Endangered and Threatened Wildlife and Plants; Permits, Santa Cruz County, CA
We, the U.S. Fish and Wildlife Service (Service), have received applications from William Menchine and Alicia Stanton and the San Lorenzo Valley Water District (applicants) for incidental take permits under the Endangered Species Act of 1973, as amended (Act). We are considering issuing permits that would authorize the applicants' take of the Federally endangered Mount Hermon June beetle (Polyphylla barbata) incidental to otherwise lawful activities that would result in the permanent loss of 0.05 acre (2,182 square feet (sq ft)) of Mount Hermon June beetle habitat near Santa Cruz, Santa Cruz County, California. We invite comments from the public on the applications, which include Habitat Conservation Plans (HCPs) that fully describe the proposed projects and measures the applicants would undertake to minimize and mitigate anticipated take of the species. We also invite comments on our preliminary determination that the HCPs qualify as ``low-effect'' plans, eligible for categorical exclusions under the National Environmental Policy Act (NEPA) of 1969, as amended. We explain the basis for this determination in our draft Environmental Action Statements and associated Low-Effect Screening Forms, both of which are also available for review.
Upper Klamath, Lower Klamath, Tule Lake, Bear Valley, and Clear Lake National Wildlife Refuges, Klamath County, OR, Siskiyou and Modoc Counties, CA
We, the Fish and Wildlife Service (Service), intend to prepare a Comprehensive Conservation Plan (CCP) and Environmental Impact Statement (EIS) for Upper Klamath, Lower Klamath, Tule Lake, Bear Valley, and Clear Lake National Wildlife Refuges (Refuges) located in Klamath County, Oregon, and Siskiyou and Modoc Counties, California. The Refuges are part of the Klamath Basin Complex. We provide this notice in compliance with our CCP policy to advise other Federal and State agencies, Tribes, and the public of our intentions, and to obtain suggestions and information on the scope of issues to consider in the planning process.

We, the U.S. Fish and Wildlife Service, announce our adoption of a representation logo for the Fish and Wildlife Service's National Conservation Training Center (NCTC, Center) in Shepherdstown, West Virginia. We will use this new logo as the Center's official graphic representation, for the specific purpose of providing a unified, consistent visual image for the Center's training products and other items, including course materials, hospitality products, artwork, and other promotional materials that identify the Center and support its mission.

After review of all available scientific and commercial information, we find that listing Susan's purse-making caddisfly is not warranted at this time. However, we ask the public to submit to us any new information that becomes available concerning the threats to the Susan's purse-making caddisfly or its habitat at any time.

We, the U.S. Fish and Wildlife Service (Service), announce the availability of the Attwater's Prairie-Chicken (Tympanuchus cupido attwateri) Recovery Plan, Second Revision. A recovery plan was originally completed for the Attwater's prairie-chicken in 1983 and revised in 1993.
Marine Mammal Protection Act; Deterrence Guidelines
These proposed guidelines set forth best practices that we, the Fish and Wildlife Service, find are appropriate for safely and nonlethally deterring polar bears from damaging private and public property and endangering the public. We would not require anyone to implement these guidelines, nor would anyone be liable if they did not implement them. If the guidelines are finalized, anyone deciding to implement them could do so without our authorization or supervision. We are proposing these guidelines to reduce occurrences of bear-human interactions with only minor, short-term behavioral effects on polar bears. As discussed in the background section of this proposed rule, we authorize other, more aggressive deterrence activities through separate provisions of the Marine Mammal Protection Act. We seek public comment on these proposed guidelines.

