In response to the 2004 Follow-Up Audit of the Title XI Loan Guarantee Program conducted by the Inspector General of the Department of Transportation, the Maritime Administration (MARAD) committed to include certain new remedies as part of the documentation for loan guarantees issued under Title XI of the Merchant Marine Act of 1936, as amended (Act). This notice sets out the remedies which MARAD has developed to fulfill its commitment to the Department's Office of Inspector General (OIG). MARAD is requesting public comments from parties who may wish to express their views on the proposed changes or who wish to suggest alternatives to the draft language developed by MARAD.

The Coast Guard and the Maritime Administration (MARAD) announce that they have received an application for the licensing of a natural gas deepwater port, and that the application appears to contain the required information. This notice summarizes the applicant's plans and the procedures that will be followed in considering the application.

The Maritime Administration (MARAD) proposes to increase the application fee for administrative waivers of the coastwise trade laws from $300 to $500. The increased fee would align the application fee with the actual cost of processing and issuing each waiver.

The U.S. Coast Guard and the Maritime Administration (MARAD) announce the availability of the draft environmental impact statement (DEIS) on the Pearl Crossing LLC Deepwater Port License Application and Pearl Crossing Pipeline LLC Application for a Certificate of Public Convenience and Necessity. The application describes a project that would be located in the Gulf of Mexico, Outer Continental Shelf West Cameron Block 220, approximately 41 miles south of Cameron, Louisiana. The Coast Guard and the Maritime Administration, as well as the cooperating agencies (i.e., Federal Energy Regulatory Commission and U.S. Army Corps of Engineers) request public comment on the DEIS.

The Maritime Administration announces that the Marine Transportation System National Advisory Council (MTSNAC) will hold a meeting to discuss MTS needs, regional MTS outreach initiatives, the West Coast port congestion issue, Council team assignments, and other issues. A public comment period is scheduled for 8:30 a.m. to 9 a.m. on Thursday, May 5, 2005. To provide time for as many people to speak as possible, speaking time for each individual will be limited to three minutes. Members of the public who would like to speak are asked to contact Richard J. Lolich by April 27, 2005. Commenters will be placed on the agenda in the order in which notifications are received. The Maritime Administration (MARAD) announces the extension of the Voluntary Intermodal Sealift Agreement (VISA) until September 30, 2005, pursuant to provision of the Defense Production Act of 1950, as amended. The purpose of the VISA is to make intermodal shipping services/systems, including ships, ships' space, intermodal equipment and related management services, available to the Department of Defense as required to support the emergency deployment and sustainment of U.S. military forces. This is to be accomplished through cooperation among the maritime industry, the Department of Transportation and the Department of Defense.

One comment was received. The commenter asserted that no waivers should be given, except in the case of medically verified disability, and there is an obligation these students assume and they should pay it. In addition, the commenter indicated that taxpayers are burdened by the costs of this education and they deserve recompense. Also, the commenter asked how many students sought waivers last year and on what grounds. 46 CFR part 310 authorizes the Maritime Administrator to grant waivers in cases where there would be undue hardship or impossibility of performance of the provisions of the agreement, due to accident, illness or other justifiable reason. The regulation also allows for deferments in exceptional cases for entry into a maritime-related graduate course of study, or the graduate may seek approval to accept maritime-related shoreside employment after first seeking afloat employment. The Maritime Administration (MARAD) is cognizant of the obligation of graduates as we review waiver and deferral requests. In 2004, MARAD granted 18 employment determination requests for shoreside employment. These employment determinations were granted for maritime- related shoreside employment on the recommendation from the U. S. Merchant Marine Academy, only after the graduates diligently sought afloat employment and were unable to obtain it.
