Non-Competitive Sale of Public Lands, Tuolumne County, California
The Bureau of Land Management (BLM) proposes a direct (non- competitive) sale of approximately 1.59 acres of public land in Tuolumne County, California pursuant to Sections 203 and 209 of the Federal Land Policy and Management Act of October 21, 1976 (90 Stat. 2750-51; 43 U.S.C. 1713, and 90 Stat. 2757-58, 43 U.S.C. 1719), and the Federal Land Transaction Facilitation Act of July 25, 2000 (Pub. L., 106-248), at not less than appraised market value. The approved appraised market value has been determined to be $15,000.00 for approximately 1.59 acres. The following described public land has been determined to be suitable for direct (non-competitive) sale to Frank and Ana M. Rocha pursuant to Section 203 of the Federal Land Policy and Management Act of 1976 (FLPMA). This sale will resolve an inadvertent trespass by Frank Rocha.
Information Collection Renewal to Be Sent to the Office of Management and Budget (OMB) for Approval Under the Paperwork Reduction Act; 1018-0113; Grants Program Authorized by the Neotropical Migratory Bird Conservation Act (NMBCA)
We (Fish and Wildlife Service, Service) plan to send a request to OMB to renew approval for the collection of information described below under the provisions of the Paperwork Reduction Act of 1995. We use the information collected to conduct our NMBCA grants program in the manner prescribed by that Act. We also use the information to comply with Federal reporting requirements for grants awarded under the program.
Battle Creek Salmon and Steelhead Restoration Project, Tehama and Shasta Counties, CA
Pursuant to section 102(2)(c) of the National Environmental Policy Act of 1969 (NEPA) and Public Resources Code, sections 21000- 21177 of the California Environmental Quality Act (CEQA), the Bureau of Reclamation (Reclamation), the lead Federal agency; the Federal Energy Regulatory Commission (FERC), a cooperating Federal agency; and the California State Water Resources Control Board (State Water Board), the lead State agency; have prepared a joint Final Environmental Impact Statement/Environmental Impact Report (Final EIS/EIR) for the Battle Creek Salmon and Steelhead Restoration Project (Restoration Project). The Restoration Project proposed action considered by the lead agencies is the five-dam removal alternative that includes the decommissioning and removal of five small hydropower diversion dams, construction of new fish screens at the intakes and fish ladders at three other dams, and the modification of several hydropower facilities to ensure continued hydropower operations. This action will require a FERC license amendment of the Battle Creek Hydroelectric Project, owned and operated by Pacific Gas and Electric Company (PG&E).
Privacy Act of 1974, As Amended; Addition of a New System of Records
The Office of the Secretary, Department of the Interior is issuing public notice of its intent to add a new Privacy Act system of records to its inventory of records systems subject to the Privacy Act of 1974 (5 U.S.C. 552a). This action is necessary to meet the requirements of the Privacy Act to publish in the Federal Register notice of the existence and character of records systems maintained by the agency (5 U.S.C. 552a(e)(4)). Notice of Proposed Supplementary Rules; Recreation Area Conditions of Use; North Fruita Desert; Mesa County, CO
The Bureau of Land Management (BLM), Grand Junction Field Office, is publishing proposed supplementary rules regulating the conduct of certain activities on all public lands within the North Fruita Desert Special Recreation Management Area (SRMA). These proposed supplementary rules notify the public that certain activities are no longer allowed in the North Fruita Desert, and include, but are not limited to the following: Prohibition of fires outside of designated fire rings within the designated campground in the bicycle emphasis area, required use of fire pans outside of the mountain bike emphasis area, prohibition of discharge of dangerous weapons within the mountain bike emphasis area, prohibition of camping outside of designated camping sites within the mountain bike emphasis area, limiting all motorized and mechanized vehicle travel within the area to designated routes, the seasonal closure of certain routes, prohibition of possession or use of firewood containing nails or other metal hardware, and the prohibition on shooting any glass objects.

The Bureau of Land Management (BLM)'s Siuslaw Resource Area is publishing these final supplementary rules for use on public lands within the West Eugene Wetlands in the Siuslaw Resource Area, Eugene District, Lane County, Oregon. The final supplementary rules address issues of conduct for such things as occupancy, motor vehicle use, firearms and campfires. The final supplementary rules are needed in order to protect the area's natural resources and provide for public health and safety. The rules are needed in order to promote consistency with the ordinances that govern adjacent City of Eugene lands.

