Notice is hereby given that, following a remand from the U.S. Court of Appeals for the Federal Circuit (``Federal Circuit''), the U.S. International Trade Commission has determined to issue a modified limited exclusion order (``LEO'') and modified cease and desist orders (``CDOs'') directed against respondents Caterpillar Paving Products, Inc. and Caterpillar Inc., respectively, and their affiliated companies, parents, subsidiaries, or other related business entities, or their successors or assigns. The Commission has terminated this investigation.
Superabsorbent Polymers From South Korea; Institution of Anti-Dumping Duty Investigation and Scheduling of Preliminary Phase Investigation
The Commission hereby gives notice of the institution of an investigation and commencement of preliminary phase antidumping duty investigation No. 731-TA-1574 (Preliminary) pursuant to the Tariff Act of 1930 (``the Act'') to determine whether there is a reasonable indication that an industry in the United States is materially injured or threatened with material injury, or the establishment of an industry in the United States is materially retarded, by reason of imports of superabsorbent polymers from South Korea, provided for in subheading 3906.90.50 of the Harmonized Tariff Schedule of the United States, that are alleged to be sold in the United States at less than fair value. Unless the Department of Commerce (``Commerce'') extends the time for initiation, the Commission must reach a preliminary determination in antidumping duty investigations in 45 days, or in this case by December 17, 2021. The Commission's views must be transmitted to Commerce within five business days thereafter, or by December 27, 2021.
Performance-Based Investment Advisory Fees
The Securities and Exchange Commission (``Commission'' or ``SEC'') is adopting amendments to the rule under the Investment Advisers Act of 1940 (``Advisers Act'') that permits investment advisers to charge performance-based compensation to ``qualified clients.'' The rule defines ``qualified client'' with reference to specific dollar amount thresholds, which are required to be adjusted every five years to account for the effects of inflation. These amendments replace specific dollar amount thresholds in the rule's ``qualified client'' definition with references to the Commission's ``most recent order,'' as defined by the amended rule, containing the specific dollar amount thresholds adjusted for inflation.
Information Collection: Facility Security Clearance and Safeguarding of National Security Information and Restricted Data
The U.S. Nuclear Regulatory Commission (NRC) has recently submitted a request for renewal of an existing collection of information to the Office of Management and Budget (OMB) for review. The information collection is entitled, ``Facility Security Clearance and Safeguarding of National Security Information and Restricted Data.''
Proposed Agency Information Collection Activities; Comment Request
In accordance with the requirements of the Paperwork Reduction Act of 1995 (PRA), the OCC, the Board, and the FDIC (the agencies) may not conduct or sponsor, and the respondent is not required to respond to, an information collection unless it displays a currently valid Office of Management and Budget (OMB) control number. On August 13, 2021, the agencies, under the auspices of the Federal Financial Institutions Examination Council (FFIEC), requested public comment for 60 days on a proposal to extend for three years, without revision, the Foreign Branch Report of Condition (FFIEC 030) and the Abbreviated Foreign Branch Report of Condition (FFIEC 030S), which are currently approved collections of information. The comment period for this notice expired on October 12, 2021. As described in the SUPPLEMENTARY INFORMATION section, the agencies will extend the FFIEC 030 and FFIEC 030S without revision as proposed. In addition, the agencies will make clarifying revisions to the instructions in response to a comment received. The agencies are giving notice that they are sending the collections to OMB for review.
Certain Oil-Vaping Cartridges, Components Thereof, and Products Containing the Same; Institution of Investigation
Notice is hereby given that a complaint was filed with the U.S. International Trade Commission on October 4, 2021, under section 337 of the Tariff Act of 1930, as amended, on behalf of Shenzhen Smoore Technology Limited of China. Supplements were filed on October 8, 2021, and October 21, 2021. The complaint, as supplemented, alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain oil-vaping cartridges, components thereof, and products containing the same by reason of infringement of: (1) Certain claims of Patent No. 10,357,623 (``the '623 patent''); U.S. Patent No. 10,791,763 (``the '763 patent''); U.S. Patent No. 10,791,762 (``the '762 patent''); and (2) U.S. Registered Trademark No. 5,633,060 (``the '060 mark''). The complaint further alleges that an industry in the United States exists as required by the applicable Federal Statute. The complainant requests that the Commission institute an investigation and, after the investigation, issue a limited exclusion order and a cease and desist order.

