Notice of Request for Extension of Approval of an Information Collection; Treatments for Fruits and Vegetables
In accordance with the Paperwork Reduction Act of 1995, this notice announces the Animal and Plant Health Inspection Service's intention to request an extension of approval of an information collection associated with regulations for the interstate movement of fruits and vegetables from Hawaii, Puerto Rico, and the U.S. Virgin Islands to help ensure that injurious plant pests are not spread to noninfested areas of the United States.

In accordance with the Paperwork Reduction Act of 1995, this notice announces the Animal and Plant Health Inspection Service's intention to request an extension of approval of an information collection associated with regulations for the possession, use, and transfer of biological agents and toxins that have the potential to pose a severe threat to human and animal health, to animal health, to plant health, or to animal products and plant products.
2008 Direct and Counter-Cyclical Program
As announced by this notice, the Commodity Credit Corporation (CCC) is implementing the provisions of the Food, Conservation, and Energy Act of 2008 (the 2008 Farm Bill) regarding direct and counter- cyclical payments for the 2008 crop year. The 2008 Farm Bill authorizes direct and counter-cyclical payments, with some changes, that were previously authorized for preceding crops under the Farm Security and Rural Investment Act of 2002 (the 2002 Farm Bill). As a result of this notice, CCC will be able to commence administration of the Direct and Counter-cyclical Program (DCP) for the 2008 crop. Through a subsequent rule, CCC will implement DCP for the 2009 through 2012 crops.
Notice of Intent To Renew a Currently Approved Information Collection
In accordance with the Paperwork Reduction Act of 1995 (Pub. L. 104-13) and Office of Management and Budget (OMB) regulations at 5 CFR 1320 (60 FR 44978, August 29, 1995), this notice announces the Agricultural Research Service's (ARS) intention to request an extension for a currently approved information collection in support of USDA's Biological Control Documentation Program dealing with documenting the importation and release of foreign biological control agents.
Catastrophic Risk Protection Endorsement and the Group Risk Plan of Insurance Regulations
The Federal Crop Insurance Corporation (FCIC) amends the Catastrophic Risk Protection Endorsement (7 CFR 402.4) (CAT Endorsement), and the Group Risk Plan Common Policy (7 CFR 407.9) (GRP policy) to incorporate changes in the administrative fees for catastrophic risk protection mandated by the Food, Conservation, and Energy Act of 2008 (Farm Bill 2008).
Information Collection; Valuation of Hemlock Decline on Public Forests in the Southern Appalachian Mountains
In accordance with the Paperwork Reduction Act of 1995, the Forest Service is seeking comments from all interested individuals and organizations on the new information collection, Valuation of Hemlock Decline on Public Forests in the Southern Appalachian Mountains.
Notice of Availability of a Pest Risk Analysis for Importation of Guavas From Mexico Into the United States
We are advising the public that we have prepared a pest risk analysis that evaluates the risks associated with the importation into the United States of fresh guava fruit from Mexico. Based on that analysis, we believe that the application of one or more designated phytosanitary measures will be sufficient to mitigate the risks of introducing or disseminating plant pests or noxious weeds via the importation of guavas from Mexico. We are making the pest risk analysis available to the public for review and comment.
National Wildlife Services Advisory Committee; Meeting

Housing Preservation Grants
The Rural Housing Service (RHS), hereafter referred to as U.S. Department of Agriculture Rural Development is amending its regulations for the Housing Preservation Grants Program to include faith-based and community organizations. Faith-based and community organizations receiving Housing Preservation Grants (HPG) Program funding for the purpose of repairing and rehabilitating housing will operate within the guidance of the 7 CFR 1944, subpart N, as well as, comply with the terms specified in the HPG grant agreement. The intended effect is to improve the delivery and operation of the HPG Program.
