Notice of Proposed Buy America Waiver To Allow Bidder To Certify Compliance
The New York Metropolitan Transportation Authority (MTA) has asked the Federal Transit Administration (FTA) to waive its Buy America requirements on the basis of public interest to permit the low bidder for a contract to construct the 86th Street Station for the Second Avenue Subway project to certify compliance with Buy America. The bidder certified non-compliance based on a misunderstanding of how FTA would apply its rules to certain construction materials. In fact, the low bidder is willing and able to comply with the Buy America rules. Without a waiver, MTA may spend an additional $32.9 million on the 86th Street Station without furthering the goals of Buy America. FTA seeks public comment before deciding whether to grant MTA's request. This Notice sets forth the justification for a public interest waiver in this instance.

FY 2011 Discretionary Livability Funding Opportunity; Section 5309 Bus and Bus Facilities Livability Initiative Program Grants and Section 5339 Alternatives Analysis Program
The Federal Transit Administration (FTA) announces the availability of discretionary funds in Fiscal Year (FY) 2011 for two programs in support of the Department of Transportation's (DOT) Livability Initiative: the Bus and Bus Facilities grant funds (49 U.S.C. 5309(b)) (``Bus Livability Program'') and the Alternatives Analysis Program (49 U.S.C. 5339), both authorized by the Safe, Accountable, Flexible, Efficient, Transportation Equity Act: A legacy for Users (SAFETEA-LU), Pub. L. 109-59, August 10, 2005. The Bus Livability Program will be funded using at least $150 million in available FY 2011 Discretionary Bus and Bus Facilities Program funds. The Alternatives Analysis program will be funded using up to $25 million in FY 2010 and FY2011 discretionary funds. These discretionary program funds will be distributed in accordance with the mission of each program and in support of the U.S. DOT's Livability Initiative and the Partnership for Sustainable Communities between the U.S. DOT, the U.S. Department of Housing and Urban Development (HUD), and the U.S. Environmental Protection Agency (EPA). Please note that this notice is one of several discretionary funding opportunities that FTA intends to issue by early Fall 2011. This notice includes priorities established by FTA for these discretionary funds, the criteria FTA will use to identify meritorious projects for funding, and describes how to apply for funding under each discretionary program. Discretionary Bus and Bus Facilities Program
The Federal Transit Administration (FTA) announces the availability of discretionary Section 5309 Bus and Bus Facilities grant funds in support of its ``State of Good Repair'' initiative. The State of Good Repair (SGR) Bus initiative will be funded with up to $750 million in unallocated Fiscal Year (FY) 2011 discretionary Bus and Bus Facilities Program funds, authorized by 49 U.S.C. 5309(b) of the Safe, Accountable, Flexible, Efficient, Transportation Equity Act: A Legacy For Users (SAFETEA-LU), Public Law 109-59, August 10, 2005. FTA may use additional Bus and Bus Facilities program funding that becomes available in the future to further support this initiative. The SGR Bus initiative will make funds available to public transit providers to finance capital projects to replace, rehabilitate, and purchase buses and related equipment and to construct/rehabilitate bus- related facilities, including programs of bus and bus-related projects which may include assistance to subrecipients that are public agencies, private companies engaged in public transportation, or private non- profit organizations. Capital Investment Program-New Starts and Small Starts Program Funds
The U.S. Department of Transportation's (DOT) Federal Transit Administration (FTA) announces the apportionment of the FY 2011 Capital Investment (New Starts and Small Starts) program funds. The funds will be used for construction of new fixed guideway systems, or extensions to existing fixed guideway systems, or corridor based bus systems to promote livable communities, improve mobility by providing alternatives to automobile, and reduce the impact on the environment.

National Transit Database: Amendments to Urbanized Area Annual Reporting Manual
This notice announces the adoption of certain amendments for the Federal Transit Administration's (FTA) 2011 National Transit Database (NTD) Urbanized Area Annual Reporting Manual (Annual Manual). On October 11, 2010, FTA published a notice in the Federal Register (73 FR 7361) inviting comments on proposed amendments to the 2011 Annual Manual. This notice provides responses to those comments, and announces the adoption of certain amendments for the 2011 Annual Manual.
FTA Supplemental Fiscal Year 2011 Apportionments, Allocations, and Corrections
The Department of Defense and Full-Year Continuing Appropriations Act, 2011 (Pub. L. 112-10), was signed into law by President Obama on April 15, 2011, appropriating funds for all of the surface transportation programs of the U.S. Department of Transportation (DOT) for the remainder of the Fiscal Year (FY) ending September 30, 2011. This Notice supplements the February 8, 2011 Federal Register notice that provided a partial apportionment of FY 2011 formula funds.
Bus Testing: Calculation of Average Passenger Weight and Test Vehicle Weight, and Public Meeting and Extension of Comment Period
The Federal Transit Administration (FTA) is hosting a conference call to address issues concerning its notice of proposed rulemaking (NPRM) regarding the calculation of average passenger weights and test vehicle weights. The purpose of this conference call is to allow the public to ask questions and to clarify any misunderstandings regarding the NPRM published on March 14, 2011 (76 FR 13580). Furthermore, due to the complexity of the issues proposed in the NPRM, FTA is extending the comment period to June 15, 2011, to allow interested parties time to carefully review the actual changes proposed in the NPRM and the information presented during the conference call.

