National Assessment Governing Board; Meeting
The notice sets forth the schedule and proposed agenda of a forthcoming meeting of the National Assessment Governing Board. This notice also describes the functions of the Board. Notice of this meeting is required under section 10(a)(2) of the Federal Advisory Committee Act. This document is intended to notify members of the general public of their opportunity to attend. Privacy Act of 1974; Computer Matching Program
Section 421(a)(1) of the Controlled Substances Act (21 U.S.C. 862(a)(1)) includes provisions regarding the judicial denial of Federal benefits. Section 421 of the Controlled Substances Act, which was originally enacted as section 5301 of the Anti-Drug Abuse Act of 1988, but amended and redesignated as section 421 of the Controlled Substances Act by section 1002(d) of the Crime Control Act of 1990, Public Law 101-647 (hereinafter referred to as ``Section 5301'') authorizes Federal and State judges to deny certain Federal benefits (including student financial assistance under Title IV of the Higher Education Act of 1965, as amended (HEA)) to individuals convicted of drug trafficking or possession. In order to ensure that HEA Title IV student financial assistance is not awarded to individuals subject to denial of benefits under court orders issued pursuant to section 5301, the Department of Justice and the Department of Education implemented a computer matching program. The 18-month computer matching agreement (CMA) was recertified for an additional 12 months on December 18, 2004. The 12-month recertification of the CMA will automatically expire on December 18, 2005. The Department of Education must continue to obtain from the Department of Justice identifying information regarding individuals who are the subject of section 5301 denial of benefits court orders. The purpose of this notice is to announce the continued operation of the computer matching program and to provide certain required information concerning the computer matching program. In accordance with the Privacy Act of 1974 (5 U.S.C. 552a), as amended by the Computer Matching and Privacy Protection Act of 1988 (Pub. L. 100-503), Office of Management and Budget (OMB) Guidelines on the Conduct of Matching Programs (see 54 FR 25818, June 19, 1989), and OMB Circular A-130, the following information is provided: 1. Names of Participating Agencies. The Department of Education (ED) (recipient agency) and the Department of Justice (DOJ) (source agency). 2. Purpose of the Match. This matching program is designed to assist ED in enforcing the sanctions imposed under section 5301. 3. Authority for Conducting the Matching Program. Under section 5301, ED must deny Federal benefits to any individual upon whom a Federal or State court order has imposed a penalty denying eligibility for those benefits. Student financial assistance under Title IV of the HEA is a Federal benefit under section 5301 and ED must, in order to meet its obligations under the HEA, have access to information about individuals who have been declared ineligible under section 5301. The President's plan for immediate implementation of section 5301 (Pub. L. 100-690), as transmitted to the Congress on August 30, 1989 in accordance with section 5301(g), directed DOJ to act as an information clearinghouse for Federal agencies. While DOJ provides information about section 5301 individuals who are ineligible for Federal benefits to the General Services Administration (GSA) for inclusion in GSA's List of Parties Excluded from Federal Procurements and Nonprocurement Programs, DOJ and ED have determined that matching against the DOJ database is more efficient and effective than access to the GSA List. The DOJ database has specific information about the Title IV, HEA programs for which individuals are ineligible as well as the expiration of the debarment period, making the DOJ database more complete than the GSA List. Both of these elements are essential for a successful match. 4. Categories of Records and Individuals Covered by the Match. ED will submit for verification, records from its Central Processing System files (Federal Student Aid Application File (18-11-01)), the social security number (SSN), and other identifying information for each applicant for HEA Title IV student financial assistance. ED will use the SSN, date of birth, and the first two letters of an applicant's last name for the match. The DOJ Denial of Federal Benefits Clearinghouse System (DEBAR) (OJP-0013) contains the names, social security numbers, dates of birth, and other identifying information regarding individuals convicted of Federal or State offenses involving drug trafficking or possession of a controlled substance who have been denied Federal benefits by Federal or State courts. This system of records also contains information concerning the specific program or programs for which benefits have been denied, as well as the duration of the period of ineligibility. DOJ will make available for the matching program the records of only those individuals who have been denied Federal benefits under one or more of the Title IV, HEA programs. 5. Effective Dates of the Matching Program. The matching program will become effective on December 19, 2005; or 40 days after a report concerning the matching program has been transmitted to OMB and transmitted to the Congress along with a copy of the CMA; or 30 days after publication of this notice in the Federal Register, whichever date is last. The matching program will continue for 18 months after the effective date of the CMA and may be extended for an additional 12 months thereafter, if the conditions specified in 5 U.S.C. 552a(o)(2)(D) have been met. 6. Privacy Act of 1974; System of Records-Presidential Scholars Program Files and PSAonline Application System (18-06-03)
In accordance with the Privacy Act of 1974, as amended (Privacy Act), we publish this notice to amend the system of records entitled ``Presidential Scholars Program Files and PSAonline Application System'' (18-06-03) to reflect the fact that the general support system for the ``PSAonline'' application system has changed from a contractor site to the U.S. Department of Education's Network (EDNet). This change in the host of the online system will increase the security of the information contained in this system of records. More specifically, we are amending the system of records, last published in the Federal Register on December 3, 2003 (68 FR 67782), in the following ways: (1) By listing the Office of Chief Information Officer as the central system location. (2) By updating the sections on storage and safeguards to reflect current retention and safety measures. (3) By adding an appendix listing additional system locations.