Sweet Onions Grown in the Walla Walla Valley of Southeast Washington and Northeast Oregon; Increased Assessment Rate
This rule increases the assessment rate established for the Walla Walla Sweet Onion Marketing Committee (Committee) for the 2008 and subsequent fiscal periods from $0.21 to $0.22 per 50-pound bag or equivalent of Walla Walla sweet onions handled. The Committee locally administers the marketing order which regulates the handling of sweet onions grown in the Walla Walla Valley of Southeast Washington and Northeast Oregon. Assessments upon Walla Walla sweet onion handlers are used by the Committee to fund the reasonable and necessary expenses of the program. The fiscal period begins January 1 and ends December 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Hazelnuts Grown in Oregon and Washington; Establishment of Interim Final and Final Free and Restricted Percentages for the 2007-2008 Marketing Year
The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim final rule establishing interim final and final free and restricted percentages for domestic inshell hazelnuts for the 2007-2008 marketing year under the Federal marketing order for hazelnuts grown in Oregon and Washington. This rule continues in effect the interim final free and restricted percentages of 8.1863 and 91.8137 percent, respectively, and the final free and restricted percentages of 9.2671 and 90.7329 percent, respectively. The percentages allocate the quantity of domestically produced hazelnuts which may be marketed in the domestic inshell market (free) and the quantity of domestically produced hazelnuts that must be disposed of in outlets approved by the Board (restricted). Volume regulation is intended to stabilize the supply of domestic inshell hazelnuts to meet the limited domestic demand for such hazelnuts with the goal of providing producers with reasonable returns. This rule was recommended unanimously by the Hazelnut Marketing Board (Board), the agency responsible for local administration of the marketing order.
Notice of Funding Opportunity With the Food Safety and Inspection Service for Food Safety and Defense Training for Spanish-Speaking Plant Owners and Operators
The Food Safety and Inspection Service (FSIS) is soliciting applications for one or more cooperative agreements for a collaborative outreach program on food safety and defense. The program will target Spanish-speaking owners and operators of small and very small establishments producing meat and poultry products. The goal is to increase knowledge of and compliance with FSIS requirements regarding meat and poultry products sold in the U.S. by this segment of the regulated industry. FSIS will allocate between $50,000 and $100,000 to one or more cooperative agreements this fiscal year 2008, with agreements being renewable for up to five years.
Regulations for Complying With the National Environmental Policy Act
The Natural Resources Conservation Service (NRCS or Agency) is amending its National Environmental Policy Act (NEPA) compliance regulations by clarifying the appropriate use of a program environmental assessment (EA) and by aligning its NEPA public involvement process with that of the Council on Environmental Quality's (CEQ) regulations that implement the NEPA. Both changes would better align the Agency regulations with the CEQ NEPA regulations and provide for the efficient and timely environmental review of NRCS actions, particularly those actions where Congress has directed NRCS action within short time periods of 60-90 days.
Revision of Land Management Plan for the George Washington National Forest, Virginia and West Virginia
The USDA, Forest Service is resuming preparation of the George Washington National Forest revised land management plan as directed by the National Forest Management Act (NFMA). Preparation of the revised plan was halted when the 2005 Forest Service planning rule was enjoined. A new planning rule (36 CFR Part 219 was adopted on April 21, 2008 allowing the planning process to be resumed. This notice resumes the plan revision process under the new 2008 planning rule. This notice also provides: 1. An estimated schedule for the planning process; 2. Request for additional public comments on the agency's draft Comprehensive Evaluation Report, and how the public can comment; 3. A list of documents available and how to get them; 4. Who to contact for more information.
TE-34 Penchant Basin Natural Resources Plan; Terrebonne Parish, LA
Pursuant to Section 102 (2) (C) of the National Environmental Policy Act of 1969; the Council on Environmental Quality Guidelines (40 CFR Part 1500); and the Natural Resources Conservation Service Guidelines (7 CFR Part 650); the Natural Resources Conservation Service, U.S. Department of Agriculture, gives notice that an environmental impact statement is not being prepared for the Penchant Basin Natural Resources Plan (TE-34), Terrebonne Parish, Louisiana.

Subsistence Management Regulations for Public Lands in Alaska-2008-09 and 2009-10 Subsistence Taking of Wildlife Regulations
This final rule establishes regulations for seasons, harvest limits, methods, and means related to taking of wildlife for subsistence uses in Alaska during the 2008-09 and 2009-10 regulatory years. These regulations have been subject to an annual public review cycle, but starting in 2008 the Federal Subsistence Management Program will provide a public review process for subsistence hunting and trapping regulations in even-numbered years and subsistence fishing and shellfish regulations in odd-numbered years. The Program will also address customary and traditional use determinations during the applicable biennial cycle. This cycle adjustment does not affect the public's ability to submit special action requests or requests for reconsideration, as outlined in the regulations. This rulemaking replaces the subpart D subsistence taking of wildlife taking regulations which expire June 30, 2008. This rule also amends the customary and traditional use determinations of the Federal Subsistence Board.

