The Tennessee Valley Authority (TVA) is making non-substantive changes to Title 18 of the Code of Federal Regulations. The purpose of this rule is to amend the process for issuing final determinations on administrative appeals of permitting decisions under section 26a of the TVA Act. Formerly, final determinations were made by the TVA Board of Directors. In 2004, the TVA Act was amended to change TVA's governance structure from a three-member, full time board to a nine-member, part- time policy board with a chief executive officer (CEO). Accordingly, the TVA Board approved revisions to the section 26a appeals process to provide for an appeal to the CEO followed by a discretionary review by a committee of the Board. The revised appeals process is consistent with the new governance structure. This rule amends TVA's published regulations to incorporate the revisions approved by the Board and to make the regulations consistent with the change in TVA's governance structure. TVA is also making minor changes to update addresses and job and organizational titles.

The Tennessee Valley Authority (TVA) is conducting a study of its energy resources in order to update and replace the integrated Resource Plan (IRP) and the associated Environmental Impact Statement (EIS) that it completed in 2011. The IRP is a comprehensive study of how TVA will meet the demand for electricity in its service territory over the next 20 years. The 2011 IRP is being updated in response to major changes in electrical utility industry trends since 2011. As part of the study, TVA intends to prepare a programmatic Supplemental EIS to assess the impacts associated with the implementation of the updated IRP. TVA will use the EIS process to elicit and prioritize the values and concerns of stakeholders; identify issues, trends, events, and tradeoffs affecting TVA's policies; formulate, evaluate and compare alternative portfolios of energy resource options; provide opportunities for public review and comment; and ensure that TVA's evaluation of alternative energy resource strategies reflects a full range of stakeholder input. Public comment is invited concerning both the scope of the Supplemental EIS and environmental issues that should be addressed as a part of this Supplemental EIS.

TVA has decided to adopt the preferred alternative in its final environmental impact statement (EIS) for the redevelopment of the Muscle Shoals Reservation (MSR) in Colbert County, Alabama. The notice of availability (NOA) of the Final Environmental Impact Statement for the Muscle Shoals Reservation Redevelopment was published in the Federal Register on November 18, 2011. Under this alternative, Unrestricted Land Use, after declaring a large portion of the MSR surplus, TVA would dispose of the property without land use restrictions other than those designed to protect TVA's program interests or to meet legal or environmental requirements.

This notice is provided in accordance with the Council on Environmental Quality's regulations (40 CFR parts 1500 to 1508) and TVA's procedures for implementing the National Environmental Policy Act (NEPA). TVA has decided to adopt the preferred alternative in its final environmental impact statement (EIS) for the dam safety modifications at Cherokee, Fort Loudoun, Tellico, and Watts Bar Dams. The notice of availability (NOA) of the Final Environmental Impact Statement for Dam Safety Modifications at Cherokee, Fort Loudoun, Tellico, and Watts Bar Dams was published in the Federal Register on May 31, 2013. This alternative, Permanent Modifications of Dam Structures: Combination of Concrete Floodwalls and Earthen Embankments, will protect the four dams against failure during the Probable Maximum Flood (PMF) event while minimizing the adverse effects to the appearance and recreational use of the dam reservations.

This notice is provided in accordance with the Council on Environmental Quality's regulations (40 CFR 1500 to 1508) and TVA's procedures implementing the National Environmental Policy Act (NEPA). On August 18, 2011, the TVA Board of Directors approved the recommendation to complete and operate Bellefonte Nuclear Plant Unit 1. A notice of availability (NOA) of the Final Supplemental Environmental Impact Statement for a Single Nuclear Unit at the Bellefonte Plant Site (hereafter referred to as Bellefonte FSEIS) was published in the Federal Register on May 21, 2010. On August 20, 2010, the TVA Board approved the expenditure of $248 million for additional engineering, design, and licensing activities, as well as the procurement of long lead-time components for the partially complete Bellefonte Unit 1. The ROD documenting this decision was published on September 9, 2010 (75 FR 54961). Bellefonte Unit 1 is a 1,260-megawatt (MW) Babcock and Wilcox- designed pressurized light water reactor. This interim decision was made in order to maintain Unit 1 as a viable alternative to meet the projected need for base load generation on the TVA system in 2018-2020.

This notice is provided in accordance with the Council on Environmental Quality's regulations (40 CFR parts 1500 to 1508) and TVA's procedures for implementing the National Environmental Policy Act (NEPA). TVA has decided to adopt the preferred alternative in its final environmental impact statement (EIS) for the Integrated Resource Plan (IRP). The notice of availability (NOA) of the Final Environmental Impact Statement for the Integrated Resource Plan was published in the Federal Register on March 11, 2011. The TVA Board of Directors accepted the IRP and authorized staff to implement the preferred alternative at its April 14, 2011, meeting. This alternative, the Preferred Planning Direction, will guide TVA's selection of energy resource options to meet the energy needs of the Tennessee Valley region over the next 20 years. The energy resource options include new nuclear, natural gas- fired, and renewable generation, increased energy efficiency and demand reduction, decreased coal-fired generation, and new energy storage capacity.

