Guidance on Passive Foreign Investment Company (PFIC) Purging Elections; Hearing Cancellation

Testing of Certain High Production Volume Chemicals

EPA is promulgating a final rule under the Toxic Substances Control Act (TSCA) that requires manufacturers (including importers) and processors of 17 high production volume (HPV) chemicals to conduct acute toxicity, repeat dose toxicity, developmental and reproductive toxicity, genetic toxicity (gene mutations and chromosomal aberrations), ecotoxicity (in fish, Daphnia, and algae), and environmental fate (including 5 tests for physical chemical properties and biodegradation) testing. EPA has determined that each of the 17 chemicals included in this final rule is produced in substantial quantities and that there is or may be substantial human exposure to each of them. Moreover, EPA has determined that there are insufficient data to reasonably determine or predict the effects on health or the environment of the manufacture, distribution in commerce, processing, use, or disposal of the chemicals, or any combination of these activities. EPA has concluded that this testing program is necessary and appropriate for developing such data. Data developed under this final rule will provide critical information about the environmental fate and potential hazards of these chemicals which, when combined with information about exposure and uses, will allow the Agency and others to evaluate potential health and environmental risks and take appropriate actions. Persons who export or intend to export any chemical included in this final rule, regardless of the form in which it is exported, are subject to the export notification requirements of TSCA section 12(b).
Approval and Promulgation of Air Quality Implementation Plans; Arkansas Update to Materials Incorporated by Reference

Approval and Promulgation of Implementation Plans; Georgia: Approval of Revisions to the State Implementation Plan

EPA is correcting the State Implementation Plan (SIP) for the State of Georgia to remove a provision relating to a Georgia general ``nuisance'' rule. EPA has determined that this provision relating to Georgia Rule 391-3-1.02(2)(a)1, was erroneously incorporated into the SIP. EPA is removing this rule from the approved Georgia SIP because the Georgia rule is not related to the attainment and maintenance of the national ambient air quality standards (NAAQS). This final rule addresses comments made on the proposed rulemaking EPA previously published for this action.
Approval and Promulgation of Air Quality Implementation Plans; Texas; Permits by Rule

EPA is approving a State Implementation Plan (SIP) revision for the State of Texas. This action removes a provision from the Texas SIP which provided public notice for concrete batch plants which were constructed under a permit by rule (PBR). On September 1, 2000, Texas replaced the PBR for concrete batch plants with a standard permit for concrete batch plants. The standard permit for concrete batch plants also requires public notice for concrete batch plant subject to the standard permit. Texas maintained the public notice requirements of its PBR to assure that proper procedures were followed for concrete batch plants that were permitted under the PBR prior to the effective date of the standard permit. All authorization requests for concrete batch plants which were constructed under the PBR have now been resolved and the public notice and comment provisions under the PBR are no longer needed.

The proposed changes are intended to ensure that the public is given notice of a proposed transaction before the exemption becomes effective; and that the Board may process such notices of exemption, and related petitions for stay, if any, in an orderly and timely fashion.
Airworthiness Directives; McDonnell Douglas Model DC-9-10, -20, -30, -40 and -50 Series Airplanes, and Model DC-9-81 (MD-81), and DC-9-82 (MD-82) Airplanes

The FAA is superseding an existing airworthiness directive (AD), which applies to certain McDonnell Douglas Model DC-9-10, -20, - 30, -40 and -50 series airplanes, and Model DC-9-81 (MD-81), and DC-9- 82 (MD-82) airplanes. That AD currently requires installing a water drain system for the slant pressure panels in the left and right wheel wells of the main landing gear (MLG). This new AD also requires inspecting the seal assemblies of the overwing emergency exit doors for defects and constant gap; replacing defective door seals; performing repetitive operational checks of the water drain system auto drain valve and corrective actions if necessary; and, for certain airplanes, modifying the insulation blankets on the slant pressure panels in the left and right MLG wheel wells. This AD results from reports of water runoff from the slant pressure panels in the left and right MLG wheel wells, which subsequently froze on the lateral control mixer and control cable assemblies. We are issuing this AD to prevent ice from forming on the lateral control mixer and control cable assemblies, which could reduce controllability of the airplane.
Airworthiness Directives; Cessna Model 500, 501, 550, S550, 551, and 560 Airplanes

The FAA is adopting a new airworthiness directive (AD) for certain Cessna Model 500, 501, 550, S550, 551, and 560 airplanes. This AD requires revising the airplane flight manual (AFM) to prohibit use of the wing fuel boost pumps for defueling under certain conditions; installing a placard; doing other specified investigative and corrective actions as necessary; and modifying the boost pumps. This AD also requires the subsequent removal of the AFM revision and placard. This AD results from a report of a chafed electrical wiring harness, which was arcing inside the fuel tank. We are issuing this AD to prevent potential fuel vapor ignition in a fuel tank, which could result in explosion and loss of the airplane.

