Public trust in Federal statistics is essential to their value and use in informing decisions across public and private sectors. To promote public trust in the statistical agencies and units that produce Federal statistics, the Office of Management and Budget issues this final rule pursuant to Title III of the Foundations for Evidence-Based Policymaking Act of 2018 (Evidence Act) to provide direction to Recognized Statistical Agencies and Units (RSAUs) in carrying out their four fundamental responsibilities: produce and disseminate relevant and timely statistical information, conduct credible and accurate statistical activities, conduct objective statistical activities, and protect the trust of information providers by ensuring the confidentiality and exclusive statistical use of their responses. This final rule also provides direction to other Federal agencies to enable, support, and facilitate RSAUs in carrying out these four fundamental responsibilities.

On July 19, 2023, the Office of Information and Regulatory Affairs (OIRA) in the Office of Management and Budget (OMB) issued a Memorandum, Broadening Public Participation and Community Engagement in the Regulatory Process, providing guidance to agencies on how to promote equitable and meaningful participation by a range of interested and affected parties, including members of underserved communities, during the regulatory process. The Memorandum also established guidance for agencies to implement the Executive Order on Modernizing Regulatory Review's call for proactive engagement to inform the development of regulatory actions and plans, with a focus on early engagement in agency priority-setting. In developing the Memorandum, OIRA drew on extensive engagement with the public, including four listening sessions and two public comment periods. In the Memorandum, OIRA anticipated organizing a follow-up listening session approximately twelve months from its issuance, to hear from members of the public about implementation of this guidance and opportunities for improvement. OIRA will hold three listening sessions to receive public input on the public's experience engaging with agency's rulemaking processes since the Memorandum's release.

The Federal Government is committed to making it easier for the American people to engage with their Government, and to harnessing their knowledge, needs, and lived experiences to improve how Government works for them and with them. Federal laws and Executive directives require agencies to frequently consult with the public to inform regulations, policies, program and service design, and other actions. However, these consultation efforts may be perceived as inaccessible, convoluted, or disconnected from the interests and priorities of impacted stakeholders. According to the 2023 Partnership for Public Service (PPS) survey on trust in government, only about 1 in 5 Americans believe that the Federal Government ``listens to the public'' or ``is transparent.'' The Office of Management and Budget (OMB), in partnership with Federal agencies and the public, is working to develop a government- wide framework, common guidelines, and leading practices for public participation and community engagement (PPCE or ``participation and engagement''). This framework will enable agencies to more frequently, effectively, broadly, and meaningfully involve the public, including underserved communities, in government decision-making. Through this Request for Information (RFI), OMB seeks input on the experiences of individuals and organizations, including from underserved communities, with informing Federal Government decision- making and participating in engagement activities with government agencies; examples of leading practices in this space; and other recommendations on available methods, approaches, and tools that could assist in the effort to develop and implement a Federal framework for participation and engagement. OMB welcomes input from a wide and diverse array of stakeholders in the public, private, advocacy, not- for-profit, and philanthropic sectors, including State, local, Tribal, and territorial governments. The Office of Management and Budget (OMB) announces the adoption of a revised Statistical Policy Directive No. 3: Compilation, Release, and Evaluation of Principal Federal Economic Indicators (Directive No. 3). The procedures in Directive No. 3, published in 1985, were designed to ensure equitable, policy-neutral, and timely release and dissemination of Principal Federal Economic Indicators. The goals of Directive No. 3 remain sound; this Notice announces the adoption of procedures consistent with these goals to reflect advances in communication technologies and methods. OMB has solely modified the provision, ``employees of the Executive Branch shall not comment publicly on the data until at least one hour after the official release time,'' by replacing ``one hour'' with ``thirty minutes.'' This change reduces the delay after official release time before commentary from employees of the Executive Branch, while retaining a necessary time delay between policy-neutral release of the official statistics and subsequent Executive Branch interpretations of this statistical data.
