Notice of Availability of Government-Owned Inventions; Available for Licensing
The inventions listed below are assigned to the United States Government as represented by the Secretary of the Navy and are available for licensing by the Department of the Navy. Patent application 60/762,561: ANTI-BALLISTIC COMPOSITE STRUCTURE FOR ORDNANCE, a thin and lightweight anti-ballistic composite structure capable of stopping a 0.50 caliber armor-piercing bullet. Patent application 11/326,674: IMPROVED EXOTHERMIC ROD IGNITER, a waterproof, non-battery operated rod igniter with marked reliability and longer shelf life. Patent application 11/229,443: DRIFT TUBE AMPLIFIER, amplifies extremely low current signals generated by extremely high input impedance sources. Renewal of Department of Defense Federal Advisory Committees
Under the provisions of the Federal Advisory Committee Act of 1972, as amended (5 U.S.C. Appendix), the Department of Defense gives notice that the Defense Advisory Committee on Women in the Services, which is determined to be in the public interest, is hereby renewed on April 17, 2006. This committee provides necessary and valuable independent advice to the Secretary of Defense and other senior Defense officials in their respective areas of expertise. It is a continuing DoD policy to make every effort to achieve a balanced membership on all DoD advisory committees. Each committee is evaluated in terms of the functional disciplines, levels of experience, professional diversity, public and private association, and similar characteristics required to ensure a high degree of balance is obtained.
Base Closure and Realignment
This Notice is provided pursuant to section 2905(b)(7)(B)(ii) of the Defense Base Closure and Realignment Act of 1990. It provides a partial list of military installations closing or realigning pursuant to the 2005 Defense Base Closure and Realignment (BRAC) Report. It also provides a corresponding listing of the Local Redevelopment Authorities (LRAs) recognized by the Secretary of Defense, acting through the Department of Defense Office of Economic Adjustment (OEA), as well as the points of contact, addresses, and telephone numbers for the LRAs for those installations. Representatives of state and local governments, homeless providers, and other parties interested in the redevelopment of an installation should contact the person or organization listed. The following information will also be published simultaneously in a newspaper of general circulation in the area of each installation. There will be additional Notices providing this same information about LRAs for other closing or realigning installations where surplus government property is available as those LRAs are recognized by the OEA.
Meeting of the Uniform Formulary Beneficiary Advisory Panel
This notice announces a meeting of the Uniform Formulary Beneficiary Advisory Panel. The panel will review and comment on recommendations made to the Director, TRICARE Management Activity, by the Pharmacy and Therapeutics Committee regarding the Uniform Formulary. The meeting will be open to the public. Seating is limited and will be provided only to the first 220 people signing in. All persons must sign in legibly. Notice of this meeting is required under the Federal Advisory Committee Act.
Notice of Intent To Request Comments on Alternative Procedures To Implement Advisory Council on Historic Preservation Program Act (NHPA) Section 106, Per 36 CFR 800.14(E) for Disposal of Naval Vessels
The Department of the Navy (Navy) is requesting ``Program Comments'' for alternative procedures to implement the National Historic Preservation Act (NHPA) Section 106 regulations. This programmatic approach substitutes all of 36 CFR part 800 subpart B, covers a category of undertakings in lieu of individual reviews and demonstrates the Navy's compliance with its responsibilities under Section 106 of NHPA regarding the disposal of U.S. Naval vessels which have been stricken from the Naval Vessel Register (NVR) and are owned and under the physical custody of the Navy. This document will remain in effect indefinitely. In accordance with 36 CFR 800.14(e)(6), if the Advisory Council for Historic Preservation (ACHP) determines that the consideration of NRHP eligible vessels are not being carried out in a manner consistent with this document, the ACHP may withdraw the comment and the Navy would be required to comply with the requirements of 36 CFR 800.3 through 88.7 for each adverse action.
The Army Privacy Program
The Department of the Army is proposing to update policies and responsibilities for the Army Privacy Program, which implements the Privacy Act of 1974, by showing organizational realignments and by revising referenced statutory and regulatory authority, such as the Health Insurance Portability and Accountability Act and E-Government Act of 2002.
Meeting of the Naval Research Advisory Committee
The Naval Research Advisory Committee (NRAC) will meet on May 5, 2006. The meeting will be an Executive Session and will discuss a study undertaken by NRAC.
Notice of Availability of the Record of Decision for the Final Environmental Impact Statement for the Transformation of the Pennsylvania Army National Guard 56th Brigade Into a Stryker Brigade Combat Team at the National Guard Training Center-Fort Indiantown GAP, PA
The National Guard Bureau and the Department of the Army announce the availability of the Record of Decision (ROD), which explains the decision to proceed with the Transformation of the Pennsylvania Army National Guard (PAARNG) 56th Stryker Brigade Combat Team (SBCT). This action includes construction of new training and support facilities at the National Guard Training Center-Fort Indiantown Gap (NGTC-FTIG), Fort Pickett, VA, and local PAARNG facilities across the Commonwealth of Pennsylvania. The action also includes Annual Training (AT) at Fort A.P. Hill, VA in order to accomplish requisite training. The Final Environmental Impact Statement (FEIS) complies with all applicable requirements, and adequately addresses the biological, physical, socioeconomic, and cultural impacts from implementing the proposed action.