The U.S. Department of Agriculture (USDA) is amending 7 CFR part 2902, Guidelines for Designating Biobased Products for Federal Procurement, to add six sections to designate the following six items within which biobased products will be afforded Federal procurement preference, as provided for under section 9002 of the Farm Security and Rural Investment Act of 2002: Mobile equipment hydraulic fluids; roof coatings; water tank coatings; diesel fuel additives; penetrating lubricants; and bedding, bed linens, and towels. USDA also is establishing minimum biobased content for each of these items. Once USDA designates an item, procuring agencies are required generally to purchase biobased products within these designated items where the purchase price of the procurement item exceeds $10,000 or where the quantity of such items or of functionally equivalent items purchased over the preceding fiscal year equaled $10,000 or more. However, USDA is deferring the effective date for two items (water tank coatings and bedding, bed linens, and towels) until such time that more than one manufacturer of products in these two items is identified. USDA additionally is revising section 2902.2 to add definitions for ``biodegradability,'' ``EPA-designated recovered content product,'' and ``functional unit'' and section 2902.8 to adopt applicable ASTM International performance tests to verify biodegradability.

Due to a failure to respond to an Order to Show Cause, Station KYQQ (FM) has been downgraded to Channel 293C0 to accommodate the Waukomis proposed allotment. Channel 292A can be allotted at Waukomis in compliance with the Commission's minimum distance separation requirements with a site restriction of 6.3 kilometers (3.9 miles) southwest of the community. The Federal Housing Finance Board (Finance Board) is proposing to add to its regulations provisions that would limit the amount of excess stock that a Federal Home Loan Bank (Bank) can have outstanding and that would prescribe a minimum amount of retained earnings for each Bank. The proposed amendments also would prohibit a Bank from selling excess stock to its members or paying stock dividends, and restrict a Bank's ability to pay dividends when its retained earnings are below the prescribed minimum.
Gas Gathering Line Definition; Alternative Definition for Onshore Lines and New Safety Standards

This action adopts a consensus standard to distinguish onshore gathering lines from other gas pipelines and production operations. In addition, it establishes safety rules for certain onshore gathering lines in rural areas and revises current rules for certain onshore gathering lines in nonrural areas. Operators will use a new risk-based approach to determine which onshore gathering lines are subject to PHMSA's gas pipeline safety rules and which of these rules the lines must meet. PHMSA intends this action to reduce disagreements over classifications of onshore gathering lines, increase public confidence in the safety of onshore gathering lines, and provide safety rules consistent with the risks of onshore gathering lines.

Channel 237A can be allotted to Sequim in compliance with the Commission's minimum distance separation requirements at 48-07-12 North Latitude and 123-04-20 West Longitude with a site restriction of 4.9 (3.1 miles) northeast of Sequim. Canadian concurrence has been obtained for Channel 266A at Coupeville and 237A at Sequim. A filing window for these channels will not be opened at this time. Special Conditions; Heritage Aviation LTD; Honeywell EFIS 40 on a Cessna 208B, Protection of Systems for High Intensity Radiated Fields (HIRF)

These special conditions are issued to Heritage Aviation LTD, 2617 Aviation Parkway, Grand Prairie, TX 75052, for a supplemental type certificate for the Cessna 208B. These airplanes will have novel and unusual design features when compared to the state of technology envisaged in the applicable airworthiness standards. These novel and unusual design features include the installation of a Honeywell EFIS 40, for which the applicable regulations do not contain adequate or appropriate airworthiness standards for the protection of these systems from the effects of high intensity radiated fields (HIRF). This system will interface to other airplane systems also covered by these special conditions. These special conditions contain the additional safety standards that the Administrator considers necessary to establish a level of safety equivalent to the airworthiness standards applicable to these airplanes.

