Quarterly Listings; Safety Zones, Security Zones, Special Local Regulations and Drawbridge Operation Regulations
This document provides required notice of substantive rules issued by the Coast Guard and temporarily effective between April 1, 2005 and September 30, 2005 that were not published in the Federal Register. This quarterly notice lists temporary local regulations, temporary drawbridge operation regulations, security zones, and safety zones, all of limited duration and for which timely publication in the Federal Register was not possible.
Safety Zone; Gulf of Alaska, Narrow Cape, Kodiak Island, AK
The Coast Guard is establishing a temporary safety zone in the Gulf of Alaska, encompassing the navigable waters in the vicinity of Narrow Cape and Ugak Island. The zone is needed to protect persons and vessels operating in the vicinity of the safety zone during a rocket launch from the Alaska Aerospace Development Corporation, Narrow Cape, Kodiak Island facility. Entry of vessels or persons into this zone is prohibited unless specifically authorized by the Commander, Seventeenth Coast Guard District, the Coast Guard Captain of the Port, Western Alaska, or their on-scene representative. The intended effect of the safety zone is to ensure the safety of human life and property during the rocket launch.
Vessel Documentation: Lease Financing for Vessels Engaged in the Coastwise Trade
The Coast Guard proposes to amend its regulations for documenting lease-financed vessels that have a ``coastwise endorsement'' (i.e., vessels used in trade and passenger service within the U.S. or between U.S. ports and those used in dredging and towing in U.S. waters). The vessels affected by this proposal are owned by foreign-owned or controlled U.S. companies, where there is a ``demise charter'' to a U.S. citizen (i.e., an agreement for the charterer to assume responsibility for operating, crewing, and maintaining the vessel as if the charterer owned it).
Waterway Suitability Assessment for Expansion of Dominion Cove Point Liquefied Natural Gas Facility, Calvert County, Maryland
On August 8, 2005, the Federal Energy Regulatory Commission (FERC) requested Dominion Cove Point Liquefied Natural Gas (LNG) Limited Partnership to prepare a Waterway Suitability Assessment (WSA) for the proposed Cove Point LNG Expansion Project to be submitted to the United States Coast Guard in accordance with the Navigation and Vessel Inspection Circular (NVIC) 05-05. The purpose of the WSA is to identify credible security threats and safety hazards associated with increased LNG marine transportation in the Chesapeake Bay and identify appropriate risk management measures. The Coast Guard Captain of the Port, Baltimore, and the Captain of the Port, Hampton Roads, received the WSA from Dominion Cove Point on January 17, 2006. The conclusions of the WSA are included in this notice. The Coast Guard solicits public comments on these conclusions to consider when preparing recommendations to FERC for inclusion in their final Environmental Impact Statement (EIS) regarding the suitability of the Chesapeake Bay for increased LNG traffic.
Maritime Security Directive (MARSEC Directive) 104-6; Guidelines for U.S. Vessels Operating in High Risk Waters
The Coast Guard announces the availability of MARSEC Directive 104-06. This MARSEC Directive provides guidelines for U.S. vessels operating in high risk waters. Information within this MARSEC Directive is designated Sensitive Security Information (SSI) and is not subject to public release.
Houston/Galveston Navigation Safety Advisory Committee
The Houston/Galveston Navigation Safety Advisory Committee (HOGANSAC) and its working groups will meet to discuss waterway improvements, aids to navigation, area projects impacting safety on the Houston Ship Channel, and various other navigation safety matters in the Galveston Bay area. All meetings will be open to the public.
Safety Zone; Cuyahoga River, Cleveland, OH
The Coast Guard is establishing a temporary safety zone for installing the West Third Street Bridge on the Cuyahoga River. The safety zone is limited to the area surrounding the bridge span during the installment process. The safety zone is necessary to ensure the safety of those working on the bridge. All other portions of the Cuyahoga River are unaffected. If the installment process is completed ahead of schedule this safety zone will be canceled immediately and notices made to the public by means of Local Notice to Mariners Broadcasts.
Drawbridge Operation Regulations: Connecticut River, Old Lyme, CT
The Commander, First Coast Guard District, has issued a temporary deviation from the drawbridge operation regulations governing the operation of the AMTRAK Old Saybrook-Old Lyme Bridge, across the Connecticut River at mile 3.4, at Old Lyme, Connecticut. This deviation from the regulations allows the bridge to operate on a fixed schedule for bridge openings from February 4, 2006 through March 6, 2006, and also authorizes one 12-hour and two 72-hour bridge closures. This deviation is necessary in order to facilitate scheduled bridge maintenance.