On September 1, 2005, we published in the Federal Register (70 FR 52084) a notice inviting applications for new awards for FY 2006 for the Technology and Media Services for Individuals with Disabilities Steppingstones of Technology Innovation for Children with Disabilities Competition. The notice contained an incorrect time period for an individual to have completed and graduated from a doctoral program. On page 52085, second column, second paragraph of paragraph (f), the information in the parenthetical is corrected to read ``(i.e., for FY 2006 awards, projects may support individuals who completed and graduated from a doctoral program no earlier than the 2002-2003 academic year).''

Student Assistance General Provisions, Federal Perkins Loan, Federal Work-Study, Federal Supplemental Educational Opportunity Grant, Federal Family Education Loan, William D. Ford Federal Direct Loan, Federal Pell Grant, and Leveraging Educational Assistance Partnership Programs
The Secretary announces an extension of the deadline dates for specific filing and reporting activities, including those published in the Federal Register on March 22, 2005, (70 FR 14450), April 13, 2005 (70 FR 19423), and June 7, 2005, (70 FR 33134). The Secretary takes this action as a result of the extensive damage and disruption in the southern United States caused by Hurricane Rita. The new dates apply only to (1) institutions or third-party servicers that are located in a federally-declared disaster area and that were adversely affected by Hurricane Rita, and (2) applicants that are adversely affected by Hurricane Rita. The Secretary notes that the deadline extensions in this notice supplement the extensions published in the Federal Register on September 9, 2005, (70 FR 53640) for parties adversely affected by Hurricane Katrina. In addition, the Secretary reminds affected parties that additional guidance and regulatory relief are provided in Dear Colleague Letter GEN-04-04, available at: https://www.ifap.ed.gov/dpcletters/ GEN0404.html.

Direct Grant Programs
The Secretary extends the deadline dates for the submission of applications for several programs. In all of the affected competitions the Secretary is making new awards for fiscal year (FY) 2006. The Secretary takes this action to allow more time for the preparation and submission of applications by potential applicants who have been affected by Hurricanes Katrina and/or Rita and are located in Louisiana, Texas, Alabama, Mississippi, and Florida. The reopening and extension of the programs or competitions are intended to help potential applicants compete fairly with other applicants under these programs.

Notice of Public Hearing
The National Assessment Governing Board is announcing a public hearing on October 25, 2005 to obtain comment on the draft 2009 Science Framework for the National Assessment of Educational Progress (NAEP). Public and private parties and organizations are invited to present written and/or oral testimony. The forum will be held at the Phoenix Park Hotel, 520 North Capitol Street, NW., Washington, DC from 9:30 a.m. to 3 p.m. Eastern Standard Time. Background: Under Public Law 107-279, the Governing board is responsible for determining the content and methodology of NAEP assessments. The Board also has responsibility for developing ``a process for review of the [NAEP] assessment, which includes the active participation of teachers, curriculum specialists, local school board administrators, parents, and concerned members of the public.'' The draft framework is the result of a comprehensive process involving participants from all these groups. The framework, subject to approval by the Governing Board, describes the content and format for a new NAEP science assessment to be administered beginning in 2009 at grades 4, 8, and 12. The frame work covers a broad range of scientific content and practices in Physical, Life, and Earth/Space sciences. It was developed by panels of educators, scientists, and interested members of the public through a widely-inclusive process. The draft framework is available on the Web site of the Governing Board at https://www.nagb.org. Other related material on the Governing Board and the National Assessment may be found at this Web site and at https://nces.ed.gov/nationsreportcard. The Board is seeking comment from policymakers, science educators, researchers, state and local school administrators, assessment specialists, parents of children in elementary and secondary schools, and interested members of the public. Representatives of the National Assessment Governing Board will conduct the hearing to receive testimony, and may ask clarifying questions or respond to presentations. Oral presentations should not exceed ten minutes. Testimony will become part of the public record. All views will be considered by the Governing Board Committee when it takes final action on the NAEP 2009 Science Framework, which is anticipated in November 2005.
