Agency Information Collection Activities: Proposed Collection; Comment Request
The NRC is preparing a submittal to OMB for review of continued approval of information collections under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: 10 CFR part 81, ``Standard Specifications for Granting of Patent Licenses.'' 2. Current OMB approval number: 3150-0121. 3. How often the collection is required: Applications for licenses are submitted once. Other reports are submitted annually or as other events require. 4. Who is required or asked to report: Applicants for and holders of NRC licenses to NRC inventions. 5. The number of annual respondents: 1. 6. The number of hours needed annually to complete the requirement or request: 37; however, no applications are anticipated during the next three years. 7. Abstract: As specified in 10 CFR part 81, the NRC may grant non- exclusive licenses or limited exclusive licenses to its patented inventions to responsible applicants. Applicants for licenses to NRC inventions are required to provide information which may provide the basis for granting the requested license. In addition, all license holders must submit periodic reports on efforts to bring the invention to a point of practical application and the extent to which they are making the benefits of the invention reasonably accessible to the public. Exclusive license holders must submit additional information if they seek to extend their licenses, issue sublicenses, or transfer the licenses. In addition, if requested, exclusive license holders must promptly supply to the United States Government copies of all pleadings and other papers filed in any patent infringement lawsuit, as well as evidence from proceedings relating to the licensed patent. How often the collection is required: Approximately 1 time annually. 4. Who is required or asked to report: Licensees of facilities on the U.S. eligible list who have been notified in writing by the NRC to submit the form. 5. The number of annual respondents: 1. 6. The number of hours needed annually to complete the requirement or request: 360 reporting hours (1 respondent x 360 hours per response). 7. Abstract: In order for the United States to fulfill its responsibilities as a participant in the US/International Atomic Energy Agency (IAEA) Safeguards Agreement, the NRC must collect information from licensees about their installations and provide it to the IAEA. Licensees of facilities that appear on the U.S. eligible list and have been notified in writing by the NRC are required to complete and submit a Design Information Questionnaire, IAEA Form N-71 (and the appropriate associated IAEA Form) or Form N-91, to provide information concerning their installation for use of the IAEA. Submit, by March 31, 2008, comments that address the following questions: 1. Is the proposed collection of information necessary for the NRC to properly perform its functions? State of Nevada; Denial of Petition for Rulemaking
The U.S. Nuclear Regulatory Commission (NRC or Commission) is denying a petition for rulemaking submitted by the State of Nevada (PRM-51-9). The petition requests that NRC modify its regulation setting criteria for adoption of an environmental impact statement prepared by the Secretary of the Department of Energy in proceedings for issuance of a construction authorization and materials license with respect to a geologic repository. The petitioner asserts that the current regulation must be ``corrected'' because it is at odds with a recent court of appeals decision. Further, petitioner asserts that certain litigation procedures that will be used in the proceedings to consider the adoption question violate the National Environmental Policy Act of 1969, as amended (NEPA). NRC is denying the petition because the court found no reason for NRC to correct its adoption criteria and because the petition does not demonstrate that NRC's litigation procedures violate NEPA. Commissioner Gregory B. Jaczko's vote on this denial is included in Appendix I to this notice.
Minor Amendments: Re-organization
The Nuclear Regulatory Commission (NRC) is amending its regulations to reflect the addresses of two additional Headquarters buildings, the reorganization of the Office of Nuclear Materials Safety and Safeguards, the creation of the Office of Federal and State Materials and Environmental Management Programs, the reorganization of the Office of Nuclear Reactor Regulation, the creation of the Office of New Reactors, and other minor changes. This document is necessary to inform the public of these minor changes to NRC regulations.

