We, the U.S. Fish and Wildlife Service (USFWS), intend to prepare an Environmental Impact Statement (EIS), under the National Environmental Policy Act (NEPA) regarding an application from Radar Ridge LLC for an incidental take permit for take of the threatened marbled murrelet (Brachyramphus marmoratus) in accordance with the Endangered Species Act of 1973, as amended (Act). Radar Ridge LLC is proposing to construct and operate the Radar Ridge Wind Project near Naselle, Washington. The project would consist of up to 32 wind turbines with a generating capacity of 82 megawatts (MW) of electricity. Power generated by the wind turbines would be transmitted to the existing Bonneville Power Administration substation at Naselle, Washington. We are furnishing this notice to announce the initiation of a 30-day public scoping period, during which we invite other agencies, and the public, to provide comments on the range of alternatives and scope of issues to be included in the EIS.

We, the U.S. Fish and Wildlife Service, published a final rule in the Federal Register on October 27, 2003, to create regulations governing migratory bird rehabilitation in the United States. Before creation of those regulations, rehabilitators were required to obtain a special purpose permit to engage in rehabilitation activities. The language in the final paragraph of the 2003 regulations dealt with the transition of special purpose permit holders to operation under the new rehabilitation permit regulations. This paragraph is no longer relevant, so we remove it from the regulation.

We annually prescribe outside limits (frameworks) within which States may select hunting seasons. This proposed rule provides the regulatory schedule, describes the proposed regulatory alternatives for the 2010-11 duck hunting seasons, requests proposals from Indian tribes that wish to establish special migratory game bird hunting regulations on Federal Indian reservations and ceded lands, and requests proposals for the 2011 spring and summer migratory bird subsistence season in Alaska. Migratory game bird hunting seasons provide opportunities for recreation and sustenance; aid Federal, State, and tribal governments in the management of migratory game birds; and permit harvests at levels compatible with migratory game bird population status and habitat conditions.
