Changes to the Practice for Handling Patent Applications Filed Without the Appropriate Fees

Among other changes to patent and trademark fees, the Consolidated Appropriations Act, 2005 (Consolidated Appropriations Act), splits the patent application filing fee into a separate filing fee, search fee and examination fee, and requires an additional fee (application size fee) for applications whose specification and drawings exceed 100 sheets of paper, during fiscal years 2005 and 2006. The United States Patent and Trademark Office is in this notice proposing changes in the Office's practice for handling patent applications filed without the appropriate filing, search, and examination fees. The Office has implemented the changes to the patent fees provided in the Consolidated Appropriations Act in a separate rulemaking.

On November 29, 2004, the U.S. Department of Commerce (``the Department'') published the preliminary results of the new shipper reviews of the antidumping order on honey from the People's Republic of China (69 FR 69350). These reviews cover four exporters, Anhui Honghui Foodstuff (Group) Co., Ltd. (``Anhui Honghui''), Eurasia Bee's Products Co., Ltd. (``Eurasia''), Inner Mongolia Youth Trade Development Co., Ltd. (``Inner Mongolia Youth''), and Jiangsu Kanghong Natural Healthfoods Co., Ltd. (``Jiangsu Kanghong''). The period of review (``POR'') is December 1, 2002, through November 30, 2003. Based on our analysis of the record, and on comments from the interested parties, we have made changes to the margin calculations of all four producers/exporters as described below. See ``Final Results of Review'' section below.

NMFS announces the receipt of an application for an exempted fishing permit (EFP) from Neil Allen on behalf of The Georgia Aquarium. If granted, the EFP would authorize the applicant, with certain conditions, to collect limited numbers of groupers, snappers, squirrelfish, sea basses, jacks, spadefish, bluefish, grunts, porgies, surgeonfish, and triggerfish. Specimens would be collected primarily from Federal waters off the coast of Georgia but may also be collected from Federal waters off the coasts of South Carolina, Florida, Alabama, Louisiana, Mississippi, and Texas during 2005 and 2006, and displayed at The Georgia Aquarium, located in Atlanta, Georgia.

The Department of Commerce (``the Department'') is amending the weighted-average dumping margin listed in the Preliminary Determination for the mandatory respondent Hebei Jiheng Chemical Co., Ltd. (``Jiheng'') and for the Section A Respondents.\1\ See Notice of Preliminary Determination of Sales at Less Than Fair Value and Postponement of Final Determination: Chlorinated Isocyanurates from the People's Republic of China, 69 FR 75293 (December 16, 2004) (``Preliminary Determination''). The Department finds that it made ministerial errors in the calculations for Jiheng, and that the correction of all errors alleged by Jiheng fulfills the requirement of a significant ministerial error within the meaning of 19 CFR 351.224(e). Therefore, the rate assigned to the Section A respondents also changes.

NMFS also corrects the description of the qualification years for the proposed modification to the monkfish limited access program that was incorrectly described in the preamble to the January 14, 2005, proposed rule. NMFS also clarifies the description of the proposed possession limit for the Offshore Fishery Program in the Southern Fishery Management Area (SFMA) provided in the preamble of the Amendment 2 proposed rule to be per monkfish day-at-sea (DAS).

NMFS announces the availability of Amendment 23 prepared by the Gulf of Mexico Fishery Management Council (Council) that would establish a 10-year rebuilding plan for vermilion snapper in the exclusive economic zone (EEZ) of the Gulf of Mexico. The rebuilding plan seeks to achieve a 25.5-percent reduction in harvest based on the 2003 predicted landings. Measures to accomplish this reduction equitably for the commercial and recreational sectors of this fishery include increases in minimum size, a decreased recreational bag limit, and a closed commercial season. Amendment 23 would also establish biological reference points and stock status determination criteria for vermilion snapper (i.e., maximum sustainable yield (MSY), optimum yield (OY), maximum fishing mortality threshold (MFMT), and minimum stock size threshold (MSST), consistent with the requirements of the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson- Stevens Act). The intended effect of these measures is to end overfishing and rebuild the vermilion snapper resource consistent with the requirements of the Magnuson-Stevens Act.

The U.S. Department of Commerce issued an amended Export Trade Certificate of Review to the Association for the Administration of Rice Quotas, Inc. (``AARQ'') on February 14, 2005. The Certificate has been amended eight times. The most recent previous amendment was issued to AARQ on March 3, 2004, and published in the Federal Register March 18, 2004 (69 FR 12831). The original Export Trade Certificate of Review No. 97-00003 was issued to AARQ on January 21, 1998, and published in the Federal Register on January 28, 1998 (63 FR 4220).
Denied Persons and Specially Designated Nationals

This final rule removes all reference in the Export Administration Regulations (EAR) to the supplement containing the list of persons denied export privileges (``Denied Persons List'' (DPL)) because no such supplement exists in the Code of Federal Regulations. In the past, such a supplement has been included only in the unofficial loose-leaf version of the EAR that is available by subscription from the U.S. Government Printing Office. In addition, the Bureau of Industry and Security provides notice to the public that it is discontinuing its practice of including in the loose-leaf version of the EAR both the DPL and the ``Specially Designated Nationals and Blocked Persons'' (SDN) List. Revisions to the DPL and SDN List are issued on such a frequent basis as to make the quarterly, hard-copy versions of the lists included in the loose-leaf version of the EAR inaccurate. The removal of the DPL and SDN List from the loose-leaf version of the EAR will minimize any potential that parties might rely on an outdated list of persons denied export privileges under the EAR.
