The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of amendments to Facility Operating License Nos. NPF-87 and NPF-89, issued to Vistra Operations Company LLC (the licensee), for operation of the Comanche Peak Nuclear Power Plant, Unit Nos. 1 and 2. Adjustment of Civil Penalties for Inflation for Fiscal Year 2020; Correction
The U.S. Nuclear Regulatory Commission (NRC) is correcting a final rule that appeared in the Federal Register on January 15, 2020, that amended its regulations to adjust the maximum civil monetary penalties it can assess under statutes enforced by the agency. These changes are mandated by the Federal Civil Penalties Inflation Adjustment Act of 1990, as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. This document corrects the final rule to provide the correct maximum civil monetary penalty, per day, for a violation of the Atomic Energy Act of 1954, as amended, or any regulation or order issued under the Atomic Energy Act.
Indian Point Nuclear Generating Unit Nos. 1, 2, and 3; Consideration of Approval of Transfer of Control of Licenses and Conforming Amendments
On January 23, 2020, the U.S. Nuclear Regulatory Commission (NRC) solicited comments on an application for direct and indirect transfers of licenses in the Federal Register. The public comment period was originally scheduled to close on February 24, 2020. The NRC has decided to extend the public comment period until March 25, 2020, to allow more time for members of the public to develop and submit their comments.
Standard Format and Content of License Applications for Receipt and Storage of Unirradiated Power Reactor Fuel and Associated Radioactive Material at a Nuclear Power Plant

This regulatory guide (RG) describes the standard format and content that the NRC staff considers acceptable for license applications to authorize the receipt, possession, and storage of unirradiated fuel assemblies and associated radioactive materials at a nuclear power plant.
An Approach for Plant-Specific, Risk-Informed Decisionmaking: Technical Specifications
The U.S. Nuclear Regulatory Commission (NRC) is re-issuing for public comment draft regulatory guide (DG), DG-1287, ``An Approach for Plant-Specific, Risk-Informed Decisionmaking: Technical Specifications.'' This proposed Revision 2 of Regulatory Guide (RG) 1.177 includes guidance to develop risk-informed applications for technical specification (TS) changes that considers engineering issues and applies risk insights. This proposed revision also provides guidance acceptable to the staff for using risk information to evaluate changes to nuclear power plant TS completion times (CTs) and surveillance frequencies (SFs) and to assess the impact of such proposed changes on the risk associated with plant operation. This DG- 1287 supplements the guidance provided in RG 1.174, ``An Approach for Using Probabilistic Risk Assessment in Risk-Informed Decisions on Plant-Specific Changes to the Licensing Basis,'' Revision 3, issued January 2018.
Revision of Fee Schedules; Fee Recovery for Fiscal Year 2020
The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend the licensing, inspection, special project, and annual fees charged to its applicants and licensees. These proposed amendments are necessary to implement the Omnibus Budget Reconciliation Act of 1990, as amended (OBRA-90), which requires the NRC to recover approximately 90 percent of its annual budget through fees less certain amounts excluded from this fee-recovery requirement.
Instrument Sensing Lines
The U.S. Nuclear Regulatory Commission (NRC) is issuing Revision 2 to Regulatory Guide (RG) 1.151, ``Instrument Sensing Lines.'' RG 1.151 describes an approach that is acceptable to the staff of the NRC to meet regulatory requirements for instrument sensing lines in nuclear power plants. The RG would endorse, with certain exceptions, standards that were updated and corrected subsequent to the last time the NRC endorsed them in RG 1.151. More information on updates can be found in the Supplementary Information section below.
Vogtle Electric Generating Plant, Unit 3; Hearing Opportunity Associated With Inspections, Tests, Analyses, and Acceptance Criteria
By letter dated January 13, 2020, Southern Nuclear Operating Company (SNC) informed the U.S. Nuclear Regulatory Commission (NRC) that its scheduled date for initial loading of fuel into the reactor for Vogtle Electric Generating Plant (VEGP) Unit 3 is November 23, 2020. The Atomic Energy Act of 1954, as amended (AEA), and NRC regulations provide the public with an opportunity to request a hearing regarding the licensee's conformance with the acceptance criteria in the combined license for the facility. This document announces the public's opportunity to request a hearing and includes orders imposing procedures for the hearing process.

Dow TRIGA Research Reactor; Consideration of Approval of Transfer of License
The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of an application filed by the Dow Chemical Company (TDCC, the licensee) on November 22, 2019. The application seeks NRC approval of the indirect transfer of control of TDCC's interests in the Dow TRIGA Research Reactor (DTRR, the facility) Renewed Facility Operating License No. R-108 to Dow, Inc. The indirect transfer resulted from the merger of TDCC with E.I. du Pont De Nemours and Company in August 2017, which established a new parent company, DowDuPont, Inc. Subsequently, in April 2019, Dow, Inc. was formed as a separate company from DowDuPont, Inc. and TDCC became a wholly-owned subsidiary of Dow, Inc.
NorthStar Nuclear Decommissioning Co., LLC; Vermont Yankee Nuclear Power Station
The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to an August 28, 2019, request from NorthStar Nuclear Decommissioning Company (NorthStar NDC), for the Vermont Yankee Nuclear Power Station, from the requirement to investigate and report to the NRC when NorthStar NDC does not receive notification of receipt of a shipment, or part of a shipment, of low-level radioactive waste within 20 days after transfer from the Vermont Yankee facility. NorthStar NDC requested that the time period for it to receive acknowledgement that the shipment has been received by the intended recipient be extended from 20 to 45 days to avoid an excessive administrative burden as operational experience indicates that rail or mixed mode shipments may take more than 20 days to reach their destination.

