State Advisory Councils
This proposed rulemaking would remove the Legal Services Corporation's (LSC) regulation on state advisory councils. LSC believes this action is appropriate because the state advisory councils are no longer active and their oversight functions have been replaced adequately by other offices and processes established by Congress or LSC. Executive Orders 13563, ``Improving Regulation and Regulatory Review,'' and 13771, ``Reducing Regulation and Controlling Regulatory Costs,'' direct agencies to review their existing regulations and repeal or revise any that are obsolete or unnecessarily burdensome. Although LSC is not an agency of the Federal government subject to either executive order, LSC regularly reviews its regulations and has determined that this regulation can be eliminated.
Requests for Documents and Testimony
The Legal Services Corporation (LSC) proposes to create a rule governing subpoenas and requests for LSC documents and testimony by non-federal litigants in cases in which LSC is not a party. Currently, LSC has no internal or external procedures in place to process such requests. This rule provides the public with guidance on where to send requests and establishes procedures by which those requests will be processed.
Income Level for Individuals Eligible for Assistance
The Legal Services Corporation (LSC) is required by law to establish maximum income levels for individuals eligible for legal assistance. This document updates the specified income levels to reflect the annual amendments to the Federal Poverty Guidelines issued by the U.S. Department of Health and Human Services (HHS).

In anticipation of a congressional appropriation to LSC for Fiscal Year 2018, LSC hereby announces that it is reopening the basic field grants solicitation for calendar year 2018 funding for service area GU- 1 in Guam. LSC is soliciting grant proposals from interested parties who are qualified to provide effective, efficient and high quality civil legal services to the eligible client population living in Guam. The availability and the exact amount of congressionally appropriated funds, as well as the date, terms, and conditions of funds available for grants for calendar year 2018, have not been determined. LSC anticipates that the funding amount will be similar to current funding, which is $242,838.

LSC's Property Acquisition and Management Manual (PAMM) and its cost standards rule required grantees to seek approval prior to making any real estate purchase with LSC funds, regardless of the purchase price. Notice and Request for Comments-LSC Merger of Service Areas in New Jersey
The Legal Services Corporation (LSC) proposes to merge the two service areas that cover the seven counties of the southern region of New Jersey and two counties of the mid-eastern region of the state. Grants for these individual service areas have been awarded to South Jersey Legal Services (SJLS) since 2015. LSC proposes to merge the two service areas into one service area and to award one grant for the new combined service area. Doing so will harmonize the grant structure with the current delivery model.

This final rule identifies the factors to consider in determining whether an award from an LSC recipient to another organization is a subgrant, establishes a dollar threshold at which recipients must seek LSC's approval to award a subgrant, authorizes recipients to use property or services funded in whole or in part with LSC funds to support a subgrant, and establishes new processes for seeking prior approval of subgrants.
