The Defense Intelligence Agency (DIA) is adding a new exemption rule for LDIA 0209, entitled ``Litigation Case Files'' to exempt those records that have been previously claimed for the records in another Privacy Act system of records. DIA is updating the DIA Privacy Act Program by adding the (k)(2) and (k)(5) exemptions to accurately describe the basis for exempting the records in the system of records notice LDIA 0209, Litigation Case Files. In addition, exempt materials from other systems of records may in turn become part of the case records in this system. To the extent that copies of exempt records from those `other' systems of records are entered into this case record, the Defense Intelligence Agency hereby claims the same exemptions for the records from those `other' systems that are entered into this system, as claimed for the original primary systems of records, which they are a part. This direct final rule makes non-substantive changes to the Defense Intelligence Agency Program rules. The Department of the Army proposes two reinstate a systems of records in its inventory of record systems to the Privacy Act of 1974 (5 U.S.C. 552a), as amended. After review, it has been determined that the records covered under these previously deleted notices (see 77 FR 13571-13573 and 77 FR 13573-13574, March 7, 2012) are not covered elsewhere as stated; therefore these notices are being reinstated.
Meeting of the Defense Advisory Committee on Women in the Services (DACOWITS); Correction
On September 5, 2012 (77 FR 54568-54569), the Defense Advisory Committee on Women in the Services gave notice of a meeting to be held September 27, 2012, from 8:30 a.m. to 4:30 p.m. and September 28, 2012, from 1 p.m. to 4:30 p.m. in Alexandria, Virginia. Pursuant to Section 10(a), Public Law 92-463, as amended, the Department of Defense announces that the agenda for the September 27, 2012 meeting has changed. Also, the time for oral presentations by members of the public has been changed. Oral presentations by members of the public will now be permitted only on Thursday, September 27, 2012 from 3:15 p.m. to 4 p.m. in front of the full Committee. All other information in the notice remains the same.
Notice of Public Hearings for the Draft Environmental Impact Statement for Medical Facilities Development and University Expansion, Naval Support Activity Bethesda, Maryland
Pursuant to section 102(2)(c) of the National Environmental Policy Act (NEPA) and the Council on Environmental Quality Regulations for implementing the procedural provisions of NEPA (Title 40 Code of Federal Regulations parts 1500-1508), the Department of the Navy (DoN) has prepared and filed with the U.S. Environmental Protection Agency a Draft Environmental Impact Statement (EIS) to evaluate the potential environmental effects of Medical Facilities Development (MFD) and University Expansion at Naval Support Activity (NSA) Bethesda, MD. The purpose of the MFD proposed action is to implement the Congressional mandate from the Fiscal Year (FY) 2010 National Defense Authorization Act (NDAA) to achieve the new statutory world-class standards for military medicine at the Walter Reed National Military Medical Center (WRNMMC) by providing enduring medical facilities commensurate in quality, capability and condition as those provided by the 2005 Base Realignment and Closure (BRAC) investment. The 2005 BRAC program was designed to accommodate transfer of Walter Reed Army Medical Center (WRAMC) to WRNMMC but not address mission capability or improvements of the existing infrastructure. The MFD is needed because current space is insufficient to meet world-class standards. The purpose of the University Expansion of the Uniformed Services University of the Health Sciences (USU) is to provide adequate education and research space to meet Military Health System (MHS) commitments to deliver training and post-graduate level education to the military medical community and enable USU to serve as the core academic health research center at WRNMMC. The University Expansion is needed because current operations are dispersed between the main USU buildings and nineteen facilities comprising off-site leased locations in Montgomery County and other buildings on NSA Bethesda. Operations are fragmented and insufficient to meet education and research space requirements as well as Liaison Committee on Medical Education (LCME) accreditation requirements. NSA Bethesda is the action proponent and Joint Task Force National Capital Region Medical, WRNMMC, and USU are tenants of NSA Bethesda. There are no cooperating agencies for the EIS. The EIS considers the 2012 NSA Bethesda Master Plan relative to the implementation of the MFD and University Expansion. The EIS evaluates the direct, indirect, and cumulative impacts of the proposed actions in the context of the programmed projects already in progress and the programmatic effects of the potential future development opportunities identified in the 2012 NSA Bethesda Master Plan. The DoN will conduct two public hearings to receive oral and written comments on the Draft EIS. Federal, state, and local agencies, elected officials, and other interested individuals and organizations are invited to be present or represented at the public hearings. This notice announces the dates and locations of the public hearings for this Draft EIS. Dates and Addresses: Public hearings will be held on the following dates and locations: 1. October 4, 2012 from 1 p.m. to 5 p.m. at the Bethesda Marriott, 5151 Pooks Hills Road, Bethesda, MD 20814; and 2. October 11, 2012 from 5 p.m. to 9 p.m. at the Bethesda Marriott, 5151 Pooks Hill Road, Bethesda, MD 20814. Both meetings will start with an open house session followed by a presentation by the DoN and a public hearing session, which will be transcribed by a court reporter. The open house session will allow individuals the opportunity to review summaries of the information presented in the Draft EIS. DoN representatives will be available during the open house sessions to clarify information related to the Draft EIS.

