This document corrects a notice appearing in the Federal Register on February 17, 2009 (74 FR 7488), that announced the availability of Final Interim Staff Guidance (ISG) COL/ESP-ISG-004. This action is necessary to correct the Agencywide Documents Access Management System (ADAMS) accession number for the ISG.

The NRC is providing notice that the NRC staff will conduct a meeting to discuss and accept comments on the PSDAR for the NS Savannah on March 11, 2009, from 7 p.m. to 9 p.m. The meeting will be held on- board the NS Savannah located at Pier 13, Canton Marine Terminal, 4601 Newgate Ave., Baltimore, MD 21224. On December 11, 2008, the U.S. Department of Transportation Maritime Administration (MARAD) submitted its PSDAR for the NS Savannah. The PSDAR provides an overview of MARAD's proposed decommissioning activities, schedule, and costs for the NS Savannah. The NS Savannah was brought to power in 1961 and removed from service in 1970. Final reactor shutdown occurred in November 1970 and defueling was completed in fall 1971. In 1975 the NS Savannah was ``mothballed.'' NRC issued a ``possessiononly'' license for the NS Savannah in 1976. The NS Savannah was in a mothballed status from 1976 to 2006. In 2006, MARAD made the decision to place the ship in extended SAFSTOR until the budget could support decommissioning and license termination. MARAD submitted the PSDAR as part of its SAFSTOR compliance program.

The U.S. Nuclear Regulatory Commission (NRC) is advertising for nominations for the radiation oncologist position on the Advisory Committee on the Medical Uses of Isotopes (ACMUI). Nominees should currently be practicing radiotherapy using Gamma Knife[supreg].

The NRC is issuing its Final Interim Staff Guidance (ISG) COL/ ESP-ISG-004 (ML090060897). This ISG provides guidance regarding the definition of construction and the delineation of preconstruction activities and those activities requiring prior approval of the U.S. Nuclear Regulatory Commission (NRC or the Commission). In addition, this ISG provides guidance regarding the information to be submitted by any applicant for a limited work authorization (LWA). The NRC staff issues ISGs to facilitate timely implementation of the current staff guidance and to facilitate activities associated with review of applications for early site permits and combined licenses for the Office of New Reactors. The NRC staff will also incorporate COL/ ESP-ISG-004 into the next revisions of the Regulatory Guide 1.206, ``Combined License Applications for Nuclear Power Plants,'' and related guidance documents.

This document corrects a rule that appeared in the Federal Register on October 24, 2008 (73 FR 63545), that amends the regulations for the protection of Safeguards Information (SGI) to protect SGI from inadvertent release and unauthorized disclosure which might compromise the security of nuclear facilities and materials. This action is necessary to correct an erroneous authority citation.

The NRC invites public comment about our intention to request the OMB's approval for renewal of an existing information collection that is summarized below. We are required to publish this notice in the Federal Register under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: Requests to Non- Agreement States For Information. 2. Current OMB approval number: 3150-0200. 3. How often the collection is required: 8 times per year. 4. Who is required or asked to report: The 17 Non-Agreement States (those States and 2 territories that have not signed 274(b) Agreements with NRC). 5. The number of annual respondents: 136. 6. The number of hours needed annually to complete the requirement or request: 1122. 7. Abstract: Requests may be made of States that are similar to those of Agreement States to provide a more complete overview of the national program for regulating radioactive materials. This information would be used in the decisionmaking of the Commission. With Agreement States and as part of the NRC cooperative post-agreement program with the States pursuant to Section 274(b), information on licensing and inspection practices, and/or incidents, and other technical and statistical information are exchanged. Agreement State comments are also solicited in the areas of proposed implementing procedures relative to NRC Agreement State program policies. With the enactment of the Energy Policy Act of 2005, specifically Section 651(e), NRC now has regulatory authority over use of accelerator-produced radioactive materials and discrete sources of radium-226 and other naturally occurring radioactive material as specified by the Commission. Therefore, information requests sought may take the form of surveys, e.g., telephonic and electronic surveys/polls and facsimiles. Results from the surveys will give insight into how NRC can make its services and products cost effective, efficient and responsive to its customer needs. How often the collection is required: The collection would only be required upon application for an exemption when access to a non- federal low-level waste disposal facility is denied, which results in a public health and safety and/or common defense and security concern. 4. Who is required or asked to report: Generators of low-level radioactive waste who are denied access to a non-Federal low-level radioactive waste and who wish to request emergency access for disposal at a non-Federal LLRW disposal facility pursuant to 10 CFR Part 62. 5. The number of annual respondents: 1. 6. The number of hours needed annually to complete the requirement or request: 233. 7. Abstract: 10 CFR part 62 sets out the information which must be provided to the NRC by any low-level waste generator seeking emergency access to an operating low-level waste disposal facility. The information is required to allow NRC to determine if denial of disposal constitutes a serious and immediate threat to public health and safety or common defense and security. 10 CFR part 62 also provides that the Commission may grant an exemption from the requirements in this part upon application of an interested person or upon its own initiative.
