Union Pacific Railroad Company-Temporary Trackage Rights Exemption-BNSF Railway Company 1
The Board, under 49 U.S.C. 10502, revokes the class exemption as it pertains to the modified trackage rights described in STB Finance Docket No. 34554 (Sub-No. 2) \2\ to permit the trackage rights to expire on or about December 31, 2005, in accordance with the agreement of the parties,\3\ subject to the employee protective conditions set forth in Oregon Short Line R. Co.AbandonmentGoshen, 360 I.C.C. 91 (1979).
Quarterly Rail Cost Adjustment Factor
The Board has approved the second quarter 2005 rail cost adjustment factor (RCAF) and cost index filed by the Association of American Railroads. The second quarter 2005 RCAF (Unadjusted) is 1.149. The second quarter 2005 RCAF (Adjusted) is 0.563. The second quarter 2005 RCAF-5 is 0.537.
Rail Rate Challenges Under the Stand-Alone Cost Methodology
The Surface Transportation Board (Board) will hold a public hearing beginning at 10 a.m. on Tuesday, April 26, 2005, at its offices in Washington, DC, to provide interested persons an opportunity to express their views on the subject of rail rate challenges under the stand-alone cost (SAC) methodology. Persons wishing to speak at the hearing should notify the Board in writing. This notice reschedules a public hearing originally planned for March 24, 2005, as described in a notice published on February 23, 2005 (70 FR 8874).
BNSF Railway Company-Acquisition and Operation-State of South Dakota
BNSF Railway Company (BNSF) \1\ has filed an application under 49 U.S.C. 10901 for authority to acquire and operate approximately 368 miles of railroad lines (referred to as the ``Core Lines'') that are owned by the State of South Dakota (the State).\2\ The Core Lines, which are described in a July 10, 1986 Operating Agreement between Burlington Northern Railroad Company (BN, a BNSF predecessor) and the State, extend principally: between milepost (MP) 777.0 near Aberdeen, SD, and MP 650.6 near Mitchell, SD; between MP 518.9 near Sioux City, IA, and MP 649.7 near Mitchell, SD; between MP 293.1 near Canton, SD, and MP 650.6 near Mitchell, SD; \3\ between MPs 74.1 and 68.8 in Sioux Falls, SD; between MP 68.8 near Sioux Falls, SD, and MP 49.4 near Canton, SD; and between MPs 511.9 and 518.9 in Sioux City, IA.