Under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Federal Acquisition Regulation (FAR) Secretariat has submitted to the Office of Management and Budget (OMB) a request to review and approve an extension of a currently approved information collection requirement concerning novation/change of name requirements. A request for public comments was published in the Federal Register at 71 FR 7546, on February 13, 2006. No comments were received. This OMB clearance expires on June 30, 2006. Public comments are particularly invited on: Whether this collection of information is necessary for the proper performance of functions of the FAR, and whether it will have practical utility; whether our estimate of the public burden of this collection of information is accurate, and based on valid assumptions and methodology; ways to enhance the quality, utility, and clarity of the information to be collected; and ways in which we can minimize the burden of the collection of information on those who are to respond, through the use of appropriate technological collection techniques or other forms of information technology.

Defense Federal Acquisition Regulation Supplement; Reports of Government Property (DFARS Case 2005-D015)
DoD is extending the comment period for the proposed amendments to the Defense Federal Acquisition Regulation Supplement (DFARS) that were published in the Federal Register of Tuesday, March 21, 2006 (71 FR 14151). The proposed amendments addressed requirements for reporting of Government property in the possession of contractors.
Information Collection Requirement; Defense Federal Acquisition Regulation Supplement; Bonds and Insurance
In compliance with Section 3506(c)(2)(A) of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), DoD announces the proposed extension of a public information collection requirement and seeks public comment on the provisions thereof. DoD invites comments on: (a) Whether the proposed collection of information is necessary for the proper performance of the functions of DoD, including whether the information will have practical utility; (b) the accuracy of the estimate of the burden of the proposed information collection; (c) ways to enhance the quality, utility, and clarity of the information to be collected; and (d) ways to minimize the burden of the information collection on respondents, including the use of automated collection techniques or other forms of information technology. The Office of Management and Budget (OMB) has approved this information collection for use through August 31, 2006. DoD proposes that OMB extend its approval for use for 3 additional years.
U.S. Air Force Academy Board of Visitors Meeting
Pursuant to Section 9355, Title 10, United States Code, the U.S. Air Force Academy Board of Visitors will meet at the United States Air Force Academy, Colorado Springs, Colorado, 28 & 29 April 2006. The purpose of the meeting is to consider the morale and discipline, curriculum, instruction, physical equipment, fiscal affairs, academic methods, and other matters relating to the Academy. A portion of the meeting will be open to the public while other portions will be closed to the public to discuss matters listed in Paragraphs (2), (6), and Subparagraph (9)(B) of Subsection (c) of Section 552b, Title 5, United States Code. The determination to close certain sessions is based on the consideration that portions of the briefings and discussion will relate solely to the internal personnel rules and practices of the Board of Visitors or the Academy; involve information of a personal nature, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy; or involve discussions of information the premature disclosure of which would be inconsistent with protection of the predecisional process by frustrating frank and open discussion. Meeting sessions will be held in the Superintendent's conference room, Fairchild Hall, USAFA, CO.

Federal Acquisition Regulation; FAR Case 2004-031, Fast Payment Procedures
The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed on a final rule amending the Federal Acquisition Regulation (FAR) by revising fast payment procedures. The revision permits, but does not require, fast payment when invoices and/or outer shipping containers are not marked ``Fast Pay'' provided the contract includes the ``Fast Payment Procedure'' clause. As highlighted in the clause, if the clause is in the contract, the invoices will no longer be rejected, as is the current practice. Instead, they will be paid using either fast payment or normal payment procedures. In addition, the revision deletes the requirement for marking invoices ``No Receiving Report Prepared.''

This Free Trade Agreement went into effect January 1, 2006.

Federal Acquisition Regulation; FAR Case 2005-002; Expiration of the Price Evaluation Adjustment
The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed to adopt as final, without change, the interim rule published in the Federal Register at 70 FR 57462, September 30, 2005, to cancel for civilian agencies (except NASA and Coast Guard) the Small Disadvantaged Business (SDB) price evaluation adjustment which was originally authorized under the Federal Acquisition Streamlining Act of 1994. Civilian agencies (except NASA and Coast Guard) are not authorized to apply the price evaluation adjustment to their acquisitions.
Federal Acquisition Regulation; FAR Case 2005-009, Confirmation of HUBZone Certification
The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed to adopt as final without change, the interim rule amending the Federal Acquisition Regulation (FAR) to clarify that prime contractors must confirm that a subcontractor representing itself as a Historically Underutilized Business Zone (HUBZone) small business concern is certified, consistent with the requirements of 15 U.S.C. 632 et. seq., as amended.
Federal Acquisition Regulation; FAR Case 2005-012, Combating Trafficking in Persons
The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed on an interim rule amending the Federal Acquisition Regulation (FAR) to implement 22 U.S.C. 7104(g). This statute requires that contracts must include a provision that authorizes the department or agency to terminate the contract, if the Contractor or any subcontractor engages in trafficking in persons.