Solicitation of Nominations for Members of the Transit Rail Advisory Committee for Safety (TRACS)
The Federal Transit Administration (FTA) is seeking nominees to serve on TRACS. The Advisory Committee meets twice a year to advise FTA on transit safety issues. On February 1, 2010, FTA issued an initial notice (75 FR 5172) soliciting nominations to serve on TRACS. From that solicitation, 21 members were chosen, each representing a broad base of expertise relating to rail transit safety. The FTA Administrator (Administrator) has since determined that he would like to seek additional members to serve on TRACS. Specifically, the Administrator would like to augment the TRACS' existing knowledge base with professionals who have done academic research in the safety field.

Intent To Prepare an Environmental Impact Statement for the Downtown San Francisco Ferry Terminal Expansion Project in the City and County of San Francisco, CA
The FTA, as the lead Federal agency, and the San Francisco Bay Area Water Emergency Transportation Authority (WETA) are planning to prepare an EIS for the proposed expansion and improvements to the Downtown San Francisco Ferry Terminal at the Port of San Francisco Ferry Building. The proposed project would serve commuters, visitors, and recreational users desiring an alternative way to cross San Francisco Bay, and reach nearby employment, entertainment, and recreational destinations in San Francisco. The project expands the number of ferry gates and improves ferry patron circulation, boarding, and wayfinding in and around the Ferry Building. In addition, the project enhances emergency response capabilities to evacuate people from San Francisco and/or mobilize first responders to San Francisco via ferries if a catastrophic event occurs. The EIS will be prepared in accordance with Section 102(2)C of the National Environmental Policy Act of 1969 (NEPA) and pursuant to the Council on the Environmental Quality's regulations (40 Code of Federal Regulations [CFR] parts 1500-08) as well as provisions of the recently enacted Safe, Accountable, Flexible Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). The purpose of this notice is to alert interested parties regarding the intent to prepare an EIS; provide information on the proposed transit project; invite participation in the EIS process, including comments on the scope of the EIS proposed in this notice; and announce when the public scoping meeting will be conducted.

Over-the-Road Bus Accessibility Program Announcement of Project Selections
The U.S. Department of Transportation's (DOT) Federal Transit Administration (FTA) announces the selection of projects to be funded under Fiscal Year (FY) 2009 and 2010 appropriations for the Over-the- Road Bus (OTRB) Accessibility Program, authorized by Section 3038 of the Transportation Equity Act for the 21st Century (TEA-21). The OTRB Accessibility Program makes funds available to private operators of over-the-road buses to help finance the incremental capital and training costs of complying with DOT's over-the-road bus accessibility rule, published in the Federal Register on September 24, 1998.

