This notice informs the public that the U.S. Department of Agriculture (USDA) in Fiscal Year 2006 established a demonstration Rural Development Voucher Program, as authorized under Section 542 of the Housing Act of 1949 as amended, (without regard to Section 542(b)). This notice informs the public that funding is available for the Rural Development Voucher Program. The notice also sets forth the general policies and procedures for use of these vouchers for Fiscal Year 2011. Pursuant to the requirements in the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2010, Public Law 111-80 (October 16, 2009) and the Department of Defense and full-year continuing Appropriations Act, 2011 Public Law 112-10 (April 15, 2011), Rural Development Vouchers are only available to low income tenants of Rural Development-financed multifamily properties where the Section 515 loan has been prepaid, either through prepayment or a foreclosure action, prior to the loan's maturity date and after September 30, 2005.

Implementation of Revised Lacey Act Provisions

The Food, Conservation and Energy Act of 2008 amended the Lacey Act to provide, among other things, that importers submit a declaration at the time of importation for certain plants and plant products. The declaration requirements of the Lacey Act became effective on December 15, 2008, and enforcement of those requirements is being phased in. We are soliciting public comment on regulatory options that could address certain issues that have arisen with the implementation of the declaration requirement. These options include establishing certain exceptions to the declaration requirement and modifying the Declaration Form PPQ 505 to simplify the collection of information.

We are advising the public that we have prepared a pest risk analysis that evaluates the risks associated with the importation into the continental United States of dragon fruit from Thailand. Based on this analysis, we believe that the application of one or more designated phytosanitary measures will be sufficient to mitigate the risks of introducing or disseminating plant pests or noxious weeds via the importation of dragon fruit from Thailand. We are making the pest risk analysis available to the public for review and comment.

As directed by the National Forest Management Act (NFMA), the USDA Forest Service is preparing the Colville, and Okanogan-Wenatchee National Forests revised land management plans and will also prepare an EIS for these revised plans. A Notice of Intent to revise the Colville, Okanogan, and Wenatchee forest plans was published in the Federal Register on March 9, 2004. That Notice also stated our intent to later publish a Notice to prepare an Environmental Impact Statement. This notice briefly describes the purpose and need, the proposed action, the scoping process for the plan revisions (including any scoping meetings), information concerning public participation, estimated dates for filing the EIS and provides the names and addresses of the responsible agency official and the individuals who can provide additional information. This notice also briefly describes the applicable planning rule. The revised land management plans will replace the land management plans previously approved by the Regional Forester. The Colville National Forest land management plan was signed on December 29, 1989, and has been amended 39 times. The Okanogan National Forest land management plan was signed on December 29, 1989, and has been amended 51 times. The Wenatchee National Forest land management plan was signed on March 2 1990, and has been amended 27 times. Most forest plan amendments are project-specific amendments and apply to that project only. Some amendments incorporated new management direction for specific resource areas, such as invasive weeds. Five amendments were incorporated into all the forest plans by the Regional Forester. The land management plans for the Okanogan National Forest and the Wenatchee National Forest were amended by the 1994 Northwest Forest Plan to incorporate standards and guidelines for management of habitat for late-successional and old-growth associated species within the range of the northern spotted owl and an aquatic conservation strategy to maintain and restore the ecological health of watersheds and aquatic ecosystems. These amendments included direction for managing streams and riparian areas, old growth forests, and treatment of invasive species. These amended plans will remain in effect until the revision takes effect. The Okanogan and Wenatchee National Forests were administratively combined in 2000; they will have a single forest plan.

Section 231 of the Healthy, Hunger-Free Kids Act of 2010, Public Law 111-296, requires that the U.S. Department of Agriculture (USDA) establish a program to recognize WIC local agencies and clinics that demonstrate exemplary breastfeeding promotion and support activities. USDA believes that public input on the development of the recognition program would be beneficial.

This final rule incorporates into the regulations governing the Programs authorized under the Richard B. Russell National School Lunch Act (NSLA) and the Child Nutrition Act of 1966 (CNA) two nondiscretionary provisions of the Healthy, Hunger-Free Kids Act of 2010 (HHFK Act). The HHFK Act requires State and local cooperation in Department of Agriculture studies and evaluations related to Programs authorized under the NSLA and the CNA. The HHFK Act also amends the NSLA to stipulate that Federal funds must not be subject to State budget restrictions or limitations, including hiring freezes, work furloughs, and travel restrictions. This final rule amends regulations for the National School Lunch Program; the Special Milk Program for Children; the School Breakfast Program; the Summer Food Service Program; the Child and Adult Care Food Program; State Administrative Expense Funds ; the Special Supplemental Nutrition Program for Women, Infants and Children; and the WIC Farmers' Market Nutrition Program. These provisions will strengthen program integrity by ensuring that sufficient data is made available for studies and evaluations. Additionally, exempting Federal funds from State budgetary restrictions or limitations is intended to increase the ability of State agencies to administer USDA's nutrition assistance programs effectively.

This rule changes the delinquent assessment requirements in effect under the marketing order for Vidalia onions grown in Georgia (order). The order regulates the handling of Vidalia onions grown in Georgia and is administered locally by the Vidalia Onion Committee (Committee). This rule establishes a late payment charge of 10 percent on unpaid assessments that are 10 days past due and increases the interest rate applied to delinquent assessments from 1 percent to 1.5 percent per month. This action should improve handler compliance with the assessment and reporting provisions of the order and help reduce the Committee's collection expenditures.

