Performance Review Board Appointments
This notice announces the appointment of those individuals who have been selected to serve as members of the Performance Review Board (PRB). The PRB is comprised of two career senior executives and one non-career executive that will meet annually to review and evaluate performance appraisal documents for all Senior Executive Service (SES) members. The National Mediation Board (NMB) is headed by a three-member board nominated by the President and confirmed by the U.S. Senate. The members self-designate a Chairman, typically on a yearly basis. Members may continue to serve after their three-year terms are up if they are not replaced. The PRB provides a written recommendation to the appointing authority. The current Board Chairman or Acting Board Chairman is the appointing authority for the National Mediation Board for final approval of each SES and SL performance rating, performance- based pay adjustment, and performance award.
Decertification of Representatives
The National Mediation Board (NMB or Board) is amending its regulations to provide a straightforward procedure for the decertification of representatives. The Board believes this change is necessary to fulfill the statutory mission of the Railway Labor Act by protecting employees' right to complete independence in the decision to become represented, to remain represented, or to become unrepresented. This change will ensure that each employee has a say in their representative and eliminate unnecessary hurdles for employees who no longer wish to be represented.
Supplemental Standards of Ethical Conduct for Employees of the National Mediation Board
The National Mediation Board (NMB or Board), with the concurrence of the U.S. Office of Government Ethics (OGE), is issuing a final rule for employees of the NMB that supplements the executive branch-wide Standards of Ethical Conduct (Standards) issued by OGE. The supplemental regulation requires NMB employees to obtain approval before engaging in outside employment.

In December of 2012, in response to amendments to the Railway Labor Act, the NMB published a Final Rule changing the showing of interest requirements for organizations seeking a representation election. As a result, the NMB is revising the Application for Investigation of Representation Dispute to reflect that all applicants must submit the same showing of interest. In addition, the NMB is revising the application by requiring applicants to attest that all of the information submitted is true to the best of the signer's knowledge. The revised application will also only provide space for one craft or class per application, thereby requiring a separate application for each craft or class.

As part of its ongoing efforts to further the statutory goals of the Railway Labor Act, the National Mediation Board (NMB or Board) is amending its Railway Labor Act rules to provide that, in representation disputes, a majority of valid ballots cast will determine the craft or class representative. This change to its election procedures will provide a more reliable measure/indicator of employee sentiment in representation disputes and provide employees with clear choices in representation matters.
Representation Election Procedure
This document clarifies a proposed rule appearing in the Federal Register on November 3, 2009. The previous document did not include the factual basis for the National Mediation Board's certification, under Section 605 of the Regulatory Flexibility Act, that the proposed rule is not expected to have a significant economic impact on a substantial number of small entities. The proposed rule affects only the Board's election process and the method used by the Board to determine the outcome of a self-organization vote by employees. The proposed rule would not directly affect any small entities as defined under the Regulatory Flexibility Act. Accordingly, the National Mediation Board certifies that it will not have a significant impact on a substantial number of small entities.