Notice of Meeting of the Transit Rail Advisory Committee for Safety (TRACS)
This notice announces a public meeting of the Transit Rail Advisory Committee for Safety (TRACS). TRACS is a Federal Advisory Committee established by the Secretary of Transportation in accordance with the Federal Advisory Committee Act to provide information, advice, and recommendations to the Secretary and the Federal Transit Administrator on matters relating to the safety of public transportation systems.
Transfer of Federally Assisted Land or Facility
Section 5334(h) of the Federal Transit Laws, as codified, 49 U.S.C. 5301, et seq., permits the Administrator of the Federal Transit Administration (FTA) to authorize a recipient of FTA funds to transfer land or a facility to a public body for any public purpose with no further obligation to the Federal Government if, among other things, no Federal agency is interested in acquiring the asset for Federal use. Accordingly, FTA is issuing this Notice to advise Federal Agencies that the City of Terre Haute by and through its Board of Public Works intends to transfer a portion of a facility to Indiana State University for use as a parking garage for students, faculty and general public. The portion of the facility being transferred is located on land owned by Indiana State University Board of Trustees and leased to the City of Terre Haute under a forty (40) year ground lease dated January 1, 2006. The facility is located at 750 Cherry Street, Terre Haute, Indiana and is bounded on the west by 7th Street, on the east by 8th Street, on the north by Larry Bird Avenue and on the south by Cherry Street. It is taxed as one parcel 84-06-22-307-002.000-002 but is more specifically comprised of Lots 98, 99, 100, and part of Lots 118, 119, 120 and 120 in Chauncey Rose's Addition to the Town (now city) of Terre Haute. The facility is located on the campus of Indiana State University and is adjacent to the Hulman Civic Center, a commercial office building housing State of Indiana Offices, Hilton Garden Inn and is one block north of the downtown Terre Haute area. The facility to be transferred is comprised of approximately Two- hundred Twenty-eight Thousand (228,000) square feet of parking structure including Six Hundred Twenty-six (626) parking spaces. Construction material includes concrete with brick fa[ccedil]ade. The transfer does not include Eighteen Thousand Three Hundred (18,300) square feet on the east end of the structure occupied by the City of Terre Haute Transit Department.
Bus Testing; Calculation of Average Passenger Weight and Test Vehicle Weight
The Federal Transit Administration (FTA) is proposing to amend its bus testing regulation to more accurately reflect average passenger weights and actual transit vehicle loads. Specifically, FTA is proposing to change the average passenger weight from 150 lbs to 175 lbs. In addition, FTA is proposing to change the floor space occupied per standing passenger from 1.5 to 1.75 square feet, and updating the Structural Strength and Distortion test procedures.

FY 2011 Discretionary Funding Opportunity: Paul S. Sarbanes Transit in Parks Program
The Federal Transit Administration (FTA) announces the upcoming availability of Fiscal Year (FY) 2011 Paul S. Sarbanes Transit in Parks Program (Transit in Parks Program) discretionary funds. This notice solicits proposals to compete for FY 2011 funds under the program, which was established by Section 3021 of SAFETEA-LU, as amended (49 U.S.C. 5320). The amount of funding available will be determined by Congressional appropriation prior to the selection of awardees, and based on the timing of such funding becoming available, may also include funding for Fiscal Year 2012. The program is administered by FTA in partnership with the Department of the Interior (DOI) and the U.S. Department of Agriculture's Forest Service. The program funds capital and planning expenses for alternative transportation systems such as buses, trams and non-motorized trails in federally-managed parks and public lands. Federal land management agencies, as well as State, tribal and local governments acting with the consent of a Federal land management agency are eligible to apply. DOI, after consultation with and in cooperation with FTA, will determine the final selection and funding of projects. Geographic diversity will be considered when allocating funds. Environmental Impact Statement for a Proposed Urban Rail system in Austin, TX
The Federal Transit Administration (FTA), as the Federal lead agency, and the City of Austin (the City) intend to prepare an Environmental Impact Statement (EIS) for the proposed Urban Rail system in Austin, Texas. The EIS will be prepared in accordance with regulations implementing the National Environmental Policy Act (NEPA), as well as provisions of the recently enacted Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). The proposed project, described more completely within, is an Urban Rail System, similar to Streetcar, that would connect key activity centers within Central AustinMueller Transit-Oriented Redevelopment (Mueller), the University of Texas at Austin (UT) campus, the State Capitol Complex (Capitol), the central business district (CBD), and Austin-Bergstrom International Airport (ABIA) with each other and to emerging regional transportation network nodes for commuter rail, regional rail, and rapid bus in Austin, Travis County, Texas. The purpose of this notice is to alert interested parties regarding the intent to prepare the EIS, to provide information on the nature of the proposed project and possible alternatives, and to invite public participation in the EIS process.
Exempt Discretionary Program Grants (Section 5309) for Urban Circulator Systems
The U.S. Department of Transportation's (DOT) Federal Transit Administration (FTA) announces the selection of projects funded with unallocated Section 5309 discretionary program funds for the Urban Circulator program in support of DOT's Livability Initiative, which was announced in the Urban Circulator Systems Program notice of funding availability on December 8, 2009. The Urban Circulator program makes funds available to assist State and local governmental authorities in constructing new fixed guideway and corridor-based bus capital projects including the acquisition of real property, the initial acquisition of rolling stock for the systems, the acquisition of rights-of-way, and relocation. Through the Urban Circulator Program grants, FTA will invest in five projects that provide a transportation option that connects urban destinations and fosters the redevelopment of urban spaces into walkable mixed use, high density environments.