Habitat Conservation Plan for City of Kent, Washington
The City of Kent, Washington (Kent), has submitted applications to the National Marine Fisheries Service (NMFS) and U.S. Fish and Wildlife Service (FWS) (together, the Services, us) for Incidental Take Permits (Permit) under the Endangered Species Act of 1973, as amended (ESA). We jointly prepared a Draft Environmental Impact Statement (DEIS) to support permit-issuance decisions by each agency. As required by the ESA, Kent has also prepared a Habitat Conservation Plan (Plan) designed to minimize and mitigate any such take of endangered or threatened species. The Permit applications are related to water withdrawal and habitat enhancement measures on Rock Creek, tributary to the Cedar River, King County, Washington. The Permit and the Plan each have a proposed term of 50 years.
Endangered and Threatened Wildlife and Plants; Reclassification of the Oregon Chub From Endangered to Threatened
We, the U.S. Fish and Wildlife Service (Service), are reclassifying the federally endangered Oregon chub (Oregonichthys crameri) to threatened status under the authority of the Endangered Species Act of 1973, as amended (Act). This decision is based on a thorough review of the best available scientific and commercial data, which indicate that the species' status has improved to the point that the Oregon chub is not currently in danger of extinction throughout all or a significant portion of its range.
Endangered and Threatened Wildlife and Plants; Final Revised Critical Habitat for Hine's Emerald Dragonfly (Somatochlora hineana)
We, the U.S. Fish and Wildlife Service (Service), are designating critical habitat for the Hine's emerald dragonfly (Somatochlora hineana) under the Endangered Species Act of 1973, as amended (Act). In total, approximately 26,531.8 acres (ac) (10,737 hectares (ha)) in 37 units fall within the boundaries of our critical habitat designation. The critical habitat units are located in Cook, DuPage, and Will Counties in Illinois; Alpena, Mackinac, and Presque Isle Counties in Michigan; Crawford, Dent, Iron, Phelps, Reynolds, Ripley, Washington, and Wayne Counties in Missouri; and Door and Ozaukee Counties in Wisconsin.

We, the U.S. Fish and Wildlife Service (Service), announced in our 12-month finding on a petition to list the mountain whitefish (Prosopium williamsoni) in the Big Lost River, Idaho, under the Endangered Species Act of 1973, as amended (Act), that listing was not warranted. Our finding published in the Federal Register on April 6, 2010, but two figures were omitted from the document. We now provide those two figures.

