Duke Energy Progress, Inc., H.B. Robinson Steam Electric Plant, Unit No. 2, Independent Spent Fuel Storage Installation
The U.S. Nuclear Regulatory Commission (NRC) is issuing an amendment to Materials License No. SNM-2502. The license authorizes Duke Energy Progress, LLC to receive, possess, store, and transfer spent nuclear fuel and associated radioactive materials. The amendment changes the name of the licensee from Duke Energy Progress, Inc. to Duke Energy Progress, LLC for the H. B. Robinson Steam Electric Plant, Unit No. 2 (Robinson Unit No. 2), Independent Spent Fuel Storage Installation.
Early Site Permit Application; Tennessee Valley Authority; Clinch River Nuclear Site; Correction
The U.S. Nuclear Regulatory Commission (NRC) is correcting a notice that was published in the Federal Register (FR) on April 26, 2018, regarding the issuance of a draft environmental impact statement (DEIS) that is part of the review of the application for the early site permit, and to provide the public with an opportunity to comment on the DEIS process as defined in the regulations. This action is necessary to correct the end date of the comment period from July 10, 2018 to July 13, 2018.
Standard Format and Content of Physical Security Plans, Training and Qualifications Plans, and Safeguards Contingency Plans for Nuclear Power Plants
On May 14, 2018, the U.S. Nuclear Regulatory Commission (NRC) solicited comments on Draft Regulatory Guide (DG), DG-5048, ``Standard Format and Content of Physical Security Plans, Training and Qualifications Plans, and Safeguards Contingency Plans for Nuclear Power Plants.'' The public comment period was originally scheduled to close on July 13, 2018. The NRC has decided to extend the public comment period by 30 days to allow more time for members of the public to develop and submit their comments.
Southern Nuclear Operating Company, Inc.; Vogtle Electric Generating Plant, Units 3 and 4 Main Control Room Emergency Habitability System Changes
The U.S. Nuclear Regulatory Commission (NRC) has issued an exemption to allow a departure from the certification information of Tier 1 of the generic design control document and issued License Amendment Nos. 108 and 107 to Combined License (COL) Nos. NPF-91 and NPF-92, respectively. The COLs were issued to Southern Nuclear Operating Company, Inc., and Georgia Power Company; Oglethorpe Power Corporation; MEAG Power SPVM, LLC; MEAG Power SPVJ, LLC; MEAG Power SPVP, LLC; and the City of Dalton, Georgia (the licensee), for construction and operation of the Vogtle Electric Generating Plant (VEGP), Units 3 and 4, located in Burke County, Georgia. The granting of the exemption allows the changes to Tier 1 information asked for in the amendment. Because the acceptability of the exemption was determined in part by the acceptability of the amendment, the exemption and amendment are being issued concurrently.
FirstEnergy Nuclear Operating Company, Perry Nuclear Power Plant, Unit No. 1
The U.S. Nuclear Regulatory Commission (NRC) has granted the request of FirstEnergy Nuclear Operating Company to withdraw its application dated December 20, 2017, for a proposed amendment to the Perry Nuclear Power Plant, Unit. No. 1, Facility Operating License No. NPF-58. The proposed amendment would have modified the facility technical specifications (TSs) pertaining to direct current electrical systems, specifically limiting conditions for operation 3.8.4, 3.8.5, and 3.8.6. The proposed amendment would have also added a new Battery and Monitoring Maintenance Program to TS Section 5.5, ``Programs and Manuals.''
Instructions for Recording and Reporting Occupational Radiation Dose Data
The U.S. Nuclear Regulatory Commission (NRC) is issuing Revision 4 to Regulatory Guide (RG) 8.7, ``Instructions for Recording and Reporting Occupational Radiation Dose Data.'' Revision 4 addresses issues that were identified after Revision 3 was issued in December 2016. Revision 4 reinstates the long-standing staff position concerning a licensee's consideration of prior occupational dose when making prospective occupational dose monitoring determinations. Revision 4 retains the guidance from Revision 3 on completing NRC Form 4, ``Cumulative Occupational Dose History,'' and NRC Form 5, ``Occupational Dose Record for a Monitoring Period.''
U.S. Army Installation Command
The U.S. Nuclear Regulatory Commission (NRC) has issued a director's decision in response to a petition dated March 16, 2017, filed by Dr. Michael Reimer (the petitioner), requesting that the NRC take enforcement-related action with regard to the U.S. Army Installation Management Command (the licensee). The petitioner's requests and the director's decision are included in the SUPPLEMENTARY INFORMATION section of this document.
