Citrus Canker; Movement of Fruit From a Quarantined Area; Bag Markings
We are amending the regulations governing the interstate movement of fruit from an area quarantined for citrus canker to extend the temporary exception that allows fruit to be packed for interstate movement in bags that are clearly marked with only a limited distribution statement, if those bags are then packed in a box that is marked with both the limited distribution statement and the statement ``Limited Permit: USDA-APHIS-PPQ.'' We are extending the ending date for this temporary exemption from August 1, 2008, to August 1, 2010. This action provides for the continued use of existing inventories of bags in which regulated fruit are packed while maintaining safeguards against the movement of regulated fruit to commercial citrus-producing States.
Minimum Age Requirements for the Transport of Animals
We are reopening the comment period for our proposed rule that would amend the Animal Welfare Act regulations by adding minimum age requirements for the transport in commerce of animals. This action will allow interested persons additional time to prepare and submit comments.
Availability of Site-Specific Environmental Assessment and Pest Risk Assessment for the Interstate Movement of Garbage From Hawaii to Oregon
We are advising the public that the Animal and Plant Health Inspection Service has prepared a site-specific environmental assessment and pest risk assessment relative to a request to allow the interstate movement of garbage from Hawaii to a landfill in the State of Oregon. The environmental assessment has been prepared to determine whether the request is consistent with the environmental effects and impacts analyzed in our March 2008 regional programmatic environmental assessment as well as to evaluate potential site-specific environmental impacts of the proposed action. The pest risk assessment evaluates the risks associated with the interstate movement of garbage from Hawaii to Oregon. We are making these documents available to the public for review and comment.
National Urban and Community Forestry Advisory Council
The National Urban and Community Forestry Advisory Council, (NUCFAC) will be filling three positions that will be expiring at the end of December 2008. Milk in the Northeast and Other Marketing Areas; Interim Order Amending the Orders
This order amends the manufacturing cost allowances and the butterfat yield factor used in the Class III and Class IV product-price formulas applicable to all Federal milk marketing orders. More than the required producers approved the issuance of the interim order as amended.
Notice of Funds Availability (NOFA) Inviting Applications for the Specialty Crop Block Grant Program-Farm Bill (SCBGP-FB)
The Agricultural Marketing Service (AMS) is withdrawing the July 9, 2008, Federal Register notice (73 FR 39278), which was published in error, announcing the availability of approximately $10 million in grant funds to enhance the competitiveness of specialty crops. Today's notice announces the availability of approximately $10 million in grant funds, less USDA administrative costs, to enhance the competitiveness of specialty crops. The funds announced under this program (SCBGP-FB) are separate from the Specialty Crop Block Grant Program (SCBGP) funds announced by AMS on March 5, 2008. SCBGP-FB funds are authorized by the recently enacted Food, Conservation, and Energy Act of 2008 (the Farm Bill). The application process to apply for the SCBGP-FB funds will parallel those currently found in 7 CFR Part 1290. Regulations to implement the amendments made in the 2008 Farm Bill will be published in the near future. State departments of agriculture are encouraged to develop their grant applications promptly. The 2008 Farm Bill makes the SCBGP-FB funds available only through the end of this fiscal year (September 30, 2008). This necessitates a short application period. State departments of agriculture interested in obtaining grant program funds are invited to submit applications to USDA. State departments of agriculture, meaning agencies, commissions, or departments of a State government responsible for agriculture within the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the U.S. Virgin Islands, and the Commonwealth of the Northern Mariana Islands are eligible to apply. State departments of agriculture are encouraged to involve industry groups, academia, and community- based organizations in the development of applications and the administration of projects.
Notice of Decision To Issue Permits for the Importation of Dragon Fruit From Vietnam Into the Continental United States
We are advising the public of our decision to begin issuing permits for the importation into the continental United States of dragon fruit from Vietnam. Based on the findings of a pest risk analysis, which we made available to the public for review and comment through a previous notice, we believe that the application of one or more designated phytosanitary measures will be sufficient to mitigate the risks of introducing or disseminating plant pests or noxious weeds via the importation of dragon fruit from Vietnam.

