The Department of the Navy (DoN) published a final rule in the Federal Register (76 FR 58399) of September 21, 2011, concerning certifications and exemptions under the International Regulations for Preventing collisions at Sea, 1972 (72 COLREGS). The document added an entry to Table Four, paragraph 23, in Sec. 706.2. The existing table has three columns and the proposed entry has four columns. This correcting amendment corrects that information.

The Department of the Navy (DoN)is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (DAJAG) (Admiralty and Maritime Law) has determined that USS FORT WORTH (LCS 3) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

Pursuant to section 102(2)(c) of the National Environmental Policy Act of 1969, as implemented by the Council on Environmental Quality Regulations (40 Code of Federal Regulations parts 1500-1508), and Executive Order 12114, the Department of the Navy (DoN) announces its intent to prepare an Environmental Impact Statement (EIS)/Overseas Environmental Impact Statement (OEIS) to evaluate the potential environmental effects associated with maintaining military readiness training and research, development, testing, and evaluation (hereafter referred to as ``training and testing'') activities conducted in the Mariana Islands Training and Testing (MITT) EIS/OEIS Study Area. The MITT Study Area includes the existing Mariana Islands Range Complex (MIRC), additional areas on the high seas, and a general transit corridor between Hawaii to MITT where training and testing activities may occur. The MIRC is the only major Navy range complex in the Study Area. The DoN is preparing this EIS/OEIS to renew current regulatory permits and authorizations, address current training and testing not covered under existing permits and authorizations, and to obtain those permits and authorizations necessary to support force structure changes and emerging and future training and testing requirements including those associated with new platforms and weapons systems within the MITT Study Area, starting in 2015, thereby ensuring critical Department of Defense (DoD) requirements are met. The DoN will invite the National Marine Fisheries Service, United States (U.S.) Fish and Wildlife Service (Pacific Islands Fish and Wildlife Office), and U.S. Air Force, to be cooperating agencies in preparation of the EIS/OEIS.