Environmental Impact Statement for Short Range-Projects and Update of the Real Property Master Plan for Fort Belvoir, VA
The Department of the Army announces its intent to conduct public scoping under the National Environmental Policy Act (NEPA) to gather information to prepare an Environmental Impact Statement (EIS) for proposed short-range improvement projects and the proposed update of the Real Property Master Plan (RPMP) for Fort Belvoir, VA. The EIS will analyze environmental impacts associated with the proposed short- range projects and anticipated land uses designated in a revised RPMP. The revised RPMP will incorporate a short-range component and a long- range component. The short-range component projects are proposed for the next five years, and the long-range component looks at land uses and potential development through 2030. The EIS will assess potential environmental impacts associated with future development and management of land, facilities, resources and infrastructure based on the population capacity identified in the revised RPMP. Additional site- specific NEPA analyses will be prepared for future development projects identified in the long-range component of the revised RPMP. The revised RPMP will incorporate adjustments to the land use plan in the RPMP that were made in the Final Environmental Impact Statement for Implementation of Base Realignment and Closure (BRAC) Recommendations and Related Army Actions at Fort Belvoir, VA (2007) and BRAC-related changes made since 2007.

Notice of Public Meetings for the Draft Environmental Impact Statement for Naval Weapons Systems Training Facility Boardman, OR
Pursuant to section 102(2)(c) of the National Environmental Policy Act of 1969 and regulations implemented by the Council on Environmental Quality (40 Code of Federal Regulations parts 1500-1508), the Department of the Navy (DoN) has prepared and filed with the U.S. Environmental Protection Agency a Draft Environmental Impact Statement (EIS) that evaluates the potential environmental effects associated with ongoing and proposed DoN and Oregon National Guard training and testing activities at Naval Weapons Systems Training Facility (NWSTF) Boardman, Oregon to include establishment of new associated Special Use Airspace (SUA). The National Guard Bureau and Federal Aviation Administration are cooperating agencies for this EIS. NWSTF Boardman is the principal regional training range for aviation units located at Naval Air Station Whidbey Island and is used for training by Oregon National Guard units located throughout the state of Oregon. NWSTF Boardman also supports training requirements of the U.S. Air Force Reserve, and SUA activities for Department of Defense (DoD) contractors for unmanned aerial system testing and training of DoD personnel. With the filing of the Draft EIS, the DoN is initiating a 60-day public comment period and has scheduled two public meetings to receive comments on the Draft EIS. This notice announces the dates and locations of the public meetings for the Draft EIS and provides supplementary information.

Intent to Prepare a Draft Environmental Impact Statement/Environmental Impact Report for the Proposed Ballona Wetlands Restoration Project at Ballona Creek Within the City and County of Los Angeles, California
The U.S. Army Corps of Engineers (Corps) and the California Department of Fish and Game (CDFG) intend to jointly prepare a Draft Environmental Impact Statement/Environmental Impact Report (DEIS/EIR) for the proposed Ballona Wetlands Restoration Project. The proposed project is intended to return the daily ebb and flow of tidal waters, maintain freshwater circulation, and augment the physical and biological functions and services in the project area. Restoring the wetland functions and services would allow native wetland vegetation to be reestablished, providing important habitat for a variety of wildlife species. As a restored site, the Ballona Wetlands would play an important role to provide seasonal habitat for migratory birds. A restored, optimally functioning wetland would also benefit the adjacent marine environment and enhance the quality of tidal waters. The purpose of this notice is to inform the public the comment period for scoping has been extended to October 23, 2012.

The purpose of the meeting is to receive briefings from the Services on their current retention programs, a briefing from the Army on their gender neutral standards, and a briefing on Australian Defence Force gender restrictions and development and implementation of physical standards for military positions. Additionally, the Committee will receive a briefing on Legislative Proposal for expanded health care coverage for military women. Finally, the Committee will develop and vote on their recommendations for the 2012 report. The meeting is open to the public, subject to the availability of space. Interested persons may submit a written statement for consideration by the Defense Advisory Committee on Women in the Services. Individuals submitting a written statement must submit their statement to the Point of Contact and address listed in FOR FURTHER INFORMATION CONTACT no later than 5 p.m., Tuesday, September 25, 2012. If a written statement is not received by Tuesday, September 25, 2012, prior to the meeting, which is the subject of this notice, then it may not be provided to or considered by the Defense Advisory Committee on Women in the Services until its next open meeting. The Designated Federal Officer will review all timely submissions with the Defense Advisory Committee on Women in the Services Chairperson and ensure they are provided to the members of the Defense Advisory Committee on Women in the Services. If members of the public are interested in making an oral statement, a written statement should be submitted as above. After reviewing the written comments, the Chairperson and the Designated Federal Officer will determine who of the requesting persons will be able to make an oral presentation of their issue during an open portion of this meeting or at a future meeting. Determination of who will be making an oral presentation is at the sole discretion of the Committee Chair and the Designated Federal Officer and will depend on time available and if the topics are relevant to the Committee's activities. Two minutes will be allotted to persons desiring to make an oral presentation. Oral presentations by members of the public will be permitted only on Thursday, September 27, 2012 from 3:40 p.m. to 4:30 p.m. in front of the full Committee. Number of oral presentations to be made will depend on the number of requests received from members of the public.