Ravalli County Resource Advisory Committee
The Ravalli County Resource Advisory Committee will be meeting to go on a field trip. The meeting is being held pursuant to the authorities in the Federal Advisory Committee Act (Pub. L. 92-463) and under the Secure Rural Schools and Community Self-Determination Act of 2000 (Pub. L. 106-393). The meeting is open to the public.
Nebraska National Forest, Nebraska & South Dakota; Black-Tailed Prairie Dog (Cynomys ludovicianus) Management on the Nebraska National Forest and Associated Units
This project would amend current management direction in the Nebraska National Forest Land and Resource Management Plan (LRMP) for black-tailed prairie dog (Cynomys ludovicianus) management on the Nebraska National Forest and associated units (NNF). The proposed LRMP amendment is to meet various multiple use objectives by: (1) Specifing the desired range of acres of prairie dog colonies that would be provided on the Nebraska National Forest and associated units; and (2) allowing the use of rodenticides if the acreage exceeds the desired range and for multiple use objectives. A Notice of Intent (NOI) to supplement the 2002 LRMP environmental impact statement (EIS) for this project was published September 29, 2006 (71 FR 57460-57462). On February 28, 2007 (72 FR 8962) a revised NOI was published indicating that the Agency would not be preparing a supplement to the 2002 LRMP EIS but would be preparing a separate environmental impact statement for black-tailed prairie dog (Cynomys ludovicianus) management on the Nebraska National Forest and associated units. This EIS would tier to 2002 LRMP. More than six months have elapsed since the projected FEIS date in that original NOI. Also, the responsible official has changed to Jane Darnell, Forest Supervisor (no change in title). This revised NOI is being issued to update the project schedule and responsible official.
Milk in the Northeast and Other Marketing Areas; Tentative Partial Final Decision on Proposed Amendments and Opportunity To File Written Exceptions to Tentative Marketing Agreements and Orders
This tentative partial final decision proposes to adopt changes to the manufacturing cost allowances and the butterfat yield factor used in Class III and Class IV product-price formulas applicable to all Federal milk marketing orders on an interim basis. A separate decision regarding the collection of manufacturing cost information, the use of an energy cost adjustor and providing for a cost add-on feature to Class III and Class IV product-pricing formulas will be addressed in a separate decision. This tentative partial decision requires determining if producers approve the issuance of the amended orders on an interim basis.
Georgia Transmission Corporation: Notice of Finding of No Significant Impact
The Rural Utilities Service (RUS), an agency delivering the United States Department of Agriculture (USDA) Rural Development Utilities Programs, hereinafter referred to as Rural Development and/or the Agency, has made a finding of no significant impact (FONSI) with respect to a request for possible financing assistance to Georgia Transmission Corporation for the construction of the approximately 38.7-mile Thomson-Warthen 500 kV transmission line connecting GTC's Thomson Primary 500/230/115/46 kV Substation in McDuffie County, Georgia to their Warthen 500 kV Switching Station in Washington County, Georgia.

On June 13, 2008 the BLM published a Notice of Availability in the Federal Register (73 FR 33802), which inadvertently printed an incorrect list of public meeting dates.
Agency Information Collection Activities: Proposed Collection; Comment Request-Evaluation of the Birth Month Breastfeeding Changes to the WIC Food Packages
In accordance with the Paperwork Reduction Act of 1995, this notice invites the general public and other public agencies to comment on this proposed information collection. On December 6, 2007, FNS published an interim regulation in the Federal Register: Special Supplemental Nutrition Program for Women, Infants and Children (WIC): Revisions in the WIC Food Packages; Interim Rule [72 FR 68966]. This current notice announces FNS' intent to request from the Office of Management and Budget (OMB) approval to collect information for the evaluation of impacts of the Interim Rule on the food package choices and breastfeeding outcomes of postpartum women who participate in WIC.
Agency Information Collection Activities: Proposed Collection; Comment Request; Waivers Under Section 6(o) of the Food Stamp Act
In accordance with Paperwork Reduction Act of 1995, this notice invites the general public and other public agencies to comment on proposed information collections. The proposed collection is a revision of a currently approved collection. The purpose of Section 6(o) of the Food Stamp Act of 1977, as amended by Section 824 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, is to establish a time limit for the receipt of food stamp benefits for certain able-bodied adults who are not working. The provision authorizes the Secretary of Agriculture, upon a State agency's request, to waive the provision for any group of individuals if the Secretary determines ``that the area in which the individuals reside has an unemployment rate of over 10 percent, or does not have a sufficient number of jobs to provide employment for the individuals.'' As required in the statute, in order to receive a waiver the State agency must submit sufficient supporting information so that the United States Department of Agriculture (USDA) can make the required determination as to the area's unemployment rate or sufficiency of available jobs. This collection of information is therefore necessary in order to obtain waivers of the food stamp time limit.