Green Diamond Resource Company, California Timberlands Division, Forest Management Habitat Conservation Plan and Incidental Take Permit, Del Norte and Humboldt Counties, California
We, the U.S. Fish and Wildlife Service (USFWS), intend to prepare an Environmental Impact Statement (EIS) under the National Environmental Policy Act (NEPA) regarding an expected application from the Green Diamond Resource Company, California Timberlands Division (Green Diamond), for an incidental take permit (ITP, or permit) authorizing incidental take of federally threatened wildlife species under the Endangered Species Act of 1973, as amended (ESA). Green Diamond is preparing a Habitat Conservation Plan (HCP) and application for an ITP related to forest management and timber operations on its lands in Del Norte and Humboldt Counties, California. The HCP and ITP will cover the northern spotted owl (Strix occidentalis caurina) (NSO or spotted owl) and may also cover the Pacific fisher (Martes pennanti) (fisher), a currently unlisted species which has the potential to become listed during the term of the HCP. We, the U.S. Fish and Wildlife Service (Service), announce the reopening of the public comment period on our June 10, 2009, proposed revised designation of critical habitat for Navarretia fossalis (spreading navarretia). We also announce the availability of a draft economic analysis (DEA); revisions to proposed critical habitat, including proposed revisions to eight subunits based on the previous public comment period; and an amended required determinations section of the proposal. We are reopening the comment period for an additional 30 days to allow all interested parties an opportunity to comment on all of the above. If you submitted comments previously, you do not need to resubmit them because we have already incorporated them into the public record and will fully consider them in our final determination.
Proposed Information Collection; OMB Control Number 1018-0144; Wildlife Without Borders-Amphibians in Decline Grant Program
We (Fish and Wildlife Service) will ask the Office of Management and Budget (OMB) to approve the information collection (IC) described below. As required by the Paperwork Reduction Act of 1995 and as part of our continuing efforts to reduce paperwork and respondent burden, we invite the general public and other Federal agencies to take this opportunity to comment on this IC. This IC is scheduled to expire on September 30, 2010. We may not conduct or sponsor and a person is not required to respond to a collection of information unless it displays a currently valid OMB control number.
Migratory Bird Subsistence Harvest in Alaska; Harvest Regulations for Migratory Birds in Alaska During the 2010 Season
The U.S. Fish and Wildlife Service (Service or we) establishes migratory bird subsistence harvest regulations in Alaska for the 2010 season. These regulations enable the continuation of customary and traditional subsistence uses of migratory birds in Alaska and prescribe regional information on when and where the harvesting of birds may occur. These regulations were developed under a co-management process involving the Service, the Alaska Department of Fish and Game, and Alaska Native representatives. This rulemaking is necessary because the regulations governing the subsistence harvest of migratory birds in Alaska are subject to annual review. This rulemaking establishes region-specific regulations that go into effect April 13, 2010 and expire August 31, 2010.
Endangered and Threatened Wildlife and Plants; Determination of Endangered Status for 48 Species on Kauai and Designation of Critical Habitat
We, the U.S. Fish and Wildlife Service (Service), determine endangered status for 48 species on the island of Kauai in the Hawaiian Islands under the Endangered Species Act of 1973, as amended (Act). We also designate 26,582 acres (ac) (10,757 hectares (ha)) of critical habitat for 47 of these species. The critical habitat is located in Kauai County, Hawaii. Critical habitat designation was determined to be not prudent for one species, Pritchardia hardyi (a palm), which is threatened by over collection and vandalism.
2009-2010 Refuge-Specific Hunting and Sport Fishing Regulations-Additions
The Fish and Wildlife Service adds two refuges to the list of areas open for hunting and/or sport fishing programs and increases the activities available at eight other refuges for the 2009-2010 season. One refuge will see a decrease in activities and another refuge will see no net change in activities for the 2009-2010 season.
Stanford University Habitat Conservation Plan
This notice announces the availability of the Draft Environmental Impact Statement (DEIS) for Authorization for Incidental Take and Implementation of Stanford University Habitat Conservation Plan (Plan), and the Implementing Agreement (IA) for public review and comment. In response to receipt of an application from The Board of Trustees of Leland Stanford Junior University (Stanford; Applicant), the U.S. Fish and Wildlife Service and National Oceanic and Atmospheric Administration, National Marine Fisheries Service (Services), are considering the proposed action of issuing a 50-year permit for four federally listed species and one currently unlisted species. The proposed permit would authorize the incidental take of individual species listed under the Federal Endangered Species Act of 1973, as amended (ESA). The permit is needed because take of species could occur during the operation and maintenance of the University, academic activities, athletic and recreational activities, leasehold activities, urban development, and resource conservation activities associated with the Plan at Stanford, which is located on 8,180-acres in San Mateo County and Santa Clara County, California.

Paiute Cutthroat Trout Restoration Project, Alpine County, CA
This notice announces the availability of the Paiute Cutthroat Trout Restoration Project Final Environmental Impact Statement (EIS)/ Environmental Impact Report (EIR) for public review. We, the Fish and Wildlife Service (Service), along with the Humboldt-Toiyabe National Forest (Cooperating Agency) and the California Department of Fish and Game (CDFG, California Environmental Quality Act lead agency) (collectively, agencies), are proposing to restore Paiute cutthroat trout to the species historical range within the Silver King Creek watershed, Alpine County, California. To accomplish this, the agencies must first eradicate the non-native and hybrid trout which currently occupy the habitat. We are publishing this notice to inform the public of the proposed action and to make available for review the Final EIS/ EIR, which includes responses to public comments received on the March 2009, Draft EIS/EIR.

