Through the IHBG program, HUD makes assistance available to eligible Indian tribes for affordable housing activities. The amount of assistance made available to each Indian tribe is determined using an allocation formula (IHBG Formula) that was developed jointly by HUD and Indian tribes using the procedures of the Negotiated Rulemaking Act of 1990 (5 U.S.C. 561– 570). A regulatory description of the IHBG Formula is located in subpart D of the IHBG program regulations codified at 24 CFR part 1000. HUD negotiated the February 25, 2005, proposed rule with active tribal participation and using the procedures of the Negotiated Rulemaking Act. The proposed regulatory changes reflect the consensus decisions reached by HUD and the tribal representatives on ways to improve and clarify the current regulations governing the IHBG Formula. On November 29, 2005, EPA proposed to approve a correction to the State Implementation Plan (SIP) for the PO 00000 Frm 00010 Fmt 4702 Sfmt 4702 2177 State of Georgia regarding the State’s general ‘‘nuisance’’ rule. EPA has determined that this rule, Georgia Rule 391–3–1.02(2)(a)1, was erroneously incorporated into the SIP. EPA is proposing to remove this rule from the approved Georgia SIP because the rule is not related to the attainment and maintenance of the national ambient air quality standards (NAAQS). At the request of several commentors, EPA is extending the comment period through January 23, 2006. DATES: Written comments must be received on or before January 23, 2006.