Bayer CropScience; Availability of Petition and Draft Environmental Assessment for Determination of Nonregulated Status for Cotton Genetically Engineered for Glyphosate Herbicide Tolerance
We are advising the public that the Animal and Plant Health Inspection Service has received a petition from Bayer CropScience seeking a determination of nonregulated status for cotton genetically engineered for tolerance to the herbicide glyphosate derived from a transformation event designated as GHB614. The petition has been submitted in accordance with our regulations concerning the introduction of certain genetically engineered organisms and products. In accordance with those regulations, we are soliciting comments on whether this genetically engineered cotton is or could be a plant pest. We are making available for public comment the petition and draft environmental assessment for the proposed determination of nonregulated status.
Interstate Movement of Municipal Solid Waste From Hawaii; Availability of an Environmental Assessment and Finding of No Significant Impact
We are advising the public that the Animal and Plant Health Inspection Service has prepared a regional programmatic environmental assessment and finding of no significant impact relative to the interstate movement of municipal solid waste from Hawaii to landfills in the States of Idaho, Oregon, and Washington. The environmental assessment contains a general assessment of the potential environmental effects associated with moving garbage interstate from Hawaii to Idaho, Oregon, and Washington subject to certain pest risk mitigation measures and documents our review and analysis of the environmental impacts associated with, and alternatives to, such movements. Based on its finding of no significant impact, the Animal and Plant Health Inspection Service has determined that an environmental impact statement need not be prepared.
Agricultural Air Quality Task Force
The Secretary of Agriculture intends to reestablish the Agricultural Air Quality Task Force (AAQTF) and requests nominations for qualified persons to serve as members.
Peanut Standards Board
The Farm Security and Rural Investment Act of 2002 requires the Secretary of Agriculture to establish a Peanut Standards Board (Board) for the purpose of advising the Secretary on quality and handling standards for domestically produced and imported peanuts. The initial Board was appointed by the Secretary and announced on December 5, 2002. USDA seeks nominations for individuals to be considered for selection as Board members for terms of office ending June 30, 2011. Selected nominees sought by this action would replace those six producer and industry representatives who are currently serving for the term of office that ends June 30, 2008. The Board consists of 18 members representing producers and industry representatives.
Dairy Product Mandatory Reporting
This final rule adopts amendments to the Dairy Product Mandatory Reporting Program that was established on August 2, 2007 on an interim final basis. The Dairy Market Enhancement Act of 2000, and certain provisions of the Farm Security and Rural Investment Act of 2002, amended the Agricultural Marketing Act of 1946 to provide for timely, accurate, and reliable market information to facilitate more informed marketing decisions and promote competition in the dairy product manufacturing industry.
Revision of the Hawaiian and Territorial Fruits and Vegetables Regulations
We are proposing to revise and reorganize the regulations pertaining to the interstate movement of fruits and vegetables from Hawaii and the territories to consolidate requirements of general applicability and eliminate redundant requirements, update terms and remove outdated requirements and references, and make various editorial and nonsubstantive changes to the regulations to make them easier to use. We are also proposing to make substantive changes to the regulations including establishing criteria within the regulations that, if met, would allow us to approve certain new fruits and vegetables for interstate movement in the United States and to acknowledge pest-free areas in Hawaii and U.S. territories expeditiously, and removing the listing in the regulations of some specific commodities as regulated articles. These changes are intended to simplify and expedite our processes for approving certain regulated articles for interstate movement and pest-free areas while continuing to allow for public participation in the processes. This proposal, if adopted, would not allow for the interstate movement of any specific new fruits or vegetables, nor would it alter the conditions for interstate movement of currently approved fruits or vegetables. These proposed changes would make our domestic interstate movement regulations more consistent with our fruits and vegetables import regulations. The proposed changes would not alter the manner in which the risk associated with a regulated article interstate movement request is evaluated, nor would it alter the manner in which those risks are ultimately mitigated.
Regulatory Flexibility Act Assessment-Locatable Minerals Operations
The Forest Service published in the Federal Register a proposed rule to revise the regulations for locatable minerals operations conducted on National Forest System lands. The proposed rule considered impacts to small entities under Executive Order 13272 and the Small Business Regulatory Enforcement Fairness Act of 1996 (SBREFA). However, the proposed rule did not make available nor seek comment on the small entities flexibility assessment. This notice allows for review and seeks comment on the flexibility assessment.
