TRICARE; Coverage of Care Related to Non-Covered Initial Surgery or Treatment

The Department of Defense (DoD) is publishing this proposed rule to allow coverage for otherwise covered services and supplies required in the treatment of complications (unfortunate sequelae), as well as medically necessary and appropriate follow-on care, resulting from a non-covered incident of treatment provided pursuant to a properly granted Supplemental Health Care Program waiver. This proposed rule is necessary to protect TRICARE beneficiaries from incurring financial hardships due to the current regulatory restrictions that prohibit TRICARE coverage of the treatment of complications resulting from non-covered medical procedures, even when those procedures were provided while the beneficiary was an active duty member and were authorized by the Director, TRICARE Management Activity (TMA), based on a determination that a waiver authorizing the original non-covered surgery or treatment was necessary to assure adequate availability of health care to the Active Duty member. Additionally, with respect to care that is related to a non-covered initial surgery or treatment, the proposed rule seeks to eliminate any confusion regarding what services and supplies will be covered by TRICARE and under what circumstances they will be covered.
TRICARE; Removal of the Prohibition To Use Addictive Drugs in the Maintenance Treatment of Substance Dependence in TRICARE Beneficiaries

The Department of Defense (DoD) is publishing this final rule to remove the exclusion of drug maintenance programs and allow TRICARE coverage of the substitution of a therapeutic drug, with addictive potential, for a drug of addiction when medically necessary and appropriate as part of a comprehensive treatment plan for an individual with substance use dependence. The current regulation prohibits coverage of drug maintenance programs where one addictive substance is substituted for another. The final rule allows TRICARE to cover, as part of otherwise authorized treatment of substance use disorder, utilization of a specific category of psychoactive agent when medically necessary and appropriate. Removal of the exclusion is based on recognition of the accumulated medical evidence supporting the use of certain pharmacotherapies as one component in the continuum of opioid treatment services. Medication assisted treatment, to include drug maintenance involving substitution of a therapeutic drug with addiction potential, for a drug of addiction, is now generally accepted by qualified professionals to be reasonable and adequate as a component in the safe and effective treatment of substance use disorders treatment services, and thus appropriate for inclusion as a component in the TRICARE authorized substance use disorder treatment for beneficiaries.

In accordance with the Privacy Act of 1974, the Department of Homeland Security proposes to update, reissue, and combine two legacy system of records notices titled, ``Department of Transportation/Office of the Secretary of Transportation004 Board for Correction of Military Records (BCMR) System of Records'' and ``Department of Transportation/Office of the Secretary of Transportation059 Files of the Board for Correction of Military Records, BCMR, for the Coast Guard System of Records.'' This updated system of records allows the Department of Homeland Security to collect and maintain records submitted by individuals who have filed applications for relief before the Board for Correction of Military Records (BCMR), records used by the Chair, the BCMR staff, the Board, and, in some cases, the General Counsel in determining whether to grant relief to applicants, and the final decisions or documentation of other actions taken in individual BCMR cases. Additionally, this notice includes non-substantive changes to simplify the formatting and text of the previously published notices. Notice is hereby given that the Office of Research Integrity (ORI) has taken final action in the following case: Nitin Aggarwal, Ph.D., Medical College of Wisconsin and University of Wisconsin-Madison: Based on the reports of the investigations conducted by the Medical College of Wisconsin (MCW) and the University of Wisconsin-Madison (UW) and additional analysis conducted by the ORI in its oversight review, ORI found that Dr. Nitin Aggarwal, former Graduate Student, MCW, and former Assistant Scientist, UW, engaged in research misconduct in research supported by National Heart, Lung, and Blood Institute (NHLBI), National Institutes of Health (NIH), grants R01 HL37981, R01 HL54075, and R01 HL57414. ORI found that that the Respondent engaged in research misconduct by falsifying and/or fabricating PHS-supported data in six (6) figures that were included in the following two (2) publications, one (1) grant application to the American Heart Association (AHA), one (1) grant application to NIH, and the Respondent's Ph.D. thesis: Aggarwal, N.T., Pfister, S.L., & Campbell, W.B. ``Hypercholesterolemia Enhances 15-Lipoxygenase Mediated Vasorelaxation and Acetylcholine-Induced Hypotension.'' Arteriosclerosis, Thrombosis, and Vascular Biology 28:2209-2215, 2008 (hereafter the ``ATVB paper''). Aggarwal, N.T., Pfister, S.L., Gauthier, K.M., Chawengsub, Y., Baker, J.E., & Campbell, W.B. ``Chronic hypoxia enhances 15- lipoxygenase-mediated vasorelaxation in rabbit arteries.'' American Journal of PhysiologyHeart Circulation Physiology 296:H678-H688, 2008 (hereafter the ``AJP paper''). Aggarwal, N.T., Principal Investigator (P.I.), National Scientist Development grant application to the American Heart Association No. 11SDG7650072, ``Sulfonylurea rReceptor-2 splice variant and mitochondrial mechanisms for cardioprotection and arrhythmia'' (hereafter the ``AHA grant application''). K99 HL113518-01, ``Mitochondrial ATP-sensitive K-channels and pharmacological approaches for cardioprotection,'' Aggarwal, Nitin, Ph.D., P.I. Aggarwal, N.T. ``Endothelial 15-lipoxygenase regulates vasorelaxation and blood pressure in rabbits in normal and pathological condictions.'' A Dissertation Submitted to the Faculty of the Graduate School of Biomedical Science of the Medical College of Wisconsin in Partial Fulfillment of the Requirements for the Degree of Doctor of Philosophy, Milwaukee, Wisconsin, 2008 (hereafter the ``thesis''). Specifically, ORI found that Respondent engaged in research misconduct by falsifying Western blot loading control data by inverting, duplicating, and cropping source blot films and/or using films from unrelated experiments to construct five (5) false Western blot figures. In the absence of valid blot images, Respondent falsified and/or fabricated the corresponding quantitative data for summary bar graphs and the data statistics in related text. Respondent admitted to falsely reporting the number of mice reported for an experiment reported in Figure 4 in grant application HL113518-01 to support the hypothesis of the research. Dr. Aggarwal has entered into a Voluntary Settlement Agreement and has voluntarily agreed for a period of three (3) years, beginning on September 17, 2013: (1) To have his research supervised; Respondent agreed that prior to the submission of an application for U.S. Public Health Service (PHS) support for a research project on which his participation is proposed and prior to his participation in any capacity on PHS- supported research, Respondent shall ensure that a plan for supervision of his duties is submitted to ORI for approval; the supervision plan must be designed to ensure the scientific integrity of his research contribution; he agreed that he shall not participate in any PHS- supported research until such a supervision plan is submitted to and approved by ORI; Respondent agreed to maintain responsibility for compliance with the agreed upon supervision plan; (2) that any institution employing him shall submit in conjunction with each application for PHS funds, or report, manuscript, or abstract involving PHS-supported research in which Respondent is involved, a certification to ORI that the data provided by Respondent are based on actual experiments or are otherwise legitimately derived, and that the data, procedures, and methodology are accurately reported in the application, report, manuscript, or abstract; and (3) to exclude himself voluntarily from serving in any advisory capacity to PHS including, but not limited to, service on any PHS advisory committee, board, and/or peer review committee, or as a consultant.