In accordance with Section 122(h) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), 42 U.S.C. 9622(h), the Department of the Navy (DoN) gives notice that a proposed Administrative Agreement for the Recovery of Past Costs in the Matter of Marine Corps Logistics Base, Yermo Annex, Barstow, California, DON CERCLA Administrative Docket No. 2011-0001, pertaining to environmental contamination at the Marine Corps Logistics Base in Barstow, California (the ``Site''), located in San Bernardino County, California. In this matter, the DoN served a demand, involving civil claims under Section 107 of CERCLA, 42 U.S.C. 9607, upon CalNev Pipe Line Company (CalNev) for recovery of response costs incurred by the DON at the Site. The proposed Administrative Settlement resolves the DON's claims by requiring CalNev to pay the DoN $500,000 in reimbursement of the DON's past response costs. Pursuant to Section 122(h) of CERCLA, 42 U.S.C. 9622(h), the Department of Justice has provided its approval of this proposed Administrative Settlement. Further, in accordance with this Section 122(i) of CERCLA, 42 U.S.C. 9622(i), the DoN is receiving public comment on this proposed settlement for thirty (30) days from the date of this publication. Pursuant to section (102)(2)(c) of the National Environmental Policy Act (NEPA) of 1969, the regulations implemented by the Council on Environmental Quality (40 Code of Federal Regulations [CFR] parts 1500-1508), the Department of the Navy (DoN) announces its intent to prepare an Environmental Impact Statement (EIS) to evaluate the potential environmental effects associated with the proposed actions at Naval Support Activity (NSA) Bethesda to implement the Congressional mandate in the Fiscal Year (FY) 2010 National Defense Authorization Act (NDAA) to achieve the new statutory world-class standards for military medicine at the Walter Reed National Military Medical Center at Bethesda (WRNMMCB) by providing enduring facilities commensurate in quality, capability and condition as those provided by the Base Realignment and Closure (BRAC) investment and address the space and operational limitations at the Uniformed Services University of the Health Sciences (USUHS). The proposed actions, which will enhance and support but not add to the missions of the installation, medical center or USUHS, include: (1) The demolition of five (5) hospital buildings and reconstruction of a single 5-story facility and associated parking garage, utility capacity upgrades, and temporary medical facilities to provide uninterrupted patient care during construction (Medical Facilities Development) and (2) the expansion of the USUHS and associated parking garage. These proposed actions are two components of the 2012 NSA Bethesda Master Plan that the DoN is currently updating and this EIS analyzes the implementation of these components. The 2012 NSA Bethesda Master Plan reflects ongoing projects previously considered under NEPA as well as potential future development opportunities at NSA Bethesda. The EIS will evaluate the cumulative effects of the proposed actions in the context of the known, ongoing activities and identify the potential programmatic effects of the proposed actions in the context of the potential future development opportunities. Therefore, the EIS will analyze the environmental effects of the 2012 NSA Bethesda Master Plan relative to the implementation of the proposed actions in this EIS. For the potential future development opportunities, the DoN will ensure the appropriate NEPA review is completed at such time as the projects are proposed for implementation. The proposed actions at NSA Bethesda consist of: (1) The Medical Facilities Development, which includes demolition of Buildings 2, 4, 6, 7, and 8 and construction of a single, 5-story replacement building in the medical center core, construction of an associated parking garage, utility capacity upgrades, construction of temporary medical facilities to maintain uninterrupted patient care during construction, and internal renovations to Buildings 1, 3, 5, 9, and 10; and (2) the University Expansion, which includes construction of a new classroom/ research facility and associated parking garage at USUHS. The proposed actions would not add to the existing missions at NSA Bethesda and would occur subsequent to the 2005 BRAC Law mandated relocation of the Walter Reed Army Medical Center's (WRAMC) tertiary (sub-specialty and complex care) medical services to National Naval Medical Center (NNMC) at NSA Bethesda in September 2011. With the relocation, the NNMC will be renamed the WRNMMCB. NSA Bethesda is the action proponent and the DoN is the lead agency for the proposed actions. Joint Task Force National Capital Region Medical (JTF CapMed), NNMC, and USUHS, are tenants of NSA Bethesda and are the stakeholders for these activities. The DoN is initiating a 45-day public scoping period to identify community interests and specific issues to be addressed in the EIS. The public scoping period starts with the publication of this Notice of Intent. The DoN will hold two public scoping meetings to inform the public of the proposed actions and receive comments. Comments, both written and oral, will be collected at each of the two public scoping meetings. Each of the public scoping meetings will consist of an open house session followed by a live presentation and an opportunity for the public to present their comments. To ensure that the full range of issues related to the proposed actions will be addressed, representatives from the DoN will be available to solicit comments from all interested parties during the public scoping meetings. Following future publication of the draft EIS, at a time to be determined, further public meetings will be held to address comments on the draft document. Pursuant to section 102(2)(c) of the National Environmental Policy Act (NEPA) of 1969 as implemented by the Council on Environmental Quality Regulations (40 Code of Federal Regulations [CFR] parts 1500-1508), the Department of the Navy (DoN), with the cooperation of the Bureau of Land Management (BLM), announces its intent to prepare an Environmental Impact Statement/Legislative Environmental Impact Statement (EIS/LEIS) to evaluate the potential environmental effects associated with the continued withdrawal of approximately 1.1 million acres of public land in Kern, Inyo, and San Bernardino counties, California. This public land withdrawal comprises the current North and South ranges at Naval Air Weapons Station China Lake (NAWSCL). The proposed land withdrawal extension will allow the DoN to continue defense-related research, development, test and evaluation (RDT&E) and training missions at NAWSCL, in addition to other land uses. The California Military Lands Withdrawal and Overflights Act of 1994 (Pub. L. 103-433, part of the California Desert Protection Act) withdrew and reserved the lands known then as the China Lake Naval Weapons Center (subsequently renamed NAWSCL) for defense-related purposes for a period of 20 years (until October 14, 2014). The Act provides that the DoN may seek extension of the withdrawal of such lands. As a part of the withdrawal process, the Secretary of the Navy is required to publish a draft EIS addressing the effects of continued withdrawal and hold public hearings in order to receive public comments on the proposal by October 12, 2012. The NAWSCL EIS/LEIS will examine current and proposed land uses in support of the DoN's military mission. The EIS/LEIS will specifically focus on those military land uses granted to the DoN under Public Law 103-433 that include: (1) Use as an RDT&E laboratory; (2) use as a range for air warfare weapons and weapons systems; (3) use as a high hazard training area for aerial gunnery, rocketry, electronic warfare and countermeasures, and tactical maneuvering and air support; (4) geothermal leasing and development, and related power production activities; and, (5) other defense-related purposes. The environmental analysis in the EIS/LEIS will be incorporated in an update to the May 2005 NAWSCL Comprehensive Land Use Management Plan (CLUMP). The CLUMP facilitates NAWSCL in planning for and managing land use and environmental resources on the withdrawn public lands in accordance with the Federal Land Policy and Management Act of 1976 (FLPMA) (43 U.S.C. 1701). The updated CLUMP will include an examination of both military land uses authorized under Public Law 103- 433 and those mission-compatible non-military land uses authorized in the 2005 CLUMP. Dates and Addresses: The DoN is initiating a 90-day public scoping process to identify community interests and specific issues to be addressed in the EIS/LEIS. This public scoping process starts with the publication of this Notice of Intent. Three public scoping meetings will be held to receive oral and/or written comments on issues to be addressed in the EIS/LEIS: 1. Tuesday, July 19, 2011, 6 p.m. to 8 p.m., Historic USO Building, 230 West Ridgecrest Boulevard, Ridgecrest, California 93555; 2. Wednesday, July 20, 2011, 6 p.m. to 8 p.m., Statham Hall, 138 Jackson Street, Lone Pine, California 93545; and 3. Thursday, July 21, 2011, 6 p.m. to 8 p.m., Trona Community Senior Center, 13187 Market Street, Trona, California 93562. The Department of the Navy (DoN) announces the cancellation of its Notice of Intent to prepare a Programmatic Environmental Impact Statement (PEIS) for the proposed Geothermal Development Program, Naval Air Facility El Centro, Imperial County, CA, as published in the Federal Register, May 5, 2008 (73 FR 87). It has been determined that preparation of a PEIS is not appropriate at this time when considering the current project scale and stage of geothermal energy development at Superstition Mountain on Naval Air Facility El Centro. The DoN will develop an internal document known as an environmental and operational feasibility study. This internal document will analyze the environmental and operational framework within which a geothermal development may proceed and will provide the DoN with information required to determine the DoN's geothermal energy program needs at Naval Air Facility El Centro. Should geothermal development be indicated as feasible and a project to be developed, the appropriate level of National Environmental Policy Act analysis and process will be performed.

The Department of the Navy (DoN) is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (DAJAG) (Admiralty and Maritime Law) has determined that USS SAN DIEGO (LPD 22) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.
