The Bureau of Land Management (BLM) is promulgating a final rule (2017 final delay rule) to temporarily suspend or delay certain requirements contained in the rule published in the Federal Register on November 18, 2016, entitled, ``Waste Prevention, Production Subject to Royalties, and Resource Conservation'' (2016 final rule) until January 17, 2019. The BLM has concerns regarding the statutory authority, cost, complexity, feasibility, and other implications of the 2016 final rule, and therefore intends to avoid imposing likely considerable and immediate compliance costs on operators for requirements that may be rescinded or significantly revised in the near future. The 2017 final delay rule does not substantively change the 2016 final rule, but simply postpones implementation of the compliance requirements for certain provisions of the 2016 final rule for 1 year.

In compliance with the National Environmental Policy Act of 1969, as amended (NEPA), and the Federal Land Policy and Management Act of 1976, as amended, the Bureau of Land Management (BLM) El Centro Field Office, with the United States Army Corps of Engineers (USACE) as a cooperating agency, intends to prepare a Supplemental Environmental Impact Statement (EIS) for the United States Gypsum Company (USG) Mine Expansion/Modernization Project. The Supplemental EIS will analyze additional alternatives and update technical information in the 2008 USG Mine Expansion/Modernization Project Final Environmental Impact Report (EIR)/EIS. The USACE was not involved in the development of the EIR/EIS, but will be involved with the Supplemental EIS, based on USACE's jurisdiction by law and special expertise, pursuant to section 404 of the Clean Water Act. Scoping is not usually required for preparation of a Supplemental EIS. However, since USACE was not a cooperating agency during scoping of the EIR/EIS, they have requested that public scoping be included for the Supplemental EIS. This notice announces the beginning of the public scoping process for input into the Supplemental EIS. The goal of the scoping process is to solicit public comments, for the purpose of identifying relevant issues that will influence the scope of the environmental analysis, including alternatives, and guide the process for developing the Supplemental EIS.

This Notice also extends the segregation initiated by that application, and the proposed classification published in the Federal Register on October 17, 2016, for the remaining lands included in the State's application to allow continued review to determine suitability.

In order to comply with the court's order and to address issues raised by various interested parties, the BLM intends to consider the possibility of amending some, all or none of the BLM land use plans that were amended or revised in 2014 and 2015 regarding Greater Sage-Grouse conservation in the States of California, Colorado, Idaho, Nevada, Oregon, Wyoming, North Dakota, South Dakota, Utah and Montana (``2015 Sage-Grouse Plans''). By this Notice the BLM is announcing the beginning of the scoping process to solicit public comments on Greater Sage-Grouse land management issues that could warrant land use plan amendments.

On November 18, 2016, the Bureau of Land Management (BLM) published in the Federal Register a final rule entitled, ``Waste Prevention, Production Subject to Royalties, and Resource Conservation'' (2016 final rule). The BLM is now proposing to temporarily suspend or delay certain requirements contained in the 2016 final rule until January 17, 2019. The BLM is currently reviewing the 2016 final rule and wants to avoid imposing temporary or permanent compliance costs on operators for requirements that may be rescinded or significantly revised in the near future.
