The Coast Guard is establishing special local regulations for the ``East Coast Boat Racing Club power boat race'', a marine event to be held over the waters of the Chesapeake Bay adjacent to Cape Charles, Virginia. These special local regulations are necessary to provide for the safety of life on navigable waters during the event. This action is intended to restrict vessel traffic on the Chesapeake Bay in the vicinity of Cape Charles Beach, Cape Charles, Virginia during the event.
Safety Zone; BART Transbay Tube Seismic Upgrade; San Francisco, CA
The Coast Guard is establishing a moving temporary safety zone in the navigable waters of San Francisco Bay, California during vibro penetration testing for a seismic upgrade of the Bay Area Rapid Transit (BART) Transbay tube. The testing will require placement of a barge at test sites along the BART Transbay tube. The safety zone will surround the barge and move with the barge as it conducts the tests at seven sites along the BART Transbay tube. This safety zone is necessary to protect persons and vessels from hazards, injury, and damage associated with the vibro penetration testing. Unauthorized persons or vessels are prohibited from entering into, transiting through, or remaining in the safety zone without permission of the Captain of the Port San Francisco or his designated representative.
Drawbridge Operation Regulations; James River, Between Isle of Wight and Newport News, VA
The Coast Guard is temporarily changing the regulations that govern the operation of the James River Bridge, at mile 5.0, between Isle of Wight and Newport News, Virginia. The temporary final rule will provide vessel openings of the drawbridge upon two hours advance notice 24 hours a day beginning at 7 a.m. July 13, 2006. This action was requested by the contractor, on behalf of Virginia Department of Transportation (DOT), to facilitate sandblasting and painting operations.

The Coast Guard is implementing the special local regulations for the 2006 Annual Chincoteague Pony Swim, a marine event to be held July 26 and July 28, 2006, on the waters of Assateague Channel at Chincoteague, Virginia. These special local regulations are necessary to control vessel traffic due to the confined nature of the waterway and to provide for the safety of life on navigable waters during the event. The effect will be to restrict general navigation in the regulated area for the safety of spectators and vessels transiting the event area.

For 2006 this marine event will be held on September 30 and October 1, 2006. These special local regulations are necessary to provide for the safety of life on navigable waters during the event. This action is intended to restrict vessel traffic in portions of Sunset Lake during the event.

The Food and Drug Administration (FDA) is amending the animal drug regulations to reflect approval of a supplemental new animal drug application (NADA) filed by Intervet Inc. The supplemental NADA provides for the revision of a food safety warning on labeling of furosemide injectable solution for use in horses.
New Animal Drugs; Ceftiofur
The Food and Drug Administration (FDA) is amending the animal drug regulations to reflect approval of four supplemental new animal drug applications (NADAs) filed by Pharmacia & Upjohn Co. The supplemental NADAs establish or revise preslaughter withdrawal periods in cattle injected with a solution made from ceftiofur sodium powder or with a suspension of ceftiofur hydrochloride, or receiving an intramammary infusion of ceftiofur hydrochloride.
New Animal Drugs; Ceftiofur
The Food and Drug Administration (FDA) is amending the animal drug regulations to reflect approval of a supplemental new animal drug application (NADA) filed by Pharmacia & Upjohn Co. The supplemental NADA provides for use of ceftiofur crystalline free acid suspension via a new injection site in beef and nonlactating dairy cattle, for use in lactating dairy cattle for the treatment of respiratory disease, and for the establishment of a 13-day pre-slaughter withdrawal period in cattle. FDA is also amending the regulations to revise the tolerance for residues of ceftiofur in bovine kidney to accommodate these new conditions of use.

The Food and Drug Administration (FDA) is amending the animal drug regulations to reflect approval of a supplemental abbreviated new animal drug application (ANADA) filed by Virbac AH, Inc. The supplemental ANADA provides for an expanded dose range and revised wording of indications for the oral use of clindamycin hydrochloride liquid in dogs and cats for the treatment of certain bacterial diseases.

