SUMMARY: The Board, under 49 U.S.C.
10502, revokes the class exemption as it
pertains to the trackage rights described
in STB Finance Docket No. 34694 1 to
permit the trackage rights to expire on
or about December 31, 2005, in
accordance with the agreement of the
parties, subject to the employee
protective conditions set forth in Oregon
Short Line R. Co.—Abandonment—
Goshen, 360 I.C.C. 91 (1979).
DATES: This exemption is effective on
October 22, 2005. Petitions to stay must
be filed by October 3, 2005. Petitions to
reopen must be filed by October 12,
2005.
An original and 10 copies of
all pleadings, referring to STB Finance
Docket No. 34694 (Sub-No. 1) must be
filed with the Surface Transportation
Board, 1925 K Street, NW., Washington,
DC 20423–0001. In addition, one copy
of each pleading must be served on T.

exemption procedures at 49 CFR 1180.2(d)(7). The
notice, served and published in the Federal
Register on May 16, 2005 (70 FR 25883), covered
the agreement by BNSF Railway Company (BNSF)
to grant temporary local trackage rights to UP over
a BNSF line of railroad between BNSF milepost
11.3 in UP Junction, WA, and BNSF milepost 36.0
near Sprague, WA, a distance of approximately 24.7
miles. Because the temporary trackage rights are
‘‘local’’ rather than ‘‘overhead’’ rights, they did not
qualify for the Board’s class exemption for
temporary trackage rights at 49 CFR 1180.2(d)(8).
The trackage rights operations under the exemption
were scheduled to begin on May 3, 2005.

Abandonment Exemption—in Raleigh
County, WV
CSX Transportation, Inc. (CSXT), has
filed a notice of exemption under 49
CFR 1152 Subpart F—Exempt
Abandonments to abandon a 15.12-mile
line of railroad on its Southern Region,
Huntington Division East, Jarrolds
Valley Subdivision, between Jarrolds
Valley Junction, milepost CLP 0.0, and
Clear Creek, milepost CLP 15.12, at the
end of the track in Raleigh County, WV.
The line traverses United States Postal
Service Zip Codes 25008, 25044, 25048,
25060 and 25193.
CSXT has certified that: (1) No local
traffic has moved over the line for at
least 2 years; (2) any overhead traffic on
the line can be rerouted over other lines;
(3) no formal complaint filed by a user
of rail service on the line (or by a State
or local government entity acting on
behalf of such user) regarding cessation
of service over the line either is pending
with the Surface Transportation Board
or with any U.S. District Court or has
been decided in favor of complainant
within the 2-year period; and (4) the
requirements at 49 CFR 1105.7
(environmental reports), 49 CFR 1105.8
(historic reports), 49 CFR 1105.11
(transmittal letter), 49 CFR 1105.12
(newspaper publication), and 49 CFR
1152.50(d)(1) (notice to governmental
agencies) have been met.
As a condition to this exemption, any
employee adversely affected by the
abandonment shall be protected under
Oregon Short Line R. Co.—
Abandonment—Goshen, 360 I.C.C. 91
(1979). To address whether this
condition adequately protects affected
employees, a petition for partial
revocation under 49 U.S.C. 10502(d)
must be filed.
Provided no formal expression of
intent to file an offer of financial
assistance (OFA) has been received, this