Notice of Seasonal Closure of Certain Public Lands Referred to as the Serpentine Area of Critical Environmental Concern (ACEC), Located in the Southern Portion of San Benito County and Western Fresno County, Central Coast Region of California, to All Types of Motorized and Non-Motorized Recreation Use
Pursuant to 43 Code of Federal Regulations (CFR) subpart 8364, notice is hereby given that the Bureau of Land Management (BLM), Hollister Field Office will seasonally restrict public access to certain BLM-administered public lands during the period of June 4, 2005 through October 15, 2005. This seasonal closure is needed to ensure visitor safety and protect public land users from potential health risks associated with naturally occurring asbestos found within the closure area. The BLM may also implement a visitor use permit system to control public access during the period October 16-June 1. A permit system will provide an opportunity to educate the public on the risks related to recreation use in areas of naturally occurring asbestos.
State of Arizona Resource Advisory Council Meeting
This notice announces a meeting and tour of the Arizona Resource Advisory Council (RAC). The business meeting will beheld on August 23, 2005, in Safford, Arizona, at the Manor House located at 415 E. Highway 70 in Safford. It will begin at 9:30 a.m. and conclude at 4:30 p.m. The agenda items to be covered include: Review of the May 3, 2005 Meeting Minutes; BLM State Directors' Update on Statewide Issues; Presentations on the Gila Watershed Council, San Simon Watershed, Arizona Land use Planning Updates, Saginaw Hill Update; and RAC Questions on Written Reports from BLM Field Managers; Field Office Rangeland Resource Team proposals; Reports by the Standards and Guidelines, Recreation, Off-Highway Vehicle Use, Public Relations, Land Use Planning and Tenure, and Wild Horse and Burro Working Groups; Reports from RAC members; and Discussion of future meetings. BLM will highlight the San Simon Watershed Project, Hotwell Dunes Off-Highway Vehicle Area, and some of the areas paleontological resources. Pelican Island National Wildlife Refuge
The Fish and Wildlife Service announces that a Draft Comprehensive Conservation Plan and Environmental Assessment for Pelican Island National Wildlife Refuge are available for review and comment. The National Wildlife Refuge System Administration Act of 1966, as amended by the National Wildlife Refuge System Improvement Act of 1997, requires the Service to develop a comprehensive conservation plan for each national wildlife refuge. The purpose in developing a comprehensive conservation plan is to provide refuge managers with 15-year strategy for achieving refuge purposes and contributing toward the mission of the National Wildlife Refuge System, consistent with sound principles of fish and wildlife management, conservation, legal mandates, and Service policies. In addition to outlining broad management direction on conserving wildlife and their habitat, plans identify wildlife-dependent recreational opportunities available to the public, including opportunities for hunting, fishing, wildlife observation, wildlife photography, and environmental education and interpretation.
Pocosin Lakes National Wildlife Refuge
Notice is hereby given that under Section 28 of the Mineral Leasing Act of 1920 (41 Stat. 449: 30 U.S.C. 185), as amended by Public Law 93-153, the Eastern North Carolina Natural Gas Company has applied for a permit to construct an 8-inch natural gas pipeline in a 35 foot wide right-of-way. The right-of-way will start at where Canal E Road enters Pungo Unit of the Pocosin Lakes National Wildlife Refuge and running approximately for 8.1 miles. This pipeline right-of-way will be on, under, and across a strip of land lying in Washington and Hyde Counties, in the State of North Carolina. The Fish and Wildlife Service is currently considering the merits of approving this application.