Drawbridge Operation Regulations; Niantic River, Niantic, CT
The Commander, First Coast Guard District, has issued a temporary deviation from the drawbridge operation regulations governing the operation of the Amtrak Bridge at mile 0.0, across the Niantic River, at Niantic, Connecticut. This deviation allows the bridge owner to require an advance notice for bridge openings from February 3, 2006 through April 3, 2006. This deviation is necessary in order to facilitate emergency unscheduled bridge maintenance.
Special Local Regulations for Marine Events; Maryland Swim for Life, Chester River, Chestertown, MD
The Coast Guard proposes to amend the special local regulations at 33 CFR 100.533, established for the ``Maryland Swim for Life'' held annually on the waters of the Chester River, near Chestertown, Maryland by changing the event date to the third Saturday in June. This proposed rule is intended to restrict vessel traffic in portions of the Chester River and is necessary to provide for the safety of life on navigable waters during the event.
Special Local Regulations for Marine Events; Severn River, College Creek, Weems Creek and Carr Creek, Annapolis, MD
The Coast Guard proposes to suspend the special local regulations at 33 CFR 100.518 and establish a temporary rule that will be effective during the suspension period. This rulemaking is intended to accommodate a change in event dates for the year 2006 and modify the boundaries of the regulated area. The marine events included in this proposed rule include the Safety at Sea Seminar, U.S. Naval Academy Crew Races and the Blue Angels Air Show. This proposed rule is intended to restrict vessel traffic in portions of the Severn River during the period of these marine events and is necessary to provide for the safety of life on navigable waters during the event.

Before submitting the ICRs to OMB, the Coast Guard is inviting comments on them as described below.
Towing Safety Advisory Committee; Vacancies
The Coast Guard seeks applications for membership on the Towing Safety Advisory Committee (TSAC). TSAC advises the Coast Guard on matters relating to shallow-draft inland and coastal waterway navigation and towing safety.
Drawbridge Operation Regulations; Shark River (South Channel), Avon, NJ
The Commander, Fifth Coast Guard District, has approved a temporary deviation from the regulations governing the operation of the New Jersey Transit Railroad Drawbridge, at mile 0.9, across the South Channel of the Shark River at Belmar, New Jersey, south of Avon. To facilitate electrical repairs, this deviation allows the drawbridge to remain closed-to-navigation from 11 p.m. on February 10, 2006, until 12 p.m. (noon) on February 11, 2006, and from 11 p.m. on February 24, 2006, until 12 p.m. (noon) on February 25, 2006. If required, a rain date has been set from 11 p.m. on March 10, 2006, until 12 p.m. (noon) on March 11, 2006.
Security Zone; Choptank River, Cambridge, MD
The Coast Guard is establishing a temporary security zone from February 9 through February 12, 2006, encompassing certain waters of the Choptank River. This action is necessary to ensure the safety of persons and property, and prevent terrorist acts or incidents during the U.S. House Republican Issues Conference. This rule prohibits vessels and people from entering the security zone and requires vessels and persons in the security zone to depart the security zone, unless specifically exempt under the provisions in this rule or granted specific permission from the Coast Guard Captain of the Port Baltimore.
Towing Safety Advisory Committee
The Towing Safety Advisory Committee (TSAC) and its working groups will meet as required to discuss various issues relating to shallow-draft inland and coastal waterway navigation and towing safety. All meetings will be open to the public.
Exclusion Zones for Marine LNG Spills
The Coast Guard announces the availability of its response to a petition for rulemaking requesting issuance of regulations establishing thermal and vapor dispersion exclusion zones for marine spills of liquefied natural gas (LNG), by the City of Fall River, MA. The Coast Guard has determined that such a rulemaking project is unnecessary.
Safety Zone: North Portland Harbor Dredging Operations; Portland, OR
This document contains a correction to effective date of the temporary final rule establishing a temporary safety zone on the Columbia River, in the vicinity of Hayden Island at North Portland Harbor (CGD-13-06-002) published on January 25, 2006, in the Federal Register (71 FR 4043).
