The rule clarifies the authority an agency must have in order to procure utility services and describes in detail agencies' responsibilities concerning the procurement of such services. To better direct agencies that operate under a utility service delegation from GSA, the rule adds a reference to the section of the Federal Acquisition Regulation (FAR) that addresses the acquisition of utility services and other procurement guidance. GSA is amending the General Services Administration's regulations implementing the Freedom of Information Act (FOIA). The regulations are being updated to incorporate changes brought about by the amendments to FOIA under both statutory and nonstatutory authorities. Specifically, this rule amends GSA's regulations under FOIA to incorporate certain changes made to FOIA by the FOIA Improvement Act of 2016. Additionally, the regulations are being updated to reflect developments in case law, recent guidance from the Department of JusticeOffice of Information Policy for processing FOIA requests, technological advancements in how the FOIA is administered, and to update the cost figures used in calculating and charging search/ or review fees. Finally, the revisions to the rule increase the amount of information that members of the public may receive from the agency without being charged processing fees through proactive agency disclosures.

The General Services Administration (GSA) is issuing a final rule amending the General Services Administration Acquisition Regulation (GSAR) to adopt an additional project delivery method for construction, known as ``construction manager as constructor'' (CMc). The private sector commonly uses a similar construction project delivery method, which allows for early industry engagement by the construction contractor to enable reduced cost growth, reduced schedule growth, and administrative savings. The current Federal Acquisition Regulation (FAR) lacks coverage of the CMc project delivery method. GSA has previously issued policies on CMc through other means. Incorporating CMc into the GSAR provides centralized guidance to industry and ensures consistent application of construction project principles across GSA. Additionally, integrating these requirements into the GSAR allowed for revision and improvement of the requirements through public comments in the rulemaking process.

This amendment is necessary because the Tax Cuts and Jobs Act of 2017 suspended both the moving expenses income tax deduction and the exclusion from income for qualified moving expense reimbursements for tax years 2018 through 2025.

This bulletin reaffirms that sleeping in buildings under the jurisdiction, custody or control of GSA, including those buildings delegated to other Federal agencies by the Administrator of General Services, is prohibited, except when expressly authorized by an agency official. Sleeping may be authorized if the person is directed by a supervisor to remain in the building to conduct official government business and it is necessary for the person to sleep on the premises or, in the case of an emergency where there is imminent danger to human life or property, where persons are directed to shelter-in-place.

OMB has approved this information collection for use through January 31, 2020.
