The NRC is providing notice that the NRC staff will conduct a meeting to discuss and accept comments on the PSDAR for the NS Savannah on March 11, 2009, from 7 p.m. to 9 p.m. The meeting will be held on- board the NS Savannah located at Pier 13, Canton Marine Terminal, 4601 Newgate Ave., Baltimore, MD 21224. On December 11, 2008, the U.S. Department of Transportation Maritime Administration (MARAD) submitted its PSDAR for the NS Savannah. The PSDAR provides an overview of MARAD's proposed decommissioning activities, schedule, and costs for the NS Savannah. The NS Savannah was brought to power in 1961 and removed from service in 1970. Final reactor shutdown occurred in November 1970 and defueling was completed in fall 1971. In 1975 the NS Savannah was ``mothballed.'' NRC issued a ``possessiononly'' license for the NS Savannah in 1976. The NS Savannah was in a mothballed status from 1976 to 2006. In 2006, MARAD made the decision to place the ship in extended SAFSTOR until the budget could support decommissioning and license termination. MARAD submitted the PSDAR as part of its SAFSTOR compliance program.

On December 23, 2008 (73 FR 78599), the Nuclear Regulatory Commission (NRC) published a final rule that amended the NRC's regulations to implement the requirements under the Protocol Additional to the Agreement between the United States of America and the International Atomic Energy Agency for the Application of Safeguards in the United States of America (Additional Protocol) for certain NRC and Agreement State licensees to report information on various nuclear fuel cycle-related activities and to provide the International Atomic Energy Agency (IAEA) with access to those locations. This document is necessary to correct an erroneous amendatory instruction which resulted in two undesignated center headings.

The NRC is issuing its Final Interim Staff Guidance (ISG) COL/ ESP-ISG-004 (ML090060897). This ISG provides guidance regarding the definition of construction and the delineation of preconstruction activities and those activities requiring prior approval of the U.S. Nuclear Regulatory Commission (NRC or the Commission). In addition, this ISG provides guidance regarding the information to be submitted by any applicant for a limited work authorization (LWA). The NRC staff issues ISGs to facilitate timely implementation of the current staff guidance and to facilitate activities associated with review of applications for early site permits and combined licenses for the Office of New Reactors. The NRC staff will also incorporate COL/ ESP-ISG-004 into the next revisions of the Regulatory Guide 1.206, ``Combined License Applications for Nuclear Power Plants,'' and related guidance documents.

The U.S. Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking (PRM-170-6) submitted by the Technical Specifications Task Force (TSTF), which is a jointly sponsored activity of the Pressurized Water Reactor Owners Group and the Boiling Water Reactor Owners' Group. The petition requests that the NRC amend its regulations to provide an explicit exemption from NRC review fees for activities associated with generic improvements to the Improved Standard Technical Specifications (ISTS). The NRC is denying the petition because the petition presents issues that the NRC has already carefully considered and addressed. Also, the petition fails to present any significant new information or arguments that would warrant the requested amendment.

The NRC invites public comment about our intention to request the OMB's approval for renewal of an existing information collection that is summarized below. We are required to publish this notice in the Federal Register under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: Requests to Non- Agreement States For Information. 2. Current OMB approval number: 3150-0200. 3. How often the collection is required: 8 times per year. 4. Who is required or asked to report: The 17 Non-Agreement States (those States and 2 territories that have not signed 274(b) Agreements with NRC). 5. The number of annual respondents: 136. 6. The number of hours needed annually to complete the requirement or request: 1122. 7. Abstract: Requests may be made of States that are similar to those of Agreement States to provide a more complete overview of the national program for regulating radioactive materials. This information would be used in the decisionmaking of the Commission. With Agreement States and as part of the NRC cooperative post-agreement program with the States pursuant to Section 274(b), information on licensing and inspection practices, and/or incidents, and other technical and statistical information are exchanged. Agreement State comments are also solicited in the areas of proposed implementing procedures relative to NRC Agreement State program policies. With the enactment of the Energy Policy Act of 2005, specifically Section 651(e), NRC now has regulatory authority over use of accelerator-produced radioactive materials and discrete sources of radium-226 and other naturally occurring radioactive material as specified by the Commission. Therefore, information requests sought may take the form of surveys, e.g., telephonic and electronic surveys/polls and facsimiles. Safety Culture Policy Statement Development: Public Meeting and Request for Public Comments

The NRC is developing an update to its policy statement on safety culture to include the unique aspects of security and to ensure that the policy applies to all licensees and certificate holders. The NRC is conducting a public meeting to solicit public input on topics relating to the development of the policy statement. The title of the information collection: 10 CFR Part 62 ``Criteria and Procedures for Emergency Access to Non-Federal and Regional Low-Level Waste Disposal Facilities.'' 2. Current OMB approval number: 3150-0143. 3. How often the collection is required: The collection would only be required upon application for an exemption when access to a non- federal low-level waste disposal facility is denied, which results in a public health and safety and/or common defense and security concern. 4. Who is required or asked to report: Generators of low-level radioactive waste who are denied access to a non-Federal low-level radioactive waste and who wish to request emergency access for disposal at a non-Federal LLRW disposal facility pursuant to 10 CFR Part 62. 5. The number of annual respondents: 1. 6. The number of hours needed annually to complete the requirement or request: 233. 7. Abstract: 10 CFR part 62 sets out the information which must be provided to the NRC by any low-level waste generator seeking emergency access to an operating low-level waste disposal facility. The information is required to allow NRC to determine if denial of disposal constitutes a serious and immediate threat to public health and safety or common defense and security. 10 CFR part 62 also provides that the Commission may grant an exemption from the requirements in this part upon application of an interested person or upon its own initiative.