Agency Information Collection Activities: Proposed Collection; Comment Request-Report of the Child and Adult Care Food Program
In accordance with the Paperwork Reduction Act of 1995, this notice invites the general public and other public agencies to comment on proposed information collections. The proposed collection is an extension of a currently approved collection. The purpose of the Report of the Child and Adult Care Food Program is to collect Program activity information from eligible programs that provide nutritious meals and snacks to Program participants.
National Dairy Promotion and Research Program; Invitation To Submit Comments on Proposed Amendments to the Order
This document invites comments on a proposed amendment to the Dairy Promotion and Research Order (Dairy Order). The proposal would modify the composition of the National Dairy Promotion and Research Board (Dairy Board) by changing the number of member seats in six of the 13 geographic regions. This modification was requested by the Dairy Board, which administers the Dairy Order, to better reflect the geographic distribution of milk production in the 48 contiguous States. The Department will issue a final rule once public comments have been received and considered.
Codex Alimentarius Commission: Meeting of the Codex Committee on Processed Fruits and Vegetables
The Office of the Under Secretary for Food Safety, U.S. Department of Agriculture (USDA), and the Agricultural Marketing Service (AMS) are hosting a public meeting on August 14th, 2008. The objective of the public meeting is to provide information and receive public comments on agenda items and draft United States positions for the 24th Session of the Codex Committee on Processed Fruits and Vegetables (CCPFV), which will be held in Arlington, VA (Washington, DC, metro area), September 15-20, 2008. International Sanitary and Phytosanitary Standard-Setting Activities
In accordance with legislation implementing the results of the Uruguay Round of negotiations under the General Agreement on Tariffs and Trade, we are informing the public of the international standard- setting activities of the World Organization for Animal Health, the Secretariat of the International Plant Protection Convention, and the North American Plant Protection Organization, and we are soliciting public comment on the standards to be considered.
Common Crop Insurance Regulations; Coverage Enhancement Option Provisions
The Federal Crop Insurance Corporation (FCIC) finalizes the Coverage Enhancement Option (CEO) Provisions. The intended effect of this action is to restrict the effect of the current Pilot Coverage Enhancement Option to the 2008 and prior crop years and replace with revised permanent CEO provisions, and to better meet the needs of insured producers. The changes will apply for the 2009 and succeeding crop years.
Forest Service Manual 2360 for Heritage Program Management
The Forest Service is issuing a new directive to Forest Service Manual 2360 for Heritage Program Management. The Forest Service Manual for the Heritage Program was last amended in 1991. The new directive addresses laws, amendments, and Executive orders passed since 1991 and issues that are increasingly important to the Forest Service Heritage Program including increased Tribal coordination on a variety of issues from re-burial of human remains to tourism, growth of educational travel and heritage tourism, emphasis on use of historic properites, and increased theft of American antiquities. The directive provides Heritage Program guidance to Forest Service land managers. It does not change management direction, but rather clarifies responsibilities, authorities, and internal procedures to improve the management and protection of cultural resources on National Forest System lands.
Special Areas; Roadless Area Conservation; Applicability to the National Forests in Colorado
The Forest Service, U.S. Department of Agriculture (USDA), is proposing to establish a State-specific rule to provide management direction for conserving Colorado roadless areas. The USDA invites written comments on both the proposed rule and the draft environmental impact statement (DEIS) and will consider those comments in developing a final rule and final environmental impact statement (FEIS). The final rule will be published in the Federal Register.
Irish Potatoes Grown in Colorado; Reinstatement of the Continuing Assessment Rate
This rule would reinstate the continuing assessment rate established for the Area No. 3 Colorado Potato Administrative Committee (Committee) for the 2008-2009 and subsequent fiscal periods at $0.02 per hundredweight of potatoes handled. The Committee locally administers the marketing order regulating the handling of potatoes grown in northern Colorado. The continuing assessment rate was suspended for the 2006-2007 and subsequent fiscal periods to bring the monetary reserve within the program limit of two fiscal periods' operating expenses. Assessments upon potato handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal period begins July 1 and ends June 30. The assessment rate would remain in effect indefinitely unless modified, suspended, or terminated.
