This final rule implements section 1097c of Title 10, United States Code, as added by section 707 of the John Warner National Defense Authorization Act for Fiscal Year 2007, Public Law 109-364. This law prohibits employers from offering incentives to TRICARE- eligible employees to not enroll or to terminate enrollment in an employer-offered Group Health Plan (GHP) that is or would be primary to TRICARE. Benefits offered through cafeteria plans that comport with section 125 of the Internal Revenue Code will be permissible as long as the plan treats all similarly situated employees eligible for benefits the same and does not illegally take TRICARE eligibility into account. TRICARE supplemental insurance plans, because they are limited to TRICARE beneficiaries exclusively, are generally impermissible. Properly documented non-employer contributed TRICARE supplemental plans, however, are allowed.

The U.S. Naval Academy Board of Visitors will meet to make such inquiry, as the Board shall deem necessary into the state of morale and discipline, the curriculum, instruction, physical equipment, fiscal affairs, and academic methods of the Naval Academy. The executive session of this meeting from 11 a.m. to 12 p.m. on June 28, 2010, will include discussions of disciplinary matters, law enforcement investigations into allegations of criminal activity, and personnel- related issues at the Naval Academy, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy. For this reason, the executive session of this meeting will be closed to the public.

Under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. The Department of the Navy hereby gives notice of the availability of exclusive or partially exclusive licenses to practice worldwide under the following pending patents. Any license granted shall comply with 35 U.S.C. 209 and 37 CFR part 404. The U.S. Army Corps of Engineers, Jacksonville District, intends to prepare a Draft Environmental Impact Statement (DEIS) for evaluation of the feasibility of providing hurricane and storm damage reduction (HSDR), and related purposes to the shores of St. Johns County, Florida. In cooperation with St. Johns County, the study will evaluate alternatives that will maximize HSDR while minimizing environmental impacts within three reaches designated critically eroded by Florida Department of Environmental Protection (FDEP): (1) South Ponte Vedra Beach (R84-R110/5 miles), (2) Vilano Beach (R110-R122/2.5 miles) and (3) Summer Haven Beach (R197-R209/2.3 miles).

The Phase III Business Rules encompass procedures for Non-temporary Storage (NTS), Domestic Small Shipments (dS2, formerly DPM), Domestic and International Local Moves (dLM and iLM) and International Intra-Country Moves (iCM).