Agency Information Collection Activities: Proposed Collection; Comment Request: Food Stamp Program Pre-Screening Tool Survey
In accordance with the Paperwork Reduction Act of 1995, this notice invites the general public and other public agencies to comment on the proposed revision of this currently approved collection. The information collection involves the use of a Web-based pre-screening tool for the general public to use to determine potential eligibility for Food Stamp Program benefits.
Notice of Availability of the Draft Programmatic Environmental Impact Statement for Leasing of Geothermal Resources in 11 Western States and Alaska and Notice of Public Hearings
In accordance with Section 202 of the National Environmental Policy Act of 1969 (NEPA) (42 U.S.C. 4321 et seq.), the Council on Environmental Quality's regulations implementing the NEPA (40 CFR 1500- 1508), and applicable agency guidance, a Draft Programmatic Environmental Impact Statement (PEIS) has been prepared on the leasing of geothermal resources in 11 Western States and Alaska. The Department of the Interior, the Bureau of Land Management (BLM) and the Department of Agriculture, the Forest Service (FS) are co-lead agencies for the PEIS, and the Department of Energy (DOE) is a cooperating Federal agency. In accordance with the Energy Policy Act of 2005 (Pub. L. 109-58, August 8, 2005), the agencies' goal is to make geothermal leasing decisions on pending lease applications submitted prior to January 1, 2005, and to facilitate geothermal leasing decisions on other existing and future lease applications and nominations for geothermal leasing on Federal lands. The planning area encompasses about 530 million acres of land with the potential for geothermal development in Alaska, Arizona, California, Colorado, Idaho, Montana, New Mexico, Nevada, Oregon, Utah, Washington, and Wyoming.
Movement of Hass Avocados From Areas Where Mexican Fruit Fly or Sapote Fruit Fly Exist
We are reopening the comment period for our proposed rule that would amend our domestic quarantine regulations to provide for the interstate movement of Hass avocados from Mexican fruit fly and sapote fruit fly quarantined areas in the United States with a certificate if the fruit is safeguarded after harvest in accordance with specific measures. The proposed rule would also amend our foreign quarantine regulations to remove trapping and bait spray treatment requirements related to Anastrepha spp. fruit flies for imported Hass avocados from Michoacan, Mexico. This action will allow interested persons additional time to prepare and submit comments.
Notice of New Fee Sites; Federal Lands Recreation Enhancement Act (Title VIII, Pub. L. 108-447)
The Soda Springs Ranger District of the Caribou-Targhee National Forest will begin charging a $8.00 fee for overnight camping at the Pine Bar and Mill Canyon Campgrounds on the Soda Springs Ranger District. There will also be a $2.00 fee for an extra vehicle. Overnight camping at other campgrounds on the Caribou-Targhee National Forest has shown that the public appreciates and enjoys the availability of developed recreation campground facilities. Funds from the use of these developed campground facilities will be used for the continued operation and maintenance of Pine Bar and Mill Canyon Campgrounds.
Goose Creek Watershed Livestock Grazing Analysis on the Tongue Ranger District, Bighorn National Forest, Sheridan and Johnson Counties, WY
The USDA, Forest Service, will prepare an environmental impact statement (EIS) to update range management planning on seven (7) cattle and horse allotments in the Goose Creek area, which will result in development of new allotment management plans (AMPs). The agency gives notice of the full environmental analysis and decision-making process that will occur on the proposal so that interested and affected people may become aware of how they may participate in the process and contribute to the final decision.

Privacy Act System of Records; APHIS National Animal Identification System (NAIS); Notice of Indefinite Suspension of Effective Date
This notice suspends indefinitely the effective date for the proposed new Privacy Act system of records entitled ``National Animal Identification System (NAIS), USDA/APHIS-16,'' published at 73 FR 23412 on April 30, 2008.
Guaranteed Loans; Number of Days of Interest Paid on Loss Claims
The Farm Service Agency (FSA) is clarifying and simplifying its regulations governing the number of days interest will be paid on loss claims. The liquidation provisions currently provide a timeframe for the interest payment based upon ``the date of the decision to liquidate,'' which is often difficult to determine. This final rule will eliminate ``the date of the decision to liquidate'' as the beginning timeframe for the interest payment on loss claims. In addition, FSA is clarifying the guaranteed lender's responsibility for future recoveries.