Walnuts Grown in California; Increased Assessment Rate
This rule would increase the assessment rate established for the California Walnut Board (Board) for the 2008-09 marketing year from $0.0122 to $0.0158 per kernelweight pound of assessable walnuts. The Board locally administers the marketing order which regulates the handling of walnuts grown in California. Assessments upon walnut handlers are used by the Board to fund reasonable and necessary expenses of the program. The 2008-09 marketing year begins August 1, 2008. The assessment rate would remain in effect indefinitely unless modified, suspended, or terminated.
Genesis Inc. 2009 Exploration Drilling Project; Kootenai National Forest, Lincoln County, MT
The Department of Agriculture, Forest Service, Kootenai National Forest will prepare an environmental impact statement (EIS) to document the analysis and disclose the environmental impacts of the proposed action to conduct a helicopter-assisted exploration drilling project near Troy, Montana. Genesis, Inc. submitted a proposed Plan of Operations on June 19, 2008, pursuant to Forest Service locatable mineral regulations 36 CFR 228, Subpart A. A single EIS, evaluating all components of the proposed project will be prepared. Scoping Comment Date: Comments concerning the proposed action must be postmarked by August 25, 2008, to be considered in the draft EIS.
Notice of Intent To Request Approval To Revise and Extend an Information Collection
In accordance with the Paperwork Reduction Act of 1995, this notice announces the intention of the National Agricultural Statistics Service (NASS) to request approval to revise and extend a currently approved information collection, the Milk and Milk Products Surveys. Revision to burden hours may be needed due to changes in the size of the target population, sample design, and/or questionnaire length.
2008-Crop Marketing Assistance Loans and Loan Deficiency Payments for Cotton and Peanuts
As announced by this notice, the Commodity Credit Corporation (CCC) is implementing provisions of the Food, Conservation, and Energy Act of 2008 (2008 Farm Bill) regarding Marketing Assistance Loans (MAL) and Loan Deficiency Payments (LDP) for 2008 crop cotton and peanuts. The 2008 Farm Bill authorizes the continuation of the MAL and LDP programs for the 2008 through 2012 crops. This notice specifies how CCC will administer 2008 crop MAL and LDP provisions.
Cotton Board Rules and Regulations: Adjusting Supplemental Assessment on Imports (2008 Amendments)
The Agricultural Marketing Service (AMS) is proposing to amend the Cotton Board Rules and Regulations by increasing the value assigned to imported cotton for calculating supplemental assessments collected for use by the Cotton Research and Promotion Program. An amendment is required to adjust the assessments collected on imported cotton and the cotton content of imported products to be the same as those paid on domestically produced cotton. In addition, AMS proposes to remove Harmonized Tariff Schedule (HTS) numbers that were absorbed into other HTS categories since the last assessment adjustment.
Nectarines and Peaches Grown in California; Changes in Handling Requirements for Fresh Nectarines and Peaches
The Department of Agriculture is adopting, as a final rule, with a change, an interim final rule changing the handling requirements applicable to well matured fruit covered under the nectarine and peach marketing orders (orders). The orders regulate the handling of nectarines and peaches grown in California and are administered locally by the Nectarine Administrative and Peach Commodity Committees (committees). This rule continues in effect the action that updated the variety-specific size requirements to reflect changes in commercially significant varieties. This will enable handlers to continue to ship fresh nectarines and peaches in a manner that meets consumer needs, increases returns to producers and handlers, and reflects current industry practices.
Milk in the Mideast Marketing Areas; Notice of Hearing on Proposed Amendments to Tentative Marketing Agreement and Order
A public hearing is being held to consider and take evidence on a proposal to temporarily adjust certain Class I differentials in the Mideast milk marketing order.
Pioneer Hi-Bred International, Inc.; Determination of Nonregulated Status for Soybean Genetically Engineered for Tolerance to Glyphosate and Acetolactate Synthase-Inhibiting Herbicides
We are advising the public of our determination that a soybean line developed by Pioneer Hi-Bred International, Inc., designated as transformation event 356043, which has been genetically engineered for tolerance to glyphosate and acetolactate synthase-inhibiting herbicides, is no longer considered a regulated article under our regulations governing the introduction of certain genetically engineered organisms. Our determination is based on our evaluation of data submitted by the Pioneer Hi-Bred International, Inc., in its petition for a determination of nonregulated status, our analysis of other scientific data, and comments received from the public in response to a previous notice announcing the availability of the petition for nonregulated status and its associated environmental assessment. This notice also announces the availability of our written determination and finding of no significant impact.