Drawbridge Operation Regulation; Mississippi River, Iowa and Illinois
The Coast Guard is changing the regulation governing the Clinton Railroad Drawbridge, Mile 518.0, Upper Mississippi River at Clinton, Iowa. Under the rule, the drawbridge shall open on signal if at least 24 hours advance notice is given from 12:01 a.m., on January 20, 2006 until 9 a.m., on March 1, 2006. This rule allows time for making upgrades to critical mechanical components and to perform scheduled annual maintenance/repairs to the bridge.
Safety Zone; Alaska, South Central, Cook Inlet, Kamishak Bay
The Coast Guard is establishing a temporary safety zone near Augustine Island, located in Kamishak Bay in Cook Inlet, Alaska. The zone is needed to protect marine traffic from hazards associated with recent eruptions of the Augustine Volcano. Entry of vessels or persons into this zone is prohibited unless specifically authorized by the Commander, Seventeenth Coast Guard District; the Coast Guard Captain of the Port, Western Alaska; or their on-scene representative. The intended effect of the proposed safety zone is to mitigate damage to vessels from hazards associated with the Augustine Volcano.

Drawbridge Operation Regulations; Atlantic Intracoastal Waterway, Broward County, FL
On August 16, 2005, the Coast Guard proposed to change the regulations governing the operation of 10 drawbridges, and establish operating regulations for 2 drawbridges, all of which cross the Atlantic Intracoastal Waterway in Broward County, FL. The proposed rule would require all of these drawbridges to open twice an hour. The proposed schedule is based on a request from Broward County officials, a test the Coast Guard conducted from December, 2004, until February, 2005, and comments received from the public based on the test. The proposed schedule meets the reasonable needs of navigation while accommodating increased vehicular traffic throughout the county. Due to the active hurricane season and lack of public comments to the previous Notice of Proposed Rulemaking we are reissuing the previous Notice of Proposed Rulemaking.
Announcement of Public Meeting Regarding the Proposed Drawbridge Schedule Change for the Anna Maria and Cortez Drawbridges, Anna Maria, FL
The Coast Guard will hold a public meeting at the Holmes Beach City Hall, 5801 Marina Drive, Holmes Beach, Florida 34217 to allow interested parties the opportunity to provide comments regarding whether the Anna Maria and Cortez Drawbridge schedules should be changed.
Drawbridge Operation Regulations; Atlantic Intracoastal Waterway (AICW), Cape Fear River, and Northeast Cape Fear River, NC
The Coast Guard is changing the drawbridge operation regulations of three North Carolina Department of Transportation (NCDOT) bridges: The S.R. 74 Bridge, across the AICW mile 283.1 at Wrightsville Beach; the Cape Fear River Memorial Bridge, mile 26.8, at Wilmington; and the Isabel S. Holmes (US 117) Bridge, at mile 1.0, across Northeast Cape Fear River at Wilmington, North Carolina. This rule will allow the bridges to remain in the closed position at particular dates and times to accommodate road races, marathons and triathlons. Vessels that can pass under the bridges without a bridge opening may do so at all times.
Drawbridge Operation Regulations; Jamaica Bay and Connecting Waterways, NY
The Coast Guard proposes to temporarily change the drawbridge operating regulations governing the operation of the New York City Highway Bridge (Belt Parkway), at mile 0.8, across Mill Basin. This notice of proposed rulemaking would allow the bridge owner to open only one of the two moveable spans for the passage of vessel traffic from March 1, 2006 through September 7, 2006. This proposed rule is necessary to facilitate bridge deck replacement.
Security Zone; Superbowl XL, Detroit River, Detroit, MI
The Coast Guard is establishing a temporary security zone on the Detroit River, Detroit, Michigan. This zone is intended to restrict vessels from a portion of the Detroit River in order to ensure the safety of up to 450,000 people expected to attend Super Bowl XL at Ford Field as well as related events at Cobo Hall, Hart Plaza and the Renaissance Center in downtown Detroit.
Security Zone; Pearl Harbor and Adjacent Waters, Honolulu, HI
This temporary rule establishes a 500-yard moving security zone around the U.S. Forces vessel SBX-1 during transit and float-off operations in the waters adjacent to Pearl Harbor, HI. The SBX-1 will transit aboard the M/V BLUE MARLIN and will be floated-off and escorted into Pearl Harbor. This security zone is necessary to protect the SBX-1 from hazards associated with other vessels or persons approaching too close during the transit, float-off, and escort operations. Entry of persons or vessels into this temporary security zone is prohibited unless authorized by the Captain of the Port (COTP).