Entergy Nuclear Operations, Inc.; Indian Point Nuclear Generating Unit Nos. 2 and 3
The U.S. Nuclear Regulatory Commission (NRC) is issuing Volume 5 of the plant-specific Final Supplemental Environmental Impact Statement (FSEIS), Supplement 38 to NUREG-1437, ``Generic Environmental Impact Statement for License Renewal of Nuclear Plants'' (GEIS), regarding the renewal of the Entergy Nuclear Operations, Inc., operating licenses DPR-26 and DPR-64 (Docket Nos. 50-247 and 50-286) for extended plant operation for Indian Point Nuclear Generating Unit Nos. 2 and 3 (IP2 and IP3). This volume of the FSEIS was issued as part of the NRC staff's review of Entergy Nuclear Operations, Inc.'s request for extended plant operation beyond the initial period of 40 years. This volume incorporates new information that the NRC staff has obtained since the publication of Volume 4 of the FSEIS in June 2013.
Florida Power & Light Company: Turkey Point Nuclear Plant Units 3 and 4
The U.S. Nuclear Regulatory Commission will conduct a scoping process to gather information necessary to prepare an environmental impact statement (EIS) to evaluate the environmental impacts for the subsequent license renewal of the operating licenses for Turkey Point Nuclear Plant (Turkey Point) Unit Nos. 3 and 4. The NRC is seeking stakeholder input on this action and has scheduled a public meeting.
Biweekly Notice; Applications and Amendments to Facility Operating Licenses and Combined Licenses Involving No Significant Hazards Considerations
Pursuant to Section 189a.(2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular biweekly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration, notwithstanding the pendency before the Commission of a request for a hearing from any person. This biweekly notice includes all notices of amendments issued, or proposed to be issued, from April 24, 2018, to May 7, 2018. The last biweekly notice was published on May 8, 2018.
Holtec International HI-STORE Consolidated Interim Storage Facility Project
On March 30, 2018, the U.S. Nuclear Regulatory Commission (NRC) published in the Federal Register a notice of its intent to prepare an environmental impact statement (EIS) and requested public comments on the scope of its environmental review of Holtec International's (Holtec) application for the HI-STORE Combined Interim Storage Facility (CISF). The NRC is announcing two additional local public comment scoping meetings, an extension of the comment period, and an additional method to submit scoping comments by email.
Cyber Security for Byproduct Materials Licensees
The U.S. Nuclear Regulatory Commission (NRC) is discontinuing the rulemaking activity that would have developed cyber security requirements for byproduct materials licensees possessing risk- significant quantities of radioactive materials. The purpose of this action is to inform members of the public of the discontinuation of the rulemaking activity and to provide a brief discussion of the NRC's decision. The rulemaking activity will no longer be reported in the NRC's portion of the Unified Agenda of Regulatory and Deregulatory Actions (the Unified Agenda).
Revision of the NRC Enforcement Policy
The U.S. Nuclear Regulatory Commission (NRC) is publishing a revision to its Enforcement Policy (Enforcement Policy or Policy) to address the requirements of the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (2015 Improvements Act). The 2015 Improvements Act amended the Federal Civil Penalties Inflation Adjustment Act (FCPIAA) of 1990, and now requires Federal agencies to adjust their maximum civil monetary penalty annually for inflation.

Diversified Scientific Services, Inc.
The U.S. Nuclear Regulatory Commission (NRC) is considering issuing an export license amendment and renewal of License No. XW008/05 requested by Diversified Scientific Services, Inc. (DSSI). On February 9, 2018, DSSI submitted a revised application with the NRC to amend and renew License No. XW008/04. The request seeks the NRC's approval for renewal and amendment of an existing license authorizing the export of radioactive waste to Canada. The NRC is providing notice of the opportunity to request a hearing on DSSI's revised application.
Westinghouse Electric Company LLC; Consideration of Approval of Transfer of License
The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of an application filed by Westinghouse Electric Company, LLC (Westinghouse) on March 21, 2017. The application seeks NRC approval of the indirect transfer of material licenses SNM-1107; SNM-33; and several export licenses for the Westinghouse Electric Company, LLC from Toshiba Corporation, the current parent company of the license holder, to Brookfield WEC Holdings Inc., which is ultimately owned and controlled by Brookfield Asset Management Inc.