TVA will prepare an environmental review (in the form of an environmental assessment [EA] or an environmental impact statement [EIS]) to address the potential impacts to the natural, physical, and human environment resulting from various alternatives for permanent modifications to the existing dam facilities at Cherokee, Fort Loudoun, Tellico, and Watts Bar dams in Tennessee. The level of review will be determined after the public scoping process has been completed. TVA is evaluating long-term permanent solutions for dam safety modifications to replace interim modifications that were implemented at the dams.

The RRSC was established to advise TVA on its natural resource stewardship activities. Notice of this meeting is given under the Federal Advisory Committee Act (FACA), 5 U.S.C. App. 2. The management of the Tennessee Valley reservoirs and the lands adjacent to them has long been an integral component of TVA's mission. As part of implementing the TVA Environmental Policy, TVA is developing a Natural Resource Plan (NRP) that will help prioritize techniques for the management of TVA's biological and cultural resource management activities, recreation management activities, water resource protection and improvement activities, and reservoir lands planning. In accordance with the National Environmental Policy Act, TVA is also developing an accompanying Environmental Impact Statement (EIS) in which TVA will evaluate the preferred strategy for the NRP, as well as other viable alternative strategies. TVA is using the RRSC as a key stakeholder group throughout the development of the NRP to advise TVA on the issues, tradeoffs, and focus of environmental stewardship activities. The draft NRP and accompanying draft EIS were recently released for public comment. At the June 2011 meeting, TVA will be seeking advice from the RRSC on issues regarding the programs which comprise the NRP. The meeting agenda includes the following: 1. Introductions. 2. Natural Resource Plan overview; Programs included in the NRP for biological, cultural, water, and recreational resources and reservoir lands planning; Historical spending; NRP funding and implementation; and incorporation of advice received from the RRSC at its April 2011 meeting. 3. Public Comments. 4. Council Discussion and Advice. The RRSC will hear opinions and views of citizens by providing a public comment session. The public comment session will be held at 2 p.m. E.D.T., on Wednesday, June 29. This notice is provided in accordance with the Council on Environmental Quality's regulations (40 CFR Parts 1500-1508) and the Tennessee Valley Authority's (TVA) procedures for implementing the National Environmental Policy Act (NEPA). TVA will prepare an environmental assessment (EA) or an environmental impact statement (EIS) to address the potential environmental effects of proposed electrical power supply improvements in the Putnam and Cumberland region of east-central Tennessee. The purpose of the proposed project is to ensure the reliable transmission of electric power to meet increasing power demands in the project area. In its environmental review, TVA will evaluate the potential environmental impacts of the construction, operation, and maintenance of proposed new and upgraded power transmission facilities. TVA will develop and evaluate various alternatives, including the No Action Alternative, in the environmental review. Public comments are invited concerning both the scope of the review and environmental issues that should be addressed.

In accordance with 5 U.S.C. 552a(e)(4), the Tennessee Valley Authority (TVA) is republishing in full a notice of the existence and character of each TVA system of records. TVA is deleting one system of records because the program has ended. The retention period for the records has expired and the records have been destroyed in accordance with their records retention schedule. TVA is proposing to add a new system of records. The records were previously included within other TVA systems of records. They are now being published as their own system of records to better reflect their organizational placement. TVA is also correcting minor typographical and stylistic errors in previously existing notices and has updated those notices to reflect current organizational structure. Also, updates are being made to show any changes to system locations; managers and addresses; categories of individuals and records; procedures and practices for storing, retrieving, accessing, retaining, and disposing of records.

Douglas and Nolichucky Tributary Reservoirs Land Management Plan, in Cocke, Greene, Hamblen, Jefferson, and Sevier Counties, TN

This notice is provided in accordance with the Council on Environmental Quality's regulations (40 CFR 1500 to 1508) and TVA's procedures for implementing the National Environmental Policy Act (NEPA). TVA has prepared the Douglas and Nolichucky Tributary Reservoirs Land Management Plan for the 3,191 acres of TVA-managed public land on these reservoirs in northeastern Tennessee. On November 4, 2010, the TVA Board of Directors (TVA Board) approved the plan, implementing the Preferred Alternative (Alternative C, Modified Land Use Alternative) identified in the final environmental impact statement (FEIS). Under the plan adopted by the TVA Board, TVA-managed public land on Douglas and Nolichucky tributary reservoirs has been allocated into broad use categories or ``zones,'' including Project Operations (Zone 2), Sensitive Resource Management (Zone 3), Natural Resource Conservation (Zone 4), Industrial (Zone 5), Developed Recreation (Zone 6), and Shoreline Access (Zone 7). Allocations were made in a manner consistent with TVA's 2006 Land Policy.