Ballast Water Management for Vessels Entering the Great Lakes That Declare No Ballast Onboard; Environmental Assessment and Finding of No Significant Impact
The Coast Guard announces the availability of the Final Environmental Assessment (EA) and Finding of No Significant Impact (FONSI) that evaluated the potential environmental impacts resulting from the implementation of the policy on ballast water management for vessels entering the Great Lakes declaring no ballast onboard (NOBOB). The purpose of this policy is to prevent the introductions of aquatic nonindigenous species (NIS) into the Great Lakes.

Safety Zone; Chicago Sanitary and Ship Canal, Romeoville, IL
The Coast Guard is establishing a temporary safety zone on the Chicago Sanitary and Ship Canal on the Illinois Waterway near Romeoville, Illinois. This safety zone is necessary to close the Chicago Sanitary and Ship Canal during safety testing of the permanent electrical dispersal barrier. This safety zone intended to restrict vessels from a portion of the Canal in Romeoville, IL, at various times over a 45 day period.
Chemical Transportation Advisory Committee
The Chemical Transportation Advisory Committee (CTAC) Subcommittees on Outreach and Hazardous Cargo Transportation Security (HCTS) will meet to discuss various issues relating to CTAC and the marine transportation of hazardous materials in bulk. The CTAC Working Groups on Barge Emissions and the International Convention for the Prevention of Pollution from Ships, 1973 (MARPOL) Annex II will also meet to discuss environmental issues and future changes to regulations. These meetings will be open to the public.

Safety Zone: North Portland Harbor Dredging Operations; Portland, OR
The Coast Guard is establishing a temporary safety zone on the Columbia River, in the vicinity of Hayden Island at North Portland Harbor. The Captain of the Port, Portland, Oregon is taking this action to safeguard individuals and vessels from safety hazards associated with dredging operations. Entry into this safety zone is prohibited unless authorized by the Captain of the Port.
Notification of the Imposition of Conditions of Entry for Certain Vessels Arriving to the United States
The Coast Guard announces that effective anti-terrorism measures are not in place in certain ports of Equatorial Guinea and that it will impose conditions of entry on vessels arriving from that country. The Coast Guard also announces that conditions of entry are being removed from vessels arriving from ports in the Democratic Republic of Congo.
Temporary Authorization To Extend Certificates of Inspection and Certificates of Compliance
The Coast Guard announces that Congress authorized (through H.R. 4508), the Secretary of Homeland Security to extend temporarily the duration or the validity of Certificates of Inspection and Certificates of Compliance that are issued under chapter 33 or 37, respectively, of title 46, U.S. Code. These certificates may be extended for up to three (3) months for any vessel inspected by the Coast Guard in Alabama, Mississippi, or Louisiana.
Drawbridge Operation Regulations; Elizabeth River, Eastern Branch, VA
The Commander, Fifth Coast Guard District, has approved a temporary deviation from the regulations governing the operation of the Berkley Bridge, at mile 0.4, across the Eastern Branch of the Elizabeth River in Norfolk, Virginia. To facilitate electrical repairs, this deviation allows the drawbridge to remain closed-to-navigation from 7 a.m. on February 7, 2006, to 7 a.m. on February 8, 2006 and from 7 a.m. on February 14, 2006, to 7 a.m. on February 15, 2006.
Meeting of the Office of Boating Safety's Recreational Boating Safety Strategic Planning Panel
The Coast Guard's Office of Boating Safety is sponsoring a panel of representatives of the recreational boating community to discuss strategic planning goals, objectives and strategies that the Coast Guard may use to improve recreational boating safety. This meeting is open to the public.
Regulated Navigation Area: Savannah River, Savannah, GA
The Coast Guard proposes to amend the Regulated Navigation Areas for Savannah River, Georgia. Two new berths have been created at the Liquefied Natural Gas (LNG) facility on the Savannah River and the current regulation only addresses facility and vessel requirements when an LNG vessel is underway, or is moored parallel to the navigational channel outside of the slip. The current regulation is no longer adequate and the proposed changes address the addition of the new berths and requirements for three different mooring situations.
Safety Zone; Vermilion River, Vermilion, OH. VYC Fleet Parade.
The Coast Guard proposes establishing a temporary safety zone for the VYC Fleet Parade on the Vermilion River between the mouth of the river and the Conrail Railroad Bridge, to extend the entire width of the river. This safety zone is needed to protect persons and vessels from the potential safety hazards associated with the Fleet Parade. Entry into this zone is prohibited to all vessels unless authorized by the Captain of the Port, Buffalo or a designated representative.