Information pertaining to the requirement to be submitted: 1. The title of the information collection: 10 CFR Part 75 Safeguards on Nuclear Material, Implementation of US/IAEA Agreement. 2. Current OMB approval number: OMB 3150-0055. 3. How often the collection is required: Reporting is done when specified events occur. Recordkeeping for nuclear material accounting and control information is done in accordance with specific instructions. 4. Who is required or asked to report: Licensees of facilities on the U.S. eligible list who have been selected by the International Atomic Energy Agency (IAEA) for reporting or recordkeeping activities. 5. The number of annual respondents: Six, two of which perform both reporting and recordkeeping and four of which perform recordkeeping only. 6. The number of hours needed annually to complete the requirement or request: 2,400 (6 Respondents x 400 hours per response). 7. Abstract: 10 CFR Part 75 requires selected licensees to permit inspections by IAEA representatives, give immediate notice to the NRC in specified situations involving the possibility of loss of nuclear material, and give notice for imports and exports of specified amounts of nuclear material. These licensees will also follow written material accounting and control procedures, although actual reporting of transfer and material balance records to the IAEA will be done through the U.S. State system (Nuclear Materials Management and Safeguards System, collected under OMB clearance numbers 3150-0003, 3150-0004, 3150-0057, and 3150-0058.) The NRC needs this information to implement its responsibilities under the US/IAEA agreement. Submit, by March 31, 2008, comments that address the following questions: 1. Managing Gas Accumulation in Emergency Core Cooling, Decay Heat Removal, and Containment Spray Systems
The U.S. Nuclear Regulatory Commission (NRC) has issued Generic Letter (GL) 2008-01 all holders of operating licenses for nuclear power reactors, except those who have permanently ceased operations and have certified that fuel has been permanently removed from the reactor vessel. The NRC is issuing this GL to address the issue of gas \1\ accumulation in the emergency core cooling, decay heat removal (DHR),\2\ and containment spray systems (hereinafter referred to as the ``subject systems''). Specifically, the NRC is issuing this GL for two purposes:
Decommissioning Planning
The Nuclear Regulatory Commission (NRC) is proposing to amend its regulations to improve decommissioning planning, and thereby reduce the likelihood that any current operating facility will become a legacy site. The amended regulations would require licensees to conduct their operations to minimize the introduction of residual radioactivity into the site, including subsurface soil and groundwater. Licensees also would be required to survey certain quantities or concentrations of residual radioactivity, including in subsurface areas, and keep records of surveys of subsurface residual radioactivity identified at the site with records important for decommissioning. The amended regulations would require licensees to report additional details in their decommissioning cost estimates, would eliminate two currently approved financial assurance mechanisms, and would modify the parent company guarantee and self-guarantee financial assurance mechanisms to authorize the NRC to require that guaranteed funds be immediately due and payable to a standby trust if the guarantor is in financial distress. Finally, the amended regulations would require decommissioning power reactor licensees to report additional information on the costs of decommissioning and spent fuel management.
Geologic Repository Operations Area Security and Material Control and Accounting Requirements; Meeting Cancellation
The Nuclear Regulatory Commission (NRC) is issuing this notice to announce cancellation of the public meeting scheduled for January 23, 2008, in Las Vegas, Nevada, and announced in the Federal Register December 31, 2007 (72 FR 74352). The purpose of the meeting was to solicit public comments on a proposed rule on Geologic Repository Operations Area Security and Material Control and Accounting Requirements that was published for public comment (72 FR 72522; December 20, 2007). This meeting will not be rescheduled. NRC will still accept public comments on the proposed rule during the comment period; comments may be mailed to the NRC or submitted via fax or e- mail.
George Barnet; Denial of Petition for Rulemaking
The Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking (PRM-20-27) dated July 11, 2007, submitted by George Barnet (petitioner). The petitioner requested that NRC amend its regulations that govern standards for protection against radiation to broaden the scope of the requirements pertaining to approval of proposed disposal methods to include recovery of material for recycling. The NRC is denying the petition because the issues raised by the petitioner fall within the scope of the rationale for a recent Commission decision to not conduct rulemaking in the area of setting radiological criteria for controlling the disposition of solid materials. The rationale for the Commission decision was that the current NRC approach for disposition of solid materials is fully protective of public health and safety, and that NRC is currently faced with several high priority and complex tasks.
Training and Qualification of Security Personnel at Nuclear Power Reactor Facilities; Issuance of Draft Regulatory Guide
The Nuclear Regulatory Commission (NRC) has issued for public comment a draft guide in the agency's ``Regulatory Guide'' series (DG- 5015).
Proposed Generic Communication; Implementation of Certificate of Compliance Amendments to Previously Loaded Spent Fuel Storage Casks
The U.S. Nuclear Regulatory Commission (NRC) is proposing to issue a regulatory issue summary (RIS) to inform addressees of requirements concerning the implementation of changes authorized by a 10 CFR Part 72 dry storage cask Certificate of Compliance (CoC) amendment to a cask loaded under the original CoC or an earlier amendment thereto (``previously loaded cask''). The NRC will include review of this matter in future inspections to verify compliance with these requirements. Who is required or asked to report: Contractors, consultants and invited NRC travelers who travel in the course of conducting business for the NRC. 5. The number of annual respondents: 100. 6. The number of hours needed annually to complete the requirement or request: 100 hours (1 hour per form). 7. Abstract: Consultants, contractors, and those invited by the NRC to travel (e.g., prospective employees) must file travel vouchers and trip reports in order to be reimbursed for their travel expenses. The information collected includes the name, address, social security number, and the amount to be reimbursed. Travel expenses that are reimbursed are confined to those expenses essential to the transaction of official business for an approved trip.
