TSA PreCheck® Application Program Fee
The Transportation Security Administration (TSA) administers the TSA PreCheck[supreg] Application Program, in which individuals determined to be low-risk travelers may receive expedited airport security screening. To apply for TSA Precheck[supreg] eligibility, individuals submit biometric and biographic information that TSA uses to verify identity and conduct a security threat assessment and submit fees to cover the costs associated with the program. TSA announces in this Notice that, under certain circumstances, the membership renewal fee will be reduced by $11.25 due to changes related to the Federal Bureau of Investigation (FBI) fee for criminal history checks.

Enhancing Surface Cyber Risk Management
The Transportation Security Administration (TSA) is proposing to impose cyber risk management (CRM) requirements on certain pipeline and rail owner/operators and a more limited requirement, on certain over-the-road bus (OTRB) owner/operators, to report cybersecurity incidents. With the proposed addition of requirements applicable to pipeline facilities and systems, TSA is also proposing that a requirement to have a Physical Security Coordinator and report significant physical security concerns be extended to the same facilities and systems. Finally, TSA is proposing clarifications and reorganization of other regulatory requirements necessitated by these changes.

Minimum Standards for Driver's Licenses and Identification Cards Acceptable by Federal Agencies for Official Purposes; Phased Approach for Card-Based Enforcement
This proposed rule would ensure that Federal agencies have appropriate flexibility to implement the card-based enforcement provisions of the REAL ID regulations after the May 7, 2025, enforcement deadline by explicitly permitting agencies to implement card-based enforcement in phases. This rulemaking proposes that agencies may implement the card-based enforcement provisions through a phased enforcement plan if they determine it is appropriate upon consideration of relevant factors including security, operational feasibility, and public impact. The proposed rule would also require agencies to coordinate their plans with DHS, make the plans publicly available, and achieve full enforcement by May 5, 2027.

TSA erroneously omitted the sentence, "TSA is revising the collection to eliminate two previously approved voluntary surveys, TSA PreCheck Experience survey and Marketing survey, but will continue to conduct the post enrollment, post renewal, and non-renewal surveys." This document adds the sentence.
Hazardous Materials Endorsement (HME) Threat Assessment Program Security Threat Assessment Fees for Non-Agent States
The Transportation Security Administration (TSA) administers the Hazardous Materials Endorsement (HME) vetting program. TSA conducts a security threat assessment (STA) of HME applicants in accordance with statutory requirements and collects fees to recover TSA's costs to conduct the STA and administer the program. Some States have elected to collect the information and fees from the applicant directly, and transmit such information and fees to TSA for the STA. In this notice, TSA announces that the fee to conduct the STA for these States will be increased to fully recover the costs to administer the program.

Air Cargo Security Threat Assessments; Technical Amendment

Civil Monetary Penalty Adjustments for Inflation
In this final rule, DHS adjusts for inflation its civil monetary penalties for 2024, in accordance with the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 and Executive Office of the President (EOP) Office of Management and Budget (OMB) guidance. DHS is also accounting for additional civil monetary penalties that the U.S. Coast Guard is statutorily authorized to collect. The new penalty amounts will be effective for penalties assessed after June 28, 2024 whose associated violations occurred after November 2, 2015.

Flight Training Security Program
The Transportation Security Administration (TSA) is finalizing the 2004 interim final rule (IFR) that established the Flight Training Security Program (FTSP) (formerly known as the Alien Flight Student Program). The FTSP implements a statutory requirement under the Aviation and Transportation Security Act, as amended by the Vision 100- Century of Aviation Reauthorization Act, to prevent flight schools from providing flight training to any individuals who are not U.S. citizens or nationals, and who have not been vetted by the Federal Government to determine whether the flight training candidate is a security threat. The rule also requires security awareness training for certain flight training provider employees. In finalizing this rule, TSA addresses the comments on the IFR, recommendations from the Aviation Security Advisory Committee, and additional comments received during a reopened comment period. TSA also is eliminating years of programmatic guidance and clarifications by codifying current and relevant information into the regulatory text. Where possible, TSA is modifying the program to make it more effective and less burdensome. Finally, TSA is making other technical modifications to its regulations to consolidate in one location the agency's inspection authority.

Frequency of Renewal Cycle for Indirect Air Carrier Security Programs
The Transportation Security Administration (TSA) is modifying its regulations to reduce the frequency of renewal applications by indirect air carriers (IACs). Rather than requiring these entities to submit an application to renew their security program each year, TSA now requires renewal once every 3 years. This modification reduces the burden of compliance without a negative impact on security.
