requirement.
AGENCY:
In compliance with section
3506(c)(2)(A) of the Paperwork
Reduction Act of 1995, DoD announces
the proposed revision of a public
information collection requirement and
seeks public comment on the provisions
thereof. DoD invites comments on:
Whether the proposed collection of
information is necessary for the proper
performance of the functions of DoD,
including whether the information will
have practical utility; the accuracy of
the estimate of the burden of the
proposed information collection; ways
to enhance the quality, utility, and
clarity of the information to be
collected; and ways to minimize the
burden of the information collection on
respondents, including the use of
automated collection techniques or
other forms of information technology.
The Office of Management and Budget
(OMB) has approved this information
collection for use through May 31, 2020.
DoD proposes that OMB extend its
approval for use for three additional
years beyond the current expiration
date.
SUMMARY:
DoD will consider all comments
received by April 27, 2020.

Needs and Uses: DFARS 205.470
prescribes the use of the clause at
DFARS 252.205–7000, Provision of
Information to Cooperative Agreement
Holders, in solicitations and contracts,
including solicitations and contracts
using Federal Acquisition Regulation
(FAR) part 12 procedures for the
acquisition of commercial items, which
are expected to exceed $1,000,000. This
clause implements 10 U.S.C. 2416, by
requiring contractors to provide
cooperative agreement holders, upon
request, with a list of the contractor’s
employees or offices responsible for
entering into subcontracts under
Department of Defense (DoD) contracts.
The Contractor need not provide the
listing to a particular cooperative
agreement holder more frequently than
once a year. Upon receipt of a
contractor’s list, the cooperative
agreement holder utilizes the
information to help businesses identify
and pursue contracting opportunities
with DoD and expand the number of
businesses capable of participating in
Government contracts.

DFARS 205.470 prescribes the use of

for the acquisition of commercial items,
which are expected to exceed
$1,000,000. The clause requires
contractors to provide cooperative
agreement holders, upon request, with a
list of the contractor’s employees or
offices responsible for entering into

must identify the specific information to
be released, the medium to be used, and
the purpose for the release. Upon
receipt of a contractor’s request, the
Government reviews the information
provided by the contractor to determine
if it is sensitive or otherwise
inappropriate for release for the stated
purpose.

DFARS 252.225–7000, Buy
American—Balance of Payments
Program Certificate, as prescribed in
225.1101(1) and (1)(i), requires the
offeror to identify in its proposal
supplies that do not meet the definition
of domestic end product, separately
listing qualifying country and other
foreign end products. The Buy
American statute does not apply to
acquisitions of commercial information
technology.
DFARS 252.225–7003, Report of
Intended Performance Outside the
United States and Canada—Submission
with Offer, and 252.225–7004, Report of
Intended Performance Outside the
United States and Canada—Submission
after Award, as prescribed in DFARS
225.7204(a) and (b) respectively, require
offerors and contractors to submit a
Report of Contract Performance Outside
the United States for subcontracts to be
performed outside the United States.
The reporting threshold is $750,000 for
contracts that exceed $15 million. The
contractor may submit the report on DD
Form 2139, Report of Contract
Performance Outside the United States,
or a computer-generated report that
contains all information required by DD
Form 2139.