Request for Public Comments on a Proposed New Information Collection To Be Submitted to OMB for Review Under the Paperwork Reduction Act
The collection of information referred herein applies to a World-Wide Web site questionnaire to be placed on the U.S. Geological Survey NWISWeb Web site (https://waterdata.usgs.gov/nwis). The optional survey will assist in identifying the types of customers who use the NWISWeb system, their needs and their satisfaction levels. In particular it will request detailed feedback from users who use the NWISWeb to electronically collect the system's data, so that their needs can be incorporated into future changes to NWISWeb. Notice of Intent To Prepare an Environmental Impact Statement for Geothermal Leasing for the Truckhaven and Superstition Mountains
Pursuant to Section 102(2)(c) of the National Environmental Policy Act (NEPA), and 42 U.S.C. 4321 et seq., the Bureau of Land Management (BLM) will prepare an Environmental Impact Statement (EIS) to analyze the proposed leasing of approximately 16,640 acres of BLM- managed public lands for geothermal exploration, development, and utilization in the Truckhaven and Superstition Mountain areas located in Western Imperial County, California. The leasing of public lands for geothermal resources is consistent with the California Desert Plan. Comments are being solicited to help identify significant issues or concerns related to the proposed action, determine the scope of issues, and identify and refine alternatives to the proposed action.
Onshore Oil and Gas Operations; Federal and Indian Oil and Gas Leases; Onshore Oil and Gas Order Number 1, Approval of Operations
This proposed rule would revise existing Onshore Oil and Gas Order Number 1, which was published in the October 21, 1983, edition of the Federal Register. The Order provides the requirements necessary for the approval of all proposed oil and gas exploratory, development, or service wells on all Federal and Indian (except Osage tribe) onshore oil and gas leases, including leases where the surface is managed by the U.S. Forest Service (FS). It also covers most approvals necessary for subsequent well operations, including abandonment. The revision is necessary due to provisions of the 1987 Federal Onshore Oil and Gas Leasing Reform Act (Reform Act), legal opinions, court cases since the Order was issued, and other policy and procedural changes. The revised Order would address the submittal of a complete Application for Permit to Drill or Deepen package (APD), including a Drilling Plan, Surface Use Plan of Operations, evidence of bond coverage and Operator Certification.

Endangered and Threatened Wildlife and Plants; 5-Year Review of 13 Southeastern Species
The U.S. Fish and Wildlife Service (Service) announces a 5- year review of the Bachman's warbler (Vermivora bachmanii), Conasauga logperch (Percina jenkinsi), Cumberland bean (Villosa trabalis), speckled pocketbook (Lampsilis streckeri), little amphianthus (Amphianthus pusillus), hairy rattleweed (Baptisia arachnifera), Geocarpon minimum (no common name), black-spored quillwort (Isoetes melanospora), mat-forming quillwort (Isoetes tegetiformans), white- haired goldenrod (Solidago albopilosa), Short's goldenrod (Solidago shortii), persistent trillium (Trillium persistens), and relict trillium (Trillium reliquum) under section 4(c)(2) of the Endangered Species Act of 1973, as amended (Act). The purpose of reviews conducted under this section of the Act is to ensure that the classification of species as threatened or endangered on the List of Endangered and Threatened Wildlife and Plants (50 CFR 17.11 and 17.12) is accurate. The 5-year review is an assessment of the best scientific and commercial data available at the time of the review.

In accordance with the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.), the Bureau of Reclamation (Reclamation) intends to submit a request for renewal of an existing approved information collection form, Right-of-Use Application (Form 7-2540), to the Office of Management and Budget (OMB). Before submitting this revised Right- of-Use Application form (application) to the Office of Management and Budget for review of the information collection requirements, Reclamation requests public comments on specific aspects of the application form.
Notice of Intent to Conduct Public Scoping Meetings and to Prepare an Environmental Impact Statement Related to the Family Forest Habitat Conservation Plan