Standard Format and Content of Physical Security Plans, Training and Qualifications Plans and Safeguards Contingency Plans for Nuclear Power Plants
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment a Draft Regulatory Guide (DG), entitled DG-5048, ``Standard Format and Content of Physical Security Plans, Training and Qualifications Plans and Safeguards Contingency Plans for Nuclear Power Plants.'' This draft revision of Regulatory Guide (RG) 5.54 (Revision 2) renames the guide and consolidates, enhances, and clarifies previous staff guidance for the development of licensee site-specific physical security plans found in NUREG-0908, ``Acceptance Criteria for the Evaluation of Nuclear Power Reactor Security Plans,'' training and qualification plans, and safeguards contingency plans. This revision to RG 5.54 includes editorial changes and clarifications provided by the staff in Security Frequently Asked Questions after the issuance of Revision 1.
Northern States Power Company: Monticello Nuclear Generating Plant
The U.S. Nuclear Regulatory Commission (NRC) has issued an exemption for the Monticello Nuclear Generating Plant, Docket No. 50- 263, in response to an April 6, 2017, request from Northern States Power Company. Specifically, the exemption is from the regulation that requires where redundant trains of systems necessary to achieve and maintain hot shutdown conditions located within the same fire area outside of primary containment, one of the redundant trains remains free of fire damage by one of three methods of physical separation.
Relocation of Regulatory Issue Summary Notices in the Federal Register
The Nuclear Regulatory Commission (NRC) is notifying the public that documents regarding draft and final Regulatory Issue Summaries that historically have published in the ``Notices'' section of the Federal Register will now be published in the ``Proposed Rules'' and ``Rules and Regulations'' sections of the Federal Register. The Office of the Federal Register (OFR) recently informed the NRC that under OFR guidelines, these documents fall into the ``Proposed Rules'' and ``Rules and Regulations'' categories and requested that NRC reclassify these notices.

The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of one amendment request for Vogtle Electric Generating Plant, Units 3 and 4. The NRC proposes to determine that the amendment request involves no significant hazards consideration. Because the amendment request contains sensitive unclassified non- safeguards information (SUNSI), an order imposes procedures to obtain access to SUNSI for contention preparation.

Modified Small Quantities Protocol
The U.S. Nuclear Regulatory Commission (NRC) is amending its regulations to collect information on nuclear material possessed by entities in the U.S. Caribbean Territories, as well as to allow for International Atomic Energy Agency (IAEA) inspection access, if requested by the IAEA. This final rule implements the requirements of ``The Agreement between the United States of America and the IAEA for the application of safeguards in connection with the Treaty for the Prohibition of Nuclear Weapons in Latin America'' (INFCIRC/366 or U.S.- IAEA Caribbean Territories Safeguards Agreement), that apply to the United States (U.S.) based on modifications to this Agreement's small quantities protocol.
Crow Butte Resources, Inc.; Marsland Expansion Area
The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of an amendment to source materials license SUA-1534 that would authorize Crow Butte Resources, Inc., to construct and operate an in situ uranium recovery (ISR) expansion facility at the Marsland Expansion Area (MEA) site in Dawes County, Nebraska. The NRC staff has prepared an environmental assessment (EA) and finding of no significant impact (FONSI) for this licensing action.
Review of Administrative Rules
The U.S. Nuclear Regulatory Commission (NRC) is initiating a retrospective review of administrative requirements to identify outdated or duplicative administrative requirements that may be eliminated without an adverse effect on public health or safety, common defense and security, protection of the environment, or regulatory efficiency and effectiveness. The NRC is providing an outline of its strategy and is seeking public comment on the criteria that the NRC proposes to use to identify administrative regulations for possible elimination. This retrospective review of administrative regulations will complement the NRC's existing strategy for retrospective analysis of existing regulations.
Bi-Weekly Public Information Sessions; National Industrial Security Program Operations Manual Insider Threat Program and Security Executive Agent Directive 3
The U.S. Nuclear Regulatory Commission (NRC) staff plans to hold a series of bi-weekly public meetings, to provide industry and affected individuals with the opportunity to interface with the NRC regarding the National Industrial Security Program Operating Manual (NISPOM) Insider Threat Program (ITP) Change 2 and the Office of the Director of National Intelligence (ODNI) Security Executive Agent Directive 3 (SEAD 3) implementation requirements.