Pursuant to section 189.a.(2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular biweekly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration, notwithstanding the pendency before the Commission of a request for a hearing from any person. This biweekly notice includes all amendments issued, or proposed to be issued, from January 14, 2020, to January 27, 2020. The last biweekly notice was published on January 28, 2020.

Survey of NRC's Materials Licensees
The U.S. Nuclear Regulatory Commission (NRC) is conducting a survey of its materials licensees to gather data to inform its decision on a future rulemaking action. The NRC established a nuclear-industry- specific size standard for categorizing the size of small business entities. The responses to this survey will provide the information necessary for the NRC to reassess, and potentially revise, its small entity size standards.
Retrospective Review of Administrative Requirements
The U.S. Nuclear Regulatory Commission (NRC) is conducting a retrospective review of administrative requirements to identify outdated or duplicative administrative requirements that may be eliminated without an adverse effect on public health or safety, common defense and security, protection of the environment, or regulatory efficiency and effectiveness. The NRC is requesting input from its licensees and members of the public on any administrative requirements that may be outdated or duplicative in nature. The NRC will use five criteria to evaluate any public input under this retrospective review of administrative requirements initiative for possible revision or elimination to reduce burden on regulated entities and the NRC.

Advisory Committee on the Medical Uses of Isotopes: Meeting Notice
The U.S. Nuclear Regulatory Commission (NRC) will convene a teleconference meeting of the Advisory Committee on the Medical Uses of Isotopes (ACMUI) on March 11, 2020, to discuss the draft report of the ACMUI Regulatory Guide 8.39 Subcommittee. A phased approach is being conducted by the NRC staff to comprehensively update Regulatory Guide 8.39, ``Release of Patients Administered Radioactive Material.'' Phase 1 of the revision provides licensees with more detailed instructions to patients before and after they have been administered radioactive material than what is currently provided in Regulatory Guide 8.39. The ACMUI subcommittee's report will include its comments and recommendations on the draft final Phase 1 revisions to Regulatory Guide 8.39. Requirements for the Storage of Spent Nuclear Fuel
The U.S. Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking (PRM), submitted by Raymond Lutz and Citizens Oversight, Inc. (the petitioners), dated January 2, 2018. The petitioners requested that the NRC amend its regulations regarding spent nuclear fuel storage systems to embrace the Hardened Extended- life Local Monitored Surface Storage (HELMS) approach and identified multiple revisions to accommodate such an approach. The NRC is denying the petition because the petitioners do not present information that supports the requested changes to the regulations or that provides substantial increase in the overall protection of occupational or public health and safety. The NRC's current regulations and oversight activities continue to provide for the adequate protection of public health and safety and to promote the common defense and security.
Indian Point Nuclear Generating Unit Nos. 1, 2, and 3; Consideration of Approval of Transfer of Control of Licenses and Conforming Amendments
The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of an application filed by Entergy Nuclear Operations, Inc. (ENOI), on behalf of itself, Entergy Nuclear Indian Point 2, LLC (ENIP2), Entergy Nuclear Indian Point 3, LLC (ENIP3), Holtec International (Holtec), and Holtec Decommissioning International, LLC (HDI) (collectively, the applicants), on November 21, 2019. The application seeks NRC approval of the transfer of control of Provisional Operating License No. DPR-5 and Renewed Facility Operating License Nos. DPR-26 and DPR-64 for Indian Point Nuclear Generating, Unit Nos. 1, 2, and 3, respectively (referred to individually as IP1, IP2, or IP3, and collectively as the Indian Point Energy Center or IPEC), as well as the general license for the IPEC Independent Spent Fuel Storage Installation (ISFSI) (collectively, the licenses). Specifically, the application requests that the NRC consent to (1) the transfer of control of the licenses to Holtec subsidiaries to be known as Holtec Indian Point 2, LLC (Holtec IP2) and Holtec Indian Point 3, LLC (Holtec IP3) and (2) the transfer of ENOI's operating authority to HDI. The NRC is also considering amending the licenses for administrative purposes to reflect the proposed transfer. The application contains sensitive unclassified non-safeguards information (SUNSI).
PSEG Nuclear LLC; Salem Nuclear Generating Station, Unit Nos. 1 and 2; Hope Creek Generating Station
The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of amendments to licenses held by PSEG Nuclear LLC (PSEG, the licensee) for the operation of Salem Nuclear Generating Station, Unit Nos. 1 and 2 (Salem), and Hope Creek Generating Station (Hope Creek). The proposed license amendments would revise certain emergency response organization (ERO) positions for these facilities with the minimum staff ERO guidance specified in the ``Alternative Guidance for Licensee Emergency Response Organizations.'' The NRC is amending its regulations to adjust the maximum civil monetary penalty for a violation of the Atomic Energy Act of 1954, as amended, or any regulation or order issued under the Atomic Energy Act from $298,211 to $303,471 per violation, per day. Additionally, the NRC is amending provisions concerning program fraud civil penalties by adjusting the maximum civil monetary penalty under the Program Fraud Civil Remedies Act from $11,463 to $11,665 for each false claim or statement.

Biweekly Notice; Applications and Amendments to Facility Operating Licenses and Combined Licenses Involving No Significant Hazards Considerations
Pursuant to section 189.a.(2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular biweekly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration, notwithstanding the pendency before the Commission of a request for a hearing from any person. This biweekly notice includes all amendments issued, or proposed to be issued, from December 17, 2019, to December 30, 2019. This notice also incorporates the revised biweekly format as noticed in the Federal Register on December 3, 2019. The last biweekly notice was published on December 31, 2019.
