Antidumping Duty Investigation and Countervailing Duty Investigation of Hard Red Spring Wheat from Canada: NAFTA Panel Decision

On June 7, 2005, a North American Free Trade Agreement United States-Canada Binational Panel reviewing the International Trade Commission's finding that an industry in the United States was materially injured by reason of imports of hard red spring wheat from Canada, remanded the case to the International Trade Commission. On October 5, 2005, the International Trade Commission determined on remand that the domestic industry is neither materially injured by reason of the subject imports nor threatened with such injury. By decision issued on December 12, 2005, the Panel affirmed in full the International Trade Commission's determination on remand. Consistent with the decision of the United States Court of Appeals for the Federal Circuit in Timken Co. v. United States, 893 F.2d 337 (Fed. Cir. 1990), the Department of Commerce is notifying the public that the International Trade Commission's remand determination for hard red spring wheat from Canada and the Notice of Final Panel Action issued by the Panel reviewing the International Trade Commission's determination, discussed below, are not ``in harmony'' with the International Trade Commission's original results.

On November 2, 2005, the United States Court of International Trade (CIT) affirmed the U.S. Department of Commerce's (the Department's) redetermination on remand of the final results of the antidumping duty new shipper review on honey from the People's Republic of China. See Wuhan Bee Healthy Co., Ltd. v. United States, Slip Op. 05-142 (CIT 2005). The Department is now issuing these amended final results reflecting the CIT's decision.

On October 28, 2005, the Department of Commerce (``the Department'') published a notice of preliminary results of the full sunset review of the antidumping duty order on brass sheet and strip (``BSS'') from Germany (70 FR 62093) pursuant to section 751(c) of the Tariff Act of 1930, as amended (``the Act''). We provided interested parties an opportunity to comment on our preliminary results. We did not receive comments from either domestic or respondent interested parties. As a result of this review, the Department finds that revocation of this order would be likely to lead to continuation or recurrence of dumping at the levels indicated in the ``Final Results of Review'' section of this notice.

Notice of Final Determination of Sales at Less Than Fair Value and Affirmative Final Determination of Critical Circumstances: Certain Orange Juice from Brazil

On August 24, 2005, the Department of Commerce published its preliminary determination of sales at less than fair value (LTFV) in the antidumping duty investigation of certain orange juice from Brazil. The period of investigation (POI) is October 1, 2003, through September 30, 2004. Based on our analysis of the comments received, we have made changes in the margin calculations. Therefore, the final determination differs from the preliminary determination. The final weighted-average dumping margins for the investigated companies are listed below in the section entitled ``Final Determination Margins.'' In addition, we have determined that Coinbra Frutesp S.A. (Coinbra-Frutesp) is the successor-in-interest to Frutropic S.A. (Frutropic) and, thus, its production and/or exports of frozen concentrated orange juice for further manufacture (FCOJM) are covered by the scope of this proceeding. Finally, we determine that critical circumstances exist with regard to certain exports of subject merchandise from Brazil.
Notice of Preliminary Results of Antidumping Duty Changed Circumstances Review: Certain Softwood Lumber Products from Canada

On June 21, 2005, the Department of Commerce (the Department) published a notice of initiation of a changed circumstances review of the antidumping duty order on certain softwood lumber products from Canada. See Initiation of Antidumping Duty Changed Circumstances Review: Certain Softwood Products from Canada, 70 FR 35632, dated June 21, 2005 (Initiation Notice). The Department initiated this review to determine the appropriate cash deposit rate for West Fraser Mills Limited (West Fraser), which acquired Weldwood of Canada Limited (Weldwood) on December 31, 2004. We preliminarily determine that the post-acquisition West Fraser is the successor-in-interest to the pre- acquisition West Fraser. Therefore, we preliminarily conclude that the post-acquisition West Fraser should be assigned the same cash deposit rate as West Fraser prior to the acquisition. Interested parties are invited to comment on these preliminary results.

On December 20, 2005, the United States Court of International Trade (``Court'') sustained the final remand determination made by the Department of Commerce (``the Department'') pursuant to the Court's remand of the amended final determination of the investigation of wooden bedroom furniture from the People's Republic of China. See Decca Hospitality Furnishings, LLC v. United States, Ct. No. 05-00002, Slip Op. 05-161 (Ct. Int'l Trade December 20, 2005) (``Decca Remand II''). This case arises out of the Department's Final Determination of Sales at Less Than Fair Value: Wooden Bedroom Furniture From the People's Republic of China, 69 FR 67313 (November 17, 2004), as amended, 70 FR 329 (January 4, 2005) (``Final Determination''). The final judgment in this case was not in harmony with the Department's January 2005 Final Determination.