The U.S. Department of Transportation (Department) seeks comment on four new proposals to strengthen the legal protections provided to consumers of charter air transportation. First, this proposal would require air taxis and commuter air carriers that sell charter air transportation but rely on others to perform that air transportation to make certain consumer disclosures as recommended by the National Transportation Safety Board (NTSB). This proposal would also create a new class of indirect air carriers to be called ``air charter brokers'' to provide as principals single entity charter air transportation of passengers aboard large and small aircraft. In addition, this NPRM would codify the exemption authority granted to indirect air carriers to engage in the sale of air transportation related to air ambulance services. Finally, the NPRM would make clear and codify that certain air services performed under contract with the Federal Government are in common carriage.

L. 104-13, 44 USC 3501 et seq). On July 6, 2012, the President of the United States signed the Moving Ahead for Progress in the 21st Century Act of 2012 (MAP-21). MAP-21 authorized $750 million in FY 2013 and $1 billion in FY 2014 for the Transportation Infrastructure Financing and Innovation Act (TIFIA) program to pay the subsidy cost of supporting Federal credit. The TIFIA program will provide Federal credit assistance in the form of direct loans, loan guarantees, and standby lines of credit to eligible surface transportation projects. This proposed rule would establish the Basic Health Program, as required by section 1331 of the Affordable Care Act. The Basic Health Program provides states the flexibility to establish a health benefits coverage program for low-income individuals who would otherwise be eligible to purchase coverage through the state's Affordable Insurance Exchange (Exchange, also called a Health Insurance Marketplace). The Basic Health Program would complement and coordinate with enrollment in a QHP through the Exchange, as well as with enrollment in Medicaid and the Children's Health Insurance Program (CHIP). This proposed rule sets forth a framework for Basic Health Program eligibility and enrollment, benefits, delivery of health care services, transfer of funds to participating states, and federal oversight. Additionally, this rule would amend other rules issued by the Secretary of the Department of Health and Human Services (Secretary) in order to clarify the applicability of those rules to the Basic Health Program.

In accordance with the Privacy Act of 1974, the Department of Transportation proposes to update and reissue a current Department of Transportation system of records titled, ``Department of Transportation Federal Motor Carrier Safety Administration DOT/FMCSA 001 Motor Carrier Management Information System System of Records.'' This system of records will allow the Department of Transportation Federal Motor Carrier Safety Administration to collect and maintain records on drivers of commercial motor vehicles and individuals who are sole proprietor/driver (owner/operator) of a motor carrier or hazardous material shipper subject to the Federal Motor Carrier Safety Regulations. As a result of a biennial review of this system, the Privacy Office has: added three routine uses of the MCMIS to permit disclosure of MCMIS records to the (1) National Transportation Safety Board; (2) to Federal, State, and local government agencies for the purposes of household goods (HHG) investigations and enforcing HHG statues and regulation; and (3) to Federal, State and local government agencies for the purposes of driver, motor carrier, broker, and freight forwarder investigations, and enforcing commercial operating statutes and regulations. Additionally this notice includes non-substantive changes to simplify the formatting and text of the previously published notice. This updated system will be included in the Department of Transportation's inventory of record systems.