Florida Power & Light Company; Turkey Point Nuclear Generating, Unit Nos. 3 and 4
The U.S. Nuclear Regulatory Commission (NRC) is considering an application for the subsequent license renewal of Renewed Facility Operating License Nos. DPR-31 and DPR-41, which authorize Florida Power & Light Company (FPL or the applicant) to operate Turkey Point Nuclear Generating Unit Nos. 3 and 4 (Turkey Point). The renewed licenses would authorize the applicant to operate Turkey Point for an additional 20 years beyond the period specified in each of the current renewed licenses. The current renewed operating licenses for Turkey Point expire as follows: Unit No. 3 on July 19, 2032, and Unit No. 4 on April 10, 2033.
Duke Energy Florida, LLC; Levy Nuclear Plant, Units 1 and 2
The U.S. Nuclear Regulatory Commission (NRC) is terminating the Levy Nuclear Plant (LNP) Units 1 and 2 Combined Licenses (COLs) designated as NPF-99 and NPF-100 and their included licenses to manufacture, produce, transfer, receive, acquire, own, possess, or use byproduct material. By letter dated January 25, 2018, Duke Energy Florida, LLC (Duke) requested that the NRC terminate the LNP COLs. Construction was not initiated for LNP Units 1 and 2, and nuclear materials were never procured or possessed under these licenses. Consequently, the LNP site is approved for unrestricted use.
In the Matter of Qal-Tek Associates, LLC
The U.S. Nuclear Regulatory Commission (NRC) is issuing an Order imposing civil monetary penalty of $22,400 to Qal-Tek Associates, LLC. After consideration of the licensee's request for mitigation of the proposed civil penalty amount, the NRC staff determined that the violations occurred and that adequate basis did not exist for mitigation of the civil penalty amount of $22,400.

The U.S. Nuclear Regulatory Commission (NRC) has issued a director's decision in response to a petition dated February 8, 2017, filed by Mr. Barry Quigley (the petitioner), requesting that the NRC take action with regard to Exelon Generation Company, LLC (Exelon or the licensee). The petitioner's requests and the director's decision are included in the SUPPLEMENTARY INFORMATION section of this document.
Centrus Energy Corp.; Proposed Decommissioning Plan
The U.S. Nuclear Regulatory Commission (NRC) has received an application from Centrus Energy Corp. (Centrus) to amend Material License Number SNM-7003 to authorize decommissioning of its American Centrifuge Lead Cascade Facility (LCF) located in Piketon, Ohio. The NRC has accepted the application for technical review and evaluation of the decommissioning plan. As all materials and equipment at the LCF were previously removed and dispositioned offsite under the authority of Centrus' existing license, the NRC's review of the decommissioning plan is limited to (1) decommissioning funding, (2) dose assessment and derived concentration guideline levels and methodology, and (3) final status survey design in accordance with the Multi-Agency Radiation Survey and Site Investigation Manual. In order to inform its review of these remaining issues, the NRC is soliciting comments from affected parties.

The U.S Nuclear Regulatory Commission (NRC) and the U.S. Army Corps of Engineers (USACE), Nashville District, are issuing for public comment NUREG-2226, ``Environmental Impact Statement for the Early Site Permit (ESP) for the Clinch River Nuclear (CRN) Site: Draft Report for Comment.'' The site is located in Roane County, Tennessee, along the Clinch River, approximately 25 miles west-southwest of downtown Knoxville, Tennessee. The purposes of this notice are to inform the public that the NRC staff has issued a draft environmental impact statement (DEIS) as part of the review of the application for the ESP and to provide the public with an opportunity to comment on the DEIS process as defined in the regulations.

The U.S. Nuclear Regulatory Commission (NRC) is issuing the final Revision 2 to Japan Lessons-Learned Division Interim Staff Guidance (JLD-ISG), JLD-ISG-2012-01, ``Compliance with Order EA-12-049, Order Modifying Licenses with Regard to Requirements for Mitigation Strategies for Beyond-Design-Basis External Events.'' This ISG provides guidance and clarification to assist nuclear power reactor licensees with the identification of measures needed to comply with requirements to mitigate challenges to key safety functions. These requirements are contained in Order EA-12-049, ``Order Modifying Licenses with Regard to Requirements for Mitigation Strategies for Beyond-Design-Basis External Events.''
Florida Power & Light Company; Turkey Point Units 6 and 7
The U.S. Nuclear Regulatory Commission (NRC) has issued Combined License (COL) Nos. NPF-104 and NPF-105 to Florida Power & Light Company (FPL) for Turkey Point Units 6 and 7. In addition, the NRC has prepared a Summary Record of Decision (ROD) that supports the NRC's decision to issue the above-named COLs.