This action is taken pursuant to Revision of Section 73.3573(a)(1) of the Commission's Rules Concerning the Lower Classification of an FM Allotment, 4 FCC Rcd 2413 (1989), Amendment of the Commission's Rules to permit FM Channel and Class Modifications by Applications, 8 FCC Rcd 4735 (1993) and Streamlining of Radio Technical Rules in Part 73 and 74 of the Commission's Rules, 15 FCC Rcd 21649 (2000).

With those limitations, Channel 274C can be allotted to Grand Portage, Minnesota, in compliance with the Commission's minimum distance separation requirements at city reference coordinates without site restriction. Channel 267C can be allotted to Sinclair, Wyoming consistent with the minimum distance separation requirements of Section 73.207(b) of the Commission's rules, provided there is a site restriction of 9.6 kilometers (6 miles) west of the community at coordinates 41-46-19 NL and 107-13-40 WL. This site requires a site restriction of 7.0 kilometers (4.3 miles) south of the community.

This final rule adopts a new marking requirement for Bound Printed Matter (BPM) machinable parcels consisting of multiple pieces secured with transparent shrinkwrap. The new marking will enable our automated equipment to recognize that these BPM machinable parcels are intended for a single address. Under the new standards, mailers must use a firm optional endorsement line or apply a pressure-sensitive firm Label F. The new standards do not apply to BPM flats or irregular parcels.
Drawbridge Operation Regulations; Connecticut River, Old Lyme, CT

The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the AMTRAK Old Saybrook-Old Lyme Bridge across the Connecticut River at mile 3.4, between Old Saybrook and Old Lyme, Connecticut. This temporary deviation requires the bridge to operate on a fixed opening schedule from March 8, 2006 through April 15, 2006, and also allows the bridge to remain in the closed position for 72 hours, from 6 a.m. on Saturday, March 11, 2006 through 6 a.m. on Tuesday, March 14, 2006. The draw shall open on signal for commercial vessels, except during the 72 hour bridge closure period, after at least a four- hour advance notice is given. This deviation is necessary to facilitate urgent bridge maintenance.

This regulation extends an existing temporary exemption from the requirement of a tolerance for residues of the Bacillus thuringiensis modified Cry3A protein (mCry3A) and the genetic material necessary for its production in corn on field corn, sweet corn, and popcorn when applied/used as a plant-incorporated protectant. Syngenta Seeds, Inc. submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting this extension of the existing temporary tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of modified Cry3A protein (mCry3A) and the genetic material necessary for its production in corn. The temporary tolerance exemption as extended will expire on October 15, 2007.

Interregional Research Project Number 4 (IR-4) requested this tolerance under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of1996 (FQPA).

The Federal Trade Commission (``the Commission'') has completed its regulatory review of the Children's Online Privacy Protection Rule (``the COPPA Rule'' or ``the Rule''), which implements the Children's Online Privacy Protection Act of 1998. The Rule regulates how Web site operators and others may collect, use, and distribute personal information from children online. The Commission requested comment on the costs and benefits of the Rule and whether it should be retained without change, modified, or eliminated. The Commission also requested comment on the Rule's effect on: information practices relating to children; children's ability to obtain online access to information of their choice; and the availability of Web sites directed to children. Pursuant to this review, the Commission concludes that the Rule continues to be valuable to children, their parents, and Web site operators, and has determined to retain the Rule in its current form. This document discusses the comments received in response to the Commission's request for public comment and announces the Commission's decision to retain the Rule without modification.

The Federal Communications Commission seeks comment on whether we should extend mandatory thousands-block number pooling by, for example, giving the states delegated authority to implement mandatory thousands-block number pooling at their discretion. Alternatively, we could continue to review requests from the states for authority to extend mandatory thousands-block number pooling to new NPAs on a case- by-case basis. Also, we could extend pooling to all rate centers, using a phased implementation schedule. As many state commissions can attest, mandatory number pooling can extend the life of numbering plan areas (NPAs) more effectively than optional pooling requirements. In addition, the Wireline Competition Bureau specifically stated that the Commission would ``consider extending pooling to NPAs outside of the top 100 Metropolitan Statistical Areas (MSAs) once pooling is implemented in the top MSAs.''
