Submission for OMB Review; Reporting Purchases From Sources Outside the United States
Under the provisions of the Paperwork Reduction Act, the Regulatory Secretariat Division has submitted to the Office of Management and Budget (OMB) a request to review and approve a revision and renewal of a previously approved information collection requirement regarding reporting purchases from sources outside the United States.
Health Promotion
This final rule removes an unnecessary and outdated Department of Defense (DoD) rule relating to a health promotion program. The majority of the content of this part includes internal DoD policy, which does not require rulemaking. Additionally, since this rule was codified, the General Services Administration (GSA) issued a rule that superseded the public-facing content of this part. Therefore, this part can be removed from the CFR.
Military Lending Act Limitations on Terms of Consumer Credit Extended to Service Members and Dependents
The Department of Defense (Department) is amending its interpretive rule for the Military Lending Act (the MLA). The MLA, as implemented by the Department, limits the military annual percentage rate (MAPR) that a creditor may charge to a maximum of 36 percent, requires certain disclosures, and provides other substantive consumer protections on ``consumer credit'' extended to Service members and their families. On July 22, 2015, the Department amended its regulation primarily for the purpose of extending the protections of the MLA to a broader range of closed-end and open-end credit products (the July 2015 Final Rule). On August 26, 2016, the Department issued the first set of interpretations of that regulation in the form of questions and answers. On December 14, 2017, the Department issued a second set of interpretations of that regulation in the form of amended questions and answers. The Department is now withdrawing the amended question and answer number 2 (Q&A #2), published in the December 14, 2017 Interpretive Rule, which discussed when credit is extended for the purpose of purchasing a motor vehicle or personal property and the creditor simultaneously extends credit in an amount greater than the purchase price of the motor vehicle or personal property. In withdrawing this amended question and answer, the Department is reverting back to the original Q&A #2 published in the August 26, 2016 Interpretive Rule. This will allow the Department to conduct additional analysis on this matter. The Department is also adding a new question and answer to address questions about the use of Individual Taxpayer Identification Numbers to identify covered borrowers in the Department's database.

The USA is rescinding a System of Records, A0385-1040 ASO, Army Safety Management Information System (ASMIS). These records consist of safety investigation case files retrieved by the report identification number, incident date, location, unit identification code, accident classification, or accident description. Personal information is collected during the investigation on individuals involved in or witness to an incident; however, their personal identifiers are not used to maintain or retrieve the records. To maintain the integrity of investigatory material, the USA established specialized procedures to restrict queries to descriptors of the incident, therefore these records are not subject to the Privacy Act of 1974. Individuals involved in or witness to the incident, and other interested parties may request information collected in safety investigations records under the provisions of the Freedom of Information Act (FOIA).

The NGA is rescinding a System of Records, Vehicle Registration and Driver Record Files, B0503-05. This System of Records maintained traffic offenses, incidents, actions taken, and parking permits issued to agency personnel and contractors. All records previously covered by the Vehicle Registration and Driver Record Files have been destroyed in accordance with the policy and direction specified within the SORN.

The NGA is rescinding a System of Records, Alcoholism and Drug Abuse Files, B0901-07. This System of Records maintained documents relating to alcohol and narcotic use, treatment, assistance, and advice provided to NGA personnel. This system is no longer in use at NGA and all records previously contained within the Alcoholism and Drug Abuse Files were destroyed in accordance with the retention and disposition schedule as stated in the SORN. Currently, all records collected relating to drug and alcohol use are covered by the Personnel Vetting Records System, DUSDI 02-DoD and the NGA Enterprise Workforce System, NGA-003 SORNs.

The DIA is rescinding a System of Records, DIA Military Recognition and Awards Files, LDIA 0435. The DIA determined this System of Records was duplicative of the Systems of Records held by the military branches which maintain the official records of military personnel. The DIA decommissioned this System of Records on January 9, 2020 to improve record-keeping efficiency, optimize business processes and better protect military members' privacy. All files within this System of Records were destroyed in accordance with the policies and practices for the retention and disposal of the records. Military service member awards and recognition records are covered by the following SORNs: AF 036 AF PC C (Air Force), A0600-8 AHRC (Army) and N01070-3 (Navy and Marine Corps).

Guidance To Establish Policies for the Agency Levee Safety Program Entitled Engineer Circular 1165-2-218
The U.S. Army Corps of Engineers (USACE) has developed draft agency guidance, entitled Engineer Circular 1165-2-218, to consolidate and formalize policies and procedures for its Levee Safety Program. The intent of the Levee Safety Program is to understand, monitor, and manage flood risk associated with levees over time, provide a framework to sustain long term benefits, and adapt activities and actions based on the dynamic nature of flood risk. USACE is seeking feedback from non-federal levee sponsors, interested associations, Tribes, other federal agencies, and any other interested individuals on this proposed draft guidance document. This notice announces the availability of the draft Engineer Circular for comment. The comment period on the draft document starts with the publication of this notice in the Federal Register and will last for 60 days. Manual for Courts-Martial; Proposed Amendments

Pursuant to the National Environmental Policy Act (NEPA) of 1969 and regulations implemented by the Council on Environmental Quality, the Department of the Navy (DON) announces its intent to prepare a supplement to the 2011 Gulf of Alaska (GOA) Navy Training Activities Environmental Impact Statement (EIS)/Overseas Environmental Impact Statement (OEIS) and 2016 Gulf of Alaska Navy Training Activities Supplemental EIS/OEIS. New information includes a new acoustic effects model, updated marine mammal density data, and evolving and emergent best available science. Proposed activities are consistent with those analyzed in the 2016 GOA Navy Training Activities Supplemental EIS/OEIS and 2017 Record of Decision.

Registration of Privately Owned Motor Vehicles
This part was established to prescribe the Department of Defense (DoD) policy and procedures for the registration, inspection, and marking of privately owned vehicles (POV) on Defense Logistics Agency (DLA) activities. Since the requirement to register, inspect, and mark privately-owned vehicles on DLA activities was rescinded in 2012, the need for this part no longer exists, and it should be removed from the CFR.