Central Utah Project Completion Act
Pursuant to Section 102(2)(C) of the National Environmental Policy Act (NEPA) of 1969, as amended; Public Law 102-575, Central Utah Project Completion Act (CUPCA), as amended; a July 2, 1999, Federal Register notice (FR Doc. 99-16852); and a March 19, 2004, Federal Register notice (FR Doc. 04-6175); the Department of the Interior is making available a Final EA and FONSI for the execution of a lease of power privilege contract and the construction, operation, and maintenance of a non-federal hydroelectric generation facility on Jordanelle Dam, Bonneville Unit, Central Utah Project and associated power transmission lines and facilities. Through a competitive selection process the joint application of the Central Utah Water Conservancy District (District) and Heber Light and Power (HL&P) was selected as the potential lessee to develop hydropower at Jordanelle Dam. Construction and generation of power will be accomplished by the non-federal partnership of the District and HL&P through a lease of power privilege with the United States. A lease contract will be executed among the District, HL&P, and the Department, which defines the development, operation, and maintenance of a hydroelectric generation facility at Jordanelle Dam, consistent with the purposes and operations of the Bonneville Unit. Development of a hydroelectric facility will not change or modify the operation of Jordanelle Dam and Reservoir.
Receipt of an Application for an Incidental Take Permit for the Florida Scrub-jay Resulting From Construction of a Single-Family Residence in Sarasota County, FL
Results Home Buyer Inc. (Applicant) requests an incidental take permit (ITP) pursuant to section 10(a)(1)(B) of the Endangered Species Act of 1973 (U.S.C. 1531 et seq.), as amended (Act). The Applicant anticipates removal of about 0.18 acre of Florida scrub-jay (Aphelocoma coerulescens) (scrub-jay) foraging, sheltering, and possibly nesting habitat, incidental to lot preparation for the construction of a single-family residence and supporting infrastructure in Venice, Sarasota County, Florida (project). The take of one family of scrub-jays, consisting of up to four individuals, could occur as a result of the Applicant's proposed activities. The Applicant's Habitat Conservation Plan (HCP) describes the mitigation and minimization measures proposed to address the effects of the project to the scrub-jay. These measures are outlined in the SUPPLEMENTARY INFORMATION section below. The Service has determined that the Applicant's proposal, including the proposed mitigation and minimization measures, will individually and cumulatively have a minor or negligible effect on the species covered in the HCP. Therefore, the ITP is a ``low-effect'' project and qualifies as a categorical exclusion under the National Environmental Policy Act (NEPA), as provided by the Department of Interior Manual (516 DM 2, Appendix 1 and 516 DM 6, Appendix 1). The Service announces the availability of the ITP application, HCP, and Screening Form for Low-Effect HCP Determinations for this incidental take application. Copies of the ITP application, HCP, and Screening Form may be obtained by making a request to the Regional Office (see ADDRESSES). Requests must be in writing to be processed. This notice is provided pursuant to section 10 of the Act and NEPA regulations (40 CFR 1506.6).
California Bay-Delta Public Advisory Committee Public Meetings
In accordance with the Federal Advisory Committee Act, the California Bay-Delta Public Advisory Committee (Committee) will meet on August 10, September 7, October 12, and November 9, 2005. These meetings will focus on the State's intense effort to fulfill the Governor's mandate for an independent fiscal and management review of the CALFED Bay-Delta Program by the end of 2005. Discussions will include a refocus of CALFED on resolving conflicts in the Delta, priority setting, and development of an action plan to finance CALFED over the next 10 years.

We, the U.S. Fish and Wildlife Service (Service), announce the reopening of the public comment period for the status review initiated by the 90-day finding on a petition to list Gentry indigo bush (Dalea tentaculoides). The original public comment period closed on April 4, 2005. This action will allow all interested parties an opportunity to submit information on the status of the species under the Endangered Species Act of 1973, as amended (Act).

