Investigation Into the Practices of the National Classification Committee
The Board is commencing an investigation into the practices of the National Classification Committee (NCC), which administers the motor carrier classification system for its motor carrier members pursuant to an agreement approved by the Board under 49 U.S.C. 13703. The purpose of this investigation is to develop a more thorough record regarding charges of abuse of market power by NCC, in its practices generally, and particularly with its action changing the classification of lighting products and fixtures in 2004.

Quarterly Rail Cost Adjustment Factor
The Board has approved the fourth quarter 2005 rail cost adjustment factor (RCAF) and cost index filed by the Association of American Railroads. The fourth quarter 2005 RCAF (Unadjusted) is 1.185. The fourth quarter 2005 RCAF (Adjusted) is 0.572. The fourth quarter 2005 RCAF-5 is 0.548.
Union Pacific Railroad Company-Temporary Trackage Rights Exemption-BNSF Railway Company
The Board, under 49 U.S.C. 10502, revokes the class exemption as it pertains to the trackage rights described in STB Finance Docket No. 34694 \1\ to permit the trackage rights to expire on or about December 31, 2005, in accordance with the agreement of the parties, subject to the employee protective conditions set forth in Oregon Short Line R. Co.AbandonmentGoshen, 360 I.C.C. 91 (1979).
The 25th Anniversary of the Staggers Rail Act of 1980: A Review and Look Ahead
The Surface Transportation Board will hold a public hearing beginning at 10 a.m. on Wednesday, October 19, 2005, at its offices in Washington, DC. The purpose of the public hearing will be to examine the impact, the effectiveness, and the future of the Staggers Rail Act of 1980 (Staggers Act). Persons wishing to speak at the hearing should notify the Board in writing.
Norfolk Southern Railway Company-Consolidation of Operations-CSX Transportation, Inc. (Petition for Supplemental Order)
On August 17, 2005, CSX Transportation, Inc. (CSXT) and Norfolk Southern Railway Company (NSR) filed with the Surface Transportation Board (Board) a petition (the Joint Petition) for a supplemental order authorizing the modification of one aspect of a series of transactions that the Board's predecessor, the Interstate Commerce Commission (ICC), approved in 1993. The contemplated modification is to have CSXT, rather than NSR, perform switching services for both carriers in the Newberry, SC area.