Alternatives Analysis Program Discretionary Funding Allocations

The Alternatives Analysis Program assists potential sponsors of major transit capital investments (``New Starts'' and ``Small Starts'' projects) in the evaluation of all reasonable modal and multimodal alternatives and general alignment options to address transportation needs in a defined travel corridor. FTA Fiscal Year 2011 Apportionments, Allocations, and Program Information
The Federal Transit Administration (FTA) annually publishes one or more notices apportioning funds appropriated by law. In some cases, if less than a full year of funding is available, FTA publishes multiple partial apportionment notices. This notice is the first notice announcing partial apportionment of Fiscal Year (FY) 2011 formula funds. It also provides program guidance and requirements; and provides information on several program issues important in the current fiscal year. The notice also includes tables that show certain unobligated (carryover) funding discretionary programs from previous years that will be available for obligation during FY 2011.
TIGGER and Clean Fuels Grant Program Funds
The U.S. Department of Transportation's (DOT) Federal Transit Administration (FTA) announces the selection of projects funded in support of the Transit Investments for Greenhouse Gas and Energy Reduction (TIGGER) program and Clean Fuels Grant program which is enhanced with Section 5309 Bus and Bus Facilities program funds. This funding supports the U.S. Department of Transportation's environmental sustainability efforts, which were announced in FTA's notice of funding availability (NOFA) on April 13, 2010. The TIGGER program makes funds available for capital investments that will reduce the energy consumption or greenhouse gas emissions of public transportation systems. The Clean Fuels Grant program makes funds available to assist nonattainment and maintenance areas in achieving or maintaining the National Ambient Air Quality Standards for ozone and carbon monoxide and supports emerging clean fuel and advanced propulsion technologies for transit buses and markets for those technologies.
Alternative Transportation in Parks and Public Lands Program
The U.S. Department of Transportation's (DOT) Federal Transit Administration (FTA) announces the selection of projects, funded with Fiscal Year (FY) 2010 appropriations and previously unallocated prior year funds, for the Paul S. Sarbanes Transit in Parks program, as authorized by Section 3021 of the Safe, Accountable, Flexible, Efficient Transportation Equity ActA Legacy for Users of 2005 (SAFETEA-LU) and codified in 49 U.S.C. 5320. The Paul S. Sarbanes Transit in Parks program funds capital and planning expenses for alternative transportation systems in parks and public lands. Federal land management agencies and State, Tribal and local governments acting with the consent of a Federal land management agency are eligible recipients.
Intent To Prepare an Environmental Impact Statement for a Potomac Yard Metrorail Station in Alexandria, VA
The Federal Transit Administration (FTA) as the Federal lead agency, in cooperation with the City of Alexandria, the Washington Metropolitan Area Transit Authority (WMATA), and the National Park Service (NPS), is issuing this Notice of Intent (NOI) to advise the public that it proposes to prepare an Environmental Impact Statement (EIS) to assess the potential environmental impacts associated with the proposed construction and operation of the Potomac Yard Metrorail Station. Notice of Funding Availability for Applications for Credit Assistance Under the Transportation Infrastructure Finance and Innovation Act (TIFIA) Program
The DOT's TIFIA Joint Program Office (JPO) announces the availability of funding to support new applications for credit assistance. Under TIFIA, the DOT provides secured (direct) loans, lines of credit, and loan guarantees to public and private applicants for eligible surface transportation projects of regional or national significance. Projects must meet statutorily specified criteria to be selected for credit assistance. Because demand for the TIFIA program can exceed budgetary resources, the DOT is utilizing periodic fixed-date solicitations that will establish a competitive group of projects to be evaluated against the program objectives. Preparation of Environmental Impact Statement for Transit Improvements in the US 90A/Southwest Rail Corridor in Metropolitan Houston, TX
The Federal Transit Administration (FTA) and the Metropolitan Transit Authority of Harris County (METRO) intend to prepare an Environmental Impact Statement (EIS) in accordance with the National Environmental Policy Act (NEPA), to evaluate the proposed transit improvements in the US 90A/Southwest Rail corridor in the Houston metropolitan area (Harris County). The US 90A/Southwest Rail corridor extends approximately eight miles from the vicinity of the Fannin South Station at the southern terminus of the existing METRORail Red Line to West Sam Houston Tollway (Beltway 8) in Missouri City, Texas. The proposed scope of the EIS, including the project's purpose and need, an initial set of alternatives proposed for evaluation, and the significant impacts to be considered, are presented below. A public scoping process seeking comment on the scope of the EIS is announced below.
Intent To Prepare an Environmental Impact Statement for Proposed Transit Improvements to the North Red and Purple Lines, Cook County, IL
The Federal Transit Administration (FTA), as the lead Federal agency, and the Chicago Transit Authority (CTA) intend to prepare a Tier 1 Environmental Impact Statement (Tier 1 EIS) for the North Red and Purple Line Modernization (RPM) Project in Cook County, Illinois. The CTA operates the rapid transit system in Cook County, Illinois. The proposed project, described more completely within, would bring the North Red and Purple lines up to a state of good repair from the track structure immediately north of Belmont Station in Chicago, Illinois to the Linden terminal in Wilmette, Illinois. The purpose of this Notice of Intent is to (1) alert interested parties regarding the intent to prepare the EIS, (2) to provide information on the nature of the proposed project and possible alternatives, and (3) to invite public participation in the EIS process.
Intent To Prepare an Environmental Impact Statement for the Metro Gold Line Foothill Extension, Azusa to Montclair in Los Angeles and San Bernardino Counties, CA
The Federal Transit Administration (FTA), as the federal lead agency, and the Metro Gold Line Foothill Extension Construction Authority (Construction Authority) intend to prepare an Environmental Impact Statement (EIS) for proposed transit improvements in the Foothill Extension Transit Corridor. FTA is the lead Federal agency with the Construction Authority as a co-lead agency for the National Environmental Policy Act (NEPA) process because the Construction Authority is seeking Federal funding for the proposed project. The proposed project is an extension of the existing Metro Gold Line light rail transit line, from Azusa to Montclair, with proposed stations in Glendora, San Dimas, La Verne, Pomona, Claremont and Montclair. The proposed project will improve mobility in eastern Los Angeles County and western San Bernardino County by introducing high-frequency transit service options; enhance the regional transit network by interconnecting existing and planned rail and bus transit lines; provide an alternative mode of transportation for commuters who currently use the congested I-210 corridor; improve transit accessibility for residents and employees who live and/or work along the corridor; and encourage a mode shift to transit, reducing air pollution and greenhouse gas emissions. The EIS will be prepared in accordance with the requirements of NEPA and its implementing regulations. Prior to commencement of a Final EIS, a locally preferred alternative (LPA) will be identified and adopted by the Construction Authority Board and included in the Los Angeles County Metropolitan Transportation Authority (LACMTA) Constrained Long Range Transportation Plan (LRTP). LACMTA and the Construction Authority do not currently anticipate applying for 43 U.S.C. 5309 New Starts funding. The Construction Authority will be preparing a joint EIS/EIR document to comply with NEPA and the California Environmental Quality Act (CEQA). The purpose of this notice is to alert interested parties regarding the intent to prepare the EIS, to provide information on the nature of the proposed project and possible alternatives, to invite public participation in the EIS process (including providing comments on the scope of the Draft EIS), to announce that public scoping meetings will be conducted, and to invite participating and cooperating agencies.