Tuberculosis; Require Approved Herd Plans Prior to Payment of Indemnity
We are proposing to amend the regulations regarding the payment of indemnity for animals destroyed because of bovine tuberculosis to provide that an approved herd plan must be in place prior to the payment of indemnity, and to provide that 10 percent of the gross indemnity payment be withheld by the Animal and Plant Health Inspection Service until the conditions of an approved herd plan have been implemented. We are also proposing to amend the regulations to deny payments of Federal indemnity for a herd whose owner has failed to follow the provisions of an approved herd plan, or has violated the conditions of an approved herd plan. We believe these proposed changes would further tuberculosis eradication efforts in the United States and protect livestock not affected with tuberculosis from the disease.
Monsanto Company; Availability of Determination of Nonregulated Status for Corn Genetically Engineered for Insect Resistance
We are advising the public of our determination that a corn line developed by the Monsanto Company, designated as transformation event MON 89034, which has been genetically engineered for insect resistance, is no longer considered a regulated article under our regulations governing the introduction of certain genetically engineered organisms. Our determination is based on our evaluation of data submitted by the Monsanto Company in their petition for a determination of nonregulated status, our analysis of other scientific data, and comments received from the public in response to a previous notice announcing the availability of the petition for nonregulated status and its associated environmental assessment. This notice also announces the availability of our written determination and our finding of no significant impact.
Deschutes Provincial Advisory Committee (DPAC)
The Deschutes Provincial Advisory Committee will meet on July 31, starting at 8 a.m. at the Deschutes National Forest Supervisor's Office, 1001 SW., Emkay Drive, Bend, Oregon. There will be a 1 hour business meeting. Then, members will go to the field to the Bend Ft. Rock Ranger District to discuss winter recreation. The trip is scheduled to end at 4:30 p.m. All Deschutes Province Advisory Committee Meetings are open to the public and an open public forum is scheduled from 8:30 to 9 a.m.
Agricultural Management Assistance Program
The Food, Conservation, and Energy Act of 2008 (2008 Act) expanded the geographic scope of the AMA Program to include the State of Hawaii. The Commodity Credit Corporation (CCC) administers AMA under the general supervision of the Chief of the Natural Resources Conservation Service (NRCS), who is one of the vice presidents of CCC. CCC announces the availability of an additional $2.5 million of technical and financial assistance funds in fiscal year (FY) 2008 to participating States. AMA is available to States which have historically low participation in the Federal crop insurance program. These States are: Connecticut, Delaware, Maine, Maryland, Massachusetts, Nevada, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Utah, Vermont, West Virginia, Wyoming, and Hawaii. Under AMA, a participant may use financial assistance to adopt conservation practices that will reduce or mitigate risks to their agricultural enterprises. AMA is authorized by Section 524(b) of the Federal Crop Insurance Act (7 U.S.C. 1524(b)), and administered under regulations found at 7 CFR part 1465. NRCS will, at a later date, formally amend the final rule located in 7 CFR part 1465 to add Hawaii as an area which is eligible for AMA assistance.
Notice of Proposed New Fee Sites; Federal Lands Recreation Enhancement Act, (Title VIII, Pub. L. 108-447)
The Superior National Forest is planning to charge fees at fifteen camping areas. Fees are assessed based on the level of amenities and services provided, cost of operation and maintenance, market assessment, and public comment. The fees listed are only proposed and will be determined upon further analysis and public comment. Funds from fees would be used for the continued operation and maintenance of these recreation sites. The following fifteen camping areas (all currently free use sites) are being proposed as fee sites: Baker Lake, Toohey Lake, Fourmile Lake, Hogback Lake, Kawishiwi Lake, Section 29 Lake, Silver Island Lake, White Pine Lake, Wilson Lake, Poplar River, Whitefish Lake, Harriet, Clara Lake, Cascade River and Eighteen Lake. These camping areas have many of the same amenities offered at the more developed campgrounds on the Superior National Forest and will be priced in accordance to the amenities provided at that site. A financial analysis is being completed to determine fee rates. The proposed fee to help maintain this site would be approximately $8 per campsite per night, and $4.00 per one additional vehicle per campsite. The fee season for these camping areas would start in early to mid May coinciding with the fishing season opener and would continue to the end of the field season in late September.