Anchorage Regulations; Port of New York and Vicinity
The Coast Guard proposes to establish a Special Anchorage Area in Haverstraw Bay on the Hudson River adjacent to Haverstraw, NY. This proposed action is necessary to facilitate safe navigation in that area and provide safe and secure anchorages for vessels not more than 20 meters in length. This action is intended to increase the safety of life and property on the Hudson River, improve the safety of anchored vessels, and provide for the overall safe and efficient flow of recreational vessel traffic and commerce.
Safety Zone; Cooper River, Hog Island Channel, Grace Memorial and Silas Pearman Bridges, Charleston, SC
The Coast Guard is establishing a temporary safety zone on the navigable waters of Hog Island Reach on the Cooper River, for the demolition and recovery operations of the Grace Memorial and Silas Pearman Bridges. This rule prohibits entry, anchoring, mooring, or transiting within the temporary safety zone without the permission of the Captain of the Port Charleston or his designated representative. This regulation is necessary to protect life and property on the navigable waters of the Cooper River from the danger associated with the demolition and recovery operations of these bridges.
Safety Zone; Town Creek Channel, Grace Memorial and Silas Pearman Bridges, Charleston, SC
The Coast Guard is establishing a temporary safety zone on the navigable waters of the Town Creek Channel for the demolition and recovery operations of the Grace Memorial and Silas Pearman Bridges. This rule prohibits entry, anchoring, mooring, or transiting within the temporary safety zone without the permission of the Captain of the Port Charleston or his designated representative. This regulation is necessary to protect life and property on the navigable waters of the Town Creek channel from the danger associated with the demolition/ recovery operations of the Grace Memorial and Silas Pearman Bridges.
Anchorage Regulations; San Pedro Bay, CA
The Coast Guard is enlarging the current anchorage area outside the Federal breakwater of the Ports of Los AngelesLong Beach, CA. This rule is necessary in order to accommodate the ever-increasing number of larger vessels necessitating anchorage and will provide vessels an appropriate area to anchor.
Safety Zone Regulation; Tampa Bay, FL
The Coast Guard is establishing a temporary safety zone on the waters of Tampa Bay, Florida in the vicinity of the Treasure Island Causeway bascule bridge. This safety zone is being established to protect mariners from the hazards associated with the blasting demolition of the concrete portions of the Treasure Island bascule bridge. This rule is necessary to provide for the safety of life on the navigable waters of the United States.
Security Zones; Port Valdez and Valdez Narrows, Valdez, AK
The Coast Guard is continuing temporary security zones encompassing the Trans-Alaska Pipeline (TAPS) Valdez Terminal Complex, Valdez, Alaska and TAPS Tank Vessels and Valdez Narrows, Port Valdez, Alaska, and is reducing the size of one of these zones. These temporary security zones will remain effective until February 12, 2006, while we complete a separate rulemaking to create permanent security zones in these locations.
Merchant Mariner Credentials: Temporary Procedures
On August 29, 2005, Hurricane Katrina devastated the coastlines of Alabama, Mississippi, and Louisiana. The Regional Examination Center at New Orleans, which provided credentialing services to approximately 29,000 mariners in those three states and 14 percent of mariners nationwide, was completely flooded, destroying vital records and equipment and rendering the facility temporarily inoperable. Mariners in the area may have lost their credentials in the storm and subsequent flooding, or may be in possession of credentials that either have expired or will soon be expiring. The Coast Guard has previously implemented temporary measures to relieve the hardship on mariners in the Gulf Coast area who need replacement documents. With new temporary authority granted by Congress, the Coast Guard is implementing the additional measure of extending the expiration dates for the credentials of eligible mariners until February 28, 2006.

Validation of Merchant Mariners' Vital Information and Issuance of Coast Guard Merchant Mariner's Licenses and Certificates of Registry
The Coast Guard is amending the maritime personnel licensing rules to include new security requirements when mariners apply for original, renewal, and raise of grade licenses and certificates of registry. This interim rule corrects omissions and ambiguities in the Coast Guard's preexisting maritime personnel licensing regulations. This interim rule will require all applicants for licenses and certificates of registry to have their identity checked and their fingerprints taken for a criminal record review by the Coast Guard. The new requirements are similar to those that apply to applicants for merchant mariner's documents.