The Department of Veterans Affairs (VA) proposes to amend its adjudication regulation regarding the definition of a child for purposes of establishing entitlement to additional monetary benefits for a child who is home-schooled. VA proposes to define educational institutions to include home-school programs that meet the legal requirements of the States (by complying with the compulsory attendance laws of the States) in which they are located.

Intent To Prepare a Draft Environmental Impact Statement for the Proposed SunCreek Project, in Sacramento County, CA
The U.S. Army Corps of Engineers (Corps), Sacramento District, will prepare a Draft Environmental Impact Statement (DEIS) for Corps authorization actions on the proposed SunCreek Specific Plan project, which as proposed would result in the permanent loss of approximately 18.25 acres of waters of the United States, including vernal pools and other wetlands. The overall project purpose is to construct large scale mixed-use development in Sacramento County.
Medicare Program; Solicitation for Proposals for Medical Savings Account Demonstration Project
This notice is to inform interested parties of an opportunity to apply to participate in the Medicare Advantage (MA) Medical Savings Account (MSA) demonstration project. The MA MSA demonstration design waives certain MA MSA plan requirements under sections 1859(b)(3), 1853(e), and 1854(c) of the Social Security Act. This waiver will allow entities to offer products that more closely resemble high deductible health plans (HDHPs) that are offered with Health Savings Accounts to the non-Medicare population. This demonstration will be conducted in accordance with the Secretary's demonstration authority under section 402(a)(1)(A) of the Social Security Amendments of 1967, 42 U.S.C. 1395b-1(a)(1)(A).

Approval and Promulgation of Air Quality Implementation Plans; Pennsylvania; NOX
EPA is approving a State Implementation Plan (SIP) revision submitted by the Commonwealth of Pennsylvania. The revision was submitted by the Pennsylvania Department of Environmental Protection (PADEP) to establish and require reasonably available control technology (RACT) for Koppers Industry, Inc. located in Lycoming County. EPA is approving this revision to establish RACT requirements in the SIP in accordance with the Clean Air Act (CAA).
Approval and Promulgation of Air Quality Implementation Plans; Virginia; NSR in the Ozone Transport Region
EPA is approving a State Implementation Plan (SIP) revision submitted by the Commonwealth of Virginia. This revision establishes and requires major new and major modified sources of volatile organic compounds (VOCs) or nitrogen oxides (NOX) to meet certain nonattainment New Source Review (NSR) requirements if they are located (or are proposing to locate) in Virginia's portion of the Ozone Transport Region (OTR). The intended effect of this action is the approval of a State Implementation Plan (SIP) revision submitted by the Commonwealth of Virginia for NSR in the OTR.
Child Nutrition Programs: Uniform Federal Assistance Regulations; Nondiscretionary Technical Amendments
This final rule makes technical changes to the regulations governing the National School Lunch Program, the Special Milk Program for Children, the School Breakfast Program, the Summer Food Service Program, the Child and Adult Care Food Program and State Administrative Expense Funds. The United States Department of Agriculture (USDA), Food and Nutrition Service (FNS) is revising its grants management regulations to bring these entitlement programs and their funds under the same regulations that already apply to nonentitlement programs, and to identify exceptions to these general rules that apply only to entitlement programs. This final rule is intended to update FNS program regulations, reflecting the revision of USDA's grants management regulations which brought entitlement programs under the same regulations that already applied to nonentitlement programs. In addition, this final rule also revises references to procurement and audit procedures in FNS's program regulations.

Airworthiness Directives; Boeing Model 757-200 Series Airplanes Modified by Supplemental Type Certificate (STC) SA979NE
The FAA is correcting a typographical error in an existing airworthiness directive (AD) that was published in the Federal Register on June 28, 2006 (71 FR 36671). The error resulted in the misidentification of the manufacturer name in the product identification line of the regulatory text. This AD applies to certain Boeing Model 757-200 series airplanes. This AD requires a one-time deactivation of the auxiliary fuel system, repetitive venting and draining of the auxiliary fuel tank sumps, and revising the Limitations section of the airplane flight manual to limit the maximum cargo weight.
