Certain Frozen Fish Fillets From the Socialist Republic of Vietnam: Notice of Partial Rescission of the Fifth Antidumping Duty Administrative Review

The Department of Commerce (``Department'') is conducting an administrative review of the antidumping duty order on certain frozen fish fillets from the Socialist Republic of Vietnam (``Vietnam''). See Notice of Antidumping Duty Order: Certain Frozen Fish Fillets From the Socialist Republic of Vietnam, 68 FR 47909 (August 12, 2003) (``Order''). On September 30, 2008, the Department initiated an antidumping duty administrative review on certain frozen fish fillets from Vietnam. See Initiation of Antidumping and Countervailing Duty Administrative Reviews and Requests for Revocation in Part, 73 FR 56795 (September 30, 2008). The Department initiated this review with respect to 18 companies. The period of review is August 1, 2007, through July 31, 2008. The preliminary results of this administrative review are currently due no later than May 3, 2009. On October 30, 2008, Vinh Quang Fisheries Corporation withdrew its request for review. On December 22, 2008, Anvifish Co., Ltd. (``Anvifish'') withdrew its request for a review. On October 17, 2008, Petitioners \1\ withdrew their request for review with respect to 12 companies, including Vinh Quang Fisheries Corporation. Following Anvifish's withdrawal, on December 23, 2008, Petitioners withdrew their request for review with respect to Anvifish.

On March 31, 2009, the Department of Commerce (the Department) issued a determination regarding the dumping margin calculation in the less-than-fair-value investigation of stainless steel sheet and strip in coils (stainless steel) from Mexico challenged by Mexico before the World Trade Organization (WTO). On April 23, 2009, the U.S. Trade Representative (USTR) instructed the Department to implement in whole this determination under section 129 of the Uruguay Round Agreements Act (URAA). The Department is now implementing this determination.

In response to requests from interested parties, the Department of Commerce (the Department) is conducting administrative reviews of the antidumping duty orders on ball bearings and parts thereof from France, Germany, Italy, Japan, and the United Kingdom. The reviews cover 15 manufacturers/exporters. The period of review is May 1, 2007, through April 30, 2008. We have preliminarily determined that sales have been made below normal value by certain companies subject to these reviews. If these preliminary results are adopted in our final results of administrative reviews, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties on all appropriate entries.

On June 29, 2007, the United States Court of International Trade (CIT) affirmed the redetermination of the Department of Commerce (the Department) on voluntary remand of the final results of the administrative review of the antidumping duty order on ball bearings and parts thereof from Germany. See Paul M[uuml]ller Industrie GmbH & Co. v. United States, 502 F. Supp. 2d 1271 (CIT 2007). The Department is amending the final results of the administrative review of the antidumping duty order on ball bearings and parts thereof from Germany covering the period of review May 1, 2002, through April 30, 2003, to reflect the CIT's order.

This review covers one firm, Yieh Hsing Enterprise Co., Ltd. (Yieh Hsing), for the period May 1, 2007, through April 30, 2008. No interested party commented on the Department's intent to rescind this review based upon its determination that the party subject to this review did not have entries of subject merchandise during the period of review (POR) on which to assess antidumping duties.

On January 7, 2009, the Department of Commerce (``the Department'') published a notice of initiation of a changed circumstances review of the antidumping duty order of certain pasta from Turkey as requested by Marsan Gida Sanayi ve Ticret A.S. (``Marsan''). After receiving additional information on the operations of Marsan, we preliminarily determine that Marsan is the successor-in- interest to Gidasa Sabanci Gida Sanayi ve Ticaret A.S. (``Gidasa''), and should be accorded the same antidumping duty treatment accorded Gidasa with respect to the antidumping duty order on certain pasta from Turkey. Interested parties are invited to comment on these preliminary results.

