWD) administered by the Rural Utilities Service; and, Business and Industry (B&I) and Rural Energy for America (REAP) administered by the Rural Business-Cooperative Service. Collectively, these four Rural Development's guaranteed loan programs work to assist in building and maintaining sustainable rural communities. This rule incorporates new and revised provisions intended to simplify, improve, expand and enhance the delivery of the four guaranteed loan programs. These provisions include, among others, clearly defining specific project eligibility criteria, revising the requirements for lenders to participate in the programs, and streamlining the documentation requirements for submission of guaranteed loan applications.

National Veterinary Accreditation Program; Correction
In a final rule that was published in the Federal Register on February 25, 2020, and effective on March 26, 2020, we amended the regulations governing the National Veterinary Accreditation Program by, among other things, replacing all instances of the term ``Veterinarian- in-Charge'' with the term ``Veterinary Official.'' However, we inadvertently left two instances of the term ``Veterinarian-in-Charge'' in the regulations. This document corrects that oversight in the final rule.

Coronavirus Food Assistance Program; Correction
The Secretary of Agriculture implemented the Coronavirus Food Assistance Program (CFAP), which provides assistance to agricultural producers impacted by the effects of the COVID-19 outbreak, through a final rule published in the Federal Register on May 21, 2020. We realized that there were errors in some of the payment rates in that final rule. In addition, we were able to reevaluate the payment rates for certain specialty crops based on data that was available from industry in response to the CFAP notice of funding availability, which was published in the Federal Register on May 22, 2020. This document corrects payment rates and categories for those specialty crops that were published in the final rule.

The Coronavirus Food Assistance Program (CFAP) helps agricultural producers impacted by the effects of the COVID-19 outbreak. As provided in the CFAP regulation, this document announces additional commodities that have been determined to be eligible for CFAP assistance. USDA carefully reviewed the additional information provided in the comments to develop the list of additional commodities. Additional review is ongoing, which will result in a subsequent announcement.
Inviting Applications for the Delta Health Care Services Grant Program
This Notice of Funding Availability (Notice) announces that the Rural Business-Cooperative Service (Agency) is accepting fiscal year (FY) 2020 applications for the Delta Health Care Services (DHCS) grant program. Approximately $6.0 million is currently available for FY 2020. The Agency will publish the program funding level on the Rural Development website https://www.rd.usda.gov/programs-services/delta- health-care-services-grants. The purpose of this program is to provide financial assistance to address the continued unmet health needs in the Delta Region through cooperation among health care professionals, institutions of higher education, research institutions, and economic development entities in the Delta Region.
Custer Gallatin National Forest; Montana; Revision of the Land Management Plan for the Custer Gallatin National Forest
The Forest Service is revising the Custer Gallatin National Forest's 1986 and 1987 Land and Resource Management Plans. The Forest Service has prepared a final environmental impact statement (final EIS) for the revised land management plan, and a draft record of decision (ROD). This notice is to inform the public that a 60-day period is being initiated where individuals or entities with specific concerns about the Custer Gallatin National Forest's revised land management plan and the associated final EIS may file objections for Forest Service review prior to the approval of the revised land management plan. This is also an opportunity to object to the Regional Forester's list of species of conservation concern (SCC) for the Custer Gallatin National Forest.
Funding Opportunity Announcement-Solicitation for Applications To Assist Persistent Poverty Farmers, Ranchers, Agriculture Producers and Communities Through Agriculture Resources
This notice announces the availability of funds and solicits applications for grants from community-based and non-profit organizations, institutions of higher education, and tribal entities to compete for financial assistance through the OPPE. Funding will be made available for the purpose of leveraging USDA, state, local and private sector resources, to address local agricultural and natural resource issues, encourage collaboration and to develop state and local leadership and partnerships to assist limited resource and socially disadvantaged and veteran farmers, ranchers, agricultural producers and communities through agriculture industries. Land Uses; Special Uses; Procedures for Operating Plans and Agreements for Powerline Facility Maintenance and Vegetation Management Within and Abutting the Linear Boundary of a Special Use Authorization for a Powerline Facility
The U.S. Department of Agriculture is amending its existing special use regulations to implement section 512 of the Federal Land Policy and Management Act (FLPMA), as added by section 211 of division O, Consolidated Appropriations Act, 2018 (hereinafter ``section 512''). This section governs the development and approval of operating plans and agreements for maintenance and vegetation management of electric transmission and distribution line facilities (powerline facilities) on National Forest System (NFS) lands inside the linear boundary of special use authorizations for powerline facilities and on abutting NFS lands to remove or prune hazard trees.