Transfer of Federally Assisted Facility
Section 5334(h) of the Federal Transit Laws, as codified, 49 U.S.C. 5301, et. seq., permits the Administrator of the Federal Transit Administration (FTA) to authorize a recipient of FTA funds to transfer land or a facility to a public body for any public purpose with no further obligation to the Federal Government if, among other things, no Federal agency is interested in acquiring the asset for Federal use. Accordingly, FTA is issuing this Notice to advise Federal agencies that the City of Charlottesville (City) intends to transfer a facility and land located at 315 4th Street, NW., Charlottesville, Virginia to the Charlottesville Facilities Maintenance Division of Public Works. The facility and land sit within a secure Public Works Yard and any other acquiring agency would need access to use this property.

State of Good Repair Bus and Bus Facilities Discretionary Program Funds
The U.S. Department of Transportation's (DOT) Federal Transit Administration (FTA) announces the selection of projects funded with Section 5309 Bus and Bus Facilities program funds in support of the State of Good Repair (SGR) Initiative, which was announced in the State of Good Repair Initiative Notice of Funding Availability on May 4, 2010. The SGR Initiative makes funds available to public transit providers to finance capital projects to replace, rehabilitate, and purchase buses and related equipment and to construct bus-related facilities, including programs of bus and bus-related projects for assistance to subrecipients that are public agencies, private companies engaged in public transportation, or private non-profit organizations. Additionally, the SGR Initiative makes funds available for Transit Asset Management systems, which is a systematic process of operating, maintaining, improving, and expanding physical assets effectively throughout their life cycles.
