DoD Investigative and Adjudicative Guidance for Issuing the Common Access Card (CAC)

This interim final rule establishes policy, assigns responsibilities, and prescribes procedures for investigating and adjudicating eligibility to hold the DoD Common Access Card (CAC). The CAC is the DoD personal identity verification (PIV) credential. Individuals appropriately sponsored for a DoD CAC must be investigated and adjudicated in accordance with this part. Prior to this rule, DoD components have been implementing investigative and adjudicative requirements for Homeland Security Presidential Directive12 (HSPD-12) based solely on broad guidance issued by the U.S. Office of Personnel Management (OPM). This interim final rule elaborates on OPM guidance for component adjudicators who determine, based on review of investigative case files, whether to grant CAC eligibility to individuals who require: Physical access to DoD facilities or non-DoD facilities on behalf of DoD; logical access to information systems (whether on site or remotely); or remote access to DoD networks that use only the CAC logon for user authentication. The adjudicator's role is discussed further in the SUPPLEMENTARY INFORMATION. The interim final rule provides the adjudicator with conditions that may be disqualifying and circumstances relevant to the determination of whether there is a reasonable basis to believe there is an unacceptable risk.

The Department of the Army announces the availability of the Draft Environmental Impact Statement (DEIS) for the proposed update of the Real Property Master Plan (RPMP) for Fort Belvoir, Virginia, which includes proposed short-term projects and long-term development. In accordance with the National Environmental Policy Act (NEPA), the DEIS analyzes the environmental impacts associated with the proposed short- term projects, long-term development, and anticipated land use changes designated in an updated RPMP. The short-term projects are proposed for implementation by 2017. The long-term development projects are proposed for implementation by 2030. The DEIS assesses potential environmental impacts associated with future development and management of land, facilities, resources, and infrastructure. The updated RPMP incorporates adjustments to the land use plan in the RPMP that were made in the Final EIS for the Implementation of 2005 Base Realignment and Closure (BRAC) Recommendations and Related Army Actions at Fort Belvoir, Virginia (2007) and BRAC-related changes made since 2007.

U.S. Air Force Academy Board of Visitors Notice of Meeting

In accordance with 10 U.S.C. 9355, the U.S. Air Force Academy (USAFA) Board of Visitors (BoV) will hold a meeting at Harmon Hall, U.S. Air Force Academy, Colorado Springs, CO, on September 25-26, 2014. On Thursday, the meeting will begin at 9:30 a.m. The meeting is scheduled to close to the public at 3:30 p.m. On Friday, the meeting will begin at 8:30 a.m. and close at 11:35 a.m. The purpose of this meeting is to review morale and discipline, social climate, curriculum, instruction, infrastructure, fiscal affairs, academic methods, and other matters relating to the Academy. Specific topics for this meeting include a Superintendent's Update; USAFA Performance Measures Report; USAFA Academics Update; a Religious Respect Briefing; and an Athletic Department Update. In accordance with 5 U.S.C. 552b, as amended, and 41 CFR 102-3.155, one session of this meeting shall be closed to the public because it involves matters covered by subsection (c)(6) of 5 U.S.C. 552b. Public attendance at the open portions of this USAFA BoV meeting shall be accommodated on a first-come, first-served basis up to the reasonable and safe capacity of the meeting room. In addition, any member of the public wishing to provide input to the USAFA BoV should submit a written statement in accordance with 41 CFR 102-3.140(c) and 10(a)(3) of the Federal Advisory Committee Act and the procedures described in this paragraph. Written statements must address the following details: The issue, discussion, and a recommended course of action. Supporting documentation may also be included as needed to establish the appropriate historical context and provide any necessary background information. Written statements can be submitted to the Designated Federal Officer (DFO) at the Air Force address detailed below at any time. However, if a written statement is not received at least 10 calendar days before the first day of the meeting which is the subject of this notice, then it may not be provided to or considered by the BoV until its next open meeting. The DFO will review all timely submissions with the BoV Chairman and ensure they are provided to members of the BoV before the meeting that is the subject of this notice. If after review of timely submitted written comments and the BoV Chairman and DFO deem appropriate, they may choose to invite the submitter of the written comments to orally present the issue during an open portion of the BoV meeting that is the subject of this notice. Members of the BoV may also petition the Chairman to allow specific personnel to make oral presentations before the BoV. In accordance with 41 CFR 102-3.140(d), any oral presentations before the BoV shall be in accordance with agency guidelines provided pursuant to a written invitation and this paragraph. Direct questioning of BoV members or meeting participants by the public is not permitted except with the approval of the DFO and Chairman. For the benefit of the public, rosters that list the names of BoV members and any releasable materials presented during the open portions of this BoV meeting shall be made available upon request.

