Notice of Training Sessions: Effective Participation in Executive Order 12866 Meetings With the Office of Information and Regulatory Affairs

Pursuant to Executive Order 12866, interested members of the public may request a meeting with the Office of Information and Regulatory Affairs (OIRA) to present their views about a regulatory action that is under OIRA review. These meetings, known as E.O. 12866 meetings, serve as listening sessions for OIRA officials and representatives from the agency or agencies taking the regulatory action. Section 2(e) of Executive Order 14094 (Modernizing Regulatory Review) directed the OIRA Administrator to implement reforms designed to protect public trust in the regulatory process, including ensuring access for meeting requesters who have not historically requested such meetings. On December 20, 2023, OIRA issued Guidance Implementing Section 2(e) of Executive Order 14094 (Guidance), describing OIRA's E.O. 12666 meeting policy, and its strategy for inclusive and transparent meetings. To assist members of the public seeking to request an E.O. 12866 meeting, OIRA has modified its website and posted an instructional video and a step-by-step guide to requesting a meeting, in English and Spanish, on its website. As outlined in the Guidance, to encourage participation by those who have not historically requested E.O. 12866 meetings, including those from underserved communities, OIRA will offer periodic and accessible trainings on effective participation in E.O. 12866 meetings. For calendar year 2024, OIRA will be holding two virtual sessions to provide training on how to request and how to effectively participate in E.O. 12866 meetings.

This review and possible revision of the 2018 SOC is intended to be completed by the beginning of 2027 and then released to begin use in reference year 2028. The Office of Management and Budget ("OMB") is issuing a final rule revising its regulations implementing the Privacy Act and the Freedom of Information Act ("FOIA"). These revisions update OMB's regulations to reflect changes in OMB's current organizational structure and best practices. The revisions also ensure consistency between the access to records procedures in OMB's Privacy Act regulations and OMB's FOIA regulations, and with applicable law and policies that were enacted after OMB originally issued its Privacy Act regulations in 1976. Finally, the revisions align OMB's regulations with those of other agencies.

Guidance for Federal Financial Assistance

The Office of Management and Budget (OMB) is revising the OMB Guidance for Grants and Agreements, which is now called the OMB Guidance for Federal Financial Assistance. The final guidance reflects public comments received in response to the OMB Notification of Proposed Guidance published in October 2023 and comments received from Federal agencies. In response to comments, OMB is revising and updating the guidance to incorporate recent OMB policy priorities related to Federal financial assistance and to reduce agency and recipient burden. OMB is also incorporating certain statutory requirements and clarifying certain sections of the prior version of the guidance that recipients or agencies have interpreted in different ways. OMB is also making revisions to use plain language, improve flow, and address inconsistent use of terms within the guidance text. Finally, OMB is making revisions to improve Federal financial assistance management, transparency, and oversight through more accessible and readily comprehensible guidance.

This request for information on the responsible procurement of artificial intelligence is being issued concurrently with the release of the OMB Memorandum titled Advancing Governance, Innovation, and Risk Management for Agency Use of Artificial Intelligence (the "AI M- memo"). Executive Order 14110, Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence, directed OMB within 180 days of the issuance of the AI M-memo to develop an initial means to ensure that agency contracts for the acquisition of AI systems and services align with the guidance provided in the AI M-memo and advance the other aims identified in the Advancing American AI Act ("AI Act").

By this Notice, the Office of Management and Budget (OMB) is announcing revisions to Statistical Policy Directive No. 15: Standards for Maintaining, Collecting, and Presenting Federal Data on Race and Ethnicity (SPD 15). The revised SPD 15 is presented at the end of this Notice; it replaces and supersedes OMB's 1997 Revisions to the Standards for the Classification of Federal Data on Race and Ethnicity. OMB is taking this action to meet its responsibilities to develop and oversee the implementation of Government-wide principles, policies, standards, and guidelines concerning the development, presentation, and dissemination of statistical information. These revisions to SPD 15 are intended to result in more accurate and useful race and ethnicity data across the Federal government.
Methods and Leading Practices for Advancing Public Participation and Community Engagement With the Federal Government

The Federal Government is committed to making it easier for the American people to engage with their Government, and to harnessing their knowledge, needs, and lived experiences to improve how Government works for them and with them. Federal laws and Executive directives require agencies to frequently consult with the public to inform regulations, policies, program and service design, and other actions. However, these consultation efforts may be perceived as inaccessible, convoluted, or disconnected from the interests and priorities of impacted stakeholders. According to the 2023 Partnership for Public Service (PPS) survey on trust in government, only about 1 in 5 Americans believe that the Federal Government ``listens to the public'' or ``is transparent.'' The Office of Management and Budget (OMB), in partnership with Federal agencies and the public, is working to develop a government- wide framework, common guidelines, and leading practices for public participation and community engagement (PPCE or ``participation and engagement''). This framework will enable agencies to more frequently, effectively, broadly, and meaningfully involve the public, including underserved communities, in government decision-making. Through this Request for Information (RFI), OMB seeks input on the experiences of individuals and organizations, including from underserved communities, with informing Federal Government decision- making and participating in engagement activities with government agencies; examples of leading practices in this space; and other recommendations on available methods, approaches, and tools that could assist in the effort to develop and implement a Federal framework for participation and engagement. OMB welcomes input from a wide and diverse array of stakeholders in the public, private, advocacy, not- for-profit, and philanthropic sectors, including State, local, Tribal, and territorial governments. OMB will review and consider the usability and applicability of responses to this RFI as OMB develops a Federal framework for PPCE and supports agencies in their work to ensure that their policies and actions are responsive to all Americans.

Update of Statistical Policy Directive No. 3: Compilation, Release, and Evaluation of Principal Federal Economic Indicators-Changing Timing of Public Comments by Employees of the Executive Branch

The Office of Management and Budget (OMB) announces the adoption of a revised Statistical Policy Directive No. 3: Compilation, Release, and Evaluation of Principal Federal Economic Indicators (Directive No. 3). The procedures in Directive No. 3, published in 1985, were designed to ensure equitable, policy-neutral, and timely release and dissemination of Principal Federal Economic Indicators. The goals of Directive No. 3 remain sound; this Notice announces the adoption of procedures consistent with these goals to reflect advances in communication technologies and methods. OMB has solely modified the provision, ``employees of the Executive Branch shall not comment publicly on the data until at least one hour after the official release time,'' by replacing ``one hour'' with ``thirty minutes.'' This change reduces the delay after official release time before commentary from employees of the Executive Branch, while retaining a necessary time delay between policy-neutral release of the official statistics and subsequent Executive Branch interpretations of this statistical data.