To comply with the Paperwork Reduction Act (PRA) of 1995, we are inviting comments on a collection of information that we will submit to the Office of Management and Budget (OMB) for review and approval. The new title of this information collection request (ICR) is titled ``30 CFR PART 206PRODUCT VALUATION, subpart CFederal Oil and subpart DFederal Gas (Form MMS-4393, Request to Exceed Regulatory Allowance Limitation).'' We changed the title of this information collection request (ICR) to clarify the regulatory language we are covering under 30 CFR part 206, and to incorporate relevant portions of three previous ICRs. On February 15, 2005, a notice was published in the Federal Register (Vol. 70, No. 30, FR 7754), that an application had been filed with the U.S. Fish and Wildlife Service (Service) by the Triview Metropolitan District and Forest Lakes Metropolitan District for a permit to incidentally take, pursuant to section 10(a)(1)(B) of the Endangered Species Act of 1973 (16 U.S.C. 1539) as amended, Preble's meadow jumping mouse (Zapus hudsonius preblei), pursuant to the terms of the ``Low-Effect Habitat Conservation Plan for Issuance of an Endangered Species Act Section 10(a)(1)(B) Permit for the Incidental Take of the Preble's Meadow Jumping Mouse (Zapus hudsonius preblei) for the Monument Creek Interceptor Tie-In Along Jackson Creek, El Paso County, Colorado.'' Notice is hereby given that on June 30, 2005, as authorized by the provisions of the Endangered Species Act, the Service issued a permit (TE-097228-0) to the above named party subject to certain conditions set forth therein. The permit was granted only after the Service determined that it was applied for in good faith, that granting the permit will not be to the disadvantage of the threatened species, and that it will be consistent with the purposes and policy set forth in the Endangered Species Act, as amended. Notice is hereby given of contractual actions that have been proposed to the Bureau of Reclamation (Reclamation) and are new, modified, discontinued, or completed since the last publication of this notice on April 19, 2005. This notice is one of a variety of means used to inform the public about proposed contractual actions for capital recovery and management of project resources and facilities consistent with section 9(f) of the Reclamation Project Act of 1939. Notice of Public Meeting, Coos Bay Resource Advisory Committee Meeting
The BLM Coos Bay District Resource Advisory Committee is scheduled to meet on August 4, 2005 from 9 a.m. to 4:30 p.m. at the BLM Coos Bay District Office. The BLM Office is located at 1300 Airport Lane in North Bend, Oregon. The purpose of this meeting will be for the BLM Coos Bay District Resource Advisory Committee to recommend for funding Title II projects, as identified under the Act. The BLM Coos Bay District Resource Advisory Committee meeting is open to the public and there will be an opportunity for the public to comment at approximately 11 a.m. at this meeting. The BLM Coos Bay District Resource Advisory Committee may also meet on August 11, 2005 for the same purpose. The need for this meeting will be dependent upon the progress made in making recommendations at the meeting on August 4. The scheduled meeting time and location for the August 11 meeting will be the same as for the meeting scheduled on August 4.

Draft Comprehensive Conservation Plan/Environmental Impact Statement for the Sweetwater Marsh and South San Diego Bay Units of the San Diego Bay National Wildlife Refuge
The U.S. Fish and Wildlife Service (Service) announces that a Draft Comprehensive Conservation Plan/Environmental Impact Statement (Draft CCP/EIS) for the Sweetwater Marsh and South San Diego Bay Units of the San Diego Bay National Wildlife Refuge is available for review and comment. This Draft CCP/EIS has been prepared pursuant to the National Environmental Policy Act of 1969 and is designed to address the Service's obligation under the National Wildlife Refuge System Administration Act of 1966, as amended by the National Wildlife Refuge System Improvement Act of 1997. The Draft CCP/EIS describes the Service's proposal for managing these Refuge Units over the next 15 years. Also available for review and public comment in the Draft CCP/ EIS are draft compatibility determinations for several public uses and a draft Predator Management Plan.
California Bay-Delta Public Advisory Committee Charter Renewal
This notice is published in accordance with Section 9(a)(2) of the Federal Advisory Committee Act of 1972 (Pub. L. 92-463). Following consultation with the General Services Administration, notice is hereby given that the Secretary of the Interior (Secretary) is renewing the charter for the California Bay-Delta Public Advisory Committee (Committee). The purpose of the Committee is to provide advice and recommendations to the Secretary on implementation of the CALFED Bay- Delta Program (Program) as described in the Programmatic Record of Decision which outlines the long-term comprehensive solution for addressing the problems affecting the San Francisco Bay-Sacramento-San Joaquin Delta Estuary, Public Law 108-361, and other applicable law. Specific responsibilities of the Committee include: (1) Making recommendations on annual priorities and coordination of Program actions to achieve balanced implementation of the Program elements; (2) providing recommendations on effective integration of Program elements to provide continuous, balanced improvement of each of the Program objectives (ecosystem restoration, water quality, levee system integrity, and water supply reliability); (3) evaluating implementation of Program actions, including assessment of Program area performance; (4) reviewing and making recommendations on Program Plans and Annual Reports describing implementation of Program elements as set forth in the ROD to the Secretary; (5) recommending Program actions taking into account recommendations from the Committee's subcommittees; and (6) liaison between the Committee's subcommittees, the State and Federal agencies, the Secretary, and the Governor. The Committee consists of 20 to 30 members who are appointed by the Secretary, in consultation with the Governor.