On September 30, 2008, we published the notice of initiation of this antidumping duty administrative review with respect to Dongbu Steel Co., Ltd., Dongkuk Industries Co., Ltd. (Dongkuk), Haewon MSC Co., Ltd., Hyundai HYSCO, LG Chem, Ltd., Pohang Iron and Steel Co., Ltd/Pohang Coated Steel Co., Ltd., and Union Steel Manufacturing Co., Ltd, for the period August 1, 2007, through July 31, 2008. See Initiation of Antidumping and Countervailing Duty Administrative Reviews and Request for Revocation in Part, 73 FR 56795 (September 30, 2008) (Notice of Initiation). Dongkuk submitted a letter to the Department that it had no shipments of subject merchandise to the U.S. during the period of review (POR). See Letter from Dongkuk to the Secretary of Commerce dated October 20, 2008. The Department corroborated the claim of no shipments by Dongkuk. See memo from Christopher Hargett, International Trade Compliance Analyst, Office 3, through James Terpstra, Program Manager, Office 3, to Melissa Skinner, Office Director, Office 3, Import Administration, dated March 27, 2009 (No Shipment Analysis). We have preliminarily determined that the review of Dongkuk should be rescinded. This review will remain in effect for all other companies initiated upon.
Certain Lined Paper Products from India: Notice of Final Results of the First Antidumping Duty Administrative Review

On October 7, 2008, the U.S. Department of Commerce (the Department) published the preliminary results of the first administrative review of the antidumping duty order on certain lined paper products (CLPP) from the People's Republic of China (PRC). See Certain Lined Paper Products from the People's Republic of China: Notice of Preliminary Results of the Antidumping Duty Administrative Review, 73 FR 58540 (October 7, 2008) (Preliminary Results). We invited parties to comment on the Preliminary Results. This review covers the following exporters and/or producer/exporters: (1) Shanghai Lian Li Paper Products Co., Ltd. (Lian Li); (2) Hwa Fuh Plastics Co. Ltd./Li Teng Plastics (Shenzhen) Co., Ltd. (H.F. Plastics/ L.T. Plastics); (3) Leo's Quality Products Co., Ltd./ Denmax Plastic Stationery Factory (Denmax/Leo's Products); and (4) the Watanabe Group (which consists of the following three companies: Watanabe Paper Products (Shanghai) Co. Ltd. (Watanabe Shanghai); Watanabe Paper Products (Linqing) Co. Ltd. (Watanabe Linqing); and Hotrock Stationery (Shenzhen) Co. Ltd. (Hotrock Shenzhen)).\1\ We find that certain exporters and producers/exporters sold subject merchandise at prices below normal value (NV) during the period of review (POR) of April 17, 2006, through August 31, 2007. Based on our analysis of the comments received and verification findings, we have made changes to certain surrogate values and to Lian Li's margin. Therefore, the final results differ from the Preliminary Results.

On March 7, 2008, the Department of Commerce (``the Department'') initiated the third administrative review of the antidumping duty order on wooden bedroom furniture from the People's Republic of China (``PRC'') covering the period January 1, 2007, through December 31, 2007. See Notice of Initiation of Administrative Review of the Antidumping Duty Order on Wooden Bedroom Furniture from the People's Republic of China, 73 FR 12387 (March 7, 2008) (``Initiation Notice''). Between March 7 and June 5, 2008, several parties withdrew their requests for review. As a result, the Department rescinded the administrative review of wooden bedroom furniture with respect to the entities for whom all review requests have been withdrawn. See Wooden Bedroom Furniture from the People's Republic of China: Notice of Partial Rescission of Antidumping Duty Administrative Review, 73 FR 49990 (August 25, 2008) (``Rescission Notice''). However, in the Rescission Notice, the Department inadvertently failed to identify Nantong Dongfang Oriental Furniture Co., Ltd. (``Nantong Dongfang'') as a company for which the review was being rescinded, and instead listed it as a company receiving the PRC-wide rate, even though it has established a separate rate. See Rescission Notice, 73 FR at 49993; Notice of Amended Final Determination of Sales at Less Than Fair Value and Antidumping Duty Order: Wooden Bedroom Furniture from the People's Republic of China, 70 FR 329, 331 (January 4, 2005) (``WBF Order''). Therefore, we are correcting this error and rescinding the review with respect to Nantong Dongfang.