We, the U.S. Fish and Wildlife Service, are initiating 5-year reviews for 69 species in Idaho, Washington, Hawaii, Guam, and the Commonwealth of the Northern Mariana Islands under the Endangered Species Act of 1973, as amended (Act). We request any new information on these species that may have a bearing on their classification as endangered or threatened. Based on the results of our 5-year reviews we will determine whether these species are properly classified under the Act.
Endangered and Threatened Wildlife and Plants; 12-Month Finding on a Petition to Reclassify the Delta Smelt From Threatened to Endangered Throughout Its Range
We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to reclassify the delta smelt (Hypomesus transpacificus) under the Endangered Species Act of 1973, as amended. After review of all available scientific and commercial information, we find that reclassifying the delta smelt from a threatened to an endangered species is warranted, but precluded by other higher priority listing actions. We will develop a proposed rule to reclassify this species as our priorities allow.
Arctic National Wildlife Refuge, Fairbanks, AK
We, the U.S. Fish and Wildlife Service (Service), will be developing a revised comprehensive conservation plan (CCP) and environmental impact statement (EIS) for Arctic National Wildlife Refuge (NWR, Refuge). The Revised CCP will establish goals and objectives, review Refuge rivers for potential recommendation for Congress for inclusion within the National Wild and Scenic Rivers System, and review Refuge lands for potential recommendation for Congress for inclusion within the National Wilderness Preservation System. We will use the internet, special mailings, public service announcements, newspaper advertisements, and other media to keep people updated throughout the planning process and to provide opportunities for input. We will hold public meetings in communities within and near the Refuge during preparation of the Revised CCP. We will also hold meetings in Anchorage, AK, Fairbanks, AK, and Washington, DC.
Approved Recovery Plan for the Scaleshell Mussel
We, the U.S. Fish and Wildlife Service (Service), announce the availability of the approved recovery plan for the scaleshell mussel (Leptodea leptodon). The endangered scaleshell mussel is now consistently found in only the Meramec, Bourbeuse, and Gasconade Rivers in Missouri. This plan includes specific recovery objectives and criteria to achieve removal of the species from the protections of the Endangered Species Act (Act).

We (Fish and Wildlife Service) will ask the Office of Management and Budget (OMB) to approve the information collection (IC) described below. As required by the Paperwork Reduction Act of 1995 and as part of our continuing efforts to reduce paperwork and respondent burden, we invite the general public and other Federal agencies to take this opportunity to comment on this IC. This IC is scheduled to expire on November 30, 2010. We may not conduct or sponsor and a person is not required to respond to a collection of information unless it displays a currently valid OMB control number.
Endangered and Threatened Wildlife and Plants; Spectacled Eider (Somateria fischeri): Initiation of 5-Year Status Review
We, the U.S. Fish and Wildlife Service (Service), announce the initiation of a 5-year status review for the spectacled eider (Somateria fischeri), a bird species listed as threatened under the Endangered Species Act of 1973, as amended (Act). We conduct 5-year reviews to ensure that our classification of each species as threatened or endangered on the List of Endangered and Threatened Wildlife and Plants is accurate. We request any new information on this species that may have a bearing on its classification as threatened. Based on the results of this 5-year review, we will make a finding on whether this species is properly classified under the Act.
Endangered and Threatened Wildlife and Plants; 12-month Finding on a Petition To List the Mountain Whitefish in the Big Lost River, Idaho, as Endangered or Threatened
We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to list the mountain whitefish (Prosopium williamsoni) in the Big Lost River, Idaho, as endangered or threatened under the Endangered Species Act of 1973, as amended. After review of all available scientific and commercial information, we find that the mountain whitefish in the Big Lost River does not constitute a listable entity under the Act and, therefore, listing is not warranted. However, we ask the public to continue to submit to us any new information that becomes available concerning the taxonomy, biology, ecology, and status of the mountain whitefish in the Big Lost River, and to support cooperative conservation of mountain whitefish within its historical range in the Big Lost River.

We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list a stonefly (Isoperla jewetti) and a mayfly (Fallceon eatoni) as threatened or endangered under the Endangered Species Act of 1973, as amended. Based on our review, we find that the petition does not present substantial information indicating that listing either of the species may be warranted at this time. However, we ask the public to submit to us any new information that becomes available concerning the status of, or threats to, the stonefly or the mayfly or their habitat at any time.