Notice of New Fee Site; Federal Lands Recreation Enhancement Act (Title VIII, Pub. L. 108-447)
The Teton Basin Ranger District of the Caribou-Targhee National Forest will begin charging $100.00 for the overnight rental of Driggs Cabin. Rentals of other cabins and guard stations on the Caribou-Targhee National Forest have shown that the public appreciates and enjoys the availability of this type of facility. Funds from the rental will be used for the continued operation and maintenance of the Driggs Cabin.
National Environmental Policy Act Procedures
The Department of Agriculture is moving the Forest Service's National Environmental Policy Act (NEPA) codifying procedures from Forest Service Manual (FSM) 1950 and Forest Service Handbook (FSH) 1909.15. In addition to codifying the procedures, the Department is clarifying and expanding them to incorporate Council on Environmental Quality (CEQ) guidance and to better align Forest Service NEPA procedures with its decision processes. This rule gives Forest Service NEPA procedures more visibility, consistent with the transparent nature of the Forest Service's environmental analysis and decision making. Also, the additions to the Forest Service NEPA procedures in this rule are intended to provide an environmental analysis process that better fits with modern thinking on decisionmaking, collaboration, and adaptive management by describing a process for incremental alternative development and development of adaptive management alternatives. Maintaining Forest Service explanatory guidance in the FSH will facilitate timely responses to new ideas, new information, procedural interpretations, training needs, and editorial changes to assist field units when implementing the NEPA process.
Almonds Grown in California; Relaxation of Incoming Quality Control Requirements
This rule relaxes the incoming quality control requirements prescribed under the California almond marketing order (order). The order regulates the handling of almonds grown in California and is administered locally by the Almond Board of California (Board). This rule changes the date by which almond handlers must satisfy their inedible disposition obligation from August 31 to September 30 of each year. This will provide handlers more flexibility in their operations in light of larger almond crops.

There will be an open house in Washington, DC to discuss the proposed rule for the management of roadless areas on National Forest System lands in the State of Colorado.
The Secretary of Agriculture's Determination of the Primary Purpose of Pennsylvania's Upper Makefield Township Riparian Restoration and Preservation Grant Program
NRCS is providing public notice that the Secretary of Agriculture has determined the payments made under Pennsylvania's Upper Makefield Township Riparian Restoration and Preservation Grant Program are primarily for the purpose of protecting or restoring the environment. NRCS was assigned technical and administrative responsibility for reviewing the Upper Makefield Township Riparian Restoration and Preservation Grant Program and making appropriate recommendations for the Secretary's determination of primary purpose. This determination is in accordance with section 126 of the Internal Revenue Code of 1954, as amended (26 U.S.C. 126), and permits recipients of cost-share payments to exclude from gross income to the extent allowed by the Internal Revenue Service.

Raisins Produced From Grapes Grown In California; Revisions to Requirements Regarding Off-Grade Raisins
This rule revises requirements regarding off-grade raisins under the Federal marketing order for California raisins (order). The order regulates the handling of raisins produced from grapes grown in California and is administered locally by the Raisin Administrative Committee (Committee). This rule revises the requirement that notification handlers must provide to the inspection service and the Committee when they perform certain functions on off-grade raisins be in writing, thereby allowing them to use other means of communication, including e-mail. This rule also removes the requirement that handlers submit reports to the Committee regarding transfers of off-grade and other failing raisins. This action brings the order's administrative rules and regulations in line with current industry practices.
Notice of Determination of the High Pathogenicity Avian Influenza Subtype H5N1 Status of Denmark and France
We are advising the public of our determination regarding the high pathogenicity avian influenza (HPAI) subtype H5N1 status of Denmark and France. Based on assessments of the animal health status of the two countries, which we made available to the public for review and comment through a previous notice, the Administrator has determined that the importation of live birds, poultry carcasses, parts or products of poultry carcasses, and eggs (other than hatching eggs) of poultry, game birds, and other birds from either Denmark or France presents a low risk of introducing HPAI H5N1 into the United States.