Pursuant to 7 CFR part 4284, subpart J, the Rural Business- Cooperative Service (RBS) announces the availability of approximately $37 million in competitive grant funds for Fiscal Year (FY) 2011 to help independent agricultural producers enter into value-added activities. This Notice of Funding Availability (NOFA) announces $19.3 million provided under the Agriculture, Rural Development, Food and Drug Administration and Related Agencies Appropriations Act of 2010 (Pub. L. 111-80), and $17.9 million from the Department of Defense and Full-Year Continuing Appropriations Act of 2011 (Pub. L.112-20). Awards may be made for planning activities or for working capital expenses, but not for both. The maximum grant amount for a planning grant is $100,000 and the maximum grant amount for a working capital grant is $300,000. Rural Development is encouraging applications that will support communities in urban or rural areas, with limited access to healthy foods and with a high poverty and hunger rate. Ten percent of available funds are reserved to fund applications submitted by Beginning Farmers or Ranchers and Socially Disadvantaged Farmers or Ranchers as defined at 7 CFR 4284.902. An additional 10 percent of available funds are reserved to fund Mid-Tier Value Chain projects (both collectively referred to as ``reserved funds''). Grants made to Majority Controlled Producer-Based Business Ventures may not exceed 10 percent of the total funds obligated for the program in the fiscal year.

The maximum amount of a loan under this authority will be $75 million. Management Area 10 (C) requires that OHVs be operated only on designated routes, while Management Area 10 (B) allows OHVs to be operated anywhere within the area. The Rural Utilities Service (RUS) is amending its regulations on Electric and Telecommunications Standards and Specifications for Materials, Equipment and Construction, by codifying specifications for wood poles, stubs and anchor logs, wood crossarms (solid and laminated), transmission timbers and pole keys, and for quality control and inspection of timber products. RUS is updating these specifications to conform with revisions to the American Wood Preservers' Association (AWPA) standards and follow agency policy on insurance requirements.

Invasive plants have been identified as a major threat to the biological diversity and ecological integrity within and outside the Salmon-Challis National Forest. Invasive plants create many adverse environmental effects, including, but not limited to: Displacement of native plants; reduction in functionality of habitat and forage for wildlife and livestock; threats to populations of threatened, endangered and sensitive species; alteration of physical and biological properties of soil, including productivity; changes to the intensity and frequency of fires; and loss of recreational opportunities. Within the 3,108,904 acres of the of the Salmon-Challis National Forest outside of the Frank Church River of No Return Wilderness, approximately 65,000 acres are identified as being infested with invasive, non-native, and/or State-listed noxious weeds. These invasive plant infestations have a high potential to expand on lands within and adjacent to the Salmon-Challis National Forest, degrading desired plant communities and the values provided by those communities. Forest lands are also threatened by ``potential invaders,'' invasive plants that have not been found on the Salmon-Challis National Forest but are known to occur in adjacent lands, counties, or states. Infestations can be prevented, eliminated, or controlled through the use of specific management practices. A clear and comprehensive integrated invasive plant management strategy would allow for the implementation of timely and effective invasive plant management and prevention for projects and programs on the Salmon-Challis National Forest. In the absence of an aggressive invasive plant management program, the number, density, and distribution of invasive plants on the Forest will continue to increase.
Mango Promotion, Research, and Information Order; Reapportionment

This rule reduces the number of National Mango Board (Board) members from 20 to 18 to reflect the elimination of two non-voting wholesaler/retailer positions. In accordance with the Mango Promotion, Research, and Information Order (Order), which is authorized under the Commodity Promotion, Research, and Information Act of 1996 (Act), a review of the composition of the Board must be conducted every five years. The Board reviewed the production volumes and geographical distribution of domestic and imported mangos, and submitted this information to the U.S. Department of Agriculture with a recommendation that no changes be made to the number of importer, first handler, or producer seats on the Board. However, the Board recommended elimination of two non-voting wholesaler/retailer positions that have not been filled since 2007.

We are requesting an extension of the proposed EIS for the USDA Forest Service Rangeland Allotment Management Planning on the Fall River West Geographic Area of the Fall River Ranger District and the Oglala Geographic Area of the Pine Ridge Ranger District, Nebraska National Forest. Our initial Notice of Intent was published in Vol. 75, No. 112 Friday, June 11, 2010. The USDA, Forest Service, will prepare an environmental impact statement (EIS) analyzing the management of rangeland vegetation resources, which includes livestock grazing, on the National Forest System (NFS) lands within the Oglala Geographic Area (OGA) of the Oglala National Grassland on the Pine Ridge Ranger District and the West Geographic Area (WGA) of the Buffalo Gap National Grassland on the Fall River Ranger District of the Nebraska National Forest (Analysis Area) areas as mapped by the 2001 Nebraska National Forest Revised Land and Resource Management Plan (Forest Plan). A Notice of Intent (NOI) for this project was published June 11, 2010 (75 No. 112 FR 33239- 33241). This revised NOI is being issued to update the project schedule. There will be a record of decision (ROD) for each geographic area. Proposed management actions would be implemented beginning in the year 2013. The agency gives notice of the full environmental analysis and decision-making process that will occur on the proposal so interested and affected people may become aware of how they may participate in the process and contribute to the final decision.