The Department of the Navy (DoN) is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (DAJAG)(Admiralty and Maritime Law) has determined that USS BREMERTON (SSN 698) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

Air Mobility Command (AMC) is providing notice that it intends to change Domestic Air Tender policy within the MFTURP NO. 1 to restrict registration in the FCRP for Domestic Air Tenders to Civil Reserve Air Fleet (CRAF) Transportation Service Providers (TSP) only. CRAF TSPs may, if they choose to, act through a freight forwarder, logistics company, or broker. This change only affects domestic air tender TSPs such as airlines, logistics companies, freight forwarders, and brokers. The purpose of the new policy is to strengthen the CRAF program in support of the national defense airlift objectives to ensure military and civil airlift resources are capable of meeting the defense mobilization and deployment requirements supporting U.S. Defense & Foreign Policy.

On May 19, 2014 (79 FR 28688-28689), the Department of Defense published a notice titled ``Comprehensive Review of the Military Justice System.'' Subsequent to the publication of that notice, the Department extended the deadline for the Military Justice Review Group (MJRG) reports recommending changes to the Uniform Code of Military Justice (UCMJ) and the Manual for Courts-Martial (MCM). This notice is being published with revisions to the notice of May 19, 2014. The deadline for the MJRG report recommending changes to the UCMJ has been extended to March 25, 2015, and the deadline for the report recommending changes to the MCM has been extended to September 21, 2015.

TRICARE Reserve Select (TRS) is a premium-based TRICARE health plan available for purchase worldwide by qualified members of the Ready Reserve and by qualified survivors of TRS members. TRICARE Dental Program (TDP) is a premium-based TRICARE dental plan available for purchase worldwide by qualified Service members. This proposed rule revises requirements and procedures for the TRS program to specify the appropriate actuarial basis for calculating premiums in addition to other minor clarifying administrative changes. For a member who is involuntarily separated from the Selected Reserve under other than adverse conditions this proposed rule provides a time-limited exception that allows TRS coverage in effect to continue for up to 180 days after the date on which the member is separated from the Selected Reserve and TDP coverage in effect to continue for no less than 180 days after the separation date. It also expands early TRICARE eligibility for certain Reserve Component members from a maximum of 90 days to a maximum of 180 days prior to activation in support of a contingency for more than 30 days.

Pursuant to section 102(2)(c) of the National Environmental Policy Act of 1969, regulations implemented by the Council on Environmental Quality (40 Code of Federal Regulations Parts 1500-1508), and Presidential Executive Order 12114, the Department of the Navy (DoN) has prepared and filed with the U.S. Environmental Protection Agency a Draft Supplemental Environmental Impact Statement/Overseas Environmental Impact Statement (EIS/OEIS). The DoN prepared this analysis to update the Gulf of Alaska Navy Training Activities Final EIS/OEIS, which was completed with community input in May 2011 (hereafter referred to as the 2011 GOA Final EIS/OEIS), and to renew federal regulatory permits and authorizations. In the Draft Supplemental EIS/OEIS, the DoN uses a new acoustic modeling method and evaluates new, relevant information, such as new marine mammal density data and new scientific information, and updates environmental analyses, as appropriate. The DoN analyzes data using the Navy Acoustic Effects Model, not previously available for the 2011 GOA Final EIS/ OEIS, to evaluate potential effects on marine species from training activities. The National Marine Fisheries Service is a cooperating agency for this Supplemental EIS/OEIS. With the filing of the Draft Supplemental EIS/OEIS, the DoN is initiating a 60-day public comment period and has scheduled five public meetings to inform the public and receive comments on the Draft Supplemental EIS/OEIS. This notice announces the dates and locations of the public meetings and provides supplementary information about the environmental planning effort. Dates And Addresses: The 60-day Draft Supplemental EIS/OEIS public review period will begin August 22, 2014, and end October 20, 2014. The DoN will hold five public meetings to inform the public about the Proposed Action and to provide an opportunity to comment on the adequacy and accuracy of the supplemental environmental analysis. Each of the public meetings will include an open house information session, followed by a short presentation by the DoN. DoN representatives will be available during the open house information sessions to provide information related to the Draft Supplemental EIS/OEIS. Federal, state, and local agencies and officials, as well as interested organizations and individuals are encouraged to provide comments in writing during the public review period or in person at one of the scheduled public meetings.