The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed to convert to a final rule without change, an interim rule amending the Federal Acquisition Regulation (FAR) to revise the definition of ``Information technology'' to reflect the changes to the definition resulting from the enactment of Public Law 108-199, Consolidated Appropriations Act, 2004. Section 535(b) of Division F of Public Law 108-199 permanently revises the term ``Information technology'', which is defined at 40 U.S.C. 11101, to add ``analysis and evaluation'' and to clarify the term ``ancillary equipment.''

Management and Mobilization of Regular and Reserve Retired Military Members
This rule prescribes uniform policy and guidance governing the peacetime management of retired military personnel, both Regular and Reserve, in preparation for their use during a mobilization. It impacts non-DoD organizations that have DoD-related missions, such as the Department of Homeland Security and the Selective Service System, and non-DoD organizations that have North Atlantic Treaty Organization- related missions, under agreements with those non-DoD organizations and advises all federal agency managers of the possible use of military retirees who may be in their employment as civilians.

Pursuant to the provisions of Part 404 of Title 37, code of Federal Regulations, which implements Public Law 96-517, as amended, the Department of the Air Force announces its intention to grant MJS International, Inc., a corporation of Missouri, having a place of business at Chesterfield, Missouri, an exclusive license in any right, title and interest the Air Force has in: U.S. Patent No. 6,267,039, issued 31 July 2001, entitled ``Aircraft Missile Hit Survivability Using Infrared Lamp and Sacrificial Support Structure,'' by Gregory J. Czarnecki.
36(b)(1) Arms Sales Notification
The Department of Defense is publishing the unclassified text of a section 36(b)(1) arms sales notification. This is published to fulfill the requirements of section 155 of Public Law 104-164 dated July 21, 1996.
Privacy Act of 1974; System of Records
The Office of the Secretary of Defense is amending a system of records notice in its existing inventory of record systems subject to the Privacy Act of 1974, (5 U.S.C. 552a), as amended. The notice corrects a system of records published on February 22, 2006 (71 FR 9103). The words ``Social Security Number'' were omitted from the Categories of Records. The notice is being republished in its entirety.
Office of the Secretary of Defense; Meeting of the Board of Regents of the Uniformed Services University of the Health Sciences
The actions that will take place include the approval of the minutes from the Board of Regents meeting held February 7, 2006, acceptance of department reports, and the awarding of post- baccalaureate degrees as follows: Doctor of Medicine, Masters of Science in Nursing, Ph.D. in Nursing Science, and masters and doctoral degrees in the biomedical sciences and public health. The President, USU; Dean, USU School of Medicine; Dean, USU Graduate School of Nursing; and Director, Armed Forces Radiobiology Research Institute, will also present reports. These actions are necessary for the University to remain an accredited medical school and to pursue our mission, which is to provide trained health care personnel to the uniformed services.

DoD has adopted as final, with changes, an interim rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to address the use of incrementally funded fixed-price contracts. The rule contains a contract clause for use in those situations where incremental funding of fixed-price contracts is permitted.
Defense Federal Acquisition Regulation Supplement; Labor Laws
DoD has issued a final rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to update text regarding the application of labor laws to Government contracts. This rule is a result of a transformation initiative undertaken by DoD to dramatically change the purpose and content of the DFARS.
Defense Federal Acquisition Regulation Supplement; Transition of Weapons-Related Prototype Projects to Follow-On Contracts
DoD has adopted as final, with changes, an interim rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement Section 847 of the National Defense Authorization Act for Fiscal Year 2004. Section 847 authorizes DoD to carry out a pilot program that permits the use of streamlined contracting procedures for the production of items or processes begun as prototype projects under other transaction agreements.
Defense Federal Acquisition Regulation Supplement; Prohibition of Foreign Taxation on U.S. Assistance Programs
DoD has adopted as final, without change, an interim rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement a statutory prohibition on foreign taxation under contracts funded by U.S. assistance programs. The rule addresses the responsibilities of the contractor and the contracting officer regarding the prohibition.
Intent To Prepare a Joint Environmental Impact Statement/Environmental Impact Report for the San Francisquito Creek Study, San Mateo and Santa Clara Counties, CA
Pursuant to section 102(2)(c) of the National Environmental Policy Act (NEPA) of 1969 as implemented by the Council on Environmental Quality regulations (40 CFR parts 1500-1508), the California Environmental Quality Act (CEQA), and Public Law 102-484 section 2834, as amended by Public Law 104-106 section 2867, the Department of the Army and the San Francisquito Creek Joint Powers Authority (SFCJPA) hereby give notice of intent to prepare a joint Environmental Impact Statement/Environmental Impact Report (EIS/EIR) for the San Francisquito Creek Project in San Mateo and Santa Clara Counties, CA to consider opportunities to reduce both fluvial and tidal flooding, to reduce the threat to public safety due to flooding and to restore ecosystem quality and function, where possible. The U.S. Army Corps of Engineers (Corps) is the lead agency for this project under NEPA. The SFCJPA is the lead agency for this project under CEQA. A public scoping meeting will be held to solicit comments on the environmental scope of the project and the appropriate scope of the joint EIS/EIR.