Sirex Woodwasp; Availability of an Environmental Assessment
We are advising the public that an environmental assessment has been prepared by the Animal and Plant Health Inspection Service relative to a proposed biological control program for Sirex woodwasp. The environmental assessment documents our review and analysis of environmental impacts associated with the proposed biological control program. We are making this environmental assessment available to the public for review and comment.
Section 538 Guaranteed Rural Rental Housing Program (GRRHP) Demonstration Program for Fiscal Year 2008
The Rural Housing Service (RHS) is amending a notice published April 21, 2008 (73 FR 21305-21307). This action is taken to extend the application obligation date of eligible applications. This amendment is to ensure that all applications that meet program criteria and have responded accordingly will be considered in the Demonstration Program. Accordingly, the Notice published on April 21, 2008 (73 FR 21305- 21307), is amended as follows: On page 21306, in the second column, second paragraph, under the heading ``Demonstration Program Selection Process,'' the second paragraph is amended to read as follows: ``The first round of selections into the Demonstration Program will be made on April 25, 2008. In the event there are not enough qualified requests for selection into the Demonstration Program to utilize all the available Demonstration Program set-aside funds of approximately $13 million, then the selection process for any remaining funds will be conducted again on July 11, 2008. If needed, an additional selection process will be conducted again on September 29, 2008. All applicants will be notified of the selection results no later than 30 business days from the date of selection.''

The Rural Utilities Service (RUS), an Agency that delivers the United States Department of Agriculture (USDA) Rural Development Utilities Programs, hereinafter referred to as Rural Development and/or the Agency, intends to hold public scoping meetings and prepare an Environmental Impact Statement (EIS) in connection with possible impacts related to a proposed action by Minnkota Power Cooperative (Minnkota Power), Otter Tail Power Company, and Minnesota Power to construct a 230 kV electric transmission line from Bemidji to Grand Rapids, Minnesota. To minimize duplication of effort pursuant to 40 CFR 1506.2, Rural Development is conducting an environmental review for the proposed action jointly with the Minnesota Department of Commerce, Office of Energy Security (OES). Rural Development and OES will jointly prepare an environmental review document in compliance with federal responsibilities under the National Environmental Policy Act (NEPA) and other federal statutes and regulations, and state responsibilities under the Minnesota Environmental Policy Act and the Minnesota Power Plant Siting Act.
Raisins Produced From Grapes Grown in California; Use of Estimated Trade Demand To Compute Volume Regulation Percentages
This rule invites comments on using an estimated trade demand figure to compute volume regulation percentages for 2008-09 crop Natural (sun-dried) Seedless (NS) raisins covered under the Federal marketing order for California raisins (order). The order regulates the handling of raisins produced from grapes grown in California and is administered locally by the Raisin Administrative Committee (Committee). This rule would provide parameters for implementing volume regulation for 2008-09 crop NS raisins, if supplies are short, for the purposes of maintaining a portion of the industry's export markets and stabilizing the domestic market.
Pistachios Grown in California; Hearing on Proposed Amendment of Marketing Order No. 983
Notice is hereby given of a public hearing to receive evidence on proposed amendments to Marketing Order No. 983 (order), which regulates the handling of pistachios grown in California. The amendments are proposed by the Administrative Committee for Pistachios (Committee), which is responsible for local administration of the order. The proposed amendments would: Expand the production area covered under the order to include Arizona and New Mexico in addition to California; authorize the Committee to reimburse handlers for a portion of their inspection and certification costs in certain situations; authorize the Committee to recommend research projects; modify existing order authorities concerning aflatoxin and quality regulations; modify the authority for interhandler transfers of order obligations; redesignate several sections of the order; remove previously suspended order provisions, and make other related changes. In addition, the Agricultural Marketing Service (AMS) proposes to make any such additional changes as may be necessary to the order to conform to any amendment that may result from the hearing. The proposals are intended to improve the operation and functioning of the marketing order program.