The Office of the Secretary of the Department of Agriculture (the Secretary) announces the establishment of the Fiscal Year (FY) 2021 (October 1, 2020-September 30, 2021) in-quota aggregate quantity of raw cane sugar at 1,117,195 metric tons raw value (MTRV), and the establishment of the FY 2021 in-quota aggregate quantity of certain sugars, syrups, and molasses (also referred to as refined sugar) at 162,000 MTRV.
Forest Service Handbook 2309.13, Chapter 50; Operation and Maintenance of Developed Recreation Sites
The United States Department of Agriculture (USDA), Forest Service is proposing to issue a proposed directive to update its handbook on operation and maintenance of recreation sites on National Forest System lands that contain infrastructure or amenities authorized by the Forest Service for public enjoyment and resource protection. Examples of developed recreation sites include boat launches, campgrounds, climbing areas, day use areas, picnic sites, fishing sites, group campgrounds and picnic sites, horse camps, informational and interpretive sites, visitor centers, recreation rental cabins, observation sites, off-highway vehicle staging areas, alpine and Nordic ski areas, developed swimming sites, snow play areas, target ranges, trailheads, and wildlife viewing sites.
Procedural Requirements Governing Proceedings Pertaining to Marketing Agreements and Marketing Orders
The U.S. Department of Agriculture (USDA) is adopting a final rule to amend the procedural regulations governing proceedings to formulate or amend Marketing Agreements and Marketing Orders. Notice of Settlement Pursuant to CERCLA; Administrative Settlement Agreement and Order on Consent for the Ross Adams Mine Site Cleanup
In accordance with section 122(i) of the Comprehensive Environmental Response, Compensation, and Liability Act, as amended (CERCLA), notice is hereby given that the USDA Forest Service is seeking comments on the Administrative Settlement Agreement and Order on Consent for Removal Action (``ASAOC'') for the Ross Adams Mine Site (``the Site''). On January 17, 2020, the United States Department of Agriculture (USDA), Forest Service, Region 10 entered into an ASAOC with Newmont USA Limited (``Newmont'') and Dawn Mining Company, LLC (``Dawn''). The ASAOC provides for a comprehensive cleanup of the Ross Adams Mine Site in southeastern Alaska.
Tart Cherries Grown in the States of Michigan, et al.; Free and Restricted Percentages for the 2019-20 Crop Year
This rule implements a recommendation from the Cherry Industry Administrative Board (Board) to establish free and restricted percentages for the 2019-20 crop year pursuant to the marketing order for tart cherries grown in the states of Michigan, New York, Pennsylvania, Oregon, Utah, Washington, and Wisconsin. This action establishes the proportion of tart cherries from the 2019-20 crop that may be handled in commercial outlets. This action should stabilize marketing conditions by adjusting supply to meet market demand and help improve grower returns. Also, a correction is made to section 930.151 to reflect the correct desirable carry-out inventory not to exceed a maximum of 100 million pounds (81 FR 63676).
Revisions to the Federal Seed Act Regulations
This final rule revises the regulations that implement the Federal Seed Act (FSA). Revisions are made to seed labeling, testing, and certification requirements. The revisions add certain seed species to the lists of covered kinds of seed and update the lists to reflect current scientific nomenclature; update regulations related to seed quality, germination and purity standards, and acceptable seed testing methods; and update seed certification and recertification requirements, including new eligibility standards and the recognition of current breeding techniques. This rule aligns FSA regulations with current industry practices, harmonizes FSA testing methods with industry standards, and clarifies confusing or contradictory language in the existing regulations. The revisions are expected to reduce trade burden associated with interstate seed commerce and encourage compliance with State and Federal laws.
Use of Radio Frequency Identification Tags as Official Identification in Cattle and Bison
In accordance with Executive Order 13892, Promoting the Rule of Law Through Transparency and Fairness in Civil Administrative Enforcement and Adjudication, the Animal and Plant Health Inspection Service (APHIS) is soliciting public comments on a proposal wherein APHIS would only approve radio frequency identification tags as official eartags for use in interstate movement of cattle and bison that are covered under certain regulations.