The U.S. Copyright Office seeks further comments on the effectiveness of copyright protections for publishers, with a focus on press publishers. This request provides an opportunity for interested parties to raise new issues related to the topic of the study, amplify initial comments, present empirical studies, or to address, reply to, or expand upon any issues raised in the initial request for written commentsresponses to which are due on or before November 26, 2021or during the virtual public roundtable, which will be held on December 9, 2021. Notice and Request for Public Comment on VVSG Lifecycle Policy
The U.S. Election Assistance Commission (EAC) is publishing the Voluntary Voting System Guidelines (VVSG) Lifecycle Policy 1.0 for public comment. The intent of the VVSG Lifecycle Policy is to help facilitate migration to the new VVSG 2.0 standard by providing guidance on the types of version changes, Voting System Test Laboratory (VSTL) accreditation, deprecation of obsolete major standards, and establishing a periodic review and update timeline for new standards going forward. The policy defines changes that may be made to systems certified to deprecated standards and describes the process for updating the standards.

The National Science Foundation (NSF) is creating a new system of records: NSF-77 Data Analytics Application Suite. This system is a vital step in NSF's commitment to maintaining U.S. leadership across all fields of science, technology, engineering, mathematics (STEM), and STEM education, and doing so with efficiency, openness, and transparency. The new system of records will aggregate, link, and analyze information reported by individuals and organizations participating in NSF-supported activities along with published information related to the research enterprise. More comprehensive information on NSF-funded research outcomes and the STEM workforce will advance NSF's understanding of its return on investments and the evolution of the scientific landscape. The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment draft plant-specific Supplement 23, Second Renewal, to the Generic Environmental Impact Statement (GEIS) for License Renewal of Nuclear Plants, NUREG-1437, regarding the proposed subsequent renewal of Renewed Facility Operating License Nos. DPR-24 and DPR-27 for an additional 20 years of operation for Point Beach Nuclear Plant, Units 1 and 2 (Point Beach). The Point Beach facility is located on the western shore of Lake Michigan (approximately 15 miles NNE of Manitowoc, WI). Possible alternatives to the proposed action (subsequent license renewal) include no action and reasonable replacement power alternatives.

On September 23, 2021, the U.S. Nuclear Regulatory Commission (NRC) issued for public comment draft NUREG, NUREG-2159, Revision 1, ``Acceptable Standard Format and Content for the Fundamental Nuclear Material Control Plan Required for Special Nuclear Material of Moderate Strategic Significance.'' The public comment period was originally scheduled to close on November 22, 2021. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments.

On June 24, 2021, the CPSC published a notice in the Federal Register announcing the agency's intent to seek approval of this collection of information. After reviewing and considering the comments, the Commission announces that it has submitted to the OMB a request for approval of this collection of information. As required by the Paperwork Reduction Act of 1995, the Consumer Product Safety Commission (CPSC or Commission) announces that the Commission has submitted to the Office of Management and Budget (OMB) a request for extension of approval for an information collection on a proposed survey to assess how hazard warnings are communicated to consumers. On July 26, 2021, the CPSC published a notice in the Federal Register announcing the agency's intent to seek approval of this collection of information. The Commission received no comments. Therefore, by publication of this notice, the Commission announces that CPSC has submitted to the OMB a request for extension of approval of this collection of information, without change.
National Defense Authorization Act of 2020, Definition of Surviving Spouse for Service-Disabled Veteran-Owned Small Businesses and Change to 8(a) Business Development Contracting Thresholds
This rule makes technical changes to regulations issued by the U.S. Small Business Administration (SBA) to conform those regulations to recent statutory changes. First, the rule incorporates a required change to SBA's ownership requirements for small business concerns owned and controlled by service-disabled veterans. The rule adopts changes to the treatment of certain surviving spouses made by the National Defense Authorization Act of 2020. In addition, the rule incorporates changes to the dollar thresholds for certain contracting actions authorized for the 8(a) Business Development (BD) program made by the National Defense Authorization Act of 2020. Finally, the rule adjusts the competitive threshold dollar levels authorized for SBA's contracting programs to changes made to the Federal Acquisition Regulation (FAR) due to inflation.