Renewal of U.S. Naval Academy Board of Visitors
Under the provisions of the Federal Advisory Committee Act of 1972 (5 U.S.C. Appendix), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b), and 41 CFR 102-3.50(d), the Department of Defense gives notice that it is renewing the charter for the U.S. Naval Academy Board of Visitors (hereafter referred to as ``the Board''). The Board is a non-discretionary federal advisory committee that shall provide independent advice and recommendations to the President of the United States on matters relating to but not limited to morale and discipline, curriculum, instruction, physical equipment, fiscal affairs, academic methods and other matters relating to the United States Naval Academy that the Board decides to consider. The Board shall visit the Naval Academy annually, and any other official visits by the Board or its members to the Academy, other than the annual visit, shall be made in compliance with the requirements set forth in 10 U.S.C. 6968(d). The Board shall submit a written report to the President of the United States within 60 days after its annual visit to the Naval Academy, to include the Board's views and recommendations pertaining to the Academy, including its advice and recommendations on matters set forth in the paragraph above. Any report of a visit, other than an annual visit, must be made pursuant to 10 U.S.C. 6968(f). The Board, pursuant to 10 U.S.C. 6968(a), shall be constituted annually and shall be composed of no more than 15 members. The Board membership shall include: a. The Chairman of the Committee on Armed Services of the Senate, or his designee; b. Three other members of the Senate designated by the Vice President or the President pro tempore of the Senate, two of whom are members of the Committee on Appropriations of the Senate; c. The Chairman of the Committee on Armed Services of the House of Representatives, or his designee; d. Four other members of the House of Representatives designated by the Speaker of the House of Representatives, two of whom are members of the Committee on Appropriations of the House of Representatives; and e. Six persons designated by the President. Board members designated by the President shall serve for three years each, except that any member whose term of office has expired shall continue to serve until his successor is appointed. In addition, the President shall designate two persons each year to succeed the members whose terms expire that year. If a Board member dies or resigns, a successor shall be designated for the unexpired portion of the term by the official who designated the member. The Board members shall select the Board's Chairperson from the total membership. With the exception of travel and per diem for official travel, Board members shall serve without compensation. The Board, pursuant to 10 U.S.C. Sec. 6968(g) and (h), may upon approval by the Secretary of the Navy, call in advisers for consultation, and these advisers shall, with the exception of travel and per diem for official travel, serve without compensation. With DoD approval, the Board is authorized to establish subcommittees, as necessary and consistent with its mission. Establishment of subcommittees will be based upon written determination, to include terms of reference, by the Secretary of Defense, the Deputy Secretary of Defense, or the Board's sponsor. Such subcommittees or workgroups shall not work independently of the chartered Board, and shall report all their recommendations and advice to the Board for full deliberation and discussion. Subcommittees or workgroups have no authority to make decisions on behalf of the chartered Board; nor can they report directly to the Department of Defense or any Federal officers or employees who are not Board members. Subcommittee members shall be appointed by the Secretary of Defense even if the member in question is already a Board member. Subcommittee members, with the approval of the Secretary of Defense, may serve a term of service on the subcommittee of one-to-four years; however, no member shall serve more than two consecutive terms of service on the subcommittee. Subcommittee members, if not full-time or part-time government employees, shall be appointed by the Secretary of Defense according to governing DoD policy and procedures. Such individuals shall be appointed to serve as experts and consultants under the authority of 5 U.S.C. 3109, and shall serve as special government employees, whose appointments must be renewed by the Secretary of Defense on an annual basis. All subcommittees or working groups shall operate under the provisions of FACA, the Government in the Sunshine Act, governing Federal statutes and regulations, and governing DoD policies/ procedures.
Defense Transportation Regulation, Part IV
The Department of Defense has published draft Direct Procurement Method (DPM) business rules for the Defense Personal Property Program (DP3) in the Defense Transportation Regulation (DTR) Part IV (DTR 4500.9R). These business rules will encompass Transportation Service Providers (TSP) participation and procedures for Personal Property Shipping Offices (PPSO) as we transition to Phase III of the Defense Personal Property Program (DP3). The DPM business rules will replace the currently approved Domestic Small Shipment (dS2) business rules and will appear under DTR Part IV, Appendix V, to include operational business rules maintained on the Surface Deployment and Distribution Command (SCCD) Web site.
